♪ a live picture of some of the people gathered outside the federal courthouse in san francisc right now protesting arizona's controversial immiation law. it's being contested this morning in front of the u.s. 9th circuit court of appeals we have advocates from the federal govement on the same side of this fight. >> jenelle is here with all th developments. >> those oral arguments started up about an hour ago and there is a large demonstration outside the courthous police are there in front of the courthouse. it isissipating a little bit. the protestors are basically against arizona's immigration law which gives police the authority to stop anyone they have reason to suspect may be in the country illegally. but within months the obama administration bught it to court and the judge issued an injunction putting a big portion

of the law on hold. they will deci whether to lift that injunction. >> the problem of drug and human trafficking has grown to epic proportion so it passed a law to require police to check the legal status of anyone they lawfully pull over. the federal government is failing on the issue of illegal i immigration so it took matters into its own hands. >> the fact that the administration won't enforce what congrs says doesn't mean that arizona should have to be the brunt of it. >> this morning arizona presented its arguments before a three-dge panel. it opens the door to the racial profiles of latinos. dozens marched through the streets of san francisco all the way to the courthouse. the obama administration is also opposed to the law saying the state is stepping on its toes when it comes to regulating

continue her election campgn for governor. election day is tomorrow. they expec to give the decision the coming weeks and months. it's expected to go up to the u.s. supme court. >> in san francisco a three-year-old girl is in serious condition after a shooting. she and her grandfather were innoce victims. it started at the home from trick or treating. gunfire happened about 10:00 last night at 25th street and connecticut hill neighborhood. she was shot several times. her grandther tried to shield the little girl th his body and he was hit once in the leg. another man was hit several times. the shooting appears to be gang-rated. >> the driver of a big rig is dead after a fiery crash in vallejo this morning. the big rig was traveling on westbound 80 when he exited on columbus parkway. he failed to negotiate a curve, hit an embankment and caught

downwn. game time dropped to the low 60s. really nice. let's take a look outside, show you why. high presse dominated our weather, brought us that halloween evening. and now it's put a lid on the atmosphere and keeping most of the clouds away. a little haze the next couple days with the stagnation of the air but so far air polluti won't get out of control. gorgeous picture from mount tamalps. those temperatures, we made it out of the 40s and almost the 50 it is. holding on at sarafael and los gatos. everybody else in the low to mid-60s. inland low to mid-60s, even a 67 in watsonville. so pretty straitforward for the rly part of this week. going to be sunny, quiet weather today. warming trend, kind of peak around the midweek and high pressure will release its grip. a cold front and that will bring us a cooler weekend and small chance of showe but nothing like we've dealt with the last couple weekends.
