♪ sky 7 shows you the aftermath of a deadly car crash in downtown san jose following a chase by the chp. if you look under that tree, you can see the car rolled on its side. >> there were four young men in the car, two killed. when the car crashed on east st. james street at north 6th street. karina rusk joins us with more. >> well, cheryl, this is considered a crime scene and the san jose police have actually been here since just after 1:30 this morning. take a look.

they are n clearing away most of the debray. a san jose police suppose person told me the driver of the car is 19-year-old jose antonio hernandez. he was treated for minor injuries at the hopital and then booked into the santa clara county jail on several charges, including two counts of vehicular manslaughter. the two passengers in his backseat of the green ford explorer died in this hoific crash. the passenger in the front seat suffered moderate injuries and is at a local hospital. the chp is not commenting yet on whether this was an actual pursuit or chase but police say a chp unit did make contact with the driver of the explorer at st. james and notre dame which is about eight blocks from here. the driver took off and lost control of hills car here at st. james an fifth street slamming into a parked jeep cherokee and then careened forward. >> after collidi with that vehicle,t continued eastbound

and struck a utility trailer, a little box trailer travels attached to a pickup truck, i believe a ford pickup truck. with that, with the impact being so great, the trailer continued forward and it actually push the pickup truck forward as well and it detached, separated from the hitch. >> so there are no speeds yet but you can see the force that was happening and result just a mangled mess. actually when you look at it, it's amazing that anyone survived. again, the chp is not commenting yet on whether this was a pursuit. the driver jose hernandez was charged with felony, driving under the ience and evading officers as well as though two charges of vehicular manslahter. now, you may remember it was in july that there was a chp chase of a driver not far from here actually. in that situation the driver of the suspect car did crash into another car carrying a mom and

her children and a 15-year-old girl died in that crash. reporting live from san se, karina rusk, abc 7 news. >> thank you. san mateo county and state officials are sending out a big warning this morning to the san bruno fire victims. watch out for scam artists trying to take advantage of you as you rebuild. authorities are alrdy seen some cases. terry sweeney joins us live from san bruno city hall, the scene of a news conference. terry? >> you expect tough talk from the san bruno police department and from the san mateo county d.a.'s office, and we had that this morning. but how about from the department of insurance. the state department of insurance saying that they will use their police powers to arrest contractors out here who are not liceed. the message is unified. if you don't have a license to build, don't bother coming. the san bruno's neighborhood. scott and connie bushman have a house in need of fixing up, the bubbles from the intense heat last week.

the house may need foundation work. >> we're going to ask for a home inspection to make sure the foundation is okay. either the house shifted just a hair or a little cement -- >> they received a sheet of vice on what to do and a list of licensed contractors from pg&e on w to do it with. but the ci of san bruno's initially property damage estimate of $31 million is certainly an enticing amount for scam artis ready to swoop down for a dishonest payday. that's why the district attorney, san bruno p. d. and insurance departmt and conacted state license board are warning fire victims, don't be victimized again and warning scam contractors, don't even try. >> whave a concerted enforcementment. we have sweep operations, ongoing with those. if you try to come to this area to get work without a license, you're potentially going to face a felony charge. >> we want to make sure they have approprte insurances so

it doesn't fall on the homeowner again to be liable for any injuries, liability on their behalf. >> the effort to educate fire victims and protect them fro unscrupulous contractors is anotherffort much appreciated by the bushmans. >> it's great. let know we're not going to get ripped off by someone that comes to fix the hou. >> an update now on the condition of some of the victims of last thursday's fire. eight were at the saint frans hospital burn unit yet. one was released yesterday. of the seven remaining, four are in critical condition, one serious and two are in fair condition at the st. francis burn unit in san francisco. if you're going to be doing anymore than $500 worth of construction work in th glenview neighborhood, you have to have a contract, a contractor's licens and if you don't they're going to come after you and they plan to arrest you. terry mcsweeneys,abc 7 news. >> house speaker nancy pelosi

talked about th san bruno fire in washington this morng. >> our prayers are with those who lost the loved ones. our prayers for those especially first responders, our firefighters and our law enforcement officers who came to the rescue and i commend the leader shift in the city of sa bruno. >> pelosi has said the bay area congressional delegation will work closely with local leaders to make sure all necsary assistance gets t victims. >> today the remnants of the destrod pipe from san bruno are arriving at the national transportationafety board lab in ashburn, virginia. here the investigators say they plan to reassemble the pieces and te the components in an effort to unrstand exactly what led to last week's explosion and fire. the ntsb said a final report on that blast could take a to complete. and you can find fire dispatch audio recordings from the night the fire brokeout as well as resources for residents and infmation on how to help.

on our website at abc7news.com. well, students at an elementary school in san bruno are being sent home for the day after reports of a gas smell in the school rattled a lot of nerves. police and firefighte chose to evacuate the childr after getting the first report of a gas smell this morning. pg&e investigators now belie the smell was the result of a heater being turned on after not having been used for a while. students moved off to miles drive where parents are arriving to pick them up antake them home. >> the danger has just ended at a prestigious hospital in baltore, maryland. a gunman who shot a doctor at johns hopkins hospital has just been shot and killed by police. all the developments from the news room. >> th just came down in the past 20 minutes. we've just received word that the gunman has shot himself and a relative inside a baimore hospital after a three and a half hour standoff. let's take a live picture from

baltimore right now. this unfolded just after 8:00 this morng when police say the suspect shot a doctor on the 8th floor of the hospital. authoritiesmmediately evacuated parts of thehospital. other parts went into lockdown. the doctor went into surge right away for a gunshot wound to the stomach. officials say he has non-li-threatening injuries. there's no wd on a motive or if the gunman had any relationship with that doctor but one report said the suspect was upset for the medical treatment for his mother. there's another report the suspect was baicaded in a room with his mom or relative but police would not confirm that. during the entire standoff, police were so confident they had the situatio undered controlthe hospital was still open for business. the emergency room was also still open for business but patients were encouraged to stay in their rooms. johns hopkins is a major hospital in baltimo, 1700 full-time doors. again just receiving word the gunman has shot and killed

himself and a relative after a three and a half hour standoff at johns hopkins hospal in baltimore. that's the latest here. live in the news room, i'm genalnal wang. >> thanks very much. investigators i concord are going through the evidence following an early morning shooting involving two of their officers. police say a man was walking on clayton road around 2:30 in the morning when police tried to stop him. they believe he was a suspect wanted for robbery. the man ran off, there was a brief chase, he pulled ou a gun and that's when offics shot at him. >> they drove off and got out of their car. i don't know the exact sequence of events but a weapon was produced and shots we fired by the offirs. he's a mal the question was asked hoold. he's a male in his early twenties. >> as we don't have a report on the gunman's condition, none of the officers was injured. >> a new snap shop of the bay area real esta market shows a mixed picture. sales plunged further but prices rise. we'll break down the figures.

we're following eaking news ght now from san francisco bay. rightow researchers from the marine mammal center are headed to the port of oakland. this is a live shot of that -- to examine a cargo ship that hit a whale while entering the bay this mornin you can see the whale there, the gray and white oect there on the bow of a ship. the collision hpened just before 10:00 this morning. researchers say they believe the whale was already dead when the ship hit it, but they don't know yet what kind of whale it is so we'll be following up on the story. >> in the meantime let's turn our attention to the weather and
