died, tens of thousands of acres have burned and it's still not clear what exactly sparked the fires. multiple sources tell nbc news in early focus of the investigation is a possible human source. dana griffin is in altadena and bill joins us in studio, dana, let's start with you, what are firefighters saying about progress in containing these fires especially as the winds are picking up? >> reporter: zinhle , very good news, the eat-in fire, did not gain any additional acreage, it's 35% contained and that's a really good number. it may seem low because one hundred percent is when you have a full line around the fire which prevents it from restarting in any fashion, so they've made significant progress but we have not seen any major flames or smoke in the area, so that is a good sign, we've seen crews going door-to-door, making sure there are no hotspots inside the homes that have already burned down because when the wind comes through, they want to make sure the embers don't fly and catch homes that are still standing. >> we mentioned a search for

the cause of some of these fires, it's appalling to think they might have been human caused by arson. what are investigators looking at? >> reporter: so they are looking at everything, you guys mentioned earlier that this is human caused, that could mean anything from accidental, equipment related and it can be intentional and arson, they say they are not leaving anything on the table, they are looking at every possible option, we actually saw them yesterday for the first time on the ground in pacific palisades, they were around a neighborhood that was roped off and also we saw them there, at a trailhead, they were riding atvs, looking at a grassy area where there was actually a new year's eve fire, six days fire to this one and some are speculating the fire may have reignited, some experts think that could be possible because usually that happens within a day or two and remember this is six days between the new year's eve fire caused by fireworks and the current fire, also the eat-in

fire, still it's undetermined. >> bill, can you take us through the timing of these strong winds heading into tonight and tomorrow, and is that particularly dangerous fire warning going on? >> it still is until tomorrow afternoon. we are in a 48 hour wind event, the first 24 hours, no new big fire starting and the fires we currently have have not gain any ground, the containment has been increasing, so so far, so good. this is our 13 million people in the red flag warnings, ventura southwards but the potentially dangerous situation where we could see the explosive growth, that's more towards ventura county. these areas in the marin. we did have a 72 mile-per-hour wind gust overnight and the relative humidity is bone dry and it hasnsn't ined in eight months. but notice that where the eat- in fire is, only 12 mile-per-

controversy since he was first elected over accusations of sexual assault and excessive drinking, the accusations he denied again today and he was also asked about his management of veterans affairs organizations and comments about the role of women in the military. >> the questioning started with the republican chair of the arms service committee asked about those charges? >> from the beginning, there was a coordinated smear campaign orchestrated in the media against us. that was clear from moment one. >> what you have to say to the almost 400,000 women who are serving today? >> i would say i would be honored to have the opportunity to serve alongside of you, shoulder to shoulder, men and women, black, white, all backgrounds with a shared purpose. >> you said you don't want politics in the dod, everything you said in these public statements is politics, i don't want women, i don't want mom's, what's wrong with a mom, by the way? >> we support women continuing

to have the opportunity to serve in combat roles? >> yes, women will have access to ground combat roles given the standards remain high. >> the last center questioning mr. hegseth was republican joni ernst, she's a veteran and a survivor of sexual assault herself. julie tsirkin joins us now, the hearing is over now, what are we hearing from senators when they talk to you on the way out about how it went, did he increase his support from the committee members? >> again, we will divide this based on party lines because republicans are saying he did great in fact the senate majority leader, the top republican, said he felt like hegseth acquitted himself and his performance today, meaning that he was able to put those allegations, really disturbing allegations, sexual assault and his heavy drinking and his mismanagement, when he was a top two veterans organization, and he did a good job by putting all of that to bed, now if you ask a democrats, they

have a different story and that's in part because most of them have not met with him yet and that's the point they kept making, most of them have not gotten to see the fbi report and so they have real question still, not only about his past, not getting direct answers to questions, i thought senators tim kane and mark kelly did an effective job at getting him to say yes or no answers about his past and also whether he's qualified for the position. in a place where republicans have the majority, it doesn't really matter. >> this is for the role of secretary of defense, beyond the questioning about the sexual assault allegations and women in the military, i kn he was also questioned about president-elect trump's recent comments around taking control of greenland and what did he say? >> the question was really

asked by democrats, to see how far hegseth would be willing to go, would he ever pushback against trump, for example, they raised how trump's secretary of defense for a while, have said no when trump asked him to do something that he thought was inappropriate and in this case hegseth replied, president trump would be commander in chief and he would follow his command and i think unlike the nominees and the people who worked around trump in the first administration, something that trump tried to do was build a team around him of people who would not say no to him. again i don't think any of that concerned republicans, if anything it concerned democrats and he was able to bolster his support from republicans after today. >> this will be a busy week for you, this is the first of many hearings, what else is on the agenda this week? >> next week started off by one republican senator telling my colleague would be a train wreck of a week just because of

the justice department released former special counsel jack smith's final report into president-elect donald trump's 2020 election interference case less than a week before he set to take office. >> in it, smith said there's enough evidence to convict trump of election interference and he says that president-

elect trump would have been convicted had he not been reelected. ken, you are able to read through most of the report, what are highlights and how is trump responding? >> probably the most striking line came at the end, the conclusion where jack smith said but for mr. trump's election, and imminent return to the presidency, jack smith and his staff assess the admissible evidence was sufficient to obtain and sustain a conviction at trial, and i think any fair-minded person reading through this report has to acknowledge the evidence that mr. trump lied about election fraud as he tried to stay in office is strong, it comes from many of his own inner circle, and from thousands of documents, another thing that stood out was the introduction by jack smith because we have not heard from him really, where he pushes back against mr. trump's

constant refrain that the investigation was a political exercise, he wrote, to all who know me, the claim for mr. trump that my decisions as a prosecutor were directed by the biden administration or other political actors is in a word, laughable. donald trump responded to report in typical trump fashion, writing on troop social that smith is quote a lamebrain prosecutor who was unable to get his case tried before the election which i won in a landslide. the voters have spoken and on that last point, he is correct. >> i want to ask about another special counsel report that was released by the justice department, this one dealing with the investigation into president biden son, hunter, what should we know here? >> what stood out is the very tough criticism leveled by the special counsel david weiss, and president biden over his explanation for why he parted his son. you will recall that the president in part mean hunter

called the decision a miscarriage of justice. weiss strongly disputed that thing he prosecuted hunter biden on gun and tax evasion charges after he walked away from a no jail time plea deal and weiss wrote that other presidents have pardoned family members but he said not have taken the occasion as an opportunity to malign the public servants at the department of justice based solely on false accusations and went on to say president biden's words undermine the public's confidence in our criminal justice system, guys? >> thank you. now to today's daily health, the fda wants to make a big change to the labels we see on food and drinks. >> today the fda officily announced the change, the agency wants to require certain nutritional labels on the front of packaging in an effort to help people make healthier choices. dr. john, let's start with the basics, what is the fda saying that these labels would look like and where would they be?

>> the important part is where they are putting it. i'm a person who says we need to be readers of the food we eat, look at the packaging label but it's on the back and rather confusing because it gives percentage of daily allowance and milligrams but the new one would be placed on the front so when you're looking at the package you will see it, it will still have the daily value percentage but it'll also have low, medium or high on there, the actual words, and it's looking at three things, saturated fat, sodium and added sugars. some of the biggest health issues that we have, so that it's easy to understand, is that going to have those things in there that i shouldn't be eating. >> we are hoping for this connection for help, the fda is saying that their ultimate goal that americans will make healthier choices but how will that really work by just moving e location of a label?

palisades fire. it started one week ago today. so far, it's burned nearly 24,000 acres. containment now at 17%. firefighters say more than 5000 structures, including many homes, have burned. the next largest is the eaton fire in altadena. that's just north of pasadena. it's burned more than 14,000 acres, and fire crews have now containment at 35%. they say 7000 structures have been burned in that fire. and the newest fire, the auto fire in ventura county, 56 acres have burned so far. and good news, we're hearing it is fully contained. our team is following all the developments as crews keep working to contain these flames when we're not on the air. our website is a great resource for updates. just go to nbcbayarea.com. as southern california is bracing for winds to pick up, things are calm around here. here's meteorologist kari hall with our forecast. we started out with cold temperatures across the bay area. some of us even below

freezing. but we're headed for the mid 60s for this afternoon. nice light jacket weather. very comfortable for the day with all of the sunshine and up to 60 in antioch, concord, as well as livermore and hayward. look for a high of 63 degreesnd those temperatures max out at 61 in san mateo and 62 in palo alto. these are some of the same temperatures and conditions we've seen recently, just not as windy, and a lot more sunshine in the forecast for the north bay, with santa rosa making it up to 64 degrees into the weekend. it will be a little bit cooler, so we'll get a look at that, as well as if there's any rain chance in our forecast coming up in the next 30 minutes. a vote impacting the future of governor newsom's controversial underground water tunnel in the central valley is set to happen. nbc bay area's bob redell joins us from the altamont in livermore. a dozen local water agencies, including zone seven here in livermore, have already voted to approve funding to help with the

planning and design of this 45 mile long underground water tunnel that would run in the central valley and connect with an existing above ground aqueduct that is on the other side of the altamont. behind me here, you cross over it when you're driving on eastbound 580 into tracy. in a few moments, a 13th water agency will vote during its board meeting. that started at 11 a.m. this morning. i'm talking about the santa clara valley water district. they're going to decide whether or not to contribute $9.7 millio towards the planning and design of this massive infrastructure project that will cost an estimated $20 billion to complete. now, the idea is to build a concrete tunnel that is 36ft in diameter that, as you can see on this map, would take fresh water from the sacramento river and divert it south underground to large water pumps already located in tracee, and then from there would be diverted to other parts of the state. and the roughly 27 million people who rely on this water that comes from the delta. for years, former california

here are some of the stories making headlines on "nbc news daily". >> some may find this video disturbing, more than 100 illegal miners are believed to have died in one of south africa's deepest gold mines, this was taken by one of the miners still trapped underground and appears to show bodies wrapped in plastic and emaciated miners calling for help. rescue efforts are underway right now. south african police have been in a standoff with minors for months as the country tries to crackdown on illegal mining. this is kate announced her cancer is in remission. she made the announcement on social media today, saying it is a relief and she remains focused on herecovering. she revealed her cancer diagnosis in march in a video announcement, neither kate nor the royal family have revealed

help out this hard-hit community, talk about some of the ories you've been hearing? >> i have, it's really tough here. this is my first time back in altadena since the fires broke out and you can see some of the devastation, it's unbelievable, we won't keep showing this because obviously it's immense and it covers the entire neighborhood. there was just a spot fire up the road, still an active fire zone but this guy, his name is josi, this is his family home, his garage burned down but not his own. he opened his home up to donations and look at this, guys, this is all clothing, food donations, water, toys, you name it, anything that anybody in the neighborhood convened, people opened up their hearts, that's what we've seen all over this community. he has so many donations now that he is canceling people bringing stuff in, he needs people to take the step because there's so much of it. we've been watching people try and organize it. this is just the last few days, people with their own homes who have burned down, all of this,

and people still have the kindness of their hearts to dig in and donate and we've been seeing this really since we've been in this community since day one, people putting fire hoses on other people's homes as the fire was burning, people now trying to get back to the community to folks that may have lost everything, this is one example and it litters the neighborhood but remember again, this is still the national guard, obviously there's been reports of looting and burglary but also this is still an active fire zone with the winds picking up. >> the california governor just signed an executive order to try and help schools and students, you mentioned school, what are the specifics? >> imagine, right, you are gen z, you've gone to school and half of that you missed because

of covid, you are working from home and now this happens again, a lot of students have to work from home, so the governor trying to relax some rules, namely one for the school system itself, relaxing those enrollment rules so you don't have to make their minimum enrollment for the school districts and also if your school did happen to burn down or you don't have a place to go, relaxing the rules that say you can go outside of the district and it also makes it easier for those school systems to provide more temporary schooling for students who want an in person, in class learning situation. obviously the governor helping to relax and study some of the rules to make it easier for kids to go to school and have a normal life despite very abnormal circumstances. guys? >> just showing us the picture of what's happening out there, we really appreciate that. we turn now to new

allegations against sean "diddy" combs. >> a woman has filed a lawsuit in new york against the musician claiming he drugged and sexually assaulted her in 2000, when she was just 16. it is just one of dozens of lawsuits accusing combs of sexual misconduct. chloe, what can you tell us about the latest lawsuit and has there been any response from the legal team? >> there has and i will get to that in a moment. here's where we start. it's filed on behalf of a woman whose only going by jane dough, she's anonymous, it was filed in new york and like she said, she claims in the year 2000 when she was 16 at the time, she was at an apartment building in manhattan's downtown neighborhood, and she claims that a woman, she does it mean the celebrity was but a high profile woman that combs was dating at the time, lived in this building, she says in the filing, that she was a babysitter and as she was leaving she ran into sean combs and two employees that worked for him, and that he kept

asking her if she wanted a ride, saying it wasn't safe for a young woman at night, to be walking by herself and she claims that she lived very close by, and she kept saying that she did not want a ride. she goes on to say that she finally acquiesced and got in the car and became concerned when they did not drop her off at home, which was a short distance away, took her somewhere else and convinced her to have a drink to calm her nerves and that's when she says that when she had a sip of the drink that she became groggy, disoriented and claims that she was sexually assaulted by combs, his team is saying, quote, no matter how many lawsuits are filed, it won't change the fact that mr. combs has never sexually assaulted or six trafficked anyone, man or woman, adult or minor and i want to point out that combs is
