an east bay homeowner is poised and ready for deputies to arrive and evict him from a foreclosed home. good morning i'm cheryl jennings. >> and i'm kristen sze. the disabled community activist says the bank committed fraud and he's using an unusual legal tactic to stay in his home. >> terry mcsweeney joins us in oakland with the latest. >> reporter: 60-year-old leonard wilson has been living in this house across the street for the past 26 years. he does expect deputies to come out here and evict or at least try to evict him. now he's got an ally and h

thinks he can beat the mortgage companies and chalk up another win for david over goliath. >> i'm not nervous, i'm mad. >> reporter: that's what 60-year-old wilson told us as he anticipated the arrival of deputies. he has lived in this house 26 years. he says an increase in his monthly more -- mortgage payment from $2,000 to $3900 combined with identity theft has left him on the verge of homelessness. >> i don't have anybody left here that is helping me. the only person that helped me is tanya dennis. >> reporter: she does care because she was evicted from her home last year during foreclosure she fought back, repossessed her house and worked out a deal with wells fargo. >> if you have a friends sick audit that will be ready next week presented to the judge and show they have no standing to for close, sell or take this house.

>> reporter: wilson severely disabled after two severe neck injuries says has documents to prove fraud. a judge's ruling last week giving him a 19 day stay inadvertent didn'tly listed his -- they took off for court this morning. dennis has signed a lease on this property. >> the banks have a lot of low hanging fruit. people walk into the foreclosure night. when they have people that fight, they have a tendancy to want to deal with you to get you out of their hair so they can move on to the next person. >> reporter: mr. wilson says he has held a number of fundraisers out here over the years and has helped 50 young people go to college. maybe some of that karma is coming back to him in the person of dennis. right now in san francisco jury selection is underway in the trial of a suspected gang member charged with the murders of a father and his two sons.

they were diving to their home when they were killed -- diving to their home when they were killed in june of 2008. edwin ramos charged. investigators say he's a member of the violent ms-13 gang and an illegal immigrant who had been arrested for other crimes, he was never turned over to federal immigration authorities because he was a juvenile. prosecutors say ramos opened fire, killing all three men after he mistook them for gang members. ramos has pleaded not guilty. the case prompted the change its sanctuary law. officials now report undocumented juveniles to federal authorities for possible deportation. crews finished repairs this morning to a ruptured water main in berkeley near the california campus. the main burst in fulton street yesterday before 5 p.m.. the break caused water to rush through the streets causing damage to some businesses. mud crews were on scene until

2:00 this morning to make repairs, merchants are cleaning up the big mess today. the cause is under investigation. san francisco charter school damaged by a fire december 22nd, needs a lot of help before it can reopen. sky 7 shows you that huge fire. it burned four buildings, including the creative arts charter school. amy hollyfield joins us with more. >> reporter: they are inside now trying too create a makeshift cafeteria and recreate nine classrooms. they lost 50% of their space to fire. they just weren't ready to open up to kids today. ron buchanan says it may look like there's a lot of stuff here but the first grade teacher lost almost all of his teaching supplies in the fire that happened next door and spread to the creative arts charter school in san francisco. >> unfortunately, in the fire i was one of classrooms that was most affected. 12, 14 years worth of teacher

materials, lovely materials that were organized over the years just starting from scratch now. >> reporter: this isn't his original classroom this part of the building has been demolished as part of a renovation project. now that nine classrooms have been damaged by fire, construction crews spent the winter break rebuilding the rooms. >> they've not had a break since friday the 22nd. they've given up time with their families over the holiday to dedicate to the creative arts. >> reporter: school was supposed to open today the director decided to remain closed until tomorrow. >> i felt like we needed a kay to return to our found -- a day to return to our foundation. >> reporter: ron needed one more day to unpack and reorganize. he says he feels disappointed to have lost so many supplies. buy, he says his lesson plans will take on a new direction

100 firefighters to help put it out. investigators believe the fire started in what they call a lightwell in the back of a pathway between two wood frame homes that were badly damaged. a paramedic on her way to an emergency call is recovering after investigators say a car broadsided the ambulance. two people in the sedan were taken to the hospital for treatment. the accident happened about 8:00 this morning. investigators say the ambulance was heading east on geary boulevard with its sirens on when it was hit by a car traveling north on spruce street. teenaged hockey fan who suffered a concussion at a sharks game says all she wants an apology from the woman who she claims hit her. 16-year-old maggie was rooting for the canucks. she and her sister were harassed and she was hit in the back of the head by a fellow fan. the discovery bay resident underwent surgery four years ago because of a benign brain

tumor. police questioned the woman she says it was an accident. hp pavillion has offered maggie free tickets to future games. a limited number of tickets for the january 14th, game went on sale online at 10:00 this morning and sold out in minutes. the 49ers say some tickets could be available between now and game time. they are urging fans to periodically check ticket master.com for additional seats. a body is found near queen elizabeth's property. decision day in iowa. republicans get the first chance to decide who is moving on and who is going home. a look at the looming question as voters prepare for today's caucuses.

in britain the royal estate is a crime scene after a body was found. police say a dog walker discovered a woman's body on new year's day and they are treating this case as a mur. autopsy is being done today to determine the cause of death and the identity of the victim. the body was found miles from the royal family's country home of sandringham in eastern england where they celebrated new year's. today the first votes in the 2012 presidential election candidates hoping to unseat president obama are going into

the iowa caucuses with no clear front-runner and a large number of undecided voters. katie marzullo joins us with a break down of the race. >> reporter: the caucuses get underway at 5:00. the results could be dramatic even mitt romney the most consistently presumed front-runner says the race is hard to predict. with many so of the candidates unsure of their chances it is no wonder voters are undecided. >> it is hard to find somebody that stands out in that crowd. a lot of them seem to be similar. >> i don't think there is a good person or a contender somebody who can beat obama >> reporter: mitt romney sees it differently. criticism of his gop competitors and went straight for the president. >> this has been a failed presidency, i will go to work to get americans back to work and make sure job one is concentrating on jobs for americans not just keeping one's own job. >> reporter: santorum going from an after thought a few weeks ago to a front-runner.

whoa! take a look at this it is so cold in eastern china now, giant icicles formed over a waterfall. the region is experiencing subzero temperatures. despite the freezing temperatures, visitors are coming out to look at the spectacular icicles. >> we don't see snowy can be said for tahoe at night in the daytime they are hot. >> record highs the last two days may set another one today hard to keep that snow even though they can make it at night. look at how green and brown it is around heavenly also all of the lake tahoe area where it should be a little green and a lot of white. shouldn't be seeing any brown at all. i'm afraid that snow survey is

so much they saved my children's lives. >> we are so grateful for their ability to step up when the moment was in front of them. >> family's two kids and another child were all pulled to safety. if the men hadn't acted when they did it is highly unlikely anyone would have made it out of the river alive. this morning an animal control officer is being praised as a row avarice being his life to rescue a -- a terrified buck trapped in a tire swing. the entire rescue was recorded and posted on youtube by the santa cruz animal shelter. the buck panics and thrashes the officer tries to get him to hold still. after a battle of wills the animal calms long enough for him to delicately cut the rope and set the buck free. after that the buck took off, didn't stick around to chat or say thank you, but he's okay.
