you are looking at live pictures from sky7hd. it's over a bank robbery in pinole. shots have been fired and a police search is under way around the wells fargo bank in the pinole district shopping center. i'm in for terry mcsweeney. >> i'm cheryl jennings. one person has been killed and officer and security guard were injured. incident happened around 9:15

this morning. mark matthews is near the scene. do we know hot victim is yet? >> reporter: no, we have not heard yet. we are half a mile from the scene. we are on the west side of i-80. this is happening on the east side of 80 at the wells fargo, right there in the shopping center on the east side. about 9:15 a loomis armored car truck was making a delivery and robber approached the bank and tried to rob the truck or the bank. from there we are told that there was shots fired, at least two people injured on the police side. a pinole police officer and a security guard. i'm told they are both okay but there is a body in the street on fitzgerald next to the wells

fargo bank. we believe that is one of the bank robbers, police are searching the other shops in that shopping center for a possible second suspect. a witness to this robbery was in the outback steakhouse, walked out in time to see it happened but here is what he saw. >> police were everywhere. i guess they have one guy that came outside of the bank. right when i came out they just let loose and shot him seven times. he was out there right on the spot. police swarmed in. they said there were still a couple people inside the bank but there was a robber still inside the bank. they told me to get the heck out of there. i started walking up the street. my truck is still stuck in there. >> reporter: people have been stuck for more than an hour. they are just able to get some of the folks that have been trapped on fitzgerald away from

the scene and back out towards the freeway so they can be on their way. they are keeping reporters and people away from the scene. as you can tell we are half a mile away from the action is happening. so far we know one security guard and one pinole police officer was shot but they are okay, i'm told. one body lying on fitzgerald believed to be a suspected bank robber. police are searching the shops next to bank for a possible second suspect. reporting live from pinole, "abc 7 news." bart's board members were expecting an overflow crowded hearing on the shutdown of cell service. they didn't get a crowd but they did get a message. amy hollyfield is live at bart headquarters in oakland. >> reporter: they created an overflow room. it wasn't a huge turnout this morning. the board of directors were hoping to hear something from

the public that would help them draft a policy for what to do in the future. right now the board seems very conflicted. >> this controversy involved a lot of shouting. for the first time they came together to talk. the board asked the public to come and give opinions before it drafts policy will have a major impact to the entire country. >> i've gotten 10,000 e-mails from across the nation, people that are not familiar with the bart line and never thank you for protecting us and everything in between. >> bart police officers say they have intelligence that a protest group would be encouraging and inciting illegal behavior on bart platforms. they decided to shut down cellphone service in the name of safety. an attorney was one of 18 speakers that give an opinion. >> i think we also need to ask ourselves do we achbt to have a

society where the government is in a position to shut down a communication network used by thousands and thousands of people simply because a few of those people are using it for a particular purpose. >> some question was violators freedom of speech and other opponents raised the issue of safety. >> god forbid if there was an earthquake monday evening you would have some serious things on pay. >> but also the argument for shutting down the service. supporters questions the first amendment argument. >> i'm a supporter of the first amendment rights. i'm here to say my opinion the claim that there is any first amendment issue here at all is species and a trivializes a person. >> couple of bart employee unions spoke out in favor of being able to shut down cell service in the name of safety.

as you heard the tone of the meeting was very civil, nothing like the protests. today was about listening, no action is expected today but the bart had of the hopes to draft a policy as soon as possible. there is a lot of shaking going around san leandro. the city was hit by a earthquake. this morning's quake was in the same exact spot as magnitude 3.6 quake that hit last night. they say both quakes and at least four more minor quakes were centered on the hayward fault about three miles north of san leandro. both of those quakes were felt as far east as antioch, and also petaluma and santa cruz. as far as west at san mateo. there are no reports of damage or injuries. >> the day after a quake rattled much of the east coast, office

buildings and schools and land marks are being inspected for hidden structural flaws. they found yax in the top of the washington monument. in virginia near the epicenter, parts of an office building collapsed. they say at least four smaller aftershocks have been registered. they say earthquakes are rare for the east coast but a good reminder to always be prepared. >> earthquakes don't have a season and they are not just a western hazard. >> first day of school have been cancelled throughout the washington region and parts of virginia today. nuclear commission says no major damage was found at 12 nuclear power plant sites. firefighters near sacramento are calling in a team from texas to help extinguish a raging fire from a propane tanker.

it caught fire yesterday afternoon in the town of lincoln. firefighters are pouring water on it to keep the tanker from cracking that could trigger a massive explosion. experts called in from texas will perform an operation called a hot cap. >> apply pipe to the tanker scar maintain the safety of the individuals that are there and the safety of the public and then we're going to have a hose that going to dump into the pond and burn it off in that location. >> this is how the fire looked a shorort time ago. they hope to have it blaze within 24-48 hours. the originally thought it would take 21 days. 4800 families have been forced out of homes. >> waters is finally back oh o in san mateo county town after a pipe broke. they still are back to normal

because the entire town has been ordered to boil water before using it. >> reporter: good morning. the people of pescadero have been out fresh drinking water or the ability to flush their toilets. can you believe that in this bay area town, the people here after all of the warnings about earthquake preparedness still did not have a secondary water supply. >> we didn't have an hour of water. >> the chairman of the advisory council and go to guy for the people of pescadero. he says the department of public works is in charge of the pump and wells that died on monday and left the 800 people of this coastal community without water until this morning. i asked him why was there no fail safe. >> certainly the government should have been more diligent in keeping a viable set of maintenance rules, schedules and

they didn't. >> he says the well was drilled in '92 and change of hand and administration means the ball was simply dropped. >> some people had earthquake kp in to. who knows how much it has. >> today officials are testing the new flow of water and collecting samples and gauging levels for bacteria. but running water doesn't mean it's safe to drink. everyone is being told to boil their water. >> we're announcing no drinking until we get the all clear. >> preschool has been cancelled. for the elementary students, hand sanitizing stations remain in place and some businesses remain closed. >> we agree, we are going to put a plan in place so it never happens again. >> again, county officials are asking they continue to boil their water for the next 24 hours. wayne freedman will have a follow-up to the story later.

we have yet another breaking news story. in south san jose where an amtrak train hit a pedestrian. this is a live picture from the scene. it happened about 10:30 near ford road. the train is stopped on the tracks. we are not sure how it's impacting rail service. caltrain is not reporting any delays at this time. more information as soon as it becomes available. >> nbc news has learned new test results from the murder mystery of a woman has positively linked the prime suspect to her murder. she disappeared in july 2001 after meeting a man in a bar in campbell. district attorney's office this morning revealed fiber evidence had linked missing from the home to the prime suspect.
