at 8:30 this morning, and the junks listening to victim impact statements. we hear oscar grant's mother will be speaking and his fiancee and we're also told that johannes mehserle will say a few words. they convicted him in the past july in the shooting death of oscar grant on new year's day. grant was unarmed. mehserle says he mistakenly pulled his gun when he meant to pull his taser. they convicted him of involuntary manslaughter and gun enhancement mang it maximum sentence of some years in state prison. this morning the jue indicated he is troubled with that. it's clear beyond any doubt that mehserle used the gun but he honestly believed he had a taser in his hand and he did not intend to sho the gun. they started by thinking about

formally denied it but he has telegrhed it. >> and where do you think the judge may fall between a low range proceed base ad a high of 14 years. will mitigating circumstances? >> there are certainly mitigating circumstances. mehserle is a young man, he served as a police officer honorably up to this incident. he abused the position of the trust as a police officer. those balance ou but what the law says when they lance out, usually the middle range term is appropriate but most judges, with no record, could be lower end. >> and the family wants 14 years. >> i think the judge is troubled with gun enhancement and i don't think is going to impose ten
