0ñ closed captioning by closed captioning services,inc good morning i'm cheryl jennings. and i'm kristen sze in a few minutes the vallejo police department will hold a news conference on death of officer james capoot shot chasing a bank robber. >> reporter: we have seen those investigators today with tears in their eyes. residents are grieving. they've been coming to the police department all morning bringing candles and flowers. just about everyone who talks about the officer uses the word "hero."

counselors at the high school are helping students through their grief. officer james capoot was known as coach capoot here. he served as the head coach of the girl's basketball team. >> the girls are pretty down. which they should be. we expect that. he touched a lot of lives. >> reporter: school officials are encouraging students to write cards or talk. the team the morning in seclusion. >> i got a lot of my girls basketball players 30 kids together just to do a lot of processing. i've been sitting in those sessions all day today. it has been rewarding to know the great work that he did as a leer. >> jim was all about the kids. -- he loved those girls. he did the extra that most coaches won't. >> reporter: in his police uniform officer capoot also did a little extra to help those in trouble get back on track. >> i've done prison time but jim never gave up on me.

he said don if you get clean there's a better life for you. i have that live now. >> reporter: one of who brought flowers and cards. >> i came to give my s to him and his family because he didn't -- my s to him and his family because he didn't deserve what he got. >> reporter: the officer was shot to death while chaing a robbery suspect yesterday afternoon. police made one arrest the rest of the day and night searching for a possible second suspect, a witness said two people were running from the scene. there are -- they are now saying they think the man in custody acted alone that the second person seen was a police officer. as vallejo police deal with this emotional investigation the people of vallejo say they will be there to help them cope. >> i wish him and his family the very best. same to all these officers. >> reporter: flowers just keep coming here this morning in vallejo. the front door is blocked now

here at the police station. the police are going to be holding a press conference in the next few minutes to release more information about this suspect. they are busy planning a memorial service. they expect it to be attribute not only officer capoot, coach, he was a husband and father to three daughters and a former marine. amy hollyfield, abc7 news. occupy oakland just held a news conference to announce a new occupation in the heart of downtown. neighbors are furious. terry mcsweeney joins us from 19th and telegrah with the story. some vocal opposition? >> reporter: there was. occupy oakland came here to 19th and telegraph to announce plans to take over the cy as the new occupy oakland tomorrow afternoon. we are right next door, right across the street from the fox theater. protesters came out here announced they are taking it over tomorrow. they did not count protesters

would be protested. >> against state repression for tomorrow, november 19th -- >> excuse me, we live here this is not an right place to have this happen. you going to put together a dirty filthy tent city where the middle of where we live? >> reporter: mr. says he lives here doesn't want occupy to occupy his neighborhood -- a woman with a sign asking occupy to go somewhere else she fears for her children. a number of other people came forward neighbors asking them not to set up shop here. business people telling me they are wary of what might happen when they take over this area tomorrow. the executive director of oakland school for arts is deeply concerned. >> i want to let people know we have 620 kids some as young as 10. it is an exciting focused place to go to school. we don't want that interrupted. i'm not saying that occupy would do that. we want to have our voice be part of this discussion.

>> reporter: occupy oakland looking for a new place to set up camp. with the city digging in its heels saying that camping will not be allowed and occupy oakland vowing to take this space tomorrow afternoon and a bunch of neighbors stepping up interrupting this news conference today saying they north going to tolerate occupy oakland coming to their neighborhood tomorrow afternoon should be interesting here in downtown oakland. terry mcsweeney, abc7 news >> occupy protesters in san francisco are thinking the end is near for their encampment. some moved out overnight a few others dug in and vowed to stay. people occupying market street federal reserve dank were issued a noncompliance order -- order yesterday telling them to vacate immediately. no police moment in the area we are keeping watch. >> just of california

rescheduled a resubsequents meeting canceled this week by uc officials over there's of violence that meeting was scheduled for wednesday and thursday. officials postponed it citing credible information that rogue elements was seeking a confrontation with police. that meeting has been scheduled for november 29th. california's unemployment rate fell slightly in october the rate now 11.7% it was 11.9. the development department said california added nearly 26,000 jobs last month. california's unemployment rate has been 11% since june 2009, the second highest in the nation behind they the national rate is 9%. state of emergency declared if a raging wildfire near reno. thousands are being -- being urged to get out as winds spread flames that have charred hundreds of acres.

katie marzullo is live in the newsroom with the latest. >> reporter: the coughlin fired started 12:30 this morning, more than 9,000 residents unvoluntary evacuation orders the fire is burning so erraticly in multiple directions they don't know where the city going next. -- at last 450 acres burned some reports say 600, 20 homes destroyed. several injuries reported most from smoke inhalation and one fire-related heart attack. 400 firefighters are fighting this fight and it is a hard battle. there are sustained high winds, gusts up to 60 miles-an-hour, plus the fire is burning in rugged terrain and steep canyons. no estimate on containment. the sheriff is on the scene he says hundreds more homes are in harm's way and it is a certainty that more will be destroyed. >> we have a fire that's burning out of control.

burning rapidly in a residential area of the city of reno. embers the size of half dollars are blowing up to a half mile ahead of the fire. >> reporter: we are learning in the last hour winds are up to 70 miles-an-hour. 90 schools are closed. two shelters open. one is already full. anyone who doesn't have to be in the area is being asked to stay away. cause of the fire, still not known. nanette miranda will have reports later. katie marzullo, abc7 news. vallejo police department starting that news conference on the death of officers james capoot. let's go there right now.@@

we are not going going to talk about the calibre now but he had a a handgun. >> [ inaudible ] can you explain why the initial confusion as there were initially two suspects? >> these situations are fast moving. sometimes information gets relayed or perceived wrong. we wanted to make sure there was not a us is -- not a second suspect. >> did he confess? >> i'm not prepared to talk about that. >> we talked to some residents, -- [ inaudible ] maybe this may have been prevented if there was more resources, more cops out there he was working alone. is that a fair complaint if there wasn't a bankruptcy problem here, more money into hiring more officers --

[ inaudible ] >> we can't determine if that's a factor or not. the officers typically work by themselves on day shift before we had these staffing issues. there were officers that were involved in the pursuit seconds behind him. they would have been closer had they not been caught up in traffic that does not appear to be a factor in this situation. >> were they riding alone the daytime shifts before the bankruptcy? >> yes our whole city did. we didn't have double cars. >> is it true there are only six officers on patrol is that down from used to be and what you really need here? >> i'm not prepared to about that. >> [ inaudible ] >> not at this time. >> do we know anything more about the actual shooting what happened between officer capoot and henry smith? >> actual details of the shooting? we have other information we are not prepare today to release that yet.

>> can you tell us how many times he was shot? >> one wound that was mortal. >> what part of his body? >> it was not through his vest and we are not going to comment beyond that >> was he shot more than one time? >> i'm not going to comment. i believe there were two or three shots fired. i don't think we are prepared to comment about how many times he was struck other than he received one mortal wound. >> do you think it was a confrontation? >> we are not prepared to talk about that. >> this is obviously a small department and i know tough on everybody. how do you move on? you have a city to protect. other agencies helping out? describe how your officers are holding up? >> well, we within through this not too long ago, 10 -- we went through this not too long ago, 10 years ago so --

we are getting a lot of support from other agencies in the community, solano, sfo, napa, chp. i think at this point it is going to be a matter of us planning and organizing and making a good use of the resources, the very many resources that have been thrown our way. >> is smith a vallejo resident? >> he's a resident of fairfield. >> [ inaudible ] >> did you recover cash if the robbery? >> we are not going to comment on that now. >> is vallejo police cars equipped with video? if so, was this incident recorded? >> some of the officers carry what we call a v-view camera it has the ability to be mounted in the windshield or the officer's person the officer did have one in his car during the course of the pursuit. we are not making that available at this time. >> [ inaudible ]

>> definitely of evidentiary value. it doesn't show the shooting, it does show the pursuit and the subsequent foot pursuit. >> he was shot from behind? >> we are not going to comment about that now. >> it shows the foot pursuit does it show him going into the yard or something along those -- >> it shows them running parallel to the police vehicle. >> did officer capoot fire his weapon at all? >> no, he did not. >> is mr. smith the only suspect in the bank robbery? >> he's the only suspect in the bank robbery the vehicle pursuit and the killing of officer capoot. >> are you going to make -- [ inaudible ] >> we are working on that now trying to get a booking photo. it was my hope we had it before the press conference hopefully we'll have it before you leave. >> i would imagine the officer played a lot of roles in the department. can you speak how the department is going to attempt to pull together -- [ inaudible ]

>> we are going to do the best we can. most of our people are professionals, they are going to do their jobs. it is tough for many of us. especially for his family. nobody is hurting more than them right now. luckily, we have plenty of help. >> can you talk about his family? [ inaudible ] >> i'm sorry say that again. >> i imagine there are -- [ inaudible ] gentleman we have members of the department with his family constantly. -- >> yes, we have members of the department with his family constantly. his wife is very distraught as well as his daughters. >> how will he be remembered here? he has an incredible history here. >> well, he is a guy that has been involved in the community. kind of a no nonsense kind of guy that tells you hike it is. despite that he was well loved -- loved among everyone at the

conference now about its decision to reopen the investigation into the death of movie star natalie wood. they just announced that actor robert wagner is not a suspect in the death. >> despite a story from the yacht captain he admitted that he lied to investigator about woods' mysterious death 30 years ago this month. he blamed woods' then husband robert wagner for her death off catalina island which was ruled accidental. he said he overheard wagner and wood argue. >> robert wagner picked up a bottle of wine and smashed it on the coffee take in front of christopher and nat and robert wagner said what are you trying to do -- what do you want to do, blank my wife? that's what the whole argument was about. >> natalie wood was born and raised in the bay area she drowned after spending several
