closed captioning by closed captioning services,inc the sentence has been decided for sheriff ross near mere. good morning i'm cheryl jennings. and i'm kristen sze. we are finding out now about mirkarimi's official punishment after he pleaded guilty to false imprisonment of his wife. >> sergio joins us with the word. >> reporter: in the last few seconds we've heard word that the sentence has been made official. mirkarimi did plead to a lesser charge of false imprisonment of his wife. that is a misdemeanor charge. this was an agreement that was made last monday today is the formal sentencing hearing. here are the terms that we

know had been hammered out, according to that formal deal that was hammered out monday. three years probation. 100 hours of community service. 52 hours of domestic violence classes. family counseling and the stay away order that is currently in effect will stay in effect, at least until he completes the last two components of this sentence. we are expecting to have a statement from the sheriff shortly after this hearing. we've been told going to be making a few statements following the hearing. we also know that the district attorney george gascon who raised concerns about the sincerity of this hearing, he is also expected to be making a statement following this hearing. however, the person who is not supposed to be speaking or we haven't heard that he is going to be speaking is mayor ed lee. we know he cancelled a morning public appearance.

there is nothing on his public calendar later today. of course, the mayor has been under some pressure by domestic violence groups, they have been asking him to suspend the sheriff and to start ethics -- an ethics hearing to possibly have him removed. again, the mayor has not -- not making himself available today. we do not that again, the sheriff is expected to make a statement. he has repeatedly said that he does not plan on resigning following this plea agreement. we are hoping to hear some of those details very shortly. reporting live at the hall of justice in san francisco, i'm sergio quintana, abc7 news. a lot of new legal questions out of this our lega analyst dean johnson is here to answer some of them. thank you for coming in. you >> you heard the sentence what is your reaction? >> thing i've been saying all along it is surprising how standard this is.

this is the kind of sentence that you would expect in this kind of case. i don't mirkarimi got any special treatment one way or the other. >> critics say they want mayor lee to remove him through official misconduct. could that qualify under official misconduct or is that personal business? >> that's the big question. an official can be removed for official misconduct. but the question is, does official misconduct mean just things that are related to the conduct of the office itself? back in 1995, the san francisco voters passed prop e, which expanded the definition of official misconduct. the courts have to interpret that definition. >> the top cop in the city who has been convicted of something and now an has sentencing. what kind of legal dilemma, ethical dilemma does it pose for city leaders. >> it is tremendous dilemma for mirkarimi. as top cop he has to set

policy, among other things domestic violence arrests, prosecution, how officers will respond when they come out to a call of domestic violence. this puts him in a very difficult position. in some i was undermines the credibility -- in some ways undermines the credibility of the office. >> thank you dean. >> my pleasure. hayward fire investigators will try to determine the exact cause of a fire that damaged this home on chandler road shortly after 9:00 this morning. reports say it may have started as a vehicle fire in a garage. sky 7 was overhead as firefighters knocked that fire down. we don't have any word on injuries. santa clara county sheriff's investigators are visiting a high school now hoping for clues in the case of a missing teenager. the 15-year-old was last seen friday morning on her way to so brat toe high in morgan -- sobrato highway high in morgan

locations where treated sue age is still moog t'g-/ñ as the -- sewage is spilling into the boy as a result of recent storms. the spill 90% storm water and 10% sewage. epa officials say the sewage is highly diluted and does not pose much of a health threat. firefighters on the scene of a water main break in menlo park. crews shut off the damaged pipe before 6:00 a.m. that spilled water on the streets nearly three hours. officers say it could take up to two days to clear. no injuries or reports of damage to homes no word on the cause of the leak. in santa cruz a sand berm continues to prevent the river from running into boardwalk. the berm was built last week most of the rides were close because of weather concerns. park officials opened more rides yesterday and expect to open more next weekend.

part of san francisco's great highway remains closed high winds blew a lot of sand on to the road that closed officials to close a two mile segment. public works crews are expected to sweep the sand away the lawyer for the army staff sergeant accused of murdering 16 afghan civilians met with his client for the first time today. he says the more than three hour meeting with robert bales was emotional. bales is being held in semisolitary confinement at the maximum prison in kansas, charges could be filed as early as today. karen travers reports. >> reporter: staff sergeant robert bales' attorneys arrived in kansas last night for their first face-to-face visit. >> political ramifications, legal ramifications, social ramifications. you couldn't imagine a bigger case. >> reporter: over the weekend bales' neighbors, friends and

promotion last year. last night bales' attorney said anybody deployed to the mideast multiple times will have some form of stress disorder. the public state's utilities commission is meeting to consider pg&e's proposal to make all customers pay the majority of cost to improve the pipelines. the 2010 explosion in san bruno deficiencies in the system. eight people were killed, more than 30 homes destroyed. the utility now wants to charge customers nearly five billion dollars over the 50 years for upgrades. pg&e says when it came out of bankruptcy a decade ago state agreed it could recoup more than the cost of its investments from customers. critics say customers not be paying for the utility's failures. apple makes a decision on what to do with anotherly 100 billion dollars in cash

a lifeguard saved three people along the sonoma county coast. the lifeguard spent 45 minutes in the chilly ocean with them after they got pulled out by a big wave.
