closed captioning by closed captioning services,inc good morning i'm eric thomas. in for cheryl jennings. and i'm kristen sze. more fallout expected today a senior prank has resulted in massive suspensions and controversy. katie marzullo is live at heritage high. >> reporter: as of yesterday, 50 students had been suspended. parents an attorney for some of the families tell us they expect more today because the school has identified more students who were involved through photographs. it is the last day of school at heritage high in brentwood

and last chance for some seniors to take finals. >> this morning i called to find out what the story is, because i heard yesterday afternoon that some of the kids that were suspended yesterday did get to come today and take their finals. she was told she could not come, absolutely could not come. >> reporter: this mom was able to get her daughter on to campus today but she isn't sure if the tests will count toward her grade. she admits her daughter participated in the senior prank. but she says the principal's decision to suspend the kids and ban them from commencement is overkill. >> i can appreciate that that he wants to stop anything for the future. other than that, i -- it doesn't make sense. >> reporter: at least a dozen families have hired an attorney to force the school to let them take their finals. this mom is not one.

>> we have going to try and make the best of it and go on. a life lesson learned. >> reporter: the principal will address this issue with the media later this afternoon. laura anthony will have more on abc7 news starting at 4:00. katie marzullo, abc7 news. new developments in the case involving missing morgan hill teenager sierra lamar. the attorney shown here at a previous court hearing with murder suspect antolin garcia-torres filed a motion today to be removed from the case. garcia was not in court when the motion was filed. specifics have not been revealed. a new attorney is now assigned. a plea hearing scheduled for early next month will take place july 31st. garcia-torres is accused of kidnapping and killing 15-year-old sierra lamar. despite searches she has not been found.

>> east palo alto police urging witnesses to come forward to help them catch a killer. a man was shot to death overnight in the 2400 block of gloria way. police did get help. >> reporter: the city's shot spotter system gave police a head start on the case but it want enough. police say they need help. they should be able to get some. plenty of people heard what happened it is questionable how many saw it. he heard the shots last night. so did this 5-year-old. her mother is scared to live here. >> it is shocking. i grew up around here the neighborhood has changed over 30 years. i feel unsafe. >> reporter: police heard about the shooting before they got a 911 call. the shot spotter system detected nine shots fired

11:45 last night. >> i want to say that we were here within about a minute and a half. and all we found was a deceased 31-year-old male. >> reporter: the killer was again. police have no leads. kimberly said she saw something suspicious last night an suv she didn't recognize parked at her relative's home. >> we are baffled whose car this was in the back of her yard driving didn't the street with no lights on. >> reporter: these are the kinds of tips police are hoping people will call in >> people are scared because they have to live here. what i want them to know is they have nothing to fear. we can't do this job alone. we need their help. >> reporter: east palo alto police say they don't normally consider this neighborhood to be a dangerous one. some who live here say the sound of gunfire is part of their lives. >> around here it is common.

it is like fireworks, we hear it all the time. >> reporter: the victim is identified as 31-year-old cedric tippinj -- tippns, jr.. officers do now him but do not know the motive behind the shooting. -- new details with the suspect shot by oakland police officer last night near 105 and e street. the man pulled a gun that's why the officer opened fire. the 22-year-old suspect was on probation already for a gun charge. he's in the hospital and is expected to recover. police say officers got information the suspect was driving in oakland and armed. police recovered a gun at the scene and they are questioning another person this is the sixth suspect shot by bay area police in the past four weeks. in los angeles president obama is attending a fundraising breakfast now for 300 people.

he's wrapping up a two-day west coast trip he started in san francisco yesterday. he was in they for three hours for two fundraisers raising five million dollars. he plans to speak in las vegas later today. his campaign says mr. obama and the democrats raised 60 million dollars last month. mitt romney the likely ran opponent and the republican party say together they've raised more than 76 million dollars in may. romney will be holding a campaign event today in st. louis. meetings taking place in washington today into leaks over classified intelligence. a bipartisan group of congressional leaders met moments ago with national intelligence director james clapper. the meeting amid outrage over last week's "new york times" report that provided classified details what it described as a u.s. cyber attack targeting iran's centrifuge program.

senator mccain claims the white house is leaking the information forever political gain. >> regardless of how politically useful these leaks may have been to the president, they have to stop. >> i don't believe any of this came directly out of the top ranks of the white house. i think one of the problems is, information is not closely held sufficiently. >> the white house denies responsibility for the leaks and says any suggestion it is behind them is grossly irresponsible. the fbi is investigating and the congressional intelligence group will meet with the fbi director this afternoon. defense secretary panetta is on a surprise visit to afghanistan today. he arrived in kabul this morning. he's pressuring pakistan to do more to loot out al-qaeda linked haqqani terrorist network saying the u.s. is reaching its limit of patience. the terror network has been blamed for several attacks on americans in afghanistan.

lawsuits from former players the nfl now faces one class action suit by athletes who claim they were misled about the risks of repeated concussions. >> reporter: hard knocks are major part of the nfl bone crushing plays like this dominate highlights and helped make it the most popular sport. today the nfl is taking a. more than 2,000 former -- former players are suing the leak. the players claim the nfl misled them for decades about the risks of brain injury. >> there's no focus on the most important part of your body, which is your brain. >> reporter: kevin turner played fullback for the eagles and can remember two documented concussions. he believes he suffered long term brain damage and is one of the former players filing suit. >> this action is about the retired players getting the

transportation secretary ray lahood is stepping up efforts to fight distracted diving he calls the problem a national he did department -- driving he call the problem a nation allege epidemic. the transportation department estimates distracted driving accounted for more than 3,000 deaths in 2010, 10% of the roadway fatalities. >> the reason i use the word epidemic is we think we can
