jen s. >> and eye kristen sze. the battle that began with a sneeze -- and i'm kristen sze. the battle that began with a sneeze is getting atntion. students punished for saying bless you. amy hollyfield is live at the headquarters. >> reporter: the district isn't commenting. officials tell us this is a personnel matter so they can't talk to us about it. they are not reaching out to the mother who contacted the district two weeks ago. she is concerned because the teacher say he would be docking the students 25 point force sneezing or saying bless you. >> i haven't heard from anybody yet. i'm still waiting. i guess they haven't made a decision. i wish somebody would e-mail, call, something. how big a deduct hunt is this? are they failing the class and not graduating because of this? are they having to retake the

class later on? what is going on? is this really something that is allowed to go on? are other teachers able to do this too? >> reporter: this is happening in vacaville. a teacher told students a sneeze and saying bless a distraction and he would be deducting 25 points off their grades and took issue with the words "bless you." >> i sneezed and somebody said bless you and he said do you think that girl is evil? do you think evil spirits are coming out of her? the guy said no i was just doing what i'm supposed to do when somebody sneezes. >> reporter: the teach -- parents and students are questioning his agenda. this happened in his health class. the concerned parent says she is not trying to get the teacher in trouble. she is just concerned about the point deduction, especially since he threatened to take points from every

agencies to meet to form a strategy. the robbers warhol wean costumes? >> reporter: yes, -- this time it was all trick and no treat. 3:30 this morning three people walked into that gas station, all armed. a short time later they showed they are not afraid to use those weapons in the middle of the night they came, some with handguns, some with rifles. cameras everywhere in the store. a person who has seen the video says it shows six in costumes. one a little la, another a skeleton in addition to the small amount in the register, robbers took two large bottles of 7-up and several s of condoms. nothing but the money, soda and condoms. -- no shops fired inside the shop. as they left one fired a runned in the direction of a customer pumping gas.

jeff pet drew was stabbed and shot to death -- jeff pettigrew was stabbed and shot to death friday. he was president of the san jose chapter. police say they've identified a suspect. a member of a rival biker gang with ties to the bay area. investigators openly warn the suspect may not survive to stand trial%eh:y if [ unintelligible ] he believe he's in hiding since the shooting. >> san francisco police arrested a 15 year formed the murder of a cookout side a mission district restaurant. the 22-year-old was shot to death august 30th while taking a break from his job at 19th and san car low street. the 15-year-old mistook him for -- for a rival gang member. in san francisco, muni officials are answering over

several major safety issues. the state is investigating following a report about problems with the light rail system. they include problems with defective track, tunnel control systems that operate poorly or not at all the meeting expected to determine whether muni has made necessary improvements. they've been threatened with fines if the problems are not addressed. american canyon soldier has died while fighting in afghanistan. he died on september 26th, he was injured when enemy forces attacked his unit with an ied. a 26-year-old u.s. citizen with a degree in physics charged with trying to blow up the pentagon and the u.s. capitol using remote controlled planes filled with explosives. the plot was uncovered in a federal sting operation.

all cantaloupe shippers and farmers to to more to ensure their fruit is safe coming from an out break of listeria linked to a colorado farm, 16 have died and 70 sickened. costco wants the cantaloupe industry to set higher standards for growing, picking and cleaning the melons. none were sold mere in california. as a preclusion health officials said people should toss any cantaloupes unless they know it came from a safe source. bank of america customers who pay for things with their debit cards will be hit with a new monthly fee. in january the nation's largest bank will begin charging customers a $5 a month fee if they use their debit cards to make purchases. customers who use the cards only for atm transactions will not be charged. jc morgan chase and wells fargo are testing a $3 fee. many banks are raising fees
