>> announcer: breaking news. breaking news is in san jose. drivers are being warned to avoid police roadblocks around blossom hill avenue annika man drive where officers believe -- a home invasion robber and carjack holed up. i'm eric thomas in for cheryl jennings. and i'm kristen sze. david louie is live at the police command center. >> reporter: as you can see behind me the san jose police have an inter section barricaded blossom avenue at blossom hill road. behind the police cars the s.w.a.t. team believe they are keeping an eye on a house where a suspect may be inside. someone who they are definitely trying to capture.

neighbors tell us the house is vacant not visible from our advantage point. the suspect is thought to be involved in a carjacking and possible robberies in the south san jose neighborhood. there's an elementary school inside the roped off area, earl frost. students have been instructed to stay in classrooms. the elementary is part of the oak grove school district it has classes from kindergarten through 7th grade. we spoke to a resident who lives a few houses down from where the suspect may be hiding. >> this is normally very quiet. within the last month we've had the bank robbery, now this >> reporter: what is your concern now? >> i just want to be able to get home. make sure everything is okay at the house. >> reporter: make sure your kids are okay? >> right i have one coming home from college nor -- for lunch. >> reporter: we did hear a short blast across the street

written messages mark the location of a murder-suicide. >> shocking when i heard the news. >> reporter: police say 27-year-old abel gutierrez shot and killed his 11-year-old sister then himself. there's evidence that their mother may have been hurt or killed she has been missing since the bodies were found wednesday night. >> it is sad. who knows she could be wounded somewhere dead. >> reporter: this morning abel's car a 2000 green ford mustang with a washington license plate found at the crime scene could be a clue a >> during a search of the vehicle we've determined the following: there was a firearm that was discharged inside the car. we found evidence to suggest that there was somebody who was a victim of a shooting. and that there was a violent altercation that occurred. >> reporter: police found martha's cell phone in the car. >> we are asking for people's help to identify here abel

gutierrez was prior to this tragedy >> reporter: it is believed abel an iraq war vet was suffering from post-traumatic stress disorder. martha called police as recently as last month. officers were trying to get help for the family. we have other new information from the national guard. we understand that abel gutierrez joined the washington national guard after being discharred from the army in 2008 and he he was currently in the process of joining the california national guard. of course if you have any information about this crime or martha gutierrez's whereabouts you are asked to call the gilroy police department. this morning afghanistan's president is angrily accusing u.s. of not sharing enough information about how an american soldier allegedly shot and killed 16 after agains in two villages. hamid karzai's comments come after reports the shooter may have been suffering from post-traumatic stress.

his attorney says his client witnessed a friend's leg being blown off less than 24 hours before the shootings. karzai says relatives of the victims are convinced there was more than one shooter. >> in his family, in four rooms children and women were killed and then they were all brought together in one room and then put on fire. that one man cannot do. >> today president obama call the afghan leader to discuss karzai's call for nato troops to withdraw from rural villages. both agree to talk further about the demand. now an oakland judge is holding hearing to decide whether to release a report on a police pepper spraying incident at uc davis. the judge released a tentive ruling saying he was leaning toward releasing the report. the police union argued releasing it and the names of the officers would violate state law. campus police sprayed peaceful protesters in the face with pepper spray last november

when firefighters started to hear ammunition they were forced to back off. the fire was snuffed out before 7:00 this morning. no one was injured. an elderly man was displaced. investigators are look into what started the fire and what kind of ammunition was in the home. a rutgers university student has been found guilty of hate crime and intimidation charges after he bullied his gay roommate into committing suicide. a jury convicted him on invasion of privacy. in september of 2010 ravi used a webcam to spy on his roommate during an intimate incounter with another gay man. ravi then shared the video and began bullying his roommate about the encounter. sraf very faces up to 10 years and could be -- deported to his native india. actor george clooney and his father were among several arrested this morning during a

update. in the santa cruz mountains fatal head-on collision has shutdown the freeway in both directions. chp said t this involved a big rig they now say it is two cars. highway 92 has been shutdown between half moon bay and 280 after an accident involving a garbage truck and big rig no fatalities there. we'll update both on
