the u.s. supreme court strikes down california's law banning the sale of violent video games to children. >> but the san francisco lawmaker behind the ban is promising the battle is not over. abc7's amy hollyfield is live in san francisco with the latest. amy? >> reporter: yeah, the state senator leland yee feels strongly about this, kristen. he is even accusing the supreme court of siding with the interest of corporate america. instead of the interest of children. >> i am rather disappointed today, by the decision of the u.s. supreme court. >> reporter: in an effort to show his defeated law has broad support, lee provided

representatives from the medical community and from law enforcement to react to today's supreme court ruling. declaring california cannot ban the sale of violent video games to children. >> we see a lot of them are enforcing targets. it's not in development of an industrial. we're concerned about this. we will stay involved. >> reporter: the bill enjoyed bipartisan support in the california legislature. the u.s. supreme court declared the law violates the first amendment with justice antonin scalia write manage the majority opinion. no doubt the state processes legitimate power to protect children from harm, but it does not include free floating power to restrict the idea may be exposed. they told us via skype that the current rating system do enough to keep kids from playing violent games. >> we do understand the concern that some parents have about the content of

being filed for discrimination against the retail chain abercrombie & fitch. this case involves a woman who says she was fired from a hollister outlet in san mateo after refusing to remove her head scarf. eric thomas joins us in san francisco with the story. eric? >> cheryl, of course, hollister is owned by abercrombie & fitch. 19-year-old hani kahn was wearing that same scarf when she got the job in october of 2009. the scarf or hijab at the center of the legal fight. she says the store manager told her it wouldn't a problem wearing it every day. but just a couple of months later in february, she says following a visit from a district manager, she was called in, and asked not to wear it anymore. when she explained it's part of religious beliefs to wear the scarf, she was fired. the company said at the time it was because of all-american look policy. well, the equal employment opportunity commission has filed suit on her behalf.

and legal aid today announced they are filing suit for hani along with the counsel on american islamic relations, trying to get the all-american look policy removed. they also want monetary damages. >> i was completely shocked. nothing like this has happened to me. i was 19 at the time. no one issued with it. >> by failing to attempt to accommodate her in any way they violated federal and state civil rights laws. >> she got death threats after it became public. abercrombie & fitch we tried to contact them for a response. but they have not responded to this point. this is not the first time thathe mpanyas be ed f methin lik this. miitasoman says s didn't get a job last year at an abercrombie & fitch store because she wore hijab. she is suing, similar case in tulsa, oklahoma, earlier that year. so once again, this suit has been filed.

another one with the equal employment opportunity commission has been filed. we are waiting for response for abercrombie & fitch. live in san francisco, eric thomas, abc7 news. >> thanks very much. union city police are investigating a shooting at a home where two murders have happened in the past year. witnesses tell officers a man walks up to the 22-year-old victim. and opened fire on them around 8:30 last night. the gunman is at large. the victim had to have surgery. it happened on whipple road. there was a fatal shooting there last month and another murder there last september. they don't know if the three incidents are related. los angeles police want to examine a new video clip that surfaced showing bryan stow inside dodger stadium the night he was badly beaten. celebrity website tmz posted the short clip showing the giants' fan in the bleachers at the giants home opener. he seemed to be fending off

verbal confrontation with a man wearing a dodgers jersey, a man who does not appear to be suspect giovanni ramirez. stow remains unconscious at san francisco general hospital. doctors upgraded his condition last week to serious and say he has been responding to some commands to open and close his eyes. ramirez is held on probation violation and denies being at the station that day. amtrak says there are five people not accounted for from friday's deadly crash in nevada. a man working for a nevada trucking company drove his big rig through desert crossing gate and into two double-decker train cars. that fiery crash killed him and five people on the train. authorities did not find any additional victims in the wreckage yesterday. one killed the train conductor, laurette lee. >> she was comfortable being a conductor. she liked it and was good at it. >> a big person with a big

voice. a heart about three times bigger than her voice. >> and she looked out for everyone. >> federal investigators looking at a number of factors that may have played a role in the crash, including fatigue, distracted driver and drugs and alcohol. they are also looking in the trucking company that employed the driver. federal records show the company has been cited repeatedly by the nevada authorities for safety violations. minnesota congresswoman michele bachmann made it official today. she is running for republican presidential nomination. bachmann made the announce in the waterloo, iowa. the tea party favorite says she is waging her campaign not for vanity, but because the voters must make a bold choice for america's future. >> government thinks it knows better they know how to spend our money and know better how to make a bigger life for us. they think they create jobs and can make us healthier.

nato is applauding the decision today by international judges to order arrest of muammar gaddafi. the international criminal court issued warrants for his son and intelligence chief for crimes against humanity. gaddafi is accused of orchestrating the killing, injuring and arrest of hundreds of civilians in first 12 days of uprising to topple him from power after four decades. it's been more than four months of intense fighting in the north african nation. libya today, officials there say a nato airstrike fired two missiles targeting
