seat has been growing in popularity. in homes and online where parents post youtube videos of kids tumbling out of molded foam chairs. but, it is not always so cute. >> i couldn't believe. >> reporter: four years ago kevin told 7 on your side his son fell out of the seat sitting on a table the child cracked his head in two places and almost died on the way to the hospital. >> when we got there he had no pulse. >> after our investigation aired the south african company that makes the chairs agreed to a voluntary recall adding warning stickers not to place the chairs on elevated surfaces. since then the consumer product safety commission says there have been at least 84 incidents of babies falling out of the seats on high and low surfaces and 21 skull fractures.

now another four million seas are being recalled so parents can install restraining belts. once again the company is reminding parents not to put babies in the seas on countertops and make sure all use is supervised. they released this statement this morning, the belt will help prevent children from getting out of or falling from the seat when used as intended on the floor with adult supervision, never on raised surfaces. the health and safety of children are our top priorities. we are committed to ensuring the safety of all children who use the seat. we are going to continue our investigation tonight. one of the things we are looking into is, is that enough? the restraints, the recall what they plan to do. also you should stop using it right now, put the restraints in before you use it again. we'll have all the information later today.

drivers on i-80 in san pablo this morning had a tougher commute after a big rig hauling a crane smashed concrete junks out of a pedestrian over pass 8:30 this morning. the truck was ing east i-80 between 40 and 50 miles an hour when that crane slammed into the over pass. concrete debris fell over two lanes and those lanes had to be shutdown for an investigation. >> the driver either didn't know or had not checked his rig properly and the crane was extended and ended up hitting the overcrossing, causing damage to the overcrossing. >> the two lanes will remain closed until crews can determine whether the safety of the over pass is stable. oakland police need the public's help identifying and catching two suspects believed to have shot a 5-year-old boy to death. artinez was killed

last december outside his family's business a taco truck on international boulevard. after a breakthrough and getting witnesses to talk police just released these sketches of a man and woman. the male seen here with and without glasses. police released surveillance video showing the car they believe the suspects were driving, a four-door 2006 to 209 chevy impala, silver or light colored. -- what san francisco police want you to look at this other video shows a mugging as it takes place monday evening. the victim was in his car outside his moment on maynard street when the suspect approached. he asked for directions, dragged him out of his car punched him in the face, stole his wallet and ran away. . the taxer remains on the loose. no word on the victim's condition. the obama administration's

ambitious dream act began today. it allows young undocumented immigrants to apply for a temporary right to live in in country without the fear of being deported. in -- in los angeles you can see lots of young people armed with paperwork ready to begin the legal process. that policy affects nearly 1.7 mill young immigrants. look at early this morning in chicago, thousands lined up. more locations in the bay area including oakland where mark matthews joins us live. >> reporter: we are outside st. elizabeth high in the fruitvale neighborhood of oakland. this school, this part of town, a center for the latino community in oakland this morning, more than 100 showed up at the high school. most of them young people between the ages of 15 and 30, hoping to apply for the deferred act program. the president could not get his dream act through congress. in june he started just by a

right now there's an occupy rally held at city college of san francisco on the first day of the new school year, already the threat looms that the school may be forced to shutdown.

amy hollyfield is live near campus. >> reporter: take a look at the protesters. they don't look like students, they are a working group of occupy sf. they are taking on this issue because they feel like there's probably 75 to 90% of the students here that don't know that this issue is going on. as city college students rush to class on the first day of the fall semester former student adrienne worries they don't realize their future is in jeopardy. >> a lot of students don't know what has been happening. they know they are felling the s but they don't know why. >> reporter: she and a few other concerned citizens reached out to students today to let them know the community college might lose its accreditation. >> to say that you are going to take this absolutely essential education away from people for something that they didn't do, that is wrong to me

itch >> reporter: the accreditation commission found that city college is spending too much money and is calling for cuts in order for the college to keep its accreditation. ryan smith blames sacramento for the problems itch >> the school is losing money because of state budget cuts which the school has no control over. >> reporter: he doesn't want to see city college give in to the commission's demands. >> if you look at cuts and changes the board is demanding it would require massive cuts to classes a rollback in offering of classes. >> reporter: without accreditation city college would likely shutdown. >> you come and all work and it is not an ed college you are waste you are -- you are wasting your time >> reporter: officials have said in the past they plan to do whatever it takes to stay open.

it has until october 15th, to come up and present a plan. amy hollyfield, abc7 news. a family in san francisco is upset with united airlines claiming the carrier lost their 10-year-old daughter on her way to camp. phoebe took a flight from san francisco, she had a lay over in chicago where she missed her connectioning flight to her final destination in michigan. her parents say nobody from united met her in chicago and they only found out she was stranded when the camp called. phoebe asked for help but was told she had to way united spokesperson tells abc7 news we reached out ly to the family to apologize and we are reviewing their concerns. the airline is refinancedding the miles the family used for that flight. a cooling some have been waiting for. getting feedback on facebook -- some are happy to

crews in southern california working now keep a 3,000 acre blaze from reaching the mountains in riverside county. the fire is 15% contained. it broke out yesterday afternoon east of temecula. more than 30 homes evacuated, several destroyed. crews are hoping to gain ground on that tire today ahead of stronger winds and rising temperatures that are forecast for this afternoon. the last evacuation order lifted for the wye fire burning along the lake people living in the hot springs area were allowed to go home an hour ago. authorities may reopen highway 20 this afternoon. the wye fire which includes the walker fire broke out sunday now 70% contained after burning through almost 8,000 acres, two homes were destroyed one out building
