they said lab tests have shown slight improvement and he's resumed some work activities. the 88-year-old has been hospitalized for ten days being treated for pneumonia and light kidney failure. >> the vatican says pope francis thanks everyone who prayed for him. joining us now claudio lavanga at the vatican and dr. john torres. claudio, what more is the vatican saying about the pope's condition right now? >> reporter: well, the vatican and the doctors say that, as you mentioned, he's critical, but they see a slight improvement in his condition. now, he had no more of the asthmatic respiratory crises that worried doctorssaturday. a kidney insufficient si that

was diagnosed is no cause of concern the doctorors say and h continues to receive oxygen through his nostrils to help him breathe. that percentage of the oxygen is now decreased. all good signs that he's improving. he this morning received the eucharist and did work with his ors in the hospital and called the parish in gaza as he's done every day since the start of the work. >> claudio, thanks. dr. john, that new statement sounds more encouraging than what we've heard. what do you make of that? >> it does sound slightly more encouraging, but slightly is the word to use. a couple things are going on in that statement. number one, there is a slight improvement. he's able to do a little bit of work and also he hasn't had any respiratory crisis situations he had over the weekend. when you look at it, they're saying he's still critical and

they don't want to make a prognosis because they're being conservative. what that is telling me is that they're in a situation right now that isn't uncommon with somebody of his age -- he cod be going either way. tomorrow morning he could be doing better. he could be doing much worse. unfortunately he could die quickly as well. they're keeping a very close eye on him, continuing those treatments and hoping for the best. >> dr. john, the pope still being in critical condition, if he was your patient what would you be looking for in the coming hours and days? >> one of the things i would say, especially with the pope who is known for doing a lot of work, number one, take things very slowly. you can do a little bit of things here and there. let's monitor you and pull back as much as we can when needed. i would also make sure he understands the complexity of his situation and how he's at that point where it could go either way. talking about what he wants to

do, end of life decisions, how aggressive does he want to treat and what does he want to do if he needs comfort measures and we just have to do what he as the patient wants to do. >> claudio, we mentioned a prayer service tonight in st. peter's square. what's the vatican's message to catholics all over the world who have been praying for the pope? >> reporter: that rosary prayer just literally started. i don't know if you can hear the prayers behind me in st. peter's scared. it was called for by the vatican's secretary of state. he called all the cardinals who reside in rome to gather in st. peter's square to say a rosary for the pope. the rosary is a number of prayers and chants. they're not the only ones playing for the pope. all around the world people are gathering in churches to pray for the pope for him to get better soon and return to the vatican. kate, zinhle?

>> claudio lavanga on the ground and dr. john torres, thank you both. how would you feel if you got an email from human resources at your company with the subject line -- what did you do last week? >> that's what millions of federal employees found in their inboxes. it came from the office of personnel management. workers were told to list five things they accomplished in the last week. they were told they had until 11:59 p.m. tonight. >> elon musk posted on x a lack of response will be taken as a resignation. vaughn hillyard joins us now. vaughn, are all the agencies telling employees they have to respond? some have said you don't have to. what happens tonight at midnight? >> reporter: some agencies and department heads, including at the fbi and the pentagon, told employees they don't have to respond to that email. health and human services employees, they received a note from their boss saying they do have to reply to the email.

this is where we're 48 hours into confusion. it was saturday president trump suggested onon hisocial media account he wanted elon musk to be more aggressive. hours later musk posted on social media that workers would be getting an email that they had to reply to or else it would be considered an automatic resignation. the email didn't say anything about a resignation. i heard from one federal worker who told me she got an email but a friend told her about the social media post and said does this mean we'll be resigned if we don't replay? that's where all the confusion is at this hour. in fact, president trump was directly asked about the email. he said he liked the idea and the concept behind it. again, a lack of clarity for thousands of workers. >> vaughn, usaid was one of the first agency that is the trump administration and elon musk made cuts to. now it does appear that agency is cutting almost all of its staff.

what happened this weekend? >> reporter: we have seen a litany of lawsuits across multiple agencies and departments over these firing efforts. a judge here over the weekend ruling that the administration is, in fact, able to terminate and place usaid workers on administrative leave. we expect 2,000 workers to be ultimately laid off. then thousands of others are, in fact, being placed on administrative leave. a great many overseas are being directed to return to the united states. >> vaughn, can i ask you about a separate issue right now, the french president emmanuel macron meeting with president trump at the white house. they're holding a press conference. there's a lot of questions about peace negotiations involving ukraine and russia. what do we know? >> reporter: this is an almost all-day affair for president macron, the first european leader to visit the white house. he's been the conduit for president trump to the eu

nations. this is coming at a time in which negotiations are so important in the ukraine/russia peace talks. i want to let you listen to president trump talking about potential end of the war. take a listen. >> so the agreement's being worked on now. they're very close to a final deal. it will be a deal with various things. he would like to come, as i understand, here to sign it. that would be great with me. >> reporter: he suggested president zelenskyy could come to the united states within a week or two. he mentioned rare earth minerals as part of the deal. this is a hold-up on this agreement. president trump wants ukraine to grant access the u.s. to $500 billion of rare earth minerals in exchange for securi guarantees and u.s. support financially and in the long term against further

deputy director of the fbi. the president selected dan bongino. he has no past experience at the fbi. typically it goes to a career fbi employee. bongino is a former new york city police officers, a former secret service agent and has grown into a major voice in conservative circles as a podcaster and a personality on fox news. nbc news' ken dilanian joins us now. ken, start with how important is that job of deputy director. what does that person do? what are you hearing from people inside the fbi in reaction to bongino's selection? >> reporter: some people say the deputy director is more important than the director, especially when the director has no experience in the fbi as kash patel does not. the deputy supervisors the special agents, runs operations, has hands on the most sensitive intelligence in the government.

there's great concern among the people i'm talking to about the fact that mr. bongino is a political appointee, has no experience at the fbi. for 117 years this job has been filled by a career fbi agent. they're concerned with what he said on his podcast. he's not just a conservative podcaster. he's a trafficker in conspiracy theories. he called the fbi corrupt. he suggested the fbi was lying when they said they didn't know the identity of the suspect who placed pipe bombs outside the rnc and dnc. he suggested the secret service intentionally allowed poor security around donald trump that resulted in the assassination attempt. mr. bongino said he's ready to put aside his role as podcaster. >> ken, we have two of president trump's key allies at the top of the fbi. kash patel is the director and dan bongino is deputy director. have they said what changes they

intend to make? >> reporter: kash patel ordered a thousand fbi agents must be reassigned to the field and others sent to huntsville, alabama. that, while extreme, was expected. what fbi employees are concerned about is the notion that they will be asked to do things that are political. they'll be asked to target and investigate donald trump's enemies. that hasn't happened yet, but that's the concern when you have two partisans leading the nation's premier law enforcement agency. >> ken dilanian, thank you. new developments on the menendez brothers murder case. the district attorney now pushing the judge to reject the petition for a new trial saying the evidence presented did not meet the requirements. the fight for the brothers' freedom is not over. ura jarrett has the details. >> reporter: the tension between

the supporters of the menendez brothers and the new d.a. heating up. some family members said they were concerned they weren't being heard by the d.a. now they're worried the brothers aren't being believed. >> i was annoyed at the show. >> reporter: family members of the menendez brothers pushing back after a lengthy press conference from the top prosecutor overseeing their case. >> that did not need to be a press conference. that could have been paperwork filed with the court. the whole thing was unnecessary. >> reporter: a response to the district attorney's laying out in painstaking detail why the evidence the menendez brothers offered doesn't mean they should receive a new trial for murdering their parents in 1989. >> while it may have been a motivation for the menendez brothers to do what they did, does not constitute self-defense.

i also understand when it came to any corroborating information about that sexual abuse, it was extremely lacking. >> reporter: his skepticism about the menendez brothers story raising more questions now about whether he will also refuse to support their separate push for a judge to resentence them next month which wouldn't require a new trial, but make them eligible for parole immediately after spending more than 30 years in prison. >> we'll be looking at the rehabilitation. part of the reason i met with the family members who wanted to meet with me is that's a factor as well. >> reporter: his office in an unusual move releasing this new video with their overview of the events, notable giving the role documentaries have played in putting the case back in the spotlight, something the menendez brothers acknowledged when they spoke out next week calling into tmz.

north bay. students are returning to class at two santa rosa high schools after learning two of their young classmates died of fentanyl overdoses over the weekend. nbc bay area's bob redell joins us outside santa rosa high. tragically, within the past 72 hours, four young people with connections to the santa rosa city school district. they passed away. you can see we're outside santa rosa high school, where there's a small memorial for one of those people, a 16 year old girl. she was a student here at santa rosa high of this morning before class. friends of the girl, they brought flowers, they signed messages. they comforted each other after learning what happened this weekend. according to santa rosa police, a friend found the six year-old girl and an 18 year-old man saturday night unresponsive in a bed in a home on brookwood drive here in santa rosa. both, as it turned out, dead from an overdose of fentanyl. the six year-old, as i mentioned, attended santa rosa high. the 18 year-old went to nearby montgomery high. in a separate case also saturday

morning, a 14 year-old and 16 year-old girl, both hospitalized with fentanyl overdoses. not clear if they are related to the overdose deaths, but police believe in all the c cases. th victims believed they were buying cocaine and didn't realize that they were ingesting fentanyl. she was a really sweet girl. she made sure everybody else was okay before herself, and for that, we will all always be forever thankful. i really wish i was able to spend more time with her and. i hope she rests easy. she is a student here at santa rosa high and was a friend of the 16 year-old victim, who she is starting to realize that the hard drug problem is worse than she knew, and believes students are turning to drugs to deal with their mental health struggles. yesterday afternoon, police did arrest a 21 year old suspected drug dealer who they say

possessed materials, including small plastic baggies that they say are linked to the deadly overdoses. the names of the students who died have not been announced and the investigation is ongoing. the district did release an email yesterday to parents and students about the weekend deaths of three current students and one former student. i've already told you about the 16 and 18 year olds. the other two deaths involved a former 19 year-old student, also from an overdose but not believed related to this case. and the fourth death was a 21 year old current student who died from natural causes. not clear if that student was in adult education. now, both santa rosa and montgomery high schools have wellness centers on campus, which they will be staffed with counselors to help students trying to procesess these tragedies. here outside santa rosa high school, bob redell, nbc bay area news. a long road of healing for that community. thank you bob. an investigation underway after an officer from the oakland housing authority was shot during a gunfight in oakland. this is video from nbc bay area. sky ranger from the scene this morning. the shooting

happened along 85th avenue near g street a little after midnight. police say officers were conducting a traffic stop when someone pulled out a gun and shot one of the officers. then the officers responded and shot the suspect. now, here's video now of the scene from citizen app. the officer and shooter were both taken to the hospital and they are expected to survive. all right. clouds are rolling into the bay area today. he is. here is meteorologist kari hall with the forecast. we're starting out our week with temperatures headed for the mid to upper 60s today and some peeks of sunshine after starting out with some fog this morning. but going into tomorrow, it is all clear and we are going to see a slight warm up for some of our interior parts of the bay area. some of the valleys looking at a high of 71 degrees in santa rosa, as well as concord and low 70s for the south bay, while san francisco will be in the mid 60s and then looking ahead to wednesday upper 60s in the city, with low 70s for the tri-valley

the two were renting rooms in his home. the stabbings came a week after the hamas terror attack on israel. prosecutors allege the mother and son were targeted because they were muslim. shuba has pleaded not guilty. maggie vespa has been following the case. maggie, what do we know? >> reporter: our producer in the courtroom telling us all 12 main jurors have been chosen. both sides still vetting potential alternates. court is not adjourned for the day. it was a pain-staking process that lasted most of the day with both sides trying to find those 12 jurors. asking them what they knew about this case, which rocked the suburban chicago area in 2023. at least one person saying he didn't think he could be unbiased because he had read so much and had such strong

feelings about the case. the defendant is joseph shuba. there he is. the attack happened one week after the october 7th attacks in israel and court documents say that shuba had tenants who were palestinian american. he was a landlord. he got into a conversation with the boy's mother asking her her take on the war in gaza. at some point according to documents she said they should pray for peace. that's when investigators say shuba became enraged going after the mother. she barricaded herself in a bathroom and that's when prosecutors say he went after her son. he faces first degree murder and hate crimes in this case. his defense is declining to comment. ck to you. >> maggie vespa, thank you. a major scare in the air for

airlines flight took off from jfk airport saturday evening. it was several hours out from new delhi when it made an abrupt u-turn touching down in rome sunday. the crew reported the security issue according to the faa, which a source says was a bomb threat made through an email. the aircraft was inspected in rome and was found to not be credible. american said, safety and security is our top priorities and we apologize to our customers. >> the airlines receive these threats from time to time. typically they don't have any validity. it's rare it reached this level. >> reporter: sunday's diversion the latest in high-profile aviation incidents. last month an army helicopter collided with an american eagle jet over the potomac river. 67 people were killed. just a week ago a delta plane

arriving in toronto crash landed and flipped upside down leaving dozens injured. remarkably everyone on board survived. emilie ikeda, nbc news. we are closely watching a high-staking case in north dakota. it stems from the building of the dakota access pipeline. >> ergy ansfer is suing the group green peace. you may remember demonstrations by climate activists in 2016 where they clashed over the oil pipeline's planned cross of the river crossing. nbc news correspondent steven romo is following this for us. steven, what can you tell us about the lawsuit and the stakes here? >> green peace says this could be an end to their organization as we've known it for years now. this $300 million lawsuit could greatly affect the organization. the trial getting under way in north dakota. there was a very similar federal

lawsuit that was filed and has been dismissed by a federal judge. this trial going forward starting today. it relates back to these 2016 and 2017 protests. there were hundreds of arrests that happened at the time. thousands of people protesting that dakota access pipeline which is upstream from the standing rock sioux tribe reservations. there was concerns about their water supply. energy transfer is alleging nuisance and trespassing, defamation and more from green peace. >> do we have any statements from either energy transfer or green peace? >> we'vheard from both of them. green peace is saying they want to silence anyone who is criticizing the oil industry. their statement reads, this trial is a critical test for the future of the first amendment, freedom of speech and peaceful protest, painting this as a larger issue than just this

lawsuit. we have a statement from energy transfer. they said, we support the right of all americans to express their opinions and lawfully protest. when it's not done in accordance with the law, we have a legal system to deal with them. this is a jury trial. it will be decided from people in north dakota. some pretty big implications. >> steven romo, thank you. now to an "nbc news day" original story. >> according to data from the national college attainment network, freshman enrollment last fall dropped 5% compared to the year before. that number is expected to go up. >> another staggering statistic hbcus have reported their lowest enrollment for men in 50 years. >> reporter: this man knew he

would go to college, but he never planned to end up at an hbcu. >> i'm here now. coming here, i didn't have any guidance. i didn't know what to get involved in or what i was meant to do. >> reporter: the 20-year-old is a sophomore at north carolina agriculture and technical statement university. black male enrollment at hbcus is at an all-time low, dropping 25% since 2010. >> what does it mean we're seeing even still black male enrollment decline in ese spaces? >> hbcus are a crucial ladder for upward economic mobility. they are. we see very good evidence that black students who attend hbcus will get a boost. >> reporter: these two conducted that study. >> many factors are playing a role in this. we look at the pathway problem with k-12 disparities, lack of

black male teachers and also some financial barriers. black students are more likely to report their finances play a bigger role in their decision and also some of the underfunding that hbcus have experienced. >> reporter: across the country schools are programming to meet the need. male empowerment network is a school-sponsored student group dedicated to giving support to first year and continuing male students. >> if we could facilitate that, that would lead them to do better in the classroom. >> reporter: this evening they're hosting a barber shop style salon event where guest speakers and student leaders discuss the importance of self-expression. >> it felt like one of the first organizations events that we had where men felt comfortable to expression themselves. >> why do you think it's important for young black men to go to college, particularly an

hbcu and find this kind of community? >> going back to high school, i didn't think i was going to college. i didn't really see a reason for it. i grew up in section 8 housing. didn't have the money to get to college or think of that as an option. it's difficult for young black males to go through the same type of transformation of meeting the people they need to meet. >> reporter: while programs like aggie men bridge the gap, more change is needed. >> this can potentially bridge the hole. >> reporter: for students, aggie men has provided guidance and mentorship. >> it's from people who have been here before me. they can show me what worked for

him. they said he is not gang related. the victim. investigators say that gutierrez managed to escape the group, but one suspect caught up with him before stabbing him several times. when police got to the scene, the suspects had left. each of the suspects is believed to be affiliated with a local san jose street gang. the investigation also revealed that the victim had no gang affiliation whatsoever, was tragically just in the wrong place at the wrong time. police say a 13 year old boy was responsible for stabbing and killing gutierrez. additionally, 316 year olds and 118 year old man were arrested. the 18 year old is named emmanuel sanchez damian and he's from campbell. all right. temperatures are warming up across the bay area. here's meteorologist kari hall with our extended forecast. today we'll see temperatures in the upper 60s, but this will be the coolest day of the week, all the way up until the weekend. we're going to be on a warming trend through wednesday, and it
