closed captioning by closed captioning services,inc fire investigators in san jose are trying to find the cause of that raging fire that divorced dozens of elderly to take quick action to save their own lives. there are injuries and significant damage to the assisted living center. good morning i'm kristen sze, cheryl jennings is off. hear tales of bravery and comradery coming from the fire scene. >> reporter: there's been a lot of emotion as residents come to see the four units that were destroyed by this fire. everyone survived the fire.

a lot of people are saying that's because there were so many who pitched in to help. the apartment building full of sleeping elderly people was consumed with fire before firefighters could get here. it became obvious the community was going to have to help save the people inside. >> when i woke up there was screaming. i looked out my window and i could see it was engulfed the whole roof. >> reporter: billow% the maintenance supervisor -- bill lopez is the maintenance supervisor he was one of five men who held pulled the elderly from their burning homes. >> i beelined over there and picked her up and took her out. >> reporter: there was a lot of neighbors helping neighbors as the fire continued to rage around 2:00 this morning. >> it could have been much worse. >> reporter: firefighters say five were hurt but they wre relieved everyone survived. victims gathered in the

community room to soothe and help each other. >> we had several injured one suffered burns and had a medical complaint some others had minor injuries. >> reporter: this is an assisted living facility. residents still exercise some independence. one 96-year-old man demonstrated that after the fire. he went back in his destroyed home and a translator, red cross volunteer and even some firefighters couldn't convince him to come out. >> kind of stubborn, 96-year-old. i just tried my best to get him out from the room because i know the smell is very bad. >> reporter: the man wanted his passport, medication and his cash. his girlfriend finally persuaded him to come out. the fire department retrieved his belongings. residents say that's the kind of community they have here. they are tight and watch out for each other. >> we tend to help each other.

>> reporter: i just found out within the last few seconds, one of the victims is now considered in serious condition with third degree burns. the other four are going to be okay. firefighters at this point are still trying too figure out what caused the fire. amy hollyfield, abc7 news. also, in and jose a fire broke out in a vacant home on north fourth street in japantown. firefighters pulled out of the house when they realized the whole structure could collapse. it appears a homeless person might have been sleeping there but nobody was inside when the fire broke out. investigators haven't determined how the fire started. fremont police detained two after searching a neighborhood for suspects in the burglary of a home. a police dog helped officers look for the suspects in the irvington neighborhood. officers took two into custody a few minutes ago.

it remains unclear if police are still looking for additional suspects. the search started after at least two suspects escaped from a home that had been burglarized this morning. novato fire investigators at the scene of another suspicious fire the latest in a string of 20. this latest broke out overnight and was a grass fire off highway 37. fires that may be arsons have hit five locations since cat day. katie marzullo is live in novato. >> reporter: there is a police tip-line we'll have that in a moment. right now where we are you can see the fire truck behind us and beyond that is a trail and another fire truck and crews out at the scene of the fire. pretty unsettling sight to people who live out here and fear an arsonist is on the loose and targeting their town. >> this is a beautiful area and we enjoy our walk every morning.

for somebody to come out and start a fire is a little troublesome. >> reporter: donald jarvis has lived in the community for 33 years. early this morning he woke to the smell of smoke. >> i don't know why they would pick this area. >> reporter: crews are still investigating the scene of a grass fire that broke out 1:15 monday the most recent in a string of fires intentionally set in novato since saturday night. the first was close to condominiums. >> there is always risk to property and life. as far as what has been burned it has been limited to wild vegetation. there has been some scorching of a fence near one of the condominiums which obviously gives us concern, all because of the potential that a fire could spread. >> reporter: the majority of the dozen or so fires burned grass or small piles of debris. >> as far as motive or identity of suspects, we done >> reporter: the police department is counting on the

exploded destroying a townhouse in cupertino. nobody was hurt. assemblyman hill held a news conference this morning to discuss his legislation. >> utilities were gambling with the public safety. less money on safety inspections and pipe replacements, men more money for profits. this culture of profits over safety needs to change. >> one of today's bills would require state regulators and utility companies to implement 29n the wake of the san bruno disaster. another would establish a whistle-blower protection program for employees who disclose public safety concerns. and the third would require regulators to set gas rates based on safety record. in morning a civil trial underway pitting richmond's police chief against several of his officers. the city hired the chief five years ago from north dakota. within pwhupbs seven high ranking african-american

officers complained that he and his former top deputy discriminated against him and told racist jokes. the chief says the incidents in question are taken out of context and some of them are simply made up. the city has already spent three million dollars defending against the suit. san francisco's new sheriff ross mirkarimi started his new job today as a domestic violence investigation looms over him. he and his wife addressed the accusations yesterday after we was sworn in as the city's 35th sheriff. court documents say mirkarimi's neighbor ivory madison called police to report a new year's eve incident in which mirkarimi grabbed his wife's arm during an argument and bruised it. madison says she took pictures of the bruise. >> a private matter, a family matter that this is -- >> completely taken out of context. and this is completely wrong. >> san francisco attorney
