concord construction site is still smoldering and many questions remain unanswered. thank you for joining us i am ama daetz. >> and i am dan ashley. is it arson? >> flames started just before 1:00 a.m. >> leslie brinkley is live from the scene with the latest. >> reporter: well, i am getting sprayed right now by mist from all of the thousands of gallons of water they are putting on this fire. still, lots of smoke back there even flames erupting from some of those windows. tomorrow they will begin to take down some of these walls and investigators will either tomorrow or wednesday look into whether this could be the result of arson. dispatchers were inundated with calls at 1:00 a.m. one describing an explosion

followed by a massive fire. >> upon arrival, they had reporting a large city block, five-sry apartment complex under construction in the framing stages well involved in fire. >> i looked out the window and all i could see is just a wall of flames and fire. unfortunately i looked as long as i could for the cat, but our pardon me started to smell like smoke. >> reporter: you had to get out. >> the dog was next to me fortunately. >> reporter: atf investigators are joining local fire officials to pinpoint the cause just as they did in three other construction fires in the east bay over the last three years. two blazes. and another in oakland. all deemed suspicious. >> way too early to know if this was accidental or intentional.

also too early to know if this fire is related to any other construction fire thatccurred in the last few years. >> reporter: this is a drone few. ash and debris rained down in the streets. >> residents should avoid washing or sweeps ash or debris into storm drains. >> what you have to come out, come back out through here and we will get you in to get your vehicle out of the garage. >> reporter: evacuated residents had ten minutes to retrieve clothes, and pets. >> we all made it out okay. livermore man in jail after allegedly robbing his neighbor in gun point. s.w.a.t. officers using tear gas

and drones to get the man to surrender. >> reporter: video from sky 7 shows the suspect being taken away in handcuffs. this follows hours long standoff. police evacuated surrounding homes. they were concerned because the suspect was armed with the hand gun. >> the s.w.a.t. team came up to my parent's house in their vehicle and escorted them in the s.w.a.t. vehicle and took them to a current location. >> reporter: setting up drones to survey the area. they threw tear gas inside and smashed a window. another team inside the front

door. crisis negotiators called the suspect's phone but got no response. >> s.w.a.t. team and a canine officer able to enter. >> reporter: broken windows and the rest of the damage that happened during that stand off. police believe the suspect was hiding in his attic and they will not release his name. but known to cause problems. new details about a dog that nearly bit off a finger of a 15-year-old san francisco boy. the dog named chops has been euthanized. cisneros suffered punctured wounds to arms, hands and legs. he is getting better. head-on collision this morning. killed a driver and injured

three others. police say it may have been caused by a distracted driver. vic lee is on the story. >> reporter: the driver of this mangled toyota prius was killed in the accident. head-on collision here on lake view highway. four hours to clear the road way. he hold the medical degree from his native peru. he rushed over to the fatally injured driver in the prius. >> bad situation. signs of brain damage. >> reporter: two men in a pickup truck were taken to a hospital. >> it appears the chevrolet silverado pickup crossed over double yellow lines.

>> reporter: the truck crashed into on-coming traffic. three other cars were also hit. police say alcohol or drugs do not appear to be factors of the collision. the driver may have been distracted. >> we believe inattention could be a factor. >> reporter: people use this highway as a shortcut to vallejo east bay. the sign says 45 miles per hour. but nearby workers say speeding makes this dangerous. >> advising us, to go the other way. >> reporter: so far no charges have been fil against the driver of the pickup. vic lee, abc7 news. happening now, let's take a live look right now.

warriors one win away of taking the first round of playoffs from the spurs. >> larry beil is live at oracle. >> reporter: the warriors are planning on making sure it does end tonight. curry is still out. although optimistic news on that front. young quin cook 25-years old getting a lot of playing time. guarding legends like parker. great in the last game for the spurs. going on 16 years playing together. their win over the warriors in game four sunday gave them a record 132 playoff wins as a tandem. and one of those playoff victories broke the heart of a young quinn ok. >> i grew up a laker fan.

you can see that we have got quite a bit of fog along the astline especially the north bay coast. let's take a look at some, well before the live shot, let's look at the 24-hour temperature change. much cooler. 11 degrees cooler right now in santa rosa. five degrees cooler inn novato. here is the view from our rooftop camera. a few wispy clouds around. mid to upper 60s in mountain view. and 64 in. 61 degrees up north in santa rosa. concord and livermore are in the low to mid-70s.

one more live view of emeryvil)5 spread. overnight fog spreading from the coast. overnight lows mainly in the mid-to upper 40s. notice how the fog deepens near the coast and spreads out over the bay and into the north bay. tomorrow morning 7:00 quite foggy. even a little bit of fog moves down into the south bay and into the north bay. reduced visibility for morning commuters. but by midday, the fog pulls back to the coastline. much like we had today. highs tomorrow will be 56 half moon bay here in san francisco

service. >> reporter: matt did cancel and thought the whole thing was over until six months later. comcast had charged an early termination fee and sent it to collections. he contacted "7 on your side" and we contacted comcast and said there was confusion over when that technician was actually scheduled. however, comcast waived the cancellation fee and took it off his credit report telling us comcast is on a mission to reinvent how we -- we strive to work with our customers to correct the situation promptly and resolve issues to the customer's complete satisfaction. we have earnestly sought to do that in this particular case. our understanding that we took the necessary steps to respond to and fully resolve the

counting down game five. steph curry is set to begin his own private individual workout in less than ten minutes on the court behind me here and just a few moments ago, a promising update regarding steph's condition and that sprained knee. just a few minutes ago, steve kerr told us that steph has been upgraded and now listed as day-to-day and it is possible if the warriors to play this weekend, a possible game seven against the spurs or game one in round two against the pelicans. kerr says he would not rule out a steph curry appearance. this is big news. the last time kerr mentioned the two time mvp, the coach said steph wasn't even close to returning. i have a feeling we are going to see steph curry sooner than
