explain this to us. >> reporter: this started as a neighborly dispute but it is raising the question, could you get criminally charged for something you say inside your own home? it happened to this 71-year-old chandler woman. she was caught on camera yelling at her neighbors, upset over them smoking outside. she claims the smell is coming through her vents and it wasn't the first time. this summer she yelled from inside her home, her neighbors were recording her until a knock at her front door. >> i just came by to ask you why you yelled what you yelled at your neighbor. you still can't yell obscenities at people over the wall. >> he told me that he was going to file charges and i'm really in a panic. i'm thinking, they're going to come arrest me. >> she's been charged with disorderly conduct and she does face possible jail time.

it's illegal to actually swear inside your home. >> we are speechless in the studio, katie. more on that litter. lots of damage after an early morning fire in tempe. we were there on the scene. and it was just food left on the stove, minor damage to the cabinets above the stove. but it was put out before firefighters arrived because of the sprinklers, doing their job. we saw water pouring from the a total of five people from two units were displaced. a murder suspect sharing his side of the story, telling abc 15 he regrets killing a man, but says defending his turf is part of life as a homeless man. he said friday night robert pruitt tried to steal his sleeping spot. he said he warned pruitt and

knife. >> no hesitation, just stabbed him like right in the heart. >> he did apologize to the victim's family and says he regrets what he did. developing now, phoenix officers investigating a stabbing near broadway and 7th street. the stabbing happened late last night and left a 38-year-old with several wounds to his arm. he was transported to the hospital in stable condition. keep in mind it didn't happen at that location, but he somehow ended up there. no suspect description there yet. a phoenix woman may not be so grandmotherly, now that she's accused of smuggling cocaine. police arrested 63-year-old cheryl cheatham last week and paperwork says she flew from las vegas to detroit with

her luggage. prosecutors say when she got her phone call? >> she said she wanted to call her daughter. when she was given the phone that she had in her possession and wanted to call her daughter, she went to a contact in her phone listed as lover boy, raising suspicion for the officers when they saw the daughter's contact as lover boy. >> her lawyer questioned the legality of the traffic stop that led to her arrest. we tried to reach her daughter but have a federal judge is one signature away from criminally charging sheriff joe arpaio. the department of justice filed the paperwork and proposed the charges. so what does that mean for the sheriff? he could face a misdemeanor and stay in the race and in office if reelected. the recommendations are in. there was a big push from the governor to test all rape kits in our state. we have seen two indictments

created. the governor asked dps to see if the state can contract with a company to track these kits so none of them are forgotten. as you wake up, the legal issues surrounding lethal injections for executions will play out in court this week as a federal judge just scheduled a hearing for tomorrow. at issue, the controversial drug that arizona prisons have used in the past. officials in ohio plan on using the drug in january. who you're talking to could be your worst nightmare. >> parents, hear any whispers about a new app? before you download it, law enforcement agencies say not so fast. >> plus an honor flight is preparing to take off. but this trip full of veterans will be the last of its kind. u.s. 60, we have a new crash and i'm going to map it out for you next. >> and 60s right now but we'll

. the phoenix va the site of so much criticism in their treatment of vets is now showing support. a new billboard thanks doctors and nurses at the hospital. local service organizations are behind it. some veteran trip of a lifetime today, boarding a plane for an honor flight. this is a live look at sky harbor, where they are flying out of today. it is special because this is the final flight to include only world war ii veterans. today's flight will include 9 women from the american rosie the riveter association, and next month korean war vets will begin taking that flight. we are told there are already 350 on that waiting list and we

a plain clothes police officer stops a man for walking on the shoulder of a road in a minneapolis suburb. he holds onto his jacket. in the 7-minute long video, thomas grows agitated. the officer said thomas was impeding the right of way. the officer appears calm before another officer arrives, handcuffing him, citing him for disorderly conduct. we'll be live on the scene this

police in california are trying to figure that out this morning. new surveillance video shows officer, chasing a man through the streets moments after they were attacked in starbucks. the city's police chief is calling this an attempted assassination. 41-year-old adam powell is the suspect and he's a person of interest in a shooting involving a 2-year-old boy. officers are calling that shooting accidental at this point. after a deadly police in overnight. protesters filling the streets in el cajon, california, demanding change. officers are on the scene watching this unfold. the memorial for alfred delongo was taken down and that's the reason behind the protest.

to see body camera footage after a shooting occurs. now there's new technology that starts recording as soon as a gun is drawn. >> the officer is not always going to have time or know when that critical incident is going to occur. >> the hollister is wired to the body camera worn on an officer's chest. it activates just as the gun leaves the hollister and records the prev seconds. it will keep recording until after the officer turns it off, and that video uploads to the cloud while the camera is in the charger. in mosul, breaking news as they try and retake the city from isis. they have already captured a handful of villages to the

ri least 20 isis militants in at least 24 hours. i think it's pretty clear donald trump is not my first choice or even my tenth choice to be the leader of the republican party. 14million voters chose differently. >> marco rubio vowing to stand up to whichever candidate is elected. rubio is still backing donald trump but dismisses the claims that the election is rigged. and donald trump suggested the speaker of the house paul ryan doesn't want trump to because ryan's own political ambitions could be at stake for 2020. trump just wrapped up a campaign event in ryan's home state and says he's confident the campaign is doing well there. there's a lot of concern with smartphone apps. some seem innocent, others not so much. one is raising red flags for parents. it is called whisper and it is free. it lets you child talk anonymously with someone on the other end.

a different position. they found routine schedule problems and missed diagnoses. it is a big day for dignity health as its new hospital opens in the east valley. the rehabilitation center in chandler has a stroke unit, physical therapy gym and 50 beds to serve those with neurological injuries. check out the newest building on asu's campus. crews will break ground on the facility today. construction should be finished by 2018. skies are clear here in arizona but that's not the case in sierra county, california. it is snowing there, and drivers are being warned to use

and katie connor has more on this exclusive story. was she threatening someone? >> reporter: not according to this police report. she yelled from her back door into the backyard over a long standing dispute. she's been charged with disorderly conduct. but her attorney says this is about protecting the first amendment an ha nothing to nothing to do with a neighbor dispute. he's filed a motion to dismiss this charge. >> it may be offensive speech but speech is protected. is it a crime to swear at another person? not in a free society, not in our society. >> reporter: the prosecutor says there will be a hearing at the end of the month.

happens. katie connor, abc 15 news. let's talk about the most accurate forecast for you. a lot of us waking up in the mid-60s right now, a gorgeous clear morning. go outside and enjoy it if you can. we're in the mid-80s by lunchtime as winds pick up too, then even warmer after that with upper 80s and low 90s today. warm temperatures will stick around for a while. let's talk about what we can expect as we head into this weekend. details on that coming up in a few minutes. we have a stall right now in the north valley that could slow you down. this is i-17 southbound, the ramp that takes you to 101 eastbound. that's where we have the stall. you can still use that ramp but you have to go over to the westbound ramp there and wrap your way over so you can use that ramp. it will slow you down a little bit this morning. besides that, we have a crash

a developingtory out of phoenix, near 30th avenue and phoenix police are investigating a shooting. we're told a 33-year-old was shot in the leg. officers haven't revealed any suspect information. meanwhile, bikers, wear your helmets. two motorcycle riders are recovering from serious injuries after they were thrown from a bike near 73rd indian school. you can see debris all over the place. we are told thankfully they are expected to survive but they were not wearing helmets. no word if anyone else was involved. unfortunately we have heartbreak in the west valley. today we are expecting to learn the names of the two little girls taken too soon in a suspected murder-suicide. investigators say their own father killed them in their home before taking his own life. before that tragedy, the girls'

about her ex-husband's well being. major bust at the border. this is 900 pounds of pot here, all in camouflage bags. order agents arrested about a dozen illegal border crossers near yuma. the dollar amount on this pot? almost $450,000. the border patrol reveals have arrested more than 400,000 people on the southwestern u.s. border with mexico. that number is up about 78,000 from last year. the department of homeland security says more families are crossing the border trying to flee violence. three weeks to election day and as we get closer to the vote, the situation is getting more volatile. >> we told you about the fire bombing at the gop office in north carolina.

officers never located that person. still recovering from a shooting, sandy hook elementary in connecticut. former congresswoman gabby gifford held an event there yesterday to talk about gun violence. she was shot in the head in 2011 during a campaign event in tucson. we are on wildfire watch. we have a fast moving fire in southern colorado, al destroyed several buildings and burning near pueblo. hundreds have now been evacuated. >> it was pretty devastating but we were pretty lucky because friends of ours down the road lost their home. >> more than 21 square miles have burned and health advisories are in effect in the area because of all the smoke there. mother nature can't make up

we showed you snow earlier. check out the rain in san francisco, in the bay area. more rain fell over the weekend than all of october 2015. and rain isn't the only problem in miami. the 305 roads are flooded thanks to high tides. some roads are submerged and residents still dealing with the aftermath of hurricane matthew. i know miami beach floods too very easily, so we hope they dry out. nice and dry woods. live look outside behind me, can't really see a whole lot. it will be another hour or so before the sun decides to wake up. mesa, you're at 60 this morning, 65 now in tempe,and glendale sitting pretty at 66. so a nice mild morning so far. if you need to get out, do that exercise right now or hike or walk the dog, now is the perfect time to do it. for the rest of the day, i think much of the morning a lot
