a homicide investigation. we are continuing to learn more from police about what exactly happened. the latest update we got just in the past 90 minutes. investigators say this afternoon they got called to russell street, not far from the san pablo park playground, looking into reports of a stolen vehicle. but when police arrived, they found three people suffering from stab wounds two men and a woman. video from the scene shows caution tape and various articles of clothing on the ground. all three were taken to the hospital where the woman later died. so far, there's no word on any arrests. nbc bay area's alyssa hoard is at the scene and will have a live update for us coming up during our 6 p.m. newscast. right now, a live look at capitol hill tonight. that is where preparations are underway ahead of monday's inauguration of president elect donald trump. but thousands across the country are making their voices heard ahead of his return to the white house. protesters taking part in the so-called people's march headed to the lincoln memorial for a rally today. organizers say the marches are part of a

long term resistance strategy to proposed policies of the incoming administration. similar events were held right here in the bay area. nbc bay area's christie smith has a look at some of those demonstrations and how gop supporters are responding. in san francisco today, people marched in the streets. michael kushner came from the east bay. so many people in this country who don't buy into what donald trump and his group are doing, and we just need to make ourselves visible. we need to organize. there was a list of concerns that brought him out. you know, certainly preserving democracy, because without it, we can't fight for all the other issues that are important to us. but climate would be high on that list. with president elect donald trump's inauguration just days away, he joined others who marched in protest through the mission district. and it's also the beginning of the resistance of the next four years. of all thesese promises and rhetoric tt

he's putting out, that he's going to do mass deportations. different groups came together and combined their efforts. some people carried signs about women's reproductive rights and other issues as they made their way to dolores park. the people united will never be. and over in alameda, people marched to engage and be with our community of persistence and being loud and speaking up for love and for all the community to, for, for, for belonging and being inclusive. in cities around the country, people were part of the people's march organizations coming together, including in washington, dc. john dennis sees it dififferentlyhe's a member of the board with the california republican party, who's in the nation's capital. looking forward to the inauguration. you know, on the surface, i'm as excited as as anyone could be and as optimistic as i've ever been, frankly, about the direction that that washington will go in and where the country

will go deeper down. yeah, that side of me is tampers that that optimism with the realities of government and the realities of washington. for those marching in the streets, they're unified and ready to keep pushing back. you know, we've always, again, here in san francisco, have worked together for social justice. christie smith, nbc, bay area news. all right, christie, thank you. new developments tonight in the looming ban of tiktok in the u.s. in an exclusive phone conversation, president elect trump tells meet the press kristen welker he'll most likely give tiktok a 90 day reprieve from a potential ban in the u.s. following his inauguration monday, although he underscores he has not made a final decision. and that comes as the app is expected to go dark this weekend. tiktok's u.s. headquarters is in santa monica, and there are a couple of reports about when it could go offline, some as early as tonight. either way, the company says the app will shut down on sunday. that is, unless it gets

guarantees from the white house that providers like apple or google won't be punished for carrying tiktok in their app stores. the supreme court upheld the ban in a ruling yesterday that says u.s. app stores must remove it unless its chinese parent company sells it by tomorrow. but now, democrats and republicans who both supported the ban say they may not enforce it. it should be noted that tiktok's ceo expected to attend the president's president elect's inauguration on monday. meanwhile, there are some last minute changes being made ahead of monday's inauguration that we want to tell you about. this as we're getting new video there. the president elect heading on a plane to washington, along with his wife and son from palm beach. now, the upcoming swearing in ceremony will now be indoors inside the capitol rotunda because of what's expected to be freezing temperatures, the low only six degrees, while the high is just expected to hit 20. now we will have live coverage when president trump gets sworn in for the second time. you can watch it right here on nbc bay

area. that's monday, beginning at 7 a.m. and an update now on the fire burning in moss landing just south of santa cruz. as of now, there are no flames visible. instead, monterey county leaders say that fire at vistra, which is a battery energy storage facility, is only smoldering today. fire crews are still working around the clock because of the potential of the blaze to reignite, but officials seem to believe the worst of it may be behind us. and in the past. so we'll get high intensity fire and it will die down overnight when it cools off. and then during the day, we'll see fire intensify. this is normal for battery fires. again, i'm hopefully optimistic that we've seen the worst of that and that this evening we won't see any more flare ups. and then we can start thinking about opening up these roadways. 80% of the building and batteries inside went up in flames because of the toxic fumes. roads were shut down and residents ordered to evacuate

until the smoke cleared. the cause of the fire remains under investigation. happening tonight, the hollister community plans to gather to remember the three high school students killed in a car crash earlier this week. investigators say 17 year olds victor lujan, angel villegas loomis and 18 year old brandon alarcon were killed when the car they were in lost control and struck another car near gilroy on tuesday night. they were all students at hollister high school. tonight, a candlelight vigil is scheduled at the legacy church in hollister. another passenger in that car and the driver of the car they hit were taken to the hospital with serious injuries. it is unclear what their conditions are tonight. the cause of the crash is still under investigation. and new at five san francisco mayor daniel lurie has only been at the helm of city hall for less than two weeks. but one of his first priorities is to make sure the city is ready for a large scale disaster. earlier today, he joined leaders from a long list of city agencies for an emergency preparedness drill. it featured the san francisco fire

department demonstrating its high pressure fire hydrant system, as well as aerial trucks and other critical resources. fire crews also have fireboats ready to battle flames offshore. i think the key here is we have to continue to be as prepared as possible, whatever comes our way. with the challenges that we face and what southern california faces, you can never be too prepared. now, this, of course, comes as the los angeles area continues to battle several deadly wildfires there. you may recall firefighting efforts have been hindered because of a lack of pressure and water in some local hydrants. the cause of the wildfires and those dried out hydrants are still under investigation. shuttering tomorrow, the barnes and noble at san jose's almaden plaza expected to close. book fans have been close to rifling through the store's final sale, with some books at up to 75% off. a sign inside the store says the chain is looking for a new location, according to

she will travel to los angeles next week. it comes as crews are getting a handle on containing the devastating southern california wildfires still buing at this hour. here's a look at the updated numbers. the palisades fire. 43% contained. cal fire says it's burned nearly 24,000 acres so far. meanwhile, even more progress is being made on extinguishing the eaton fire in altadena. it has burned more than 14,000 acres, but is 73% contained. the death toll is at 27. 31 people are still missing. nearly 13,000 structures have been destroyed, and with so many different ways to help first

responders and fire victims, we wanted to make it easy for you to learn what you can do and put a ton of resources on our website. there you can also find the latest news on the fire, ongoing investigations and tips for how to develop an emergency plan for your family. that is all at nbcbayarea.com. all right. moving to the coast now. we're tracking some pretty intensifying conditions there. this is new video from ocean beach in san francisco. the national weather service issued a beach hazard statement that starts at seven tonight through monday evening, warning of an increased, increased risk of waves and rip currents. and a reminder for beachgoers do not turn their backs to the ocean. yeah, it could be some pretty potentially dangerous conditions there, especially if the sunny skies. you know, it's kind of tempting to get out there. we're not talking about wave heights or breakers of 10 to 20ft, but rather waves about 5 to 8ft. but the sneaker wave threat and rip currents will be an issue out on the coast. and as you just heard, starting at 7:00 this evening, this is going to last all the way through 7:00 monday,

so use caution. this is a long period westerly swell, so those west facing beaches might see some of that. and you may also have some pchy areas of dense fog too. if you're heading out to the coast during the morning now, right now in san jose, we're at 59 degrees. you see the clear skies, a little bit of haze in the air. we'll talk about air quality coming up in just a a minute.ight now in dublin after 60 earlier pretty clear 58 degrees around san rafael 53 cooling quickly now as we head over to san francisco, a little bit of late day sunshine left on some of the tops of the buildis there at 53 degrees. so coming into the end of the weekend, night and morning fog setting up could have reduced visibility tomorrow morning. and then a bit of a change late tomorrow for the hills of the north bay and near the diablo range. we'll see the return of some gusty dry offshore wind. now, today, not enough wind to kind of move some of that haze out of the bay area. we have moderate air quality again for your sunday. and here's a look at the fog. a summerlike pattern because it's getting pushed inland across the bay into those inland east bay valleys. so

patchy dense fog to wake up to tomorrow morning. and just like we saw today, back into the hazy sunshine as we head towards sunday afternoon, another chilly start as we wakup to 30s and low 40s across those inland valleys. then the hazy sunshine breaks out around noon for inland spots and you can see our highs tomorrow. staying pretty cool. upper 50s from san francisco to oakland and still seeing some low 60s closer to san jose than we talked about the gusty, dry offshore wind. there's the timeline. after midnight sunday to 10 a.m. monday, we'll see those wind speeds picking up 20 to 40mph out of the northeast. that is a dry offshore wind here. and notice how the wind speeds should start come down as we head into monday night and tuesday. this is part of an ongoing weather pattern as high pressure continues to block incoming storms. in fact, it is going to strengthen as we get towards wednesday and thursday. so our temperatures are going to be climbing up now. there is one chance next weekend. inland tracking low may try to bring a few showers our way, but because it's inland may not have a lot

of moisture. so as you're about to see here in the extended forecast, our rain chances as we head into next weekend well, saturday and sunday, maybe a 10th of an inch of rain. it's something, but it's still not a lot in the forecast here. so you can see san francisco. we've got the foggy conditions in the morning watching those offshore breezes monday and then mid to upper 60s for highs around the santa clara valley midweek. and then stay tuned next week and at least we'll have a better chance of snow, i think for the sierra and maybe a few showers around here next saturday. yeah, but you're so right rob. today i saw it was sunny and i wanted to go outside without my jacket. and once you get out there, it's chilly. it's cold. yeah. highs in the 50s, but. but sunny. all right. rob, thanks. well, our investigative unit is looking into a breaking issue on bart trains during wet weather. the transit agency says it is aware that it is happening the way they are, hoping

plaguing bart in wet weather. braking causes flat spots that require entire trains to go in for wheel resurfacing. now, bart is in the process of implementing a $4.3 million, two year strategy it hopes will help. investigative reporter jaxon van derbeken explains. you just sit there and wait. just do nothing. you know, go on your phone, play wordle if you have to. at the walnut creek bart station, benjamin brewster says he's tired of having to wait up to 20 minutes to catch bart on rainy days. just stay there, and the time just keeps going up and up or like, it goes down, and then it goes up and fluctuates. and so it can be pretty annoying. anytime there's wet weather. bart riders typically deal with delays because bart cuts train speeds in half to prevent sudden braking. that happens automatically when sensors on the new fleet of cars detect too much spinning or sliding of the wheels on the rails. it slams on all the brakes. john ghanem, the manager of bart's new fleet, briefed the

bart board on the problem back in october. he explained that unlike its old fleet, sudden braking grinds flat spots in the wheels of every fleet of the future car at once, and all those wheels need to be resurfaced. so we've been looking for a way to fix this. bart now has a $4.3 million plan, one it believes could reduce flats by as much as 80%. since bart says it can't override the sudden braking system, it will reprogram train software, so trains only have to run more slowly as they approach problem areas. instead of running all trains at half speed. the train will know five seconds before it comes in there, or six seconds it'll start to slow down early so that it gives it a longer runway to meet the speeds. the speed reductions and it won't slam on the brakes. how slow trains will have to go to avoid flats in

those problem areas is still being worked out. bart declined to make ghanem or other officials available to answer questions about their new strategy, which will be implemented over two years. but bart internal reports obtained under the public records act show bart identified the risk of sudden braking nearly a decade ago, well before the first fleet of the future cars arrived. by 2022. bart assured regulators that reducing speeds to 30mph in wet conditions had significantly decreased the damage. yet as more cars replaced old ones, the problem has continued. according to bart tracking data. by november, bart was losing on average, 14 cars on each day of wet weather. the $8,000 repair cost per car is under warranty for now. as an engineer, you know you want to do preventive maintenance. preventive maintenance. you don't want to see something like this. this is a clear failure. bart board

member liz ames says she is only learning the details now about all the brakingroblems. she says even if the plan cuts flats by the 80% goal, bart could still end up paying for extra repair costs after the warranty expires. it's just too costly to just let this keep going, and then we may not have the warranty enforced. she wants bart to require a long term permanent fix, like a re-engineered braking system, and not just cut speeds as it may be delayed. meanwhile, bart passengers like brewster are anxious for relief. it still makes me want to ride bart because i love bart. i think it's a good system, but also i just hate the delays. jaxon van derbeken nbc, bay area news. all right. still ahead, the u.s. department of justice is going after walgreens, and it all has to do with prescriptions. we will fill you in on what the doj is alleging in new court documents, plus how walgreens is responding.

statement saying it stands behind its pharmacists and that it follows all government rules and regulations when filling prescriptions. now seemingly unrelated to the suit, walgreens announced plans late last year to shut down 1200 of its stores across the country, including a dozen in san francisco. well, monday is martin luther king junior day, and ahead of the federal holiday, south bay leaders rolled up their sleeves to plant trees in honor of the late civil rights leader. this morning, volunteers and city leaders, including san jose mayor matt mahan, were on hand to participate in today's event, sponsored by our city forest. the president and ceo of the nonprofit says the annual event gives a chance for many to give back to the community. our whole m.o. is about getting people involved, because 85% of the urban forest is actually the responsibility of everyday people. no. no agency can take care of all the trees or plant all the trees. and so we need people to know how to do that. and that's what we do is engage people and train them and
