the primary suspect in beating of a bay area giants fan is in court right now on an unrelated charge. there is a remote possibility he could be released from jail. today, a judge has to decide on a charge which 31-year-old giovanni ramirez being held is valid. abc7's karina rusk has been following the morning's court hearing and is in the newsroom with more. >> a hearing to determine if giovanni ramirez violated his parole and got underway at 9:30 this morning, it could last for hours. prosecutors have not charged ramirez in the attack on bryan stow and it's possible they could be forced to take action rather than see ramirez set free on the

unrelated charge. court observers said several witnesses are scheduled to testify at the hearing, including some who do not speak english and will need a spanish translator. police says ramirez violated parole because they found gun in a laundry basket where he was arrested. he's the primary suspect in the attack at dodger stadium that put giants fan bryan stow in a coma. if a judge rules that parole violation did not take place, ramirez will be released and likery rearrested on charges related to the beating and formally charged in 48 hours. an attorney for ramirez insists his client was not involved in the attack. and says a photo released this weekend shows ramirez with dark hair at the time, which looks different than the police sketch and booking photo. it comes on the heels of an emotional father's day for stow's children who say they usually spend father's day at a giants game. >> it feels weird not having him by my side. >> i spent a lot of time with him. it's different not going

and look east from south beach this morning. doesn't the water look inviting? 56, 58 degree water? we're going to be near 100 in some areas. here is the reason why. the high pressure, marine layer up north. nowhere near us. temperatures already running anywhere from five to 11 degrees warmer than they were at this time yesterday. that puts us almost near 90 in antioch. mid-70s in san francisco. the cool spot, half moon bay at 64. we'll talk about how much warmer the temperatures will go. they come without a spare the air day. >> beach goers are warned to stay in shallow water after a shark sighting near stinson beach. it was a mile north of stinson at sea drift beach. shark warning signs are posted along the southern marin county beaches. people are told not to go in the water past their knees through thursday. officials say that warning could be extented if more sharks are spotted.

developing news oversea, 6.5 magnitude earthquake rattled a sparsely populated area of northern chile. no immediate reports of damage or injuries. the u.s. geological survey says the quake's epicenter was located about 55 miles west of colama. it was felt across several northern chilean cities. officials say the quake did not pose a tsunami threat. dozens of people in sunnyvale were shocked out of their sleep this morning by a fire. one person was injured. they had to make a run for it out of an apartment building. our nick smith is there. this is so tough. they have to find new places to live. >> absolutely. one resident described it as chaos and panic as she and her neighbors were awakened to the sounds of scream, smoke and fire. >> all of a sudden we hear a guy screaming "help me, lyanne melendmehelp me." my boyfriend ran outside and saw the smoke and said there

lanes north of south king road at 8:15. highway patrol says 25 gallons of pesticide spilled across the freeway. the three right-hand lanes were closed as a hazardous materials crew cleaned up the mess. the c.h.p. reopened the lanes about an hour ago. residents of a leaned leaned apartment complex -- san leandro apartment complex back home after an eventful morning. suv severed a gas line when it crashed in the 103rd avenue complex at 8:20 this morning. seven apartments were evacuated as a precaution. pg&e crews turned off the gas line. everybody was allowed back inside one hour ago. the alameda county fire department tells us nobody was hurt. >> the u.s. supreme court today blocked a potentially massive sex discrimination lawsuit against wal-mart. the court ruled that the suit cannot proceed as class action. that reverses a decision by the ninth circuit court of appeals in san francisco.

if it had been allowed to go forward as a class action suit it could have involved up to 1.6 million women. wal-mart could have faces billions of dollars in damages. duke claimed that male employees were promoted more often and paid more than the female counterpart. after the decision, wal-mart released a statement saying as the majority made clear the plaintiff claim were worlds away showing a company wide discriminatory promotion policy. the court's ruling mean duke and other plaintiffs can move forward with individual lawsuits. but with much less money at stake. less pressure on wal-mart to settle. still ahead, check the tires. all of them. >> wow! the standard feature that is not so standard anymore on several u.s. vehicles. plus -- >> what 75,000 square feet has a big red bow around it and helps feed people? i'm amy hollyfield. i'll have the answer for you after the break.

♪ commander in chief is now the tweeter in chief. the president's re-election staff says it will monitor the account but president obama will now start regularly tweeting on his own. white house official says the tweets will be signed b.o. for barack obama. he had an active twitter account since 2007 operated by staff members when they used social media in the campaign for the presidency. his first personal tweet didn't come in 2010. >> the staff might want to rethink the b.o. thing. not what you want to send. mike has the forecast. hottest day of the year. until tomorrow. >> i knew you'd go there.

food. the country of nepal celebrated the first public lesbian wedding ceremony today with two women from the united states tying the knot. 41-year-old court knit mitchell and -- courtney mitchell and her partner married in kathmandu. same-sex marriages are not legal in nepal but the supreme court recently ordered the government to guarantee sexual rights and end discrimination. the decision prompted mitchel in the peace corps in nepal to persuade her partner to travel to kathmandu to get married. >> i love nepal. i would have brought sarah back to nepal anyway for tourism. it's because of everything that has been happening since 2003 with sexual minority rights we decided to come here for the wedding. >> the come say they are happy to contribute to campaign for gay rights in nepal. and they plan to register the wedding in iowa where same-sex marriage
