closed captioning by closed captioning services,inc right now a messy cleanup after an overnight storm caused raw sewage to overflow. we go live to amy hollyfield in jut a minute. good morning i'm cheryl jennings. -- i'm eric thomas in for kristen sze. that fast moving storm passed through the bay area this morning. this is san jose a bit ago combination of rain and speed caused several accidents, including this overturn car on highway 101 san jose near 13th street. >> let's check in with lisa argen for the lates -- latest on the storm. >> >> it was just a matter of two hours how quickly it came down. getting in a little closer, you will notice highway 4 the wet weather willow pass road east of concord if you are

heading to the pittsburg area, west 4th street will be a little wet there. offshore along the north coast reports of thunderstorms these will continue to rotate slowly to the south and east. certainly not out of the question later today to see showers or a thunderstorm by the afternoon. within that three hour time period i've added on yesterday's totals almost 8/10 in santa rosa, half inch in san francisco, over a third in san jose, more to come. the storm caused a sewage overflow san francisco. amy hollyfield with that story. >> reporter: we are inside a leather warehouse. the owner estimates that he has filled up that call cleaner, about 50 times, trying to pump the water out of here this morning. the city has sent a cleanup company to help. there's a lot to do. water invaded several

buildings here. standing water in a restaurant kitchen is not only damaging, in this case disgutting. >> it is rainwater mixed with sewage. my restaurant smells like a toilet. that's exactly how it smelled three years ago in 2009. >> reporter: yes, this happened before. when thomas lackey woke up this morning and took this cell phone video of sewage water flooding homes and businesses it looked like what he saw in 2009 this is video from the last time it happened when a surge of water came blasting out of sewers. it also happened in 2007. he took one look this morning and knew. >> i was beaten, i guess, felt beaten. because i know what this is going to be mean. it is explosive to be closed. >> disgusting to though that i'm stepping on poop. >> reporter: a day she says half of her car was covered

with sewage water. her father is the building manager and is in the hospital. she says he has cleaned this up before and is frustrated to hear the build something flooded again. >> it is going to continue happening until the right person makes a big stink about it. >> reporter: city officials tell us they are frustrate food. crews tried to fix the problem in 2009. now it looks like they are back to where they started. >> we were hoping it was fixed. that's where it is. >> reporter: here's the mess at the leather warehouse. the cafe across the street trying to get things cleaned up. it knows it is not going to be open for a while. the city has a long list it wants to look into including putting a camera in the sewer line. this is the lowest point in the city with a lot of hills. when there's rainú#+rb all at e that water comes from twin peaks to here. amy hollyfield, abc7 news.

less than half an hour from now senator feinstein will announce a new partnership to build levees that will protect homes and businesses in the south bay. they hope to raise a billion and a half dollars over the next decade the current levees are 100-years-old. the money is going to be used to build new levees and restore wetlands where much of the property is vulnerable to flooding. officials say some of the property is 13 feet below sea level behind those levees. right now ground is being broken for the three billion dollar bart to san jose project. terry mcsweeney is live at santa clara at a pregroundbreaking party. you in santa clara, why? >> reporter: bart's silicon valley group, if they have their way, santa clara is where bart is going to be going next this is the big lunch on here honoring senator

feinstein. all of those people who detail together to make the dream of bart in san jose a reality. a bart train sits at mayberry road and east taylor street in the berryessa neighborhood of san jose. it is a signal things are changing. >> it will be a significant help to the highly conjested i-80 and i-680 commute core -. this will take cars off of those major corridors for the north-south commute. bringing commuters from santa clara county into oakland and san francisco. it will be a transit alternative that will connect with lots of other transit systems many >> reporter: this animation shows what the station is supposed to look like when phase one of the project is completed in 2017 or so. this 2.3 billion dollar barry esa extension is a 10 mile

project that will begin in fremont through milpitas and ends here santa clara county residents twice voted to raise billions to help pay for this project. the locals appreciate bart in san jose for a variety of reasons. >> great. >> reporter: why? >> for people that commute to go from one place to another, yeah, it is great. >> great because it is work, work coming here. >> reporter: that means jobs for you? >> i need one. >> it could save on gas money for most of us who like to go from san jose to an a's game you don't have to drive all the way to fremont. >> reporter: how do you celebrate when you brought bart to san jose? you have fillet mignon and salmon i don't know what they will do when they figure out how to get bart to santa clara. that project is going to be possibly finished by 2025. the barry esa station should

be carrying 20 ,000 passengers a year they are -- 23,000 passengers a year they say bay 2017. developing news in florida, moments ago george zimmerman appeared in court to face second degree murder charges in the death of an unarmed teen. katie marzullo is here with the story it >> reporter: let's take a look at video this just in. you see a much slimmer george zimmerman, a judge didn't recognize him. that judge set a date for a formal arraignment, may 29th. the whole thing lasted only a few minutes. both sides are reacting to zimmerman's arrest. florida civil rights leaders are asking authorities for big picture changes. >> we need to revisit the stand your gunned law. >> reporter: religious leaders and attorneys want the killing of trayvon martin to force florida legislators to take another look at the stand your ground law. it says you don't have to try and retreat before using force to defend yourself as long as there's a reasonable belief

being threatened. >> we want to make sure we point out since this law was passed the justifiable homicide claims were tripled in the state of florida. >> reporter: they take issue with gun licensing laws and zimmerman's concealed gun permit. >> somebody who just murdered a young man still had his gun on him and nobody knew where he was. >> reporter: as of last night everyone knew where zimmerman was in a jail cell, facing second murder charge for the shooting death of trayvon martin who was unarmed. >> we have a sense of peace now. we know that the person that shot and killed our son will be held accountable for it. we can't really say what the outcome will be, but we have committed to this journey >> reporter: zimmerman, the neighborhood watch captain said it was an act of self-defense. he has since received death threats. his brother says at least he's safe in jail.

zimmerman's attorney is worried about his client's health. >> he's stressed. he's tired. he's been through a lot with the way this case has been handled to date. i'm just hoping that his mental health stays well and we can move forward with getting the case figured out with >> zimmerman's attorney says his client will plead not guilty at that arraignment, set for may 29thth. developing news within the hour -- here in california supreme court ruled your employer must provide lunch and rest breaks but not responsible for making you take them. the ruling in a lawsuit filed by a group of restaurant employees who argued they skip breaks rather than leave colleagues short-handed and that amounts to working for free. the company argued that whether or not to take a break is the worker's decision. she is being called are argentina's miracle baby. newborn left for dead at the morgue. amazing discovery by her

day in her life. >> ann romney fired back on twitter saying i made a choice to stay home and raise five boys, believe me it was hard work. rosen replied that most young american women have a job and raise kids. >> this is not about ann romney. this is about the waitress in a diner some place in nevada who has two kids whose daycare funding is being cut off because of the romney-ryan budget and she doesn't know what to do. >> even some democrats are calling rosen's remarks inappropriate and offensive >> amazing story out of argentina. newborn found alive in a hospital morgue hours after doctors declared her dead. cecilia vega has the story. >> reporter: with the power of a mother's intuition that drove this woman to insist on seeing her stillborn daughter one last time. the hospital staff told these young parents their baby, born three months premature, showed no signs of life.

from the delivery room shermantine any body was sent to a refrigerated hospital morgue that's where she the next 12 hours until her parents came to say good-bye. we looked for a crowbar to open the box. i started to pry it open and took a deep breath my wife went to look at the body first then she uncovered the hand and the face and then there was the first whimper. the mother, thought she was hallucinating. then, the maybe girl moved. the hospital had already issued a death certificate, saying the baby died of unknown causes. it turns out her time in that refrigerated morgue may have helped her cling to life. >> the temperatures lowering so quickly acted to protect the baby because the brain doesn't need as much oxygen. >> reporter: hospital staffers say the baby girl weighs 2 1/2 pounds but her strength is remarkable. she reportedly needed no resuscitation after her
