the accident resulted in spilled acid and injured worker and smoke billowing into the air. amy hollyfield is live in newark at evergreen oil facility. >> the plant is shut down and refinery officials are meeting now with representatives from osha and the bay area quality air management district. they are trying to figure out how it started. >> the two-alarm fire woke up the neighborhood across the street. it was 5:30 in the morning. residents were groggy and nervous. >> i heard a big boom and i asked my grandmother, did you hear that. and they said yeah, came outside go back in your house because we might have to evacuate. >> there were 20 people working inside the plant. two men were performing a routine task he using a heat exchanger when the equipment failed. one worker hurt his arm but is

expected okay. >> we had an expected release. for some reason it came out. right now we don't understand why that is. >> a worker inside the plant tells "abc 7 news" the flames were huge and the situation was scary. heat from the fire melted a tank containing acid that then spilled. two hazmat teams came in. >> that acid is contained and hazmat teams are in the process of cleaning it up. >> they the tested the water and determined no chemicals leaked out the plant. a crew spent the morning vacuuming the foam used to fight the fire. this is the second fire at this refinery in less than a year. last may it took firefighters about two hours to contain a fire that started at 12:45 in the morning. no one was hurt. this history of problems have residents on edge. >> it's like roaming around in

ten feet following last weekend's storm and moved another six inches overnight. muddy water from the saturated hill forced residents from four other homes to move out completely. the city council meets tonight in a special session to declare a local emergency. neighbors are petitioning the city stepping in to pay to shore up the hillside. >> three homeowners are frustrated. they believe the city should be doing more to help them. the landslide was reported last thursday. city has issued an emergency declaration hoping to get state and federal funds to stabilize the hillside. they are promising to hold a meeting tomorrow night to update the situation. >> eric: dozens of residents are trapped in a west morgan hill neighborhood after a landslide made the only road assessing their homes impassable. the slide happened early sunday morning.

there are less than 20 residents living there. the slide happened after a series of storms drenched the area with more than 6 inches of rain. there is an alternative back road but they have to be escorted by fire officials. >> barry bonds trial watchers are waiting for them to stake the stand today. a trainer will reveal what he knows. terry mcsweeney is live in san francisco. >> reporter: we are waiting for former oakland a's superstar jason giambi and gt waiting for sam conti to take the stand. what we have so far this morning is two men who were tied to the lab that did the testing on barry bonds that determined he was positive for steroids. take a look at him arriving at the courthouse in san francisco. first step today, was a doctor

sample. he talked about how major league baseball was testing players in may of 2003 with the understanding, with the players union that there will be no discipline for players that tested positive. that was before the feds seized the samples and bonds' sample tested positive. another witness talked about the collection of bonds' urine. take a look at jason giambi. big star of oakland, most valuable player in 2000. then he went on to the yankees. he has admitted of taking steroids. he has apologized to fans. his testimony expected to be that he bought steroids from greg anderson, barry bonds's personal trainer. he is refusing to testify

against long time friend barry bonds but the most damning test will be samconti. prosecutors say that he will testify that barry bonds knew he had taken steroids but was prepared to lie to a grand jury. and that could be very damaging testimony. consti is now employed by los angeles dodgers. we are waiting for the star power to show up. giambi and his brother and former giants as well and then mr. conti. we'll see how it shakes out today. teachers in the mount diablo school district voted on a contract proposal that would shorten the school year by three days because it includes three furlough days. it's help to balance the budget.

results are expected by the end of the week. today the state legislature is expected to take up the governor's proposal for a special election. it's whether democrats can get enough republican support to approve a june special election and to extend taxes to help balance the deficit. talks bogged down when republicans said they would only support the tax initiative if democrats accepted their policy demands. >> overseas, government tanks and rockets pounded rebels in into a panic sole retreat after a battle. in london, hillary clinton and international leaders device add plan for any post gadhafi government. >> we must continued to pursue the broader goal of a libya that

>> eric: right now the supreme court are hearing arguments about a major discrimination case against walmart. whether they can move forward on a class action suit. they accuse the largest retailer of favoring men and women over pay and promotions. justices were troubled by a lower court's rulings allowing the class action to proceed. the retailer wants the high court to force each plaintiff to file separate suits. >> we don't say the cases are too big but the claims of three people who are acting on behalf of millions are aberrational.

calm the bay is. >> let's talk temperatures, running to the mid to upper 50s just about everywhere. let's head down further to the south, 50 in salinas. everyone around the monterey bay mid to upper 50s. highlights, partially cloudy and north bay there may be a few sprinkles but no organized rain. near record warmth tomorrow and thursday but the wind is looking less likely this weekend. let's talk about today's temperatures and how we're back to average. livermore, oakland and san jose, just about on. >> temperatures in the south bay 70 in campbell and everybody in the upper 50s. mid to upper 50s on the coast. say low 50s around downtown san francisco. mid to upper 50s at your beaches

also. low to mid-60s throughout the east bay shore, fremont 66. that would be the cool spot in the east bay valleys, and walnut creek and dublin in the upper 60s. mid to upper 50s for the rest of the bay and even 70 in gilroy. 73 in fresno and look at that 80 in palm springs. got a game tonight, giants and a's, 62 dropping down to about 57 degrees. we'll keep falling into the upper 40s to low 50s tonight so not nearly as cool. one area of disturbed weather and another one is coming by and that will keep the clouds and stray sprinkle chance in the north bay. otherwise the storm track moving to the north and it's going to stay that way. because of that we're going to see temperatures once the winds
