shooting inside his own dispensary. it eventually leads to a deadly police shooting. the new details we're learning about what went down that night. this is today in the bay. good morning to you on this wednesday. thanks so much for allowing us to be a part of your morning. i'm marcus washington. and i'm laura garcia. we'll check that wednesday midweek commute with mike in just a moment. but another chilly start to our morning. kari. yeah, it's not as cold, but you can actually tell i was like, ooh, it's a balmy 45. very sensitive. we can tell the difference in a few degrees. so we're feeling that this morning that that little blanket of clouds is actually giving us a little bit of a blanket and keeping those temperatures up just slightly compared to yesterday morning. at this time, it's 46, in san jose. it's 37, though, in danville. so some of these spots are still very chilly. but we were in the upper 20s here yesterday. so there's the difference. we're at 42 in sonoma and 43 in napa, while san francisco is in the upper 40s.

and for san jose you can see the cloud cover overhead that will linger at least into the early afternoon. and that will give us a slower warmup into the day and keeping those temperatures in the 50s all across the bay area. so a little bit cooler for this afternoon. we'll talk about that and rain for our weekend coming up in a few minutes. but mike, you're seeing more of a build up now in the east bay. no surprises here at the bay bridge. and that's good news. we like the steady, predictable build and slowing we have here. get there on your usual time. you should be fine getting into the city. one new incident up here as you're traveling past richmond parkway west. 80 year commute on the upper east shore freeway. everything got to the shoulder, but the distraction will slow you from highway four. then you're clear. once you get through richmond and into berkeley. some slowing here for 80. southbound in hayward and behind the shield, there may be a new crash right around 92. we'll check on lane status once chp gets there. anywhere south of hayward, we're looking pretty standard. back to you. thanks, mike. we start with new developments out of the white

house. the trump administration now offering all federal workers an unusual deal. quit and receive a severance package. today in the bay's alice barr is live in washington this morning. and alice, this follows the last minute reprieve from a judge halting president trump's funding freeze. marcus and laura, starting with these buyout offers, they were emailed to federal workers as part of the ump administration's efforts to dramatically cut costs and reduce the size of government. and they note that those who don't take the offer could still see their positions eliminated. this morning, more than 2 million federal workers facing a choice take a newly offered severance package or accept trump administration requirements, including returning to work in the office. a senior administration official telling nbc news they expect up to 10% to quit, leading to around $100 million in savings. some democrats pushing back on the president's move. he doesn't have any authority to do this.

do not be fooled by this guy. you were here before he was here. and you'll be here after he was here. a judge hitting a week long pause on a separate order, freezing federal grants and loans after nonprofit groups, 22 states and washington, d.c, all sued the trump administration, citing constitutional provisions that congress, not the president, sets federal spending. the white house press secretary saying the freeze is aimed at federal aid that might run counter to president trump's executive orders, and is not a blanket pause on all assistance. social security benefits, medicare benefits, food stamps, welfare benefits, assistance that is going directly to individuals will not be impacted by this pause. organizations like meals on wheels that delivers meals to seniors confused and concerned. it's not considered a direct federal assistance program like

social security or medicare would be. so we're concerned it all comes as president trump is pressing ahead on immigration enforcement and rounding out his cabinet picks. today, a confirmation hearing begins for his controversial choice to head the department of health and human services, robert f kennedy jr. and going back to those federal worker buyouts, the american federation of government employees is warning that what it calls a civil servant purge could mean chaos for americans, depending on a functioning federal governmen though the offers we should note exclude members of the military, postal service, immigration enforcement, and national security. lauren marcus. it will be interesting to see how it all play out. thank you very much, alice. 604 for you this morning. and the bay area continues to grow over the federal immigration crackdown. now, some students are planning to voice their concerns later today. today in the bay's bob redell joins us live in the east bay this morning. and bob, the fear

there from a lot of those migrant communities only heightened there since the recent ice activity. correct. good morning to you, marcus. earlier this week, ice agents took some people into custody in san jose, which is why yesterday, this is the scene we saw at the intersection of story and king during a protest for immigrant rights. hundreds of students and members of the community blocked that intersection in east san jose, which is near where agents with the federal immigration and customs enforcement agency, otherwise known as ice, were spotted in recent days. one woman who showed up to that protest with her father told us, quote, referring to her father, he only came for a better life. he's not a criminal. she says. her dad has worked hard to provide for her and her brother, while her mom has remained in mexico. i have not seen my mom in almost like ten years, i call her, but it's still sad because both of my parents are not together. they're separated. so you know what it's like. you know what it's like for families not to be together? yeah, it is

extremely important to me and to our police chief that residents know when they see an sapd officer that we do not enforce immigration laws, just as we don't enforce the irs laws or the epas laws. we enforce violent and property crime in our community. that was mayor matt mahan of san jose, who says his police department does not go around and ask his citizens about their immigration status. but if someone is committing serious and violent crimes, they will be held accountable, prosecuted and might be deported. nbc news reports nearly half of the undocumented immigrants arrested nationwide on sunday had no prior criminal record besides being in the country illegally. earlier this week, ice wrote in statement, quote, enforcement and removal operations law enforcement activity takes place around the clock. however, ice does not conduct raids or sweeps, nor does the agency operate

roadblocks or checkpoints. ice's enforcement resources and resources are based on intelligence driven leads, and ice officers do not target non-citizens indiscriminately. students at cal uc berkeley, they have planned a protest, a rally march later today between 3:00 and 5:00. and there's also more protests scheduled for this weekend in the south bay. reporting live. bob redell today in the bay. when it comes to all that's happening right now, a lot to know there, bob. thanks for that information. and also, our scott mcgrew is breaking down the white house's response to these increased rates. that's going to come up for you this morning at 630. now, the bay area immigration attorneys, meanwhile, they want everyone to know their rights happening later today in east palo alto. an information form including legal advice and a question and answer session both in english and spanish. english is happening at five. the spanish is happening at six. this is all going to take place at san mateo's san mateoeoounties human services agency. this is in east

palo alto at 2415 university avenue, and the immigration institute of bay area has created a red card that is to remind everyone detained or questioned by ice officers what your rights are and how to exercise them. so there is a card available in eight different languages on our website. we do have that information for you. once you get there, you're going to be able to download that information there so you can have it handy anytime you need it. that card will be able to be printed from our website nbcbayarea.com. new at 6:00. authorities are identifying a san frcisco merchant critically injured in the south of market shooting. it happened monday night outside the vapor room pot dispensary on ninth and mission, the chronicle reports. a dispensary owner, martin alev, suffered life threatening injuries. a gofundme page says he was shot four times and is now in the icu. investigators are not saying what led up to

the shooting, but right now it's not believed to have been a robbery attempt. responding officers later shot and killed the suspect following a standoff. that drama unfolded inside a nearby building, with the suspect firing at officers. police and the city attorney's office are still investigating. san jose city council once again fully seated with the addition of a new member. last night, the council appointed engineering executive karl salas to represent district three, and that is the seat vacated last fall by omar torres, who is now fighting criminal charges. salas beat out jamaal williams, director of advocacy for racial justice at san jose state, in a narrow race. a special election is scheduled for april 8th to decide a permanent replacement, along with a runoff if need be, in june. all right. we've been talking about what a chilly start it's been across the bay area, but a little bit of cloud cover making things warmer. not in a huge way. kari got a look

at our forecast for this wednesday morning. and the thing about cloud cover in the morning is that it keeps temperatures a bit higher. but if the clouds linger longer will. it also keeps us from warming up from that sunshine that we typically get. so we're right now in the upper 30s for walnut creek, but it's 51 in san francisco and 46 for palo alto and san jose. so as we take a look at palo alto, it will be mostly cloudy throughout the morning. temperatures going from mid 40s, but we are not going to be as warm and no 60s here for many of us as we're going to stay in the 50s for the afternoon, but this is actually normal for this time of year. we've had warmer than normal temperatures, so we're coming back to something more seasonable for the end of january, and eventually we're going to get something else, that seasonable rain. so we'll see that in our weekend forecast, and we'll talk about it in a few minutes. mike, saving us a little bit of money at the gas pump. yeah. my numbers are staying the same though. for this first price, san jose still keeps the best

planes. meantime, a group of good guy hackers, they call themselves white hat hackers, announced this week they were able to get into newer subarus over the internet. they can start the car, unlock it, honk the horn. most importantly, see where you are and where you've been. the vulnerability isn't in the car, it's in subaru's servers. back at headquarters, they alerted subaru first, and then they posted some of the things they found, like a map, the travel habits of one of the hackers, moms who owns a subaru. this is everywhere she has been. now, to be clear, subaru has solved the problem. good guys wouldn't show the world how they did it if it weren't solved. but cyber experts say with all the cool things our computerized cars can do now, it will not be the last time. if we think about our adversaries, can you imagine them turning off hundreds of thousands of cars during the beginnings of a cyber war? and what kind of, you know, havoc

the game, and all must pass an inspection before being shipped out to those teams. wow. lacing them up there. well, happening today, the largest and oldest rummage sale in northern california returns to oakland. the annual white elephant sale runs every wednesday through saturday over the next four weeks, kicks off today and ends february 22nd. all proceeds go to the oakland museum of california. the event is held at the warehouse over on lancaster street. shoppers say you can find just about anything you're looking for, and some days, including today, are already sold out. tickets are still available for the next few days, though it will cost you $7 to get in. think of the treasures you can find in there. it's kind of cool and something to do inside. this weekend, as we are going to see some rain coming in. we've been so dry for so long. well, we are desperately needing the rain at this point. so we're going to talk about that. let's get a look at today's forecast. still a mix of sun and clouds and no issues with any of the heavy downpours

expected. nothing like that today. it's going to be partly cloudy and temperatures about normal for this time of year in the mid to upper 50s. let's talk about our water year rain update. and for most of us, unless you're in the north bay, it has been super dry. santa rosa still at a very big surplus after getting 27in of rainfall and most of that happening in early december, while much of the rest of the bay area kind of missed out on that atmospheric river. and so we are really lacking only now at anywhere from 50 to 85% of our normal amount of rainfall, while santa rosa once again over 100%. so we are going to see this next storm system coming in to start out the month of february with some heavy rainfall that's going to be tapping in to some deeper subtropical moisture. and that's going to at times make the rainfall a little bit heavier and bringing in some wet weather throughout the weekend. so it starts on friday, continues

through saturday and sunday, may not be raining the entire time. you can see that at least for monday, most of the forecast keeps it dry for san jose, and then this system will push to the south and bring the rest of the bay area some heavy amounts of rainfall. so here's as of now, what we're expecting throughout the weekend into early next week. so this is over the course of several days. we could see about two inches of rainfall for the south bay up to san francisco, but much higher amounts for the north bay, possibly 3 to 6in of rainfall. and it's dry. we have some time to prepare, at least for today, tomorrow and most of the day onn fray. but then once that rain comes in, it's going to be off and on in the forecast through tuesday and temperatures stay mild with highs in the low to mid 60s. mike you have now a bart delay. yeah. let's start with the update f for the gen line. the berryessa line that goes along this side of the bay all the way up in through south hayward where there's an issue on the tracks. and so there is a

happy lunar new year to all of you out there. i'm marcus washington, and i'm laura garcia. all right. we want to take a live look outside this morning at dublin. okay. traffic. we'll check it out in just a moment with mike inouye. but let's talk about the temperatures for today. a tad bit warmer, but it's not hot. it's not hot. and we've also seen more clouds coming in. so that's kind of acting as a blanket, keeping those temperatures a little bit milder as we start the day, but also will create a slower warm-up going into the afternoon if those clouds decide to stick around. so take a look at the range and temperatures. we're anywhere from 51 in san mateo to 35 in fairfield, and you can see that for the inland areas it is much cooler. and the temperature trend for dublin will go from mid 40s to seeing highs in the mid 50s into the afternoon. so not as much of a warm up there. it will be in the upper 50s for san jose, 59 for santa rosa and

55 for san francisco. tomorrow is a repeat of today, but we will be staying dry friday. a new storm system comes in, so we'll talk about the timeline and what you can expect as you make weekend plans coming up in the full microclimate forecast. sounds good. we'll check back with you. kari 631 right now. happening today, san francisco's fentanyl crisis is taking center stage as leaders debate the mayor's new emergency declaration plan. today in the bay's ginger conejero saab joins us live in san francisco this morning. and ginger, getting all supervisors on board could actually be a challenge here. it could be. and today is not really just focusing on a huge problem here in the city, although that is a main focus, laura. but it can also serve as a test to new leadership in san francisco. the city has a new mayor. it has new supervisors. can mayor lurie deliver on a key campaign promise of cracking down on the fentanyl crisis here in the city? he says yes, he can, but he needs help specifically from supervisors

that are on the budget and finance committee. they are expected to debate the mayor's proposed citywide fentanyl state of emergency ordinance. now, today will be the first time it is being heard under this proposal. the mayor plans to create more treatment facilities for fentanyl users. he also hopes to coordinate with city departments for enforcement and treatment. but he needs the ability to spend currently budgeted funding. he also needs the ability to seek out private funding, and he's asking for less bureaucracy when it comes to nonprofits and vendors who will work side along or who will work alongside this goal. now, here is the mayor from a presser calling for a fentanyl state of emergency a couple weeks ago. we have a crisis that needs the urgency. it demands urgency. and that's what you're seeing from my administration and everybody behind me. now, supervisors have raised questions around the mayor's proposal. weeks back,

supervisor shamann walton said the request to waive certain processes is clear, but there wasn't a clear enough plan for him. what would happen after now? supervisor connie chan also raised concerns that the proposal could weaken oversight from the board of supervisors. the mayor said that he will work with the concerns of the supervisors. we're going to see what progress he's made so far, depending on how the committee votes or if there's a decision today. laura, it will also be a busy day for the mayor. he's planned to meet with the san francisco business times. that's kind of an annual tradition for each new mayor in the city. but after that, he is expected as well to join a rally outside the steps of city hall that's organized by mothers against drug addiction and deaths. that will, as we assume, talk about the fentanyl crisis and will we'll see what else the mayor has to say, how he plans to really attack this problem. we're live in san francisco,

ginger conejero saab. today in the bay. all right. thank you very much, ginger. in a late night vote, alameda county leaders have selected a new district attorney. supervisors voted for county judge ursula jones dixon over six other candidates. she previously worked in the da's office from 1999 to 2013, when she first won her position on the bench. last night, votes followed a lengthy public comment. dixon is a cal graduate who earned her law degree from usf. she'll fill out the term of recall da pamela price. voters will elect a new da in 2026. well, a change of language from the white house about its roundup of migrants. scott mcgrew joins us now. candidate trump promised to round up criminals first, but the definition of criminal has been changing. it's morphing. yeah. good morning. the department of homeland security says about half the migrants rounded up on sunday were hardened, wanted felons here illegally, and half were not.

that half, i says, were here without permission. that does violate the law, of course, but it's a misdemeanor. those people are not the priority that candidate trump spoke about. the white house is now clarifying any immigrant here without permission is considered a criminal. so i'm asking, though he said he was going to focus on those violent offenders first. so it was violent offenders, no longer the predicate for these people to be deported. the president has said countless times on the campaign trail. i've been with him at the rallies. i know you've been there covering them to peter, that he is focused on launching the largest mass deportation operation in american history of illegal criminals. and if you are an individual, a foreign national who illegally enters the united states of america, you are by definition a criminal. that is the press secretary in the white house speaking this afternoon or this yesterday afternoon. meantime,

take a look at this. it wasn't clear to me whether you were saying that no medicaid would be cut off. obviously, a lot of this goes to states before it goes to individuals and so forth. so are you guaranteeing here that no individual now on medicaid would see a cut off because of the pause? i'll check back on that and get back to you. i think we found some things that are maybe a little out of order, but we can get through this no problem. president trump offered buyouts to federal workers, quit now, get paid through september. experts say he does not have that authority. not clear how he would secure the money for buyouts anyway. over the weekend, trump fired 18 inspectors general who are in charge of following the money and rooting out abuse. now, all of this makes it very difficult to keep up with what's happening in washington. former trump aide steve bannon called this flooding the zone. we don't have the time and the power to examine every legality before the next thing pops up, like the

firing of government watchdogs. president trump pulls the news cycle into the next story about freezing federal aid or whatever will happen today. and there's more to watch. robert kennedy jr starts his senate confirmation hearings today. trump nominated him as secretary of health and human services. dozens of medical groups, hundreds of doctors, 87 advocacy groups including the naacp, the union for concerned scientists, say kennedy should not be put in charge of the nation's health. his family members tend to agree. caroline kennedy, daughter of john kennedy, calls her cousin, quote, a predator. rfk jr has expressed doubts about vaccines linking it to autism. there's no truth in that. questioned whether hiv causes aids and that wi-fi causes cancer. again, no evidence of that. his confirmation starts in just a few minutes, 7 a.m. our time. a lot of bay area parents involved in autism awareness andnd care will certainly be watching. they

are concerned. thank you very much, scott. 638 right now. taking a live look outside up from the north bay this morning. a live look at san rafael. temperatures across the bay area. i mean, we are in winter, right? yes. and you're getting good use of those, perhaps christmas sweater gifts? yes. so we do need a lot of layers this morning. we're in the upper 30s in walnut creek, but you compare that to the 51 that we're seeing in san francisco. and it's 46 in palo alto and san jose. the difference this morning compared to yesterday is that we are seeing more cloud cover. and then when we take a look at our highs for this afternoon, it will be lower as those clouds linger a little bit longer throughout the morning, keeping those temperatures from warming up so quickly. but this is about what we typically see for this time of year. upper 50s for santa rosa, 59 for hayward, as well as 59 for san jose. and this repeats tomorrow. starting out partly cloudy. and notice how a lot of these numbers don't even change going into our

afternoon. but eventually we'll see rain for the weekend, so we'll talk about that in a few minutes. mike, you've got a few spots to watch. yeah, one right now we've been watching is south 880 at tennyson. the crash, i just learned, has made all activity to the shoulder. still a distraction. you'll still see some slowing, but some speeds are recovering now. heading south out of san lorenzo, san leandro, and down past the san mateo bridge. again. south 880. in that same quarter. hayward. we still have the issue on the track, so the bart green line has a delay. that's the berryessa line. there is about a 20 minute delay. watch those overhead signs for options as well. the rest of the east bay and south bay. pretty predictable over here. we had a crash at whipple off 101 that did clear, but watch whipple, hillsdale and beatty overnight. they may do some work repair work along that retaining wall on the side, so that may be a factor. highway 92 overnight. they're talking about landscaping work between half moon bay and 280. another note for the locals heading to or from half moon bay. and then in the city tonight, the warriors game. a second 1 in 2 nights. so note the slowing around chase

i'm not happy with the way that pg&e handled the wildfires. yeah. yeah. i totally, totally understand. we're adding a ton of sensors. as soon as something comes in contact with the power line, it'll turn off so that there's not a risk that it's gonna fall to the ground and start a fire. okay. and i want you to be able to feel the improvements. we've been able to reduce wildfire risk from our equipment by over 90%. that's something i want to believe. back here in the bay area, san francisco police are apparently telling concerned parents. so far, there is nothing they can do about a man repeatedly seen walking around unclothed, disturbing minors. one parent showed us video. we've blurred. she says that man is often wearing nothing but a sock and touching himself. others say he often seems to wait for moments when teenagers are around, usually after school in the castro. an unidentified parent tells us that that same man is seen in the past year a lot. but the problem is that now he's been targeting kids because he's been following kids. he's in front of the kids doing it, and he's been doing it this for they said it for a year. now, police say after looking into it, there is not enough probable cause to make an arrest. but our legal expert believes based on the video evidence the conduct may raise to the level of criminal

act. but he says that misdemeanor is not committed in the presence of a police officer must be brought directly to prosecutors. 6:45. right now, leaders at lawrence livermore lab are organizing an unusual virtual public hearing for tonight. it comes following the recent announcement from the national nuclelearafety administration indicating plans to upgrade the lab's plutonium facility to help advance the nuclear stockpile. people who live near there say it could mean higher levels of plutonium at the lab, transported along nearby roads and highways. leaders are holding a presentation at 6 p.m. on the potential environmental impact. 645 for you this morning, and we are celebrating the start of the lunar new year this morning. and it begins with hope, along with a lot of festivities across the bay area to help usher in the year of the snake. all right. today in the bay's kris sanchez joins us with a look at the new year may bring to all of us. well, before you say year of the snake, that can't possibly be

district attorney brooke jenkins addressed the plan to keep all of those people safe. they did say that there is no specific threat against today's lunar new year opening ceremony. the lunar new year parade coming up february 15th, nor the nba all star game, which is happening the same weekend as the big parade. sfpd chief bill scott said his department is actively recruiting and will have enough officers to handle both events next month. now back to what's happening today. the opening ceremony is happening between 11 this morning and two this afternoon at portsmouth square, which you probably know the nickname is the heart of chinatown. there were a lot of celebrations over the weekend as well. a lot of little red envelopes floating around, but there's still more ahead in the month to come. cal academy is doing something. oakland asian cultural center, san francisco symphony, and of course, that parade that just draws so many people. it is amazing to see if you get a chance, you know, take it all in. yeah, yeah. not for the people with sensitive ears, though. a lot of firecrackers. true. yeah. i saw some people

and livermore. tomorrow is also going to be a repeat of today and seeing a mix of sun and clouds. we at this point desperately need some rain. so let's talk about where we stand with our water year update. well, we know that santa rosa had so much rainfall in december that we still don't need any. we're still at a surplus of over 12in after getting 26in of rainfall so far, but south of that area we are really needing some rain and as much as a deficit of about five inches in oakland, and we've only gotten about half of our normal rainfall there. so here we go. we're going to finally see a change in our pattern, where the high pressure moves away and allows for those storm systems to move in. and this next one is picking up a lot more moisture. and by the time it gets here on friday, it's going to dump some heavy rain over the course of several days. it will be a slow mover. and as we go forward from

friday to saturday to sunday, not raining the entire time, there may be times when that atmospheric river waves to the north gives us a bit of a break, but the north bay is still looking like it's going to pick up the most amount of rainfall, and then this will finally push through late tuesday into wednesday. during that time, from friday through tuesday, we could see rainfall totals anywhere from three to possibly over six inches of rainfall for ukiah. but notice how that drops off to about two inches from san francisco on southward. while the sierra will get some much needed snow, we're only at about 65% of our normal amount.nd this weekend, if you're going there, we're going to see some snow showers in about 5 to 16in. but much more snow coming next week, and the potential of about 3 to 4ft of snow in the forecast as we begin february. so we're dry for today and tomorrow. we have some time to prepare for that wet weather, and we'll be watching it as things could change over the next few days, and might give a look at san

welcome back. we are moving you forward this morning with a look at our top stories here on today in the bay, and that new twist in the federal funding tug of war. president trump is giving more than 2 million federal workers the choice to play by the rules or resign with a buyout. workers received word of the buyout offer in an email. if they choose to leave their job, they will receive pay and benefits through september. the white house expects up to 10% of the workforce to accept the deal, which would lead to $100 billion in savings. bay area backlash building in response to the federal immigration crackdown. hundreds of protesters. you can see right here yesterday blocking the intersection at story and king and east san jose. this is near where ice agents have been spotted in recent days. later today, students at uc berkeley plan to hold a protest starting
