♪ the four americans taken hostage on their yacht off the coast have been killed by somali pirates. a navy team stormed that boat but it was too late. the couple from sant monica owned the yacht. they were traveling the world delivering bibles. another couple joined them to take part. phyllis's mother lives in san francisco. her niece spoke on her army's behalf. >> my aunt was not dead. she had been shot was was not dead and they tried to save her. >> marines and navy seals

boarded the boat this morning after hearing gunfire. they killed at least two of the pirates and captured another 13. >> the death toll is rising in new zealand but the state department says two delegations of u.s. lawmakers and business leaders are safe. the 6.3 magnitude quake hit christ church, the second largest city. new pictures are stunning. >> people are waking up to the sight of more devastation and crews ton search for those still buried in had the rubble. the death toll is at 65 right now but it's expected to rise. the u.s. sent a search and rescue team to look for the missing. more than 100 people are unaccounted for including visiting japanese students that could still be trapped in the rubble. >> they don't know if the death toll will stop at 65 or there's some suspicion it will move into the hundreds because of this. 100 people --

>> the 6.3 magnitude earthquake hit just before 1:00 tuesday new zealand time at the height of the busy workday. powerful aftershocks and survivors running for their lives. >> the thing you see roads, some bridges out. it's just like a muddy -- it's everywhere. >> kurt campbell was there when the quake hit. he said he was nearly killed. >> suddenly just a terrific shaking. people were thrown all around the room. >> most of the city is without power. the water supply had been compromised. the quake was so large it broke off a 30 million chunk of ice from a glacier causing massive waves for about 30 minutes. this is the second earthquake to hit the area in five months. the first one in september was larger, a mag sued 7.1 but the

usgs says this latest one caused more devastation because it was centered closer to the city and had a much shallower epicenter, just 2 miles below the service. >> she's living n church. she says the city has a lot of older masonry buildings which have crumbled. crews are out now digging through the rubble. >> all right, jenelle. counselors are at walnut creek creek after the tragic accident of two teens. terry mcsweeney joins us with more. >> yeah, the two boys drowned on saturday trying to raft down a rain-swollen walnut creek. 17-year-old gavin was supposed to be on campus now playing in the school jazz band as part of the health fair. the music is gone as is the

anything. >> school principal matt campbell said shock is the common denominate temperature. that's why school councils will be joined by counselors from other district high schools to offer one-on-one for students. now students can counsel students. >> what we know about students at this age they're all feeling it so they like to hang out in groups and process in groups so the library's a really good place, safe place to go, a big place to go and just process together. >> the health fair scheduled for today will proceed as usual. they thought of cancels it but what could be a more important topic for schools today than help and how to get healthy again. there's going to be a candle vigil. that's where the boys used to go to plot their next adventure. >> terry, thank you.

san jose's police chief's new policy on racial profiling is winning praise by groups targeted by officers in the pass and the person's idea that triggered the change. live in san jose with the story. >> some people of color complain san jose police will make them sit on the curb even after they've been searched. they question whether a white man in a suit will also be asked to sit on the curb. now that officer's decision can be scrutinized to see if race played a role. >> this office has been pushing for this change and to see it realize with the new police chief that's only been in office a matter of a few weeks, it's huge. >> ladoris spent nine months worrying about what happens to people of color after they have been pulled over or stopped by a san francisco police officer. she hears the complaints.

but the department policy only folks -- focussed on why, not what happened next until now. >> it's important to have rules that say to law enforcement these are the things you must not do when you're engaging in the public. >> kordell tried to get the former police to change the policy. then she approached the new chief chris moore and got it done. >> i took over when there was a level of distress and the community raised a number of concerns around racial profiling and issues -- disproportionate treatment of people with color. >> they think the relationship will change, especially considering this policy change. >> i think it actually is a big deal and the reason that is, it sends a message out to the community that if you are -- you think you're a victim of racial

profiling that now there will be more investigation into the matter. >> this police chief says he obviously has a lot on his plate, like the budget problems. but look for him to take more steps to try and heal relations between police officers and the people they serve. live in san jose, amy hollyfield. >> supervisors plan to file papers today. markari was voted in 2005. he graduated from the police academy in 1996 and worked as an investigator in the district attorney's office before becoming a city supervisor. michael hennessey has been sheriff since 1980. he was reelected eight times. he announced last week he will not be running for re-election. >> the fight since in wisconsin as the governor warns of layoff notices if a controversial bill is not passed.

we may see $4 a gallon gas as early as the spring. libya says it is temporarily suspended it following violent clashes. the new york stock exchange, stocks are down 177 points. >> protests continuing with overcollective bargaining. neither side is budgeting. scott walker wrapped up his opposition that they will get layoff notices as early as next week if bargaining sides are not passed soon. it would force public workers to pay more for their benefits. rallies are inspiring units here. hundreds from the mount diablo unified district are planningto protest today. they're meeting to demonstrate tonight outside the school board meeting where the members will talk about the possible closure

motion picked are pushing for safer drinking water. erin brockovich will announce a bill that will set students for chemicals in drinking water. that chemical is the subject in the movie erin brockovich. a recent study showed tap water in 31 cities nationwide including san jose contain that chemical. >> well, think daughters are closer to their moms? explain a new survey out of britain to show moms are three times more likely to allow their adult sons to return to the family home. 58% of moms admit to spoiling their sons saying they're more inclined to cook dinner for their sons, wash their clothes and give them cash. it will by 20th century fox, a movie about a son that won't share his mom with another man. >> i thought it was because i'm the youngest.

it's the friday night into saturday morning where we could see the snowfall all the way down to sea level. i think we could see some accumulations as low as 500 feet, grassy surfaces, cars, some of those things that are cooler than the ground. napa, 2 degrees cooler than average. redwood city 5 to 7. most of us low to mid-60s. we're in the mid to upper 50s today. cooler in the mid to upper 50s. clear lake at 2. the coast low 50s. monterey bay and inland, temperatures range from 55 in monterey, gilroy and salinas at 58 degrees. tonight it will be chilly once again. north bay valleys, low to mid-30s there. upper 30s to low 40s around the bay shore and out to the coast. over the last ten hours we watched this low continue pulling away.

nice bubble of high pressure taking over, bringing us the sunshine and the brief break from winter's chilly rain. let's jump ahead 6:00 wednesday morning. everything will be quiet. tomorrow see the clouds gathering to the north. the rain moves back into forecast. by friday morning the cold front still to our north so the snow level is still going to be up rather high friday morning, 2 2 2,020 feet. that's where we can see snowflakes just about anywhere saturday morning. it will be quick and you'll have to probably get up early because the rain and snow is supposed to move out by 6:00 or 7:00. here's a look at your accu-weather 7-day forecast. we have temperatures in the must f mid to upper 50s today. that was after frosty temperatures this morning. we could make another run at record cold temperatures

tomorrow, especially the north bay if we do hit the upper 20s as you see there. mid to upper 50s tomorrow. with the increasing clouds, the temperatures will be cooler thursday, low to mid-50s. look for rain again during the evening rush hour and beyond. friday and saturday unbelievably cold high temperatures, mid to upper 40s. we'll be lucky if we get that warm friday, especially with the snow level dropping all throughout the day. saturday a break late into the afternoon hours and sunday and monday look at the sunshine. low to mid 50s. some of those mid to upper 50s by monday. >> it will be a heat wave! >> i know. running around in shorts and short sleeves. have a snowball fight. >> i see that in our future for sure. what do you think of this pair. br
