road. let me tell you what happened here and then tell you what led up to it. police surrounded this neighborhood in south san jose easy street el cajon drive, and they had a suspect carjacking suspect from milpitas. milpitas police called san jose pd said they were in pursuit they needed help. san jose police came on to the scene they had k-9 units doing a house-to-house search, in search of jared brown who they believe had a handgun. he was hiding somewhere in this area. just a few moments ago, he sped off in a car. he broke the perimeter and took off. that is where we are right now. milpitas police told me the carjacking suspect they couldn't tell me when this

carjacking initially occurred. they did spot the suspect in milpitas 8:30 this morning that is when they went in pursuit and san jose police came. what we have is a perimeter in this neighborhood with a lot of officers, k-9 units still here. right now, the search is active on monterey road in pursuit of the this suspect brown. we will have more in our later newscast. karina rusk, abc7 news. san francisco's mayor is joining the chorus of calls for investigation into the power outages last night during the nationally televised football game between the 49ers and steelers. amy hollyfield joins us with more. >> reporter: a lot of pressure from the 49ers to make sure this never happens again. crews were here at the ballpark until 3:30 this

morning trying to figure out what happened. teams of people from pg&e, the park and rec department and candlestick parks people were all out here they still don't know what happened, why the power went out. we have video of something they are probably looking into. look at the lower bottom half of your screen. you will see what appears to be a transformer blowing you see a flash outside the stadium an nfl security chief saw it and some fans saw it. pg&e says it still doesn't know dent know what caused the two outages, 30 minutes -- minutes before the game started and a 20 minute one during the second quarter. the team want as sure republicanses this will not happen during the -- wants assurances this will not happen during the playoff game scheduled this month. >> there were fireworks on the corner of the lot. then we saw a big flash on the

hillside and the lights went off. i thought that flash originally was some of the fireworks. we didn't see anything other than the flash on the hillside. >> power goes off and mechanical stuff wears out and it is just unfortunate. those things happen. >> it could be any number of things. it could be equipment owned by pg&e or it could be equipment owned by candlestick. that's what we are investigating. >> reporter: there were some trust straighted fans left night who left and some players who said they didn't appreciate it. they made it made it hard to stay warm and focused. the 49ers did win the game so they can't complain too much. mayor lee has order add investigation. he and the fire chief will be briefing reporters this hour on what they know now. the 49ers who are tenants here

say this has got to get worked out in time for the playoffs game next month. they don't know what time that game is yet, even if it is an afternoon game they still need power for the scoreboard, concession stand, number of things. they say this has got to get figured out asap. amy hollyfield, abc7 news. pg&e now saying if you don't want a smart meter, you don't have to have one but opting out is going to cost you. the change of heart comes after two years of wrangling with customers. the new proposal comes with the a price some customers say it is a bad deal. >> does that make sense to you? >> no. >> why? >> rip-off either way. >> i'm paying for their technology upgrade. >> to opt-out you would pay a $90 upfront fee then $15 a month for a total of $270 a year. pg&e says the fees are necessary to pay for

maintaining the analog meters. 85,000 have signed up for an opt-out. the public utilities commission must sign off on the deal their decision is expected early next month. tonight the oakland city council will consider a resolution giving police the green height to use every legal tool they have to stop -- green light to use every legal tool they have to stop future -- waterfront operations lost between four and eight million dollars. during previous protests police were nonconfrontational allowing protesters to block the port entrances. city leaders say they've been flooded with complaints from hundreds who were prevented from earning a paycheck. another blow to americans hoping their paychecks won't shrink house republicans have just voted down president obama's plan to extend payroll tax cuts and

demanding immediate talks on their own plan. terry mcsweeney joins us from the newsroom. >> reporter: four minutes ago president obama addressed the situation saying the two month -- [ unintelligible ] a lot of things happened, 160 working americans will have smaller paychecks benefits end for two million who can't find work and 48 million seniors could be impacted by cuts to medicare all of these programs now are in limbo. house republicans have turned didn't a two month extension of the two month payroll tax cut extension saying they want the cut expended for a year. democrats say the blame lieses with members of the tea party who are not interested in any tax cut for the middle class. >> their focus has been on tax cuts for the wealthiest people in our country those wealthy people want a tax cut for the

middle class. >> reporter: the payroll tax cut means $1,000 per year for the average family. the senate approved the two month extension measure, 89-10 saturday. efforts to find a compromise that would have extended the cuts a year never materialized. now house republicans who initially opposed any extension of the payroll tax say any extension mut be for one year. they also say democrats are to blame for the stand off. >> today we will appoint a conference committee which since the dawn of the republic is how you work out differences between the house and senate. so far, leader pelosi, leader reid said they won't negotiate, our way or the highway. >> reporter: house republicans say they won't approve a payroll tax extension until senate leaders rework the bill. harry reid says he won't rework anything until the house approves the bill. senators have gone home for the holidays.

in just a few hours hanukkah against. today marks the first day of hanukkah or the jewish festival of lights this is video from last year's lighting of a 22 foot menorah in union square. tonight's lighting is at 5 p.m. hanukkah commemorates the rededication of the temple in jerusalem after syrians were chased out. it teaches a candelabra burned for eight days with only one day's worth of oil. we are just wondering what the weather is going to be like for the holiday season. >> you need to shop, hard to buy sweaters and heavy coats and gloves when it is in the 60s but that's what we'll have. snow shovels are probably not

-- monterey bay inland we cleared out for the most part low to mid 50s. we have dry air over top of us that combined with the sunshine makes for mild temperatures today also kind of cold overnight is what we will -- which is what we will have tonight. winter begins tomorrow 9:30 in the evening. best chance of rain is not until the 4th or 5th of next year. compared to average here are some of the temperatures this morning. notice how much colder we are on average. santa rosa started out 9° cooler than average when you make it to 66, 10° warmer most of us cooler than average because of the dry, still air in the nighttime warmer than average during the afternoon. upper 50s to low 60s in the east bay valley today, pretty much the same along the east bay shore. as we head into the south bay, low 60s for all your neighborhoods up the peninsula low 60s, 59 millbrae upper
