♪ animal control takes action this morning against a pitbull that savagely mauled a ten-year-old vallejo boy. its owner is speccing out. terry mcsweeney is liv with the new development. >> the attack happened here on springs road. the dog was captured a mile away where its owner had taken it. the boy had was bitten monday afternoon had going to have to go in for surgery. the dog is going to be put down but the question that remains is will the neighbors on springs road be able to get past this traumatic event. >> this vage animal control officer has to battle not only a

pitbull but the owner that does not want to give him up. the dog named savage is off the streets for the last time. the attack happenedat 2:30. >> my friends had the dog on the leash and dropped the leash. it ran off and he -- i was walking up on me. >> the drawing raced towards ten-year-old ray who lives a couple blocks away. the first encounter saw the animal bite his shoes. >> he got me and ripped off. i was like ah! >> he has had 16 rab by shots and more are anticipated but the dog has paperwork that shows it's current. >> most likely the dog will be euthanized and put down. >> the couple upstairs with the focus of angry neighbors.

of silence monday. 6 were killed, 13 others wounded including arizona congress woman gabriela giffords. the president ais to meet privately with the victims. members passed a resolution condemning the attack while paying tribute to the giffords and the other victims. >> our hearts are broken. but our spirit is not. this is a time for the house to lock arms in prayer for the fallen and the wounded and resolve to carry on a dialogue of democracy. >> house minority leader nancy pelosi signed a book of condolence today in the capital rotunda. members of public and staff are all welcome to sign it. meanwhile there are new details on the alleged gunman.

arizona authorities say a wildlife officer pulled over jared loughner just three hours before the shooting rampage for running a red light. the officer found no outstanding warrants, warned him and let him go. we're hearing for the first time from a close friend of the suspect. >> zack was jared loughner's high school friend yet he doesn't recognize the alleged killer in this mug shot eye can't look at that. it scares me. i wish i could help but -- >> it's hard to look at the picture of him. it looks like a monster. >> investigators say they found a profanity-laced note at the loughner's home, apparently refer to the congresswoman. on the morning of the shootings his father saw him take a black bag out of the car trunk and

blamed heated political pundants. >> congresswoman giffords and her constituents were exercising their right to exchange ideas that day to celebrate a republican's core values and peaceful assemble to petition our government. it's inexcusable, incomprehensible why a single evil man took the lives of peaceful citizens that day. >> investigators have not given any sign political rhetoric may have been linked to the shooting. palin was called into the discussion because she used gun hair controls hairs during midterms elections. it was districts where the tea party should focus their efforts. >> oakland police are looking for a suspect in a high-speed chase. 8:00 officers tried to stop a

car on 84 avenue in east oakland but it took off. police finally stopped it in the parking lot of a safeway store. this is the scene shot from sky 7 hd. two people were taken into custody. a third man, a suspected parolee, ran off. the order press is reporting that former governor schwarzenegger has sent the letter to the family of a murder victim apologizing for not giving them notice before commuting the sentence of a man involved in the killing. in one of his final moves as governor where schwarzenegger reduced the sentence of nunez from 16 years to 7 years. he is the son of former assembly speaker. he had pleaded guilty to voluntary manslaughter and assault in connection with the 2008 killing of louise santos from concord. governor schwarzenegger called the sentence excessive because he had no prior criminal record.

santos' father said he is considering a lawsuit. >> a fire overnight caused damage and renewed questions about the legal status of pot clubs in san jose. amy? >> kristen, police are involved. they saw the law around these pot clubs is very gray. investigators at the fire department are also involved wildfire we've seen them here. moments ago they were focusing on the porch. they aren't saying what possibly started this fire. they got the call 3:00 this morning. the victorian house was on fire. it was leased to a company called herb appeal, a pot dispensary. firefighters say there was merchandise inside but they weren't growing any plants in there. the fire was so big, the next-door neighbors had to evacuate. >> my son came and got me, got my grandson up, got me up and

said put a jacket son because we gotta get out of the house. and i saw the flames coming up and it went through the roof and everything. >> police say they will document what occurred and they will send a report to investigators. they say it's very difficult to determine if these dispensaries are operating within the law. they say aside from dealing with federal and state law, they also have a municipal code here in san jose that's up in the air. they say here in san jose, the pot clubs are being debated. police are watching the whole thing. they're watching this situation. they say they're going to document and just forward it on to investigators. no one was hurt in this fire and, again, firefighters haven't said yet what they think caused the fire. abc 7 news. >> all right, amy. thank you. a fourth year medical student has died from a brain injury he suffered during a nightclub bral in san francisco last weekend. he died yesterday. the city medical examiner says

he was taken off life support and his organs were donated. police were called to the temple night club near first street shortly after 1:00 sunday morning. they say he was hit in the head during one of two fights in the club. two other men were stabbed. the city's entertainment commission has ordered the club's owners to improve security. in san jose a club owner's debt may have been the motive behind a nightclub shooting that left three people dead on friday. they believe it happened during an attempt to kidnap one of the club's owners. two killed were suspects, the third person worked at the club. police are still looking for another gunman and a get away driver. >> the quake that made for a rude wake-up call for some in santa clara county. and rebuilding haiti. a look where things stand one year after a devastating earthquake that leveled much of the island nation.

>> oakland's new mayor is taking on an unofficial adviser who may not be popular with the city's police department. he's a vocal critic of the police and critical of the injunctions police use to keep gang members out of certain neighborhoods. siegel won't draw a salary and expects to talk about the budget and marijuana farms and policing.

siegel and quan were classmates back in the '60s. today is the one-year anniversary of the earthquake in haiti that killed 230,000 people. much of port of prince was left after the quake. meanwhile supporters are demands accepted up recovery efforts. a year later only 5% of the rubble removed. more than a million people still live under tarps and diseases is spreading. it's relieve efforts focus on immediate needs. >> emergency shelter, water, sanitation. food for a million people. a vaccination campaign, keeping hospitals open and now focusing primarily on trying to move into a recovery phase and getting people out of camps and into homes. >> the red cross has spent about a quarter billion on haiti quake relieve efforts, about half what the organization received from american donors.

the series of small earthquakes ralted the south bay overnight. they started just before 1:00 this morning. it was centered about eight miles southwest of hollister. several aftershocks were felt in the same area across the next hour. the strongest measure 3.4. a photographer felt the effects. >> i woke up, my bed was shaking and i heard the lamp on my nightstand was rolling back and forth. i kind of got up and the house was still actually moving. also i could hear the dishes in the kitchen rattling in my house. >> up a little early. got to work a little early no doubt. no reports of serious injuries or damage. we slept right through it, didn't we? >> yeah. thanks to that. mike is up next. >> let's take a look outside. show you some of the sunshine that we talked about this morning is coming back but it will be short lived.

that does include hawaii, by the way. let's talk about temperatures. you can see we're still pretty much in the upper 40s to low 50s. same thing armed the monterey bay. our destination warmer this afternoon thanks to the pockets of sunshining and the dry air. rain tomorrow, most likely that will accumulate in the north bay and sunshine and warmer than average weather for the weekend. i 60 san jose. 58 morgan hill. the monterey bay and inland low to mid-60s. cloud cover tonight mild when you step outside tomorrow. possibly even a little drizzle. mid-40s inland, upper 40s to near 50 along the bay shore. about 47 out around half moon bay and also in santa cruz. cold front went through last night. fell apart. small area of high pressure punching holes in thecloud. next system with clouds tonight and then scattered rain for
