this morning. a federal court judge wants america's self-proclaimed toughest sheriff to face criminal charges for violating his orders. this is connected to the racial profiling case with sheriff joe arpaio. maryellen resendez is following this case this morning. what's next for the sheriff. this could be a game changer. >> reporter: it really could be. but it all depends on the u.s. attorney. it is in his hands right now whether or not to actually go forward with the recommendation to federal court judge murray snow feels that there is enough evidence to hold sheriff arpaio in contempt of court which could lead to a huge fine and possible jail time. first the u.s. attorneys office will look at this case and determine whether or not to charge the sheriff with criminal contempt. arpaio's attorney telling us that if charges are filed, despite arpaio's age and the ongoing legal issues, his

plea bargain. even if arpaio is successful in his current campaign for reelection, putting it simply, the sheriff will fight this to the very end. >> you plea if you violated contempt yowsly and willfully the order of the court. if you haven't done there, there's no basis. this is why the sheriff is fighting it all the way because quite simply we judge is wrong. >> reporter: now, we did ask the sheriff's attorney if there's a possibility the sheriff will step down, and he replied, no, absolutely no. i was in court last year when the judge said he wanted to see part of the sheriff's skin as he called it, in the game. coming up at 5:30. we'll tell you what part of the ruling will put the sheriff's skin into the game. we have that coming up. >> you have covered this

thank you for your reporting. the group promise arizona, a well known critic of the sheriff releasing this statement in part innocent families have been torn apart by his discriminatory actions. it is time the sheriff learned firsthand about the proper application of the law and that he is not and has never been above the law. the sheriff's rivals also speaking out this morning. paul penzone running for sheriff saying in part the decision epitomizes the sheriff's disrespect for the law and dan sabin running for sheriff says quote mr. arpaio has soiled his badge by violating his oath of office. he has rendering himself utterly useless as sheriff. the charges are expected to meet $54 million next summer. as for his campaign run. we hear he has raised nearly $10 million in cash, arpaio is 84 years old and has been

he faces two retired law enforcement challengers and a fourth candidate in the august 30th republican primary. right now, two police investigations happening in the valley, the first near 7th 7th street and baseline. air 15 capturing all of those police lights last night. we are work to go figure out what this was all about. meanwhile, more violence in maryville. this video coming in from 43rd 43rd and thomas, where we hear one person was shot, possibly by a family member. no other details being released at this point, but you post posted on what -- you posted on what we learn from there. a woman shot after she says another driver learned -- rear ended her. she asked for the other driver's information, and she says a man rear ended her thursday near 43 43rd and fleet water. he drove off. she followed him. she says he pointed a gun at her and fired. >> you don't think that

you over a small, almost fender bender accident. like my car was still drivable, his car was still drivable and you're going to try to shoot somebody over that. >> now, the bullet hit her bumper. she crashed as she tried to get away. the shooter drove off too. phoenix police not able to talk about the case. the victim remembers the man being in a light colored car but not much else. >> so happy she's doing okay this morning. >> a massacre, and the woman who witnessed the serial street shooter's deadliest attack is speaking for the first time hoping to catch the killer. 12-year-old and her mom and friend were shot sitting in their car back on june 12th. according to their friend, sharon layton, malia and stephanie had both been in the house just moments before, but malia followed her mom out to the car where the three were listening to music. when the shots rang out, layton

tried to save little malia. >> i'm just like, malia, it's okay. breathe, we're here. but the bullet, i seen it went straight in her neck. i tried putting a finger in the hole, but it didn't work. there was too much blood. >> the serial shooter has killed 7 people in 9 attacks since march. silent witness is offering a reward of $50,000. phoenix council member, phoenix fire and phoenix police all expected to attend a prayer vigil in mareville, along with the friends and families of these victims. this starts a start at -- at 6:00 tonight. police have not stopped looking for this teen accused of shooting a 40-year-old woman at an apartment complex thursday afternoon. he's 19-year-old malik thompson and escaped through a back well

the 19-year-old had a romantic relationship with the woman. she's now in extremely critical condition. this morning, this guy is sitting in a valley jail days after police say he shot three people, ran over one of them and took off for winslow. adram blomdale arrived in the valley yesterday,. this morning, flowers are on the door steps of an 84-year- old man stabbed and killed in chandler. silent witness offering a $1000 reward for more information about the murder of hosaco, found dead in his car at la fitness. his neighbors say they are shocked. >> it's a situation where, you know, a nice guy that he would do anything for anybody, and if anybody would say, hey, i need some money, whatever, he would give it to them just because that's the way he was. >> now, police are telling us

trying to look for any clues into this murder. we know so many of you are thinking about the little girl hit by a police cruiser earlier this week. she is still in the hospital. we checked in on the 3-year-old and we're told she is still in critical condition. police say she ran out in the street while she was just trying to get a popsicle from the ice cream man near 75th avenue and camelback. a brief moment of hope that one of america's most wanted was captured in arizona. his name, robert fisher, man accused of killing his entire family and burning down a scottsdale house back in 2010. now, sources tell us that sheriff's deputies got a tip about a man there that fit fisher's profile. they brought him in, finger printed him and found out it wasn't their guy. it has been so long since anybody has seen fisher that nobody really knows what he looks like. this is a case that has been going on 15 years, and people

we warned you about a crime alert in the east valley. there could be more victims. a neighborhood watch group says as many as a dozen homes have been burglarized near dobson and warner. someone else reached out to us after seeing our story on the news, and he says he caught someone on video the day his neighbor was robbed in broad daylight. neighbors believe crooks are getting there through an just like the one you see here. these guys were able to get off without getting caught. the city is considering putting up gates in this area to add extra protection. coincidence or something else. a chandler man voicing his concerns this morning about his campaign signs being damaged. sam wong is running for city council, and he says a number of signs have been knocked down, stolen or vandalized and he feels he's being targeted.

home depot off cave creek road, and i saw a few clashes at 7:00. a little show in the sky. >> my goodness. i don't think we're going to see anything like that today. take a look at where we are right now. it's 82 degrees. we have lingering cloud coverage out there. humidity in the 40s. not terrible. look at the dew points, those are in the 60s. you're going to definitely feel it. measuring moisture in the air, it's going to be toasty out there. not so much toasty but muggy, is what i mean there. it will feel outside. here's a look at abc15 desert doppler. not a ton happening in our specific area, but take a look if we zoom toward buckeye there. you can definitely see that we have isolated showers, even still right now, where we see some of the yellows and reside, that's where we could see heavy pockets of rain. that's not a widespread event at all. and you are seeing lightning strikes with that. moving west ward. it will break down a little bit before it enters the california side of things. here's a look at valley wind

hour. not terrible. i noticed yesterday those winds kicking on and off throughout the day. look out for that, and if we do see storms develop later in the day, that could also produce higher winds. for today, 103 is -- 103 degrees is where it tops out. winds 5 to 10 miles per hour on and off throughout the day. your uv index, if you're going to be outside. know we're going to be at a ten. a very high category. the air quality, now, the arizona department of air quality has issued an ozone watch. that puts us in the moderate category. no other weather alerts and storm chances at 20%. here's a look at future cast. we'll track this together as promised. definitely need that daytime heating and the best chances we will see, some storms or at least some showers pop up here. some lightning possibly. it's most likely going to be in the early evening hours to the later evening hours. then things will start to quiet down as we get into overnight. we'll see cloud coverage and

little bit better and tell you about them. america's so called toughest sheriff could be facing criminal charges of his own. a federal judge wants toot judge to weigh in. abc15's maryellen resendez live at the federal courthouse, all stemming from racial profiling cases. i'm curious, what do those victims have to say about this. >> they have been waiting a very long time for this ruling. in fact, they have attended every court case. they will wait once again while the u.s. attorney los the case and decides whether or not to go forward with the criminal contempt charges. in a 32-page report, judge murray snow lists the evidence against sheriff joe arpaio including the orders he says sheriff joe arpaio and top level depp tips have violated -- deputies have violated. and for the very first time, he is ordering sheriff joe arpaio himself to put out $300,000 of

termed to the sheriff in a court hearing as putting his own skin in the game. >> this is like poetic justice. you thought you could ride the backs of taxpayers forever. and do what you wanted to do forever. but now it's on your shoulders. >> he makes it very clear that sheriff arpaio needs to have skin in the game. he needs to be held personally accountable for his wrong doing. >> reporter: now, arpaio's attorney medical mcdonald told abc15 in an interview that the sheriff is not guilty of these charges and there will be no plea bargain, and no resignation. now, we also called the u.s. attorney's office, and they told abc15 that they are currently reviewing this case. but they did not say when they'll have a decision. back to you. maryellen, keep us posted. thank you so much. now a valley mom behaving badly. phoenix police say she left her

complex in triple degree weather while she went and got done. that mom, antoinette gail little nashio, the baby boy found crying, sweaty and dirty in an apartment complex at 12th 12th avenue and indian school. several neighbors called for help, calling 911, to keep the baby cool. >> we wiped him down, and changed his pampers. i would never do my kids like that. >> police say the mom blew a .389. she already had two warrants and her baby was taken into child protective services custody. zika here in the valley, west nile is a much bigger threat. two people died in maricopa county. one mom is speaking out about her, with the hope people take this more seriously. trish is home after two months in the hospital but she's still pretty weak. she thinks that a mosquito got

probation. >> what kind of penalty would you have liked to have seen? >> i would like to see him at least a couple of years. that's a punishment for what he did was wrong. >> the youngest victim, 4-year- old aria still needs surgery on her left eye. and reyes' son is going to battle lifelong back problems. let's get to exclusive feud. police storming a home. we saw a couple of people short time later. a third person was taken in for questioning. officers aren't saying too much about this one right now. here's the big headline for us. this search happened just down the street from an unsolved killing. a convenience store clerk gunned down at a 7-eleven earlier this month. these two are accused of causing trouble in their own neighborhood. they are two people busted in a major pot growing operation in the west valley this week. in all, 3 homes were raided in surprise and peoria.

seized. deputies say the couple had been running the operation for four years, producing a million dollars worth of drugs each year. in glendale, these two guys got away, and they could put you in danger. the two masked men held up a convenience store near 47th 47th avenue and bethany home. you can see the guns based on these surveillance pictures. what's more, they fired off two shots. fortunately nobody was injured. if you know anything about this crime, call police. the search is on in san tan valley all because of a co of armed burglars there. had it not been for the family dog, the suspects could have done a lot more damage. here's one of the accused. he's 18-year-old lorenzo lopez. he was with a minor at the time, which is why we're not showing the picture. they tried to break into a home. once the dog barked, they took off and ended up in handcuffs. the water is thigh high in parts of louisiana, and more rain is in the forecast. by the time president obama gets there tuesday, there may

donald trump and mike pence toured a damaged high school. a passer in baton rouge also says trump donated 70,000 pounds of goods. the national guard handing out food and supplies to so many families. at least 40,000 homes are damaged, and now there is a new concern here, and it's getting medication because so many pharmacies are flooded, and the storms that slammed baton rouge, they are not just affecting people. louisiana animal shelters, they are swamped right now. are stepping up and taking in dozens of dogs and cats from these shelters. what they need now more than ever is foster families for hundreds of homeless pets. in washington state, a horse runs through a crowd injuring five people including a child. the horse was connected to a carriage at the time but something spooked him, and then after that, it sent him racing there through the crowd. one person is in serious condition this morning.

captured. new details in that deadly maryland apartment fire. investigators say a build up of natural gas caused explosion sparking this, killing 7 people and injuring dozens more. what exactly caused the explosion may take a year to find out. there's no evidence anyone was behind it. and investigators are not saying whether it was an accident. things are bad enough as crews battle that massive wildfire in san bernardino county k california. >> now homeowners have to worry if their they are having to deal with looters. three people just arrested trying to get away with a flatbed truck. investigators say the trio made up a story about trying to help a friend, and it just didn't add up. authorities have set up extra patrols now to keep an eye out. there's a little bit of good news here. some evacuees have been told they can go home. that's after tough news. a hundred homes have been lost.

two big update, the push to stop legal pot, going up in smoke. a judge ruling that legalizing recreational marijuana is up to the voters. a handful of groups filed a lawsuit arguing the petition signed by thousands of people for proposition 205 was misleading. but advocates say this is a plot to take the decision out of the hands of voters. >> it has nothing to do with marijuana. it's just wrong, and it's a slap in the face to voters. appeal this decision all the way to the state supreme court. and a win for people looking to boost our state's minimum wage. you'll be voting on this in november. a judge ruling it's going to be on the ballot. the current minimum wage is 8.05. if passed it would go up to $12 an hour on by 2020. they're going to begin the grunt work next month for the

east and west valleys. it's expected to open by late 2019. as the cardinals make their way home, an update on whether the owner of university of phoenix stadium has enough money to even pay the bills. a state audit last year posed that very question, and now the arizona sports and tourism authority, which owns the stadium is giving their response. they say they are not going to have enough to pay for all of their programs like children's sports and tourism promotion for the next five years. but they are going to have enough money to their payments for the stadium. 5:44. we are taking action to keep you safe after a number of you have contacted us about health concerns in the water specifically crypto, a bacteria of human waste. a number of complaints were received. county health officials aren't labeling the water park an official exposure location.

self-proclaimed toughest sheriff to face criminal charges for violating his orders. >> this is connected to the racial profiling case against maricopa sheriff joe arpaio. maremma has been following -- maryellen resendez has been following this case this morning for us and has been following for a little while. what is next for the sheriff. >> reporter: it all depends on the u.s. attorney. it is now in his hands. judge murray snow handed in his recommendation from federal court here and he feels there's enough to hold sheriff joe arpaio in criminal contempt of court which huge fine and possibly jail time. as i said, first the u.s. attorney's office will look at the case and decide whether or not to charge sheriff joe arpaio in criminal contempt of court. arpaio's attorney telling us if those charges are filed, despite arpaio's age and the ongoing legal issues, his client will not take a plea bargain even if arpaio is successful in his current campaign for reelection. he put it simply that sheriff arpaio is going to fight this

. two updates about initiatives you'll see on the ballot this november. the push to stop legal pot going up in smoke this morning. a judge ruling legalizing recreational marijuana is up to the voters. a handful of groups filed a lawsuit arguing the petition was misleading. advocates says this was a plot to take the decision out of the hands of voters. >> it has nothing to do with marijuana. it's just wrong, and it's a slap in the >> opponents already vowing to appeal the decision all the way to the state supreme court. victory this morning for people who want to see arizona's minimum wage go up. we'll be voting on the issue in november. a judge ruling it will go on the ballot. the current minimum wage stands at 8.05 an hour. if passed it would go up to $12 an hour by the year 2020. let the construction begin, adot given the go ahead on the south mountain freeway after a

they're going to begin the grunt work next month. 22-mile freeway will link the east and west valley, expected to open by late 2019. we have a couple of big closures this weekend as they're doing some maintenance on the deck park tunnel, so you're going to see a closure, i-10 eastbound, that's going to be friday night at 9:00 p.m. until 9:00 a.m. on saturday so basically from the i-17 stack until you hit the mini stack as they do some maintenance there on the tunnel. and then the next night they're going to switch directions and close it down in the westbound direction. th o i-17 split until you hit 7th 7th avenue and again, saturday at 9:00 p.m. until sunday at 9:00 a.m. let's hop over to scottsdale where we have had a little break for the closures on loop 101. they are definitely picking back up again. loop 101 northbound, they're going to shut down from chaparral to ventura as they lay asphalt. friday night at 10:00 p.m. until monday morning.

against sheriff joe arpaio including the orders he says sheriff and deputies violated and recommends the county put aside $500,000 to compensate the racial profiling victims and for the very first time in the sheriff's career, he is ordering the sheriff to pay out $300,000 of his very own money out of his very own bank account in what he termed to the sheriff in a court hearing as quote putting his own skin into the game. >> this is like poetic justice. you thought you could ride the backs of taxpayers forever, and do what you wanted to do forever. but now it's on your shoulders. >> he makes it very clear that sheriff arpaio needs to have skin in the game. he needs to be held personally accountable for his wrong doing. >> reporter: now sheriff joe arpaio's attorney mel mcdonald says the sheriff is innocent of these charges, and he says if

there will be no plea bargain, and there will be no resignation. now we also spoke with the u.s. attorney's office. they have said that they do have the case. they are reviewing it. there's no word on when they'll get back to us with the decision. back to you, nick and allison. >> maryellen, thank you very much. a valley mom is behind bars after police say she got drunk with a friend, and she left her baby outside in a stroller. that baby boy found crying, sweaty, and dirty in the courtyard of an apartm indian school. several neighbors rushed in to help, calling 911 trying to keep that baby cool. >> we wiped him down real good with a wet, cool towel and changed his pampers. who does his kids like that. i have kids of my own, and i would never do my kids lining that. >> police say the mom blew a .389 more than four times the legal limit. she has two warrants. that baby now in cps custody. a crime alert in the east valley may be expanding.

as many as a dozen homes have been burglarized near dobson and warner. somebody else reached out to us after seeing our story, and he says that he caught somebody on video the day his neighbor was robbed in broad daylight. neighbors believe that crooks are getting through an alleyway just like the one you see right there. these guys were able to get off without getting caught. the city is considering putting gates up in the area. in glendale, these guys got away, and they could put you in danger. the two masked men held up a 47th avenue and bethany home. you can see they have guns based on these surveillance pics. they fired off two shots. if you know anything about this crime please call police: this search in san tan valley because of a couple of armed burglars, had it not been for the family dog, the suspects could have done a lot of damage. one of the accused, 18-year- old, with a minor, investigators say they did try

the dog parked, they took off and ended up in handcuffs. the reality is here in the valley, west nile is a much bigger threat. two people just died in maricopa county, and this morning, one mom is sharing her battle with us with hopes that people will take this more seriously. trish baty is home after two months in the hospital, but she thinks a mosquito got her hiking or doing yard work. she is a young preschoolteacher a would expect would have all these complications. >> just i have that little fear in the back of my head saying what if this is it. i can't think that way, i have to stay positive and convince myself this isn't it. that i will get back. >> now, you can take action to fight back. use bug spray, wear long sleeves when you can and after rain, walk your property, make sure there's no standing water

arizona. cochief county confirmed three cases a day after a case was found in santa cruz county. there have been at least two dozen cases in our state. a special lab is constantly testing samples to try to keep everybody safe. the valley's crypto outbreak is growing. the health department telling us more than 100 people have been infected. more than 20 pools and water parks throughout the county are linked but not being identified. a number of complaints we have received specifically mention wet and county health officials are not labeling the water park as an official exposure location yet, and why not. because no tests can confirm crypto is present at a facility even if a number of infected people were there. wet and wild maintains they are taking all the necessary precautions to keep people from getting sick and to keep you from getting sick, doctors say remember to avoid swallowing water while swimming. wash your hands with soap and

of seattle. the house was connected to a carriage, but something spooked him, sending him running through the crowd. one person is still in serious condition this morning. the horse was eventually captured. new details in the deadly maryland apartment fire. investigators say a build up of natural gas caused explosion, sparking the fire, killing seven people and injuring dozens more. what exactly caused that explosion may take a year to find out. there's no evidence anyone was behind it, and investigators are not saying whether it an accident. things are bad enough as crews continue to battle this massive wildfire in san bernardino county. and now homeowners, well they have to worry if their homes are still standing and having to deal with looters. three people were arrested trying to get away with the flatbed truck. investigators say the trio made up a story about helping a friend but it just didn't add up to authorities. they have now set up extra patrols to keep an eye out. and there is a little bit of good news here, some evacuees have been told that they can go
