morning to you. thanks for starting your morning with us. i'm marcus washington and i'm laura garci we'll check that morning commute with mike in just a little bit. but first let's talk about the cold temperatures once again to start our day. yeah. we're having to bundle up and crank up the heat a little bit more before you even step out the door. as our temperatures are now in the 30s, pretty widespread around the bay area, san jose has dipped to 38 degrees. it's 35 in walnut creek and san francisco at 44 degrees. in livermore, we are going to have another cold start, but at 9:00 we are still wearing jackets with some mid 40s, but you can probably take it off for a few hours in the afternoon as that sunshine helps to heat things up and we make it into the mid 60s. but just as fast as those temperatures warmed up, it's going to drop again right around sunset. so taking a look at our highs for today, that's actually going to be a little bit above what's normal for this time of year with san jose. one of the warmer spots 68 degrees. that's eight degrees above our average high temperature for this date. and across the bay

area we're usually seeing temperatures in the 50s, but we are going to at least make it into the mid 60s for today. going into the weekend. cooler air returning. we'll talk about that in a few minutes. mike, have they activated the metering lights yet? yeah, just about five minutes ago. so just after the last report we have the metering lights active. we do see the backup forming here at the toll plaza. that means it's slow from the metering lights all the way back to the toll plaza itself. and on the incline, things are moving pretty smoothly down towards san francisco. there may be a disabled vehicle somewhere in the backup, so i didn't see it on the live camera, but we'll look for the chp and bridge reports here. we have that crash seal on the shoulder. west 80, your commute direction at university. it's a distraction there is slowing that ripples back toward richmond. it started early and it will probably stay around so slower off the east shore freeway coming out of san pablo south of there, everything moves very smoothly in toward the san jose. we do have that sticking around with the north 101 slowing up toward oakland road. back to you. thank you very much, mike. well, two developments in the middle east. israel says its cabinet will not

meet to approve the recently brokered cease fire and hostage release deal with hamas. israeli leaders say hamas militants are creating a, quote, last minute crisis. and without elaborating, prime minister benjamin netanyahu's office is accusing the group of backing out of parts of the agreement. a senior hamas leader, meantime, released a statement saying the group is committed to the cease fire agreement. the sides agreed yesterday to the deal following 15 months of fighting in gaza. the conflict has believed to have led to the deaths of more than 46,000 people. and new this morning, a pulitzer prize winning cartoonist with bay area ties is arrested after being accused of possessing child pornography. today in the bay's ginger conejero saab live for us in san francisco this morning. i know you've been digging deep into this and more about those connections here to the bay area. that's right. good morning. marcus. daryn bell is a famed cartoonist who got his start right here in the bay

area. he went to uc berkeley and he started doing cartoons for the daily californian. then he also contributed to the chronicle and other local outlets. but it was in 2019 when he received one of the biggest honors for his work. he was awarded a pulitzer prize for editorial cartooning and became the first african-american man to do so. the award giving body praised bell for, quote, beautiful and daring editorial cartoons that took on issues affecting disenfranchized communities, calling out lies, hypocrisy and fraud in the political turmoil of the trump administration. he has said the goal of his work is for people to be more respectful of human dignity. now, bell was arrested yesterday and booked into the sacramento county main jail, sacramento valley. internet crimes against children, detectives, or icac. they were tipped off by the national center for mission for missing and exploited children. now the tip was related to 18 files that were uploaded that contained

child pornography. but then detectives conducted their investigation. they found a total of 134 videos of child pornography that were linked to an account that was owned and controlled by bell. investigators searched his home. they found evidence related to the case, as well as computer generated or ai child pornography. now, bell is currently held on $1 million bail. he is also scheduled to appear in court tomorrow. but marcus, this arrest is actually significant for sacramento valley detectives as well as ai child pornography in general. since the start of the year, there's been a change to the la, and it now includes computer generated or ai child pornography to be added as a criminal offense. this is the first arrest for sacramento valley detectives in doing so in in san francisco, ginger conejero saab today in the bay. just hearing all of this. so disturbing there. all right, ginger thank you. well, this is a heartbreaking follow up to a

deadly head-on crash in gilroy. the three people who died tuesday night all attended hollister high school. a roadside memorial is growing for the students who lost their lives. the chp says the victims car veered into oncoming traffic on shore road, hitting another car. one person in that car survived along with the driver of the other car. the names of the students who died have not been released, but one victim's great grandmother says her family is in shock. we're all broken. brokenhearted. he was going to graduate this, this senior year. this year is going to graduate. the cause of the crash is still under investigation. oakland police commissioners are able to weigh public sentiment ahead of what should be a pivotal decision next week. this is over. the department's restricted pursuit policies. commissioners held a town hall last night to get public feedback. governor gavin newsom recently demanded the city end its policies, which include supervisor approval, to chase someone going more than 50

miles an hour. if there's no change, he's threatening to pull the chp crime fighting help people on both sides of that issue weighing in. it wasn't too long ago tha we were mourning the death of black men at the hands of police officers. and so i'm really just concerned about the tenor of this conversation. i ask and plead for behalf of all the business. you guys need to come up with something. this is not working. department leaders are already indicating that they are open to altering that policy. the commission will hold a vote next week. conditions are improng for firefighters battling the southern california wildfires, with the strong santa ana winds dying down last night. the palisades fire, now 21% contained with nearly 24,000 acres burned. crews are also gaining ground on the eaton fire in altadena, which is now 45% contained. the fire, sadly, have killed 25 people and destroyed

more than 12,300 structures. we'll keep tabs on what's happening there. meteorologist kari hall also tracking that weather for us in southern california this morning. so are they going to get how much of a break here? those winds are going to remain calm. yes. it looks really much improved compared to what we have had. the particularly dangerous red flag warning has expired. while there is still a red flag warning in effect until 3:00 today for the western san gabriel mountains, not too far from the eaton fire and where that happened. so we are still looking at some breezy winds in the higher elevations. but as far as our overall wind and the relative humidity, it is improving. it is another dry morning with seeing some of the relative humidity numbers in the teens and a light wind, but as we go throughout the day, in the next several days, we are going to see a surge in mid-level moisture. the green shadings that we are seeing there indicating some slightly higher humidity as we go into the weekend, which can actually slow the spread of any fires. it's

still very dry today, with relative humidity numbers in the single digits and teens. but look at tomorrow morning if we're not going to get some rain. it's nice that at least we see a big increase in the relative humidity. mike. looking around the bay area, where can we get some slightly lower gas prices? doing our best and right off the top i'm going to point to north star gas in san jose. that's 357 the best in santa clara county. contra costa county's best san ramon 359 at freedom gas on acosta boulevard in the middle here, and much higher by comparison. in marin county, the low for san rafael is 387 at elite gas and mart. that's on ritter street. you check what's on streets near you. that's a gasbuddy.com on the roadways. we'll talk about the highways, the freeways. the road sensors still show majority green. the east bay does show that build in the persistent problem. west 88 university. the crash on the shoulder set off some slowing. it's slow out of richmond and toward about university avenue. then an incident at the bay bridge reported the disabled vehicle

612. let's take a live look outside in san francisco before the sunrise. we can already tell it's clear. and as you step out the door, you feel that it is chilly once again. we have a morning start in the mid 40s here, 30s for some of the inland valleys. but as we go throughout the day, a gradual warm up with more sunshine in today's forecast. we'll see more clouds

this weekend and cooler temperatures. we'll check that out coming up in a few minutes. and as we've seen all week, it's a gradual build up at the bay bridge. the metering lights were active just before 6:00. it's very light here still. now some traffic may be held up in berkeley. that might shift some traffic over toward richmond. we'll explain that coming up. well good morning. very happy thursday to you. big numbers on the board because core inflation data showed price hikes slowing mamarkets wi their biggest rally since before the election. cnbc says tesla is discounting the price of its cybertruck. netflix upgraded by analysts ahead of its profit reports next week. silicon valley got a lot of attention in president biden's farewell address last night. the president made an explicit warning about the power of tech moguls and tech companies, drawing parallels to president eisenhower's warning about the military industrial complex delivered during his farewell address some 60 years ago. six

decades later, i'm equally concerned about the potential rise of a tech industrial complex that could pose real dangers for our country as well. americans are being buried under an avalanche of misinformation and disinformation, enabling the abuse of power. president biden also warned about a new oligarchy. we'll talk more about that in politics. but yeah, the power of tech and tech ceos and wealthy tech investors on the rise, with promises of fewer regulations ahead in the trump administration, may be less opposition to mergers as well. business insider says google's ceo is attending the inauguration. apple's tim cook, mark zuckerberg, jeff bezos, elon musk all invited. the new york times says the ceo of tiktok is going to the inauguration. you remember erik shoji chu from those congressional hearings?

congress, of course, voted overwhelmingly to set a ban on tiktok for this coming sunday. three days from now, and all of a sudden, it seems like one of the least popular ideas in washington. three senior officials at the white house say president biden is working on a way to delay sunday's deadline, so that the enforcement of the ban would push to the trump administration. trump becomes president on monday, and trump has indicated he's against the tiktok ban as well. here's a big fan. the president is now on tiktok. it's my honor. no tax on tips, by the way. no tax on gifts. i'm going to save tiktok. it is astonishing to see how fast this is changing. oh yeah. we have yet to hear from the supreme court, but it may be moot at this point. it'll be interesting. and a lot of people switching trying to find new avenues as well. yeah for sure. in business. yes. interesting. diversifying. all right. thanks, scott. well, happening today, san francisco mayor danielle lowery plans to discuss safety

and security ahead of this year's lunar new year celebrations, which, of course, center around the chinese new year festival and parade in chinatown. other city leaders, including police chief bill scott and d.a. brooke jenkins, will also attend today's news conference. it takes place at 11 a.m. at chinatown's iconic dragon gate. events for the year of the snake kick off later this month, and the parade will take place february 15th, right after valentine's day. don't forget trending this morning. how can you not know the iconic line live from new york? it's saturday night and there's a new documentary series that's taking us behind the scenes of saturday night live's 50 seasons, and it premieres today. there was nothing like it. wild and crazy guy in a van down by the river. it's an american institution. so this is a four part series. it's called snl 50 behind saturday night. now we got a chance to chat with morgan neville. he's

the academy award winning director of 20ft from stardom and executive producer of the new series. he shares his vision that he had for that project when snl creator lorne michaels actually asked him to take the lead. and i said, you know, rather than doing a documentary or doing a kind of like history of, i said, i'd rather as a comedy fan, what i want to see are deep dives into how the show works. so we did an episode about auditioning for the show, an episode about writing the show, an entire episode about the cowbell sketch, and then an episode about season 11, which we call the weird years. some people refer to as the worst year ever, but it was the year that actually made snl what it is. all four episodes of snl 50 behind saturday night are now available on streaming service peacock. i mean, there's so many iconic moments, you know, that you remember wild and crazy guys, the coneheads, the church lady, the cowbell. i mean, they talk about pop culture, but then

they become pop culture. they really do, right? everybody uses the phrases, right? yeah, absolutely. like superstar. superstar. and this morning is sweater weather. sweater weather? yeah, absolutely. yeah. it's going to be a cold one as you're heading out. and let's get a look at what we've been seeing. i have another update for you with the drought monitor that was just updated a little while ago. and taking a look at all of these colors on the screen, we're going to talk about what that means. so the bright red is extreme drought. we are seeing that in spots even across the intermountain west. and then taking a look at southern california that no surprise, we are seeing the drought conditions worsening. we know that it's been several months since we've had a significant rainfall, and that's been part of the reason why we saw those fires get so out of control so quickly. but for southern california, we went from a moderate drought to a severe drought with an increase in that drought status by 15% across the state. we've also

seen the drought conditions worsening in parts of the sierra, but there is such a big split between the southern sierra and the northern sierra that's doing very well at 125% of its normal snowpack, while the southern sierras, about half of its normal amount. and looking ahead, we've been talking about how dry it's been and most likely, how the dry weather will continue through at least the next week or so. the only glimmer of hope that we're seeing is that we may end the month with some rainfall, at least a little bit, before we wrap things up and say that it's the third driest january on record. and today it's not only dry, but it's also warm as our temperatures head for the low 60s in the north bay and mid 60s for the east bay. much of the peninsula in the low to mid 60s for today, and upper 60s and even 71 degrees today in gilroy. and throughout the forecast, we are going to see a slight dip in those highs for the next several days, with low 60s for the inland valleys, breezy winds and a few more clouds moving in. and

it's a long holiday weekend for a lot of people off of work and off of school. on monday it will be 62 and also sunny and throughout the middle of next week. cold mornings but mild afternoons. this will be the last day. for a while. we'll see san francisco's highs make it into the low 60s. and mike, there may be some shifting traffic out of the east bay. yeah, you talked about the monday holiday and that's why we're probably seeing lighter morning commutes this part of the week as we slide in toward a three day weekend for many. but here, an early crash west 80 at university, a critical part of the east shore freeway that caused a backup going into richmond. folks didn't expect that because of the lighter traffic. some may be shifting over toward the richmond bridge and then down across the golden gate bridge to avoid the backup. as you're getting through berkeley and approaching the bay bridge. now, we'll look at the backup here out of richmond. it is showing a build. nothing dramatic, but more than we might expect given the lighter traffic around the rest of contra costa county. over here, the bay bridge did finally fill in after the metering lights were turned

and now to our climate in crisis. california is falling short on federal food waste reduction goals. uc davis researchers say based on current food waste generated, it's likely that none of the 50 states will meet the federal goal of cutting food waste by the year 2030. while composting has become a popular solution to keeping food out of the

landfill, scientists say it also has environmental downsides because of the resources needed to grow, process and distribute food. the problem with with that is that we're not addressing kind of upstream food waste. we're not thinking about the causes of that food waste. we're not thinking about preventing that food waste. and so we need to be thinking more as a nation and in california as well, about stopping food waste from happening in the first place. so what can we do at home, especicially ashe new year kicks off and we think more about food? we can be more creative with leftovers. or that spinach wilting in the fridge. sticking to your grocery list is a good way, and understanding best buy labels and expiration dates can help keep food around longer. if you're a business owner, try donating more food to help fight food waste, and you can read the full story and learn about climate solutions on our website, nbcbayarea.com, and

will change later. we have such a big range from the way we start our day to the afternoon. so we are for a lot of spots, feeling a big chill out there and even frosty conditions developing in some of the inland valleys. it's now 35, in south san jose and in morgan hill. it's 31 in danville, and it's 33 in santa rosa and sonoma. so it is a cold start. we will see a big ramp up in those temperatures again today, where we trend actually above normal by about eight degrees in a lot of spots. so in santa rosa we're looking at a high of 64 and 68 in san jose. but it will be cooler for the weekend. so we'll get a look at that forecast coming up in a few minutes. marcus. thanks, kari. well, later this morning, a call for help from the city of vallejo. this is to help solve the shooting of a four year old girl today in the bay's bob redell. live for us this morning. and, bob, do we have any information about possible arrests? not that we're aware of. good morning to

you, marcus. that's why later this morning at 11, the city of vallejo, we're talking about the mayor, police department. they're going to hold this news conference to address this weekend shooting of that young child and try to get the public's help, to try to find the person or persons responsible for this crime that police say is sad and senseless. that's video and sound from a home surveillance camera that captured some of the gunshots this past sunday night at around 830, that where what was described as a gun battle in vallejo's crest neighborhood, two parties shooting at each other, a mother and her young daughter. unfortunately, they happened to be driving through the area when one of the bullets hit the young girl who was in the car. her motr raced her daughter to the hospital where the child, according to our last report, remains in critical condition. one of the bullets pierced through the wall of a family's home in that

neighborhood and almost hit an eight year old boy who was sitting on the sofa. here's that boy's mother. it was a really close call, and i still haven't, like, gathered my thoughts completely. if these kids need to shoot, then they can go down to the local recruiter and we can get them a job in afghanistan, and they can shoot all day. a bullet also hit mario bernal's truck, which was parked outside his home in that area. he says that neighborhood has gotten so dangerous. he keeps his kids inside all the time. now, again, no arrests that we're aware of, which is why the city of vallejo and the police department are holding this news conference at 11 to try to get the word out that they are looking for the person or persons responsible for this tragedy. reporting live, bob redell today in the bay. hope they find them soon. all right, bob, thank you. 633 right now. an east bay council member so far not commenting on the raid of his home by fbi agents. fbi, meantime, will only confirm to

nbc. bay area agents yesterday acted on a search warrant at the home of san leandro council member brian acevedo, who recently won reelection. the chronicle reports that acevedo has ties to a powerful east bay family, also connected to former oakland mayor sheng thao, who is still under investigation in a federal corruption probe but has not been charged. well, president biden is warning americans of a new american oligarchy. scott mcgrew two billionaires make decisions every day about what we see on social media. that's true. yeah. good morning. another billionaire, laura, owns the washington post. and that's just three of the tech leaders who have robber baron like powers in this new gilded age will soon have a very rich man as president. once again. president biden gave a farewell address last night where he warned about the tech industrial complex and the new oligarchy, where all power rests in a small number of

people. today, an oligarchy is taking shape in america of extreme wealth, power and influence that literally threatens our entire democracy, our basic rights and freedoms, and a fair shot for everyone to get ahead. now we've seen the power of elon musk. not only does he shape what's on x, washington pays him hundreds of millions of dollars through government contracts, yet he will be in charge of budget cuts. musk, jeff bezos, mark zuckerberg all will attend the inauguration front row. zuckerberg is going to hold a party for trump now, hardly the first time tech has snuggled up to power. video of barack obama here and his visit to facebook in 2011. obama joking only he had the power to make mark zuckerberg wear a tie. at the time, tech was counting on obama and the democrats to be hands off silicon valley. and they were. now, there are several more confirmation hearings today so that trump's cabinet can be

in place as quickly as possible. doug burgum for secretary of the interior. lee zeldin, environmental protection agency. scott turner for housing and urban development. scott. percent for treasury. still not scheduled at all. the other controversial picks of tulsi gabbard to run intelligence and robert kennedy to run health and human services. they're not on the calendar. trump's choice to run the department of energy fracking company ceo chris wright got the wrath of california senator alex padilla yesterday in his confirmation hearings, padilla, reading back some of wright's social media posts claiming global warming was hype. you've written that the hype over wildfires is just hype to justify more impoverishment from bad government policies. end quote. given the devastation that we're

currently experiencing in los angeles, do you still believe that wildfires are just hype? sir? it is with great sorrow and fear that i watch what's happening in your city of la. do you think it's just hype or not? climate changes a real and global phenomenon. is it hype or not? i stand by my past comments. so you believe it's hype? other news, it sounds like both biden and trump are working independently on a way to save tiktok before sunday's ban. that is certainly something we will be watching very carefully. marcus, back to you. all right, scott, thank you. well, back to those wildfires down in southern california. conditions there are improving for firefighters on the front lines of l.a. county wildfires. the number of confirmed deaths still stands at 25, with more than 12,000 structures destroyed. the causes of the two largest fires still under investigation. now, we do have an update this morning. the

palisades fire, now 22%, contained. the eden fire in altadena is now more than half contained. dozens of shelter animals are now in the bay area after southern california shelters were just overwhelmed by animals because of the fires. 30 shelter pets recently arrived at the san francisco spca. they came from shelters in downey, lancaster and carson, all of which are not in the fire zone. but they've been overwhelmed and over capacity. the 19 dogs and 11 cats are seeking forever homes here to allow shelters there to make way for new incoming animals. they've had hundreds of animals coming to them from the fires with no room to put them, which is exactly why we went down. the animals will have to be checked out by a vet today, but they'll be ready for adoption within two days. the san francisco shelter has already scheduled a second transport mission for next week in case l.a. shelters need continued support. you can find

lighted art festival, and this will be continuing through the middle of february. it's just going to be very chilly out there. just a heads up that if you're out at about 6:00, it's 49 degrees, but then dropping down to the low 40s the later we get in the evening. we don't have to worry so much about the cold air if you're going to the warriors game on saturday, but maybe you'll be going out to dinner right before the game, and it will be in the low 50s and then dropping down to the upper 40s by the end of the game, and then wrapping up the weekend this sunday with the sea lions 35th anniversary at pier 39. it's going to start out in the morning at 52 degrees, and then head for the mid 50s and breezy throughout the day. and mike, you have a look now at the east shore freeway. yeah. let's take a look at the timing. over half an hour now from highway four down through richmond berkeley toward the bay bridge. that may not seem bad, but today had lighter traffic. it was set off with some slowing because of a crash at university, and is kind of sticking around because that's where you usually td to see the cluster of slowing sensors out of the richmond area of richmond. across the bridge,

police in seaside, near monterey, are the first law enforcement agency in california to roll out a new technology meant to help avoid the chaos of a high speed police chase. warning high speed pursuit in progress nearby. use extreme caution. so it's called pursuit alert. it's a warning system that's used when police are chasing suspects. the app will alert mapping apps like waze and apple maps, so that people will know to clear out of the way. now, here's the ceo of pursuit alert. the dangers associated with pursuits, particularly innocent bystanders, are significant. that's why our mission at pursuit alert has been clear. make them safer. our technology aims to provide a 30 to 45 second warning to innocent drivers who may be unknowingly entering a dangerous area. that small window of time can prevent a fatal crash or a terrible incident from ever occurring. good. well, you know, in addition, seaside police are also launching a new safe aid program. the idea is to learn

more about someone with special needs so that police can better respond and interact with them. interesting. well, happening today, registered nurses will protest outside numerous california hospitals to draw attention to contract talks, patient care, and the use of artificial intelligence. today in the bay's kris sanchez, live for us outside of good samaritan hospital in san jose. and kris, this is not the only bay area hospital that the union is calling out this morning. no it's not. and we should mention that one, at least one of the health care providers says that this is an informational protest that they were notified about, and that this will not impact patient care nor staffing at the facilities. but i can tell you that here at good samaritan hospital, the nurses will be protesting outside, coming up at 8:00. they are trying to draw attention to their upcoming contract negotiations with the hospital and the hospital owner, hca. they are going to be asking for better working conditions,

which they say will eventually impact patient care. they will be joined by nurses outside kaiser permanente facilities, uc healthcare, sutter health care facilities in oakland, san francisco, walnut creek and vallejo. the video you are seeing here is from a prior protest. now, california nurses association want to draw attention to nurse to patient ratios, a lack of workplace violence prevention plans and policies to address the use of artificial intelligence. they say these are all things that are keeping some nurses who are fully qualified off the job. they just don't feel safe at work. we did get a comment back from kaiser permanente, which reads in part, we are not in contract bargaining with cna and in fact reached an agreement on a generous four year contract with cna in 2022 that provides our nurses with competitive wages, excellent benefits, valuable professional opportunities and a work environment committed to their well-being and safety. i'm here at good samaritan hospital this morning. we have reached out for

there by 1:00. it's in the upper 50s and eventually making it into the mid 60s. for today we have upper 60s expected for the south bay with a light wind and sunshine. cupertino 66 degrees, but gilroy the warmest spot at 71 this afternoon and we'll see some mid 60s for the east bay with danville up to 64 degrees and 66 in fremont and 63 in san mateo and redwood city. san francisco in the mid 60s today and the north bay. highs in the mid 60s for this afternoon. it will be a little bit cooler as a cold front drops in, but still no chances of rain here. as we go through the next several days. even into next week it looks dry, but there's one glimmer of hope there in the forecast, with the possibility of a system dropping in. that could change the pattern going into next weekend. so this weekend long holiday weekend for a lot of people, it's going to be cooler and breezy with a mix of sun and clouds. our mornings will be in the upper 30s and

highs in the low 60s, and more of the same through the middle of next week. while san francisco may see the last day of those highs in the 60s. it does look significantly cooler going into the end of the weekend. and mike, you're following up on that crash in san jose. yeah, we're seeing this live camera north 101 just north of 680. things are just starting to break up a little bit. really packed in because i believe this is because of this crash. north 101 at mckee. that was in middle lanes. they may be trying to clear it to the shoulder any second. that could entail a traffic break. so there will be more slowing right now that builds north from capital expresay to 80. some folks using that as a relief valve that's slowing down 87 as folks come up through the slowdown, releasing at curtner, they may slow down once again in toward downtown san jose. we watch that ripple over here. six 8880 slowing south of 580. no surprises. a lighter volume of traffic actually going on through much of the east bay. still slow past the earlier crash at university. it's a sticking point for the morning commute, but no problem across the richmond or the bay bridge as you're heading west over

toward the peninsula side. back to you. thanks so much, mike. 652 right now. happening now. a vacaville police dog is recovering this morning after being shot in the line of duty. the canine, named murph, was part of a police response yesterday to reports of a gunman threatening to harm himself and others. police say murph was shot in the leg while attempting to subdue the man who officers arrested. that suspect is now fang multiple felony charges, and our hero, murph is now getting some much needed bed rest. and back here in just a few moments with our top stories, including the outrage in vallejo. it follows the shooting this week that seriously injured a young girl. this is all caught. she was caught in the gunfire and the update expected today from leaders. plus the latest from southern california and the major break. firefighters are getting today that's already boosting wildfire containment levels.

gunman and a tragic shooting. vallejo police this morning will ask for help in solving the shooting of a four year old girl. it happened on sunday night when police say there was a gun battle in the city's crest neighborhood, and a mother and her daughter were driving by. a bullet struck the four year old girl, who was critically injured. another bullet pierced a nearby home and nearly struck an eight year old boy. so far, there are no arrests. a pulitzer prize winning cartoonist with ties to the bay area is accused of possessing child porn. 49 year old darren bell attended uc berkeley and most recently worked at the washington post. now, his work has been published in daily californian, the chronicle and other local outlets. investigators in sacramento valley say that they discovered 134 videos containing illegal material linke to an account owned and controlled by the cartoonist. he is currently being held on a $1 million bail. he is due in court tomorrow. an east bay council member so far not commenting on the rate of

his home by the fbi. agents, meantime, will only confirm to nbc bay area that they acted on a search warrant at the home of san leandro council member brian acevedo, who recently won reelection. the chronicle reports acevedo has ties to a powerful east bay family, also connected to former oakland mayor sheng thao, who is still under investigation in a federal corruption probe but has not been charged. in southern california, conditions are improving for firefighters on the front lines of the l.a. county wildfires, and with the end of the most recent round of strong winds, things are looking better. now, the number of confirmed deaths there still stands at 25, with more than 12,000 structures destroyed. the cause for the two largest fires still under investigation. we do know the latest update this morning from the palisades fire. it is now 22% contained. the eden fire in altadena is now more than half contained. all right, good things. those winds

are subsiding there. here in the bay area. another cold start. it's a cold morning, but will be a very pleasant day. and this may be one of the warmest days we see in a while, at least for the afternoons. our mornings each morning will be frosty and highs headed for the low 60s and a long holiday weekend ahead. all right. and that's probably why we're seeing lighter traffic. although in san jose we've had this big slowing starting to break up right now in front of us. north 101 that is in the distance is six 8280 overcrossing. so that's the top circle there. that crash should be over to the shoulder. i'm guessing by the behavior we saw on the live camera. there's a build up for 85 and 87. there's another crash that's been sticking around at the bottom of the screen, north 85 at saratoga. that may still be in lanes. i've seen a lot of slowing as we're approaching with a building commute. so watch for that portion as you're coming out of san jose and in toward the saratoga cupertino area. and of course, the bay bridge, which actually had a lighter build today, but it's still got all lanes full. that's lighter. yes. comparison. hey, the today show is just ahead. but we continue today in the bay on roku and other streaming
