>> announcer: right now breaking news. happening now in san jose, a fatal accident a big rig has crashed on to a car northbound i-680 be neat the mckey road overpass, you are looking at live pictures. the chp has shutdown one northbound lane in east san jose to deal with the crash as well as the connector ramps to mckey road. here's another live look it is going toe take some time to clear the scene since this is a fatal crash no word on what caused it. we'll bring you more information as we get it. good morning i'm eric thomas in for cheryl jennings. and i'm kristen sze. president obama has just left the bay area he took off 40 minutes ago, more on his departure in a moment. first, terry mcsweeney is live in san jose where the president hosted an expensive breakfast before he left. >> reporter: yes he did right

terry mcsweeney, abc7 news. there was no gallery waiting for the president typical for a departure he quickly climbed the steps and air force one took off 45 minutes ago heading for iowa where the president has a few appearances supporting alternative energy ventures. the man jailed for the murder of sierra lamar is due in court in two hours. 21-year-old antolin garcia-torres is set to be formally charged with murder and kidnapping. investigators found his dna on clothes lamar had in her backpack. her body has not been found. volunteer searchers continue to look for lamar holding out hope they will find her alive. new york city police have a man in custody in the cold case kidnapping of 6-year-old etan patz. the first missing child whose picture appeared on a milk carton. a man owned a convenience

store in the neighborhood where boy disappeared in 1979 has confessed to kidnapping and killing the child. the golden gate bridge turns 75 with a big party this weekend. temporary closures will cause traffic problems sunday. katie marzullo is live near the bridge with the latest details. >> reporter: see this beautiful spot at fort point. do not drive here sunday. don't drive anywhere near here sunday the event celebrating the 75th anniversary of the golden gate bridge are from 11 a.m. to 11 p.m. sunday. mark my words, there is no parking, no parking at the marina green, not at the presidio, not at fort point you want to move your cars out of any of those parking lots no later midnight saturday into sunday. set-up is underway on the marina green, tents and stages and a lot of port-a-potties.

update on our breaking news. a big rig has fallen on and crushed a car off northbound 680 at mckey road. you see the the picture from sky 7 hd live overhead and abc7 news reporter david louie is on the ground. what can you tell us about how this happened? >> reporter: that in a second. let's set the scene. mckey road overpass you can look straight down and see where a toyota camry on the passenger side the big rig overturned as the big rig and the vehicle were both on the access road to 680 northbound

this is the first time we are seeing the driver's side door open. there's a fatality involved on the passenger's side the driver is supposedly okay. the big rig was taking the transition route, the on-ramp from eastbound mckey on to northbound 680 it has broccoli inside. let's talk to the public information officer. tell us first of all do you have any idea how this happened? >> right now our preliminary investigation finds the big rig driving eastbound mckey to northbound 680 was traveling too fast to negotiate the curve and that caused it to crash into the -- caused the rollover on to the camry. >> reporter: there's one fatality what about the driver of the car and big rig? >> driver of the camry now at the hospital with minor complaint of pain to injuries as well as the big rig driver. they also have minor complaint of pain and injuries. >> reporter: as we pan back to

that in her hometown of caracas, venezuela saturday she told me leaving san francisco and the spotlight of the domestic violce scandal was like having a huge weight lifted off her shoulders. a lot of people think you are not coming back. >> i think san francisco has not been nice with me >> reporter: eliana struggled as a new mother, workaholic husband san francisco supervisor ross mirkarimi who became sheriff this year. she longed for her hometown and the security of her family. the tensions bubbled over new year's eve. ross cut short a drive to get pizza, because of an argument. >> i grabbed her arm. i caused a bruise. i will always regret that. and always will be sorry for that >> moment i said stop, he immediately apologized and he realized that was wrong. and then i said we were talking and i said we need therapy, we need help. >> reporter: before the couple

could go for counseling the scandal exploded. eliana says her big mistake was trusting her neighbor, ivory madison, with the story. whose idea was it to make the video? >> her idea. >> reporter: it was her idea? >> yes. >> reporter: through an attorney madison said eliana never asked for it to remain confidential. madison call police and turned over the video showing a bruise to eliana's arm in response to a search warrant. >> the police asked are you afraid? of course no, i'm here making lunch for theo. i'm not afraid of anything. actually, if i want to go, i can go. if i want to call the police, i will call the police. >> reporter: still prosecutors charged mirkarimi with domestic violence battery. he pled down to misdemeanor false imprisonment. then mayor lee suspended the sheriff without pay, and asked the ethics commission to fire him. mirkarimi is preparing his defense. >> with that conviction, for a

low level misdemeanor, that does not at all inhibit me from being i think, effective sheriff. >> reporter: ross and eliana are also dealing with the remnant of the criminal case the judge imposed a restraining order that neither of them wanted. >> is it painful? yes. but i want them to be happy. >> reporter: eliana and their 3-year-old son theo are in caracas but he misses ross badly and cries for him often. >> last night he says one day i'm going to open the door and daddy is going to be there. >> reporter: when the scandal first broke and the judge had not yet allowed visitation for ross and little theo his mom says the boy broke out in a rash. >> i run to the hospital and i called the doctor and they told me this is allergy and this is an emotional thing for him. >> reporter: he an emotional

thing? >> this is emotional. >> reporter: because of the separation? >> i think so. that is why i to the family court to ask -- why i to the family court to ask theo needs to see his dad. >> reporter: now theo has daily visits from his dad by skype. >> daddy. >> reporter: >> it is my lifeline. i regulate my whole day in anticipation of having that contact with our son, with theo. >> reporter: the family is bracing for the next blow. mayor lee is pressing the d.a. to release the bruise video to the ethics commission and the public. eliana can't imagine it being on the internet. >> it is really right to release the video? don't think of my son or my career, my life?

in developing news a fire aboard a nuclear attack submarine in maine is finally out. the uss miami burst into flames late wednesday afternoon the navy says the weapons had been taken off while i was being overhauled the nuclear reactor is

shutdown and the navy says it was never in danger. the fire started in the forward section from unknown causes seven were hospitalized, including five firefighters suffering from heat exhaustion. the damage to the sub is being called major. uss iowa departs for new home in southern california this weekend the world war ii battleship has been docked in richmond where it was restored and converted into a floating museum. it is scheduled to leave saturday morning. the battleship should pass under the golden gate bridge between 2:00 and 3:00 it was supposed to head out to the port of los angeles last weekend but rough seas delayed the trip. the seas won't be rough today, right? >> a little choppy because of the winds, there's no warnings or anything hopefully once they get out there they can start riding that wind down there. let's look outside and show what is going on. good morning. 11:21. san jose, lots of sun, trees moving a little as you see.
