what is it? good morning to you here on today in the bay. a lot to get to this morning as president trump launches his second term in office. we're going to talk about that and so much more. that's right. vianey is in for kari this morning. we were just talking before we came on air about how cold it is out there. there's a frost advisory. there is. and we've got 30s on the map right now, so that is definitely something to keep in mind, because these 30s are going to linger through that kind of 7 a.m, seven 30 hour. look at this. 39 right now in south san jose, 36 in saratoga, concord, 35 degrees and up through parts of the north bay as well. now we do have that frost advisory in effect again through 9 a.m, but notice we are running a few degrees colder this hour compared to just around the same time yesterday. a look at napa about seven degrees cooler right now and here's what we can expect. so
5:02 am
the areas highlighted in the blue are included in that frost advisory. we're talking about santa rosa san rafael, napa stretching in through parts of danville, livermore, san jose, morgan hill and gilroy. now would not surprise me if we saw these issued yet again through later portions of this week. but if you take a look at about 9 a.m, we'll finally start climbing into the 40s. lots of sunshine ahead. we'll talk about that. plus wind advisories coming up in just a few minutes. thanks, vianey. well, president trump already making sweeping changes, signing a flurry of executive orders hours after taking office. and while doing so, the president wasted no time pardoning hundreds of people charged in the january 6th insurrection. we have a live look at the central detention facility in washington, dc, where two previously charged rioters have already been released and more criminal defendants are expected to be freed any time now. our live coverage this morning includes kris sanchez tracking immigration concerns and california's response to those executive orders. but first, we want to go to today in the bay's
5:03 am
chris pollone live for us on capitol hill this morning. and, chris, the president wasn't wasting any time taking swift action here. no, not at all. marcus and laura, good morning to you, the 45th president. of course, now the 47th president. and amidst all the ceremonies and celebrations yesterday, he started pursuing his very aggressive agenda. glory, glory as the new president danced and celebrated his inauguration with supporters in washington. this is going to be the dawn of the golden age of america. some 1500 january 6th defendants celebrated their legal slates being wiped clean. as one of his first official acts, president trump pardoned and commuted the sentences of everyon charged with crimes related to the january 6th insurrection, one cutting his ankle monitor off after getting word that the new president, who campaigned on bringing law and order back to american cities, absolved him with the stroke of a pen. this is january 6th, and these are the hostages. but they weren't
5:04 am
hostages. they were people who were found guilty by a judge or jury, or pled guilty to crimes committed as a pro-trump mob stormed the capitol to stop the certification of the 2020 election. one trump official posting a picture of two brothers after being released from a washington jail, pled guilty to felony assault charges just days ago. it was one of dozens of executive orders and actions president trump signed in his first hours back in office. definition of birthright citizenship president signing an order denying u.s. citizenship for children born in the u.s. to undocumented parents, a right guaranteed in the constitution and order sure to face legal challenges. we have very good grounds. people have wanted to do this f decades. it came after an inauguration ceremony unlike anyone had seen in decades. i, donald john trump, do solemnly swear. with the swearing in ceremony being held indoors because of cold temperatures and the inaugural parade marching through a nearby arena, many people thought it was impossible for me to stage

such a historic political comeback. day one of an already record breaking return to power. yeah, just one day in and president trump's second cabinet already taking shape. the senate unanimously confirming senator marco rubio to be secretary of state. marcus and laura, back to you. a lot of changes, especially from the get go. thanks, chris. well, california is preparing to defend some of its newest citizens against trump administration policies. this as president trump is vowing to end birthright citizenship. the state's attorney general is vowing to fight it. today in the bay's kris sanchez joins us from our newsroom with the action that we can expect today. good morning to you, laura and mark. so california attorney general rob bonta says california is prepared to fight for that birthright citizenship on his inauguration day. as kris pollone mentioned, president donald trump signed an executive order saying, in effect, that children born of parents who did not enter the country legally can be denied citizenship. in a
5:06 am
statement, california attorney general rob bonta said as home to more immigrants than any state in the country, california has a vested interest in ensuring that the federal government recognizes the fundamental rights of the children of immigrants who are born in our state, as he so often did in his first term, the president has once again overstepped his authority with this unconstitutional executive order. bonta not the only state attorney general promising to fight, and the aclu already filed suit just hours after that order was signed. meantime, protesters in san jose gathered to decry that order and nine others related to immigration action, including declaring a national emergency at the us-mexico border and major immigration enforcement action in major cities. and my biggest fear is losing my parents. i can't imagine losing my parents. it's difficult to even think about anyone to think about it, because if i were to lose my parents to deportation, my whole world would fall apart. the only way that we will collaborate
5:07 am
with ice is if there's a criminal threat to our community, or if there's any type of criminal charges. but aside from that, we will not be cooperating with ice. the birthright citizenship issue dates back to the civil war, and one of the biggest court challenges was posed by a san francisco man whose parents were born in china. in that 1898 case, the court ruled that because that man was born san francisco, he was in fact a u.s. citizen. laura, so much to follow there. thank you. chris silicon valley tech giants were sitting just feet away from president trump during his inauguration. just ahead in our next segment, scott mcgrew will break down the role some of them are likely to play in the trump administration. 506 this morning, we want to take a live look for you in san diego, where developments are happening right now. the crew is working there tirelessly, so that's why that camera was moving. but we can tell you about those mandatory evacuation orders. they were in place for east of oceanside as firefighters tried to get a
5:08 am
handle on the out-of-control fire. now it started after midnight. this is in the bonsall area north of san diego. some 50 acres have burned there so far. now we know that there is no reports of any structure damage, but firefighters are dealing with those wind gusts at more than 20 miles an hour. meanwhile, firefighters are making more headway on reaching full containment in both the palisades and eden fires burning in l.a. county. a total of 28 combined deaths so far now confirmed, with more than 14,000 structures destroyed. but overnight, teams were dealing with stronger winds and the latest red flag warning. meteorologist vianey arana is tracking the conditions in southern california. what's the situation looking like now? a red flag warning still very much in effect. they registered wind gusts upwards of 70 plus in some of those higher ridges, but it's also paired with extremely low humidity single digits. it's actually more dry than it was when some of these fires initially broke out. and i want to show you the map of where we're currently seeing that red
5:09 am
flag warning. so anything that you see highlighted in red is included within that red flag warning. as of right now, this is set to expire at 2 p.m. but in addition to this red flag warning, there are also fire weather watches that will be in place through the evening hours. judging by where the percentages are right now with the humidity, it would not surprise me if it got extended a bit even into later tonight or early tomorrow morning. look at the numbers. right now we're talking 9% in thousand oaks. i took this through about 9 a.m. now keep in mind, typically with humidity, what we like to see is what's known as an overnight recovery, especially when we're dealing with areas around the coastline. notice not much of an onshore breeze there. even in through parts of la, we're still at about 11% and there is no recovery through this afternoon. this is through 5 p.m. tonight. we start dropping down to 5% in some zones, including simi valley, and it stays very dry through your tuesday wednesday forecast. look at the wind speeds right now. we're still at about 56 plus miles per hour in
5:10 am
that santa clarita range. so we're going to monitor the conditions there very closely. but unfortunately extreme fire weather conditions will continue through today. now let's get a check of how those roads are doing. this is a live look right now in san jose. so far we haven't seen any reports of any crashes via chp. a live look right now at that bay bridge toll plaza. you're going to notice the metering lights are still off, so things are moving smoothly through that zone there. let's take a quick look right now at the speed sensors. notice a lot more green on that map. we are starting to see just that typical morning commute at about 5 a.m. at about 530. we do tend to see more of a build up and your bridge drive times. also looking good. westbound 80 towards the bay bridge looking at about eight minutes. we'll be back with another local forecast coming up in just a few minutes. sounds good. 509 right now, those wildfires burning in southern california are serving as a reminder that the state's insurance crisis is not going away. in fact, you may not even have protection with your insurance company on your home. well, coming up at 525, our

i'm not happy with the way that pg&e handled the wildfires. yeah. yeah. i totally, totally understand. we're adding a ton of sensors. as soon as something comes in contact with the power line, it'll turn off so that there's not a risk that it's gonna fall to the ground and start a fire. okay. and i want you to be able
5:13 am
to feel the improvements. we've been able to reduce wildfire risk from our equipment by over 90%. that's something i want to believe. now and it is a frosty start. 35 degrees right now in walnut creek. expect to keep these chilly temps through the first half of our morning before we see a gradual warm up back up into those 60s. we're going to have a closer look at your extended forecast, and when there could be rain chances in our forecast coming up. and we're going to take a lk right now as well, at how the traffic conditions are doing at the bay bridge toll plaza. the metering lights are still off, so we've got a smooth traffic flow. we're also not seeing any major crashes at this hour. we'll talk more about the drive times all the way from the peninsula, through the south bay and east bay. coming up in just a few minutes. well good morning. very happy tuesday to you. netflix and los gatos will report its profits today. wells fargo, still suffering from that scandal way back in 2016, where tellers were pressured to sign customers up for new accounts

politics, but many affect the economy, including the crackdown on immigrants. what we did not see was the institution of tariffs trump promised on day one. he said tariffs on china, mexico and canada would likely come february 1st. the u.s. dollar jumped in value on those comments. the dollar gets stronger during times of conflict and trade. now that's good. if you got dollars like we do. it makes travel cheaper, but a strong dollar also makes american products more expensive for people outside the u.s, like boeing airplanes, or u.s. steel, or american wheat and corn. a top chinese official speaking at the world economic forum in davos warned this morning nobody wins a tariff war. canada and other countries have already indicated they'll put tariffs on american exports if president trump goes through with it. one thing to remember, if we get into a tariff war, the people we are at war with aren't at war with each other. if countries can't get their products from
5:17 am
america, they can still get them from canada and mexico. president trump also proposed a 100% tariff against any product from a bric country. here he is threatening 100% tariffs on spain. they're a brics nation. spain. you know what a brics nation is? you'll figure it out. but. and if the brics nations want to do that, that's okay. but we're going to put at least a 100% tariff on the business they do with the united states. you know what the brics is, right? well, now i think spain's reaction would be like, we're not in brics. the s in brics is brazil, india, china, south africa. now there are some other countries as well. but i think spain's reaction when it comes will be what? right. okay. yeah. interesting. a lot going on yesterday. a lot. all right. well trending this morning. switching gears a little bit here, one san francisco giants standout may be used to

slugfest, but this weekend chug fest is now capturing the attention of social media. the giants on saturday hosted one of four events leading up to the team's annual fan fest celebration. fans in napa challenged third baseman matt chapman to a beer chugging contest at napa's beer garden. the team posting this video saying chapman basically hit a grand sm, taking only a few seconds to down a pint. he won the challenge with ease. fan fest, by the way, takes place at oracle park on march 8th. i'd be more like the lady back there sipping it a little bit like beer. that could be fun. all right. forecast for us. it's been fun. afternoons. yeah. weather wise. yeah. we've had the clear conditions. that high pressure has helped kind of warm us up. we were even above average for quite some time, but the cold mornings are here to
5:19 am
stay at least through the next several days. and i'm going to also show you the long range outlook, which gives us a better idea of rain chances, if any, in our extended forecast. so right now it's abo 45 degrees in san francisco. notice the skies that we've got clear conditions, the fog this morning. and as you know, when we don't see any fog or any low clouds, that makes for a very cold start. in fact, here's what it looks like right now. our temperatures are in the low 30s for a lot of areas. we've managed to dip down to 29 degrees in fairfield, so definitely a frosty start.. we are expected to keep this frost advisory in place until 9 a.m. now, right now that's set to expire as of today. but it would not surprise me if they issued a new one heading into wednesday and thursday. now let's talk about what's ahead. because if you look at satellite right now, it describes perfectly what we're seeing on our live cameras. and that's the clear conditions. but we're always looking out for the pacific and out to the north. and that's
5:20 am
going to bring some changes heading into this week. good news. the wind advisories here locally have expired. we had some wind advisories for far parts of northern california that included areas in the north bay. today we're expecting calm winds, sunny skies, clear conditions and daytime highs will manage to climb into the mid and upper 60s for this afternoon. san jose 65 degrees oakland 63. take a look at san francisco also in the 60s. so still a few degrees above normal for this time of year. and here's what the long range outlook right now is showing that high pressure that i mentioned. that's what's been keeping us nice and warm but also clear during the day. so those cold mornings with the mild afternoons will continue stretching in through thursday and friday. here's what we were monitoring. we have a low pressure system that was beginning to build, but if you notice, the way that the model runs right now are showcasing this, it looks like we might get a scattered activity possibility into saturday, but mainly down through southern california,
5:21 am
which of course rain would be helpful. we're just hoping the rain totals right now are looking a lot lower, which could be tricky once we start seeing some of those burn scars show. now we're going to talk about san jose because if you're thinking, well, it hasn't really rained here as much either. the last time we got just a little under half an inch of rain for san jose was christmas eve, december 24th. and since january 1st, we've only gotten a couple of hundredths of an inch so far. so to date we're talking less than two inches for the south bay. a typical rain shadowed san jose. a lot of the santa cruz mountains, of course, take majority of that rainfall through system. so right now this is what your 7-day forecast is looking like, a very low possibility for saturday. we're talking a 10% chance of seeing some spotty showers through that saturday forecast. by the time we inch into sunday, that system will be completely cleared out. and then we'll start to dip in those morning lows, but also the afternoon highs. we're going to get a bit more seasonable, dropping down by as much as ten degrees in some spots in through parts of the interior. we're
5:22 am
going to max out only in those upper 50s, so definitely expect to keep the dry conditions. as far as your traffic goes, we've been doing good here so far. the bay bridge toll plaza has managed to keep its lights off, although typically the metering lights come on right around 525. but looking at this camera, i can see that that traffic has already started to build. so there is a possibility that we could see those traffic lights come on at the bay bridge. now, as far as what we can expect for your speed sensors, i'm not seeing any big changes there. no major impacts as far as any traffic accidents, which is always good to see here. but the bridge drive times right now also looking like a bit normal into tuesday morning. i feel like we're still seeing more of that holiday light commute westbound 92 towards the san mateo bridge. you're looking at about 11 minutes. i'll be back with another traffic and weather update in just a few minutes. sounds good. we'll check back with you. 522 and the wildfires burning in southern california. that raises the question are you insured enough with our consumer investigator. they're looking into how you can protect your

is burning down may soon serve as a crushing and expensive lesson. those homeowners may soon discover they were underinsured and unaware. consumer investigator chris chmura is here to explain the hardship it can create, and just how easy it is to protect yourself. if the l.a. firestorm mirrors other fire disasters,
5:26 am
67% of homeowners are probably underinsured, which means they'll get less insurance money than the actual cost to rebuild their homes. when we do our surveys after wildfires, it's surprisingly consistent at two thirds of the people. amy bach heads united policyholders, a nonprofit that's helped families with insurance since 1991. amy says your family blindly becomes underinsured when your policy auto renews each year, but doesn't keep pace with the realistic cost to rebuild your home. well, then, if your house burns down and you don't have enough coverage, you're on the hook to pay the difference. check your policy now and do one math problem. look at the number under dwelling insurance, then divide it by your home's square footage. if that per square foot insurance per square foot number is somewhere in the $200 range, you're underinsured. amy says
5:27 am
300 to 400 is more realistic. ask a contractor to confirm. then ask your agent about getting more insurance, and you don't have to wait for your policy's renewal date. you can take action today if you have a consumer battle for us to check out, please share your story. scan the qr code on your screen right now to fill out our consumer complaint form online. thanks, chris. well, we've got a lot more ahead for you. at 5.30 on president trump's inauguration. ahead, our scott mcgrew breaking down everything the commander in chief did during his first day in office. plus, what's likely to come in the days ahead. plus, the search for the new alameda county district attorney, the public interview of seven finalists taking place later this afternoon.

of america and the revolution of common sense. it's all about common sense. right now, at 530, he hasn't been at the white house a full day. but already president donald trump is changing the country through a long list of executive orders. this is today in the bay. well, we're rolling up our sleeves, too. and getting to work. maybe not in the same fashion, but we're here for you. good morning. thanks for joining us.
5:31 am
i'm laura garcia. and i'm marcus washington. we'll get to scott mcgrew in just a moment. but first, let's get a look at that forecast. walk out the door this morning. you're going to see or feel those temperatures. at least it's cold. yeah i'm seeing 27 somewhere. what you're like what is going on? yeah. right there near santa cruz mountains. look at that. 27 degrees fairfield at 29. so we managed to dip down below freezing in some spots. frosty conditions indeed. and here's the thing. so even though we've got 30s and 40s right now, we can expect to see a nice climb. and the reason for that? well, we do have plenty of sunshine in store for this afternoon. take a look at the temperature trend at about 12:00 your lunch hour. we're going to be in the 50s, but it's going to take a while. by about 8 a.m. we're still going to be in those 30s for walnut creek. let's take a look at san jose. we're at about 42 right now. we don't really climb into the 60s until that noon hour at least. the wind speeds are nice and calm. right now in san francisco, it's about 42 degrees, but we will eventually see that the sunshine will prevail, and that's going to
5:32 am
leave us with a little bit more warmth heading into the afternoon. it's also going to keep the dry conditions around, and that frost advisory is expected to expire at 9 a.m, so we should be okay. as far as the temperatures, by the time we get to this afternoon, we're going to keep that pattern holding at least through the end of the week. but i'll be back with a look at the extended forecast in just a few minutes. i do want to check your traffic conditions in san jose. we're looking good.d.i ven't seen any major slowdowns right now. so far. we've had a smooth flow of that traffic. if you look at the speed sensors, green on this map means go. that's doing pretty good. moving along, whether that's in through parts of san francisco, the east bay, down the peninsula, and in through san jose. let's take a quick look at those east bay drive times. westbound 80 from highwayour to the bay bridge, you're looking at about 16 minutes and westbound 580 from 238 to the bay bridge about 15 minutes. no major slowdowns through the east bay. a quick check of your contra costa. i am noticing some light slowing in through parts of vasco road.
5:33 am
from marsh creek road to 580, you're looking at 21 minutes. typically, that tends to show a number between 15 and about 17 minutes. so just a few minutes delayed through there. westbound 580 from grant line road to 680. you're looking at about 23 minutes. so we'll get a closer look at your extended forecast for the bay area. another traffic update in just a few minutes. sounds good. we'll check back with you. 532 right now, president trump has pardoned nearly all participants in the january 6th attack on the capitol. scott mcgrew. he said he was going to do that. and the first day, no surprise, he did it. he did it. yeah. good morning to you. it's a really good way to put it, actually, because for the next four years, we are going to have to try to figure out what trump says he will do and what he will actually do. for instance, he also said he would slap huge tariffs on china, mexico and canada on day one. but he didn't. he did though, pardon the attackers, sir. yes, sir. first we have a list of pardons and commutations relating to
5:34 am
events that occurred on january 6th, 2021. okay. and how many people is this? i think this order will apply to approximately 1500 people, sir. so this is january 6th,, and these are the hostages, approximately 1500 for a pardon. yes. full pardon, of course, they were not hostages. video here from one of the federal prisons. as friends and family waited for their jailed family members to be released, the law says they need to be released the moment the bureau of prisons is given access to the pardon. there have always been huge differences between trump and biden, but january 6th is one of the ggest. yesterday, when he was still president, biden pardoned the police officers who were attacked. also yesterday, the president trump, the new president trump pardoned the ones convicted of attacking the police. officers hadn't been accused of any crimes. but with his pardon, president biden wanted to make sure the officers
5:35 am
were not exposed to any legal harassment. president trump said it was all pardons, but later corrected himself to say there were a few, around six that were commutations. that is, they're still convicted, but they can get out of jail. and chief among them was stewart rhodes, founder and leader of the far right oath keepers. he was convicted of seditious conspiracy. he says his only regret about that attack is they had not brought rifles with them. there's a long list of executive orders that trump has signed. we expect him to sign more this week. took the united states out of the world health organization and the paris accords. second time he's done that, instituted a hiring freeze for federal employees, except military. and there were several executive orders about immigration as promised as expected, including ending the special treatment of immigrants from cuba, haiti, nicaragua and venezuela. and he says he's ended birthright citizenship. the idea that a child born in america is american, no matter
5:36 am
where his parents are from. this next order relates to the definition of birthright citizenship under the 14th amendment of the united states. good. that's a good one. birthright. that's a big one. the president does not have the power to sign away birthright citizenship because it's codified in the constitution. the constitution says all persons born in the united states are united states citizens. you wouldn't think a court would have to clarify that. but the supreme court did back in 1898, saying a san franciscan born to parents from china was clearly a u.s. citizen. our kris sanchez is focusing on that today. she'll be up in just a minute. all right, back to the white house. trump, ever the showman, showed off the sealed letter. president biden left him in the resolute desk. you'll hear the voice of our peter alexander. president trump, did president biden leave you a letter? he may have? don't they leave it in the desk? i
5:37 am
don't know. oh, what's in there? thank you. peter, it could have been years before we found out. wow. thank you. katie, what did we say on the outside? maybe we should all read it together. let's read it. well, maybe i'll read it first and then make that determination. that's great. peter, thank you very much. i may not have seen this for months. happy to help with the passing of the torch i did. i left him one in the desk just like this. and video from last night. the president and first lady appeared at several inaugural balls. this is the liberty ball. the vice president and his wife were there as well. by the way, as we start a new four years of our checks and balalances segment, we have a nw graphic. and this is the picture the president wants used as his official picture. president trump says he'll speak about infrastructure later today. an interesting choice as people often teased as old white house about constant promises about
5:38 am
infrastructure. marcus, that just never materialized. all right, scott, we'll be following for the next four years for sure and beyond. all right. well, it's not just president trump getting down to business. so is our team on the today show ahead for you this morning at 7 a.m. just confirmed secretary of state marco rubio will break down what he expects in his new role over the next four years. later today, alameda county could get a better sense of who will permanently replace district attorney attorney pamela price, who was recalled by voters last november. today in the bay's bob redell joins us live from outside the east county hall of justice in dublin. and bob, the alameda county board of supervisors. they're set to meet this afternoon. correct. in a special meeting at 130 this afternoon. good morning to the alameda coty board of supervisors. they will publicly interview the seven finalists who are vying to become the next alameda county district attorney, who would be prosecuting cases not only here at the east county hall of
5:39 am
justice in dublin behind me, but the other courthouses throughout alameda county. last november, you'll recall, as you alluded to, voters recalled alameda county district attorney pamela price over criticism that she was not tough on crime. since then, chief assistant district attorney royl roberts, he's been running the prosecutor's office until a board selects a new d.a. last week, the board whittled the pool down from 15 to 7 finalists. and again, that special meeting at 130 this afternoon, the board will interview those finalists. those finalists are there. seven. as i mentioned, there are two internal candidates in the alameda county district attorney's office, both who have decades of experience prosecuting cases, according to east bay times. they are elgin low, who is a senior district attorney, and jimmy wilson, who is a deputy da, a venus johnson. she's another finalist who's been endorsed by california state attorney general rob bonta. again, according to the east bay times. she is currently the chief deputy attorney general for the california department of justice, was previously director of oakland's department of public safety and the chief assistant d.a. in
