continue to search for her daughter even though police arrested a suspect for sierra's murder. abc7 news spoke to his family. good morning i'm kristen sze. and i'm cheryl jennings the search for sierra, according to investigators is now a search for her body. right now sky 7 hd is over the reservoir in santa clara county divers are out in their boat patrolling the area right now presumably some have gone into the water. sierra disappeared march 16th, on her way to school. there have been many searches for sierra the reservoir where they are searching now is eight miles south of sierra's home in morgan hill. >> amy hollyfield talked with the suspect's family. let's begin with terry mcsweeney live with the investigators in san jose. >> reporter: no doubt here at the sheriff's office you will hear a lot of people saying there's no doubt about it, they have the man who did it, 21-year-old antolin

garcia-torres, he kidnapped and murdered 15-year-old sierra lamar the sheriff laid out her case a short time ago followed bye8b sierra's mother that her daughter cannot be dead. 21-year-old antolin garcia-torres sit in jail charged with kidnapping and lamar chosen at random says the sheriff. >> there's no information that we have of any type that the two know each other have had any contact. we believe this is the worse kind of a -- the worst kind of a crime. >> reporter: dna from sierra's clothing found days after her kidnapping came back on march 28th. >> also her property in the bag foundaan dna from antolin garcia-torres. >> reporter: his name was in a law enforcement data bank because he had been convicted of interfering with an officer and had been charged but never

tried for melanie assault. he owned this red jetta with a black hood he was placed under surveillance, investigators hoping he would lead them to the body of sierra lamar. april 7th they seized the car which yielded physical evidence of sierra's presence. investigators are she dead. >> the discovery of sierra's cell phone, her clothing, what she wore that day, and her personal belongings have contributed to our that -- to our belief that she is the victim of murder. >> reporter: her mother thanked all who searched for her daughter and says she still does not believe her daughter is dead. >> please give the information, if you have that you have to lead us to sierra to help end this nightmare. i believe there's a reason why she wasn't found. we are not giving up on that. >> reporter: the search is on

for sierra lamar's body. it is not needed for a conviction but it is needed foreclosure for the family. so far the suspect is not helping. -- he is just charged not convicted of anything. he's also been tied to at least one of three assaults that happened near morgan hill in 2009, all of them against women. terry mcsweeney, abc7 news. abc7 news reporter amy hollyfield is live in morgan hill where she spoke with the suspect's family. they are defending him? >> reporter: yeah, they say police have the wrong man. police arrested him at this safeway with guns drawn last night took him into custody without problems. the family says he couldn't have done it. they heard about his arrest by watching the news last night and his family is devastated. >> it is a shocker to all of us. he of course did not do it. i know everybody says that. i know everybody says that. but i know him. i know he didn't do it.

he's not capable of that. there's no motive. >> reporter: she says the sheriff's case against her brother doesn't add up. she says he is not a violent person and he didn't know sierra lamar. >> he's sweet, he's not -- i mean he has a baby on the way. he has a 1 1/2-year-old they are very happy. there's no motive for him to be doing any of this. i don't know, it is a mistake i feel. >> reporter: the sheriff says the case against antolin garcia-torres is strong and investigators believe he acted alone. >> we seized the suspect's vehicle on april 7th. at the time we did search warrants we had physical evidence linking sierra to his vehicle. >> reporter: the suspect's sister and brother in law listened to the sheriff's morning press conference but dispute her claims.

>> they don't have physical evidence. there's no physical evidence at all. >> they had her dna in the car. >> not in the car actually. >> reporter: garcia believes investigators zeroed in on her brother because his car was spotted in sierra's neighborhood. she says her whole family knew he was unsurveillance and her brother has cooperated. she says a guilty man would have acted ly. >> you would think he would -- i don't know, go away or try to runway or something. he's done nothing been nothing but compliant he's given them two dna swabs. >> reporter: the family also doesn't believe that garcia-torres committed previous assaults. the sheriff said there were three assaults against him in morgan hill three years ago. one happened in this safeway parking lot where the suspect once worked and where he was arrested this one involved a stun gun. the sheriff believes he's attached to one of those assaults but didn't say which

one. amy hollyfield, abc7 news. many of sierra lamar's neighbors spent weeks hoping for her safe return now they are feeling loss and frustration after learning investigators believe she was murdered. some have tied pink ribbons to their mail bob'ses as a sign they are not giving up -- mailboxes as a sign they are not giving up on finding her alive >> i feel this killed this area. this terrible news. >> it is really sad. we prayed for her all these days she has been missing. so it is really -- that it is almost coming to an 's the good part if we find her that would be the best part. >> wow. legal analyst dean johnson is here with some analysis. you hear the charges and the family of the suspect and the family of the victim, we don't know if sierra is alive, investigators say she is not.

>> sheriff was pretty emphatic she is certain based on whatever evidence she has seen that sierra, unfortunately, is no longer alive. the real question is, we haven't found a body. can we prosecute a case without a body? the answer is yes, we've been doing that for 30 years even in the 80s there were cases that were prosecuted, the only connection between victim and defendant was a few specks of blood in a vehicle. we've had 30 years of scientific advance since. >> a lot of dna in this case. >> -- apparently. connections to the backpack clothing, vehicle if true it is going to be easy to connect see rather to the suspect. >> what do you think investigators are -- are doing behind the scenes now. >> i've been there. this is a critical time in a homicide investigation because the suspect is still talking to the police. those police want an answer to one question, where is sierra
