the summer concert series to help you kick off your weekend. fine way to do it. first, though, we want to get you the breaking news out of arizona this morning. a dangerous escaped convict and his fiancee are behind bars this morning after a three-week manhunt. john mccluskey and casslyn welch were arrested last night in apache county arizona. patrick reynolds was outside the county jail this morning in st. johns, air with the latest. good morning. >> reporter: good morning. as we learned more details about this arrest it is very clear that it could have easily gone the other way. both of these fugitive has guns either on them or close by. and from their own words, they had every plan to use them. >> the nightmare that started on july 30th is finally over. >> reporter: after 21 days on the run, america's most wanted fugitives are finally behind bars. escaped inmate john mccluesy ask and his fiancee, his cousin

casslyn welch, were captured around 7:00 p.m. local time thursday evening. a s.w.a.t. team was convened to capture the two who were believed to be armed and dangerous. although there were no shots fired the u.s. marshal said mccluskey had different plans. >> there was a gun there and he would have killed the officers involved. >> reporter: the two were captured after an alert park ranger noticed their stolen vehicle parked up against trees at their campsite. and had a conversation with mccluskey he said the fugitive was very nervous. >> should have killed the park -- excuse me forest ranger, when he had an opportunity to. >> reporter: nationwide manhunt had been under way for mccluskey and fellow fugitive tracy province since they escaped from a prison july 30th with the help of welch who threw a pair of wire cutters over a fence. the two were linked to the deaths of an elderly oklahoma couple whose bodies were found badly burned in santa rosa new mexico. province was captured three days

later in northwestern wyoming. >> mccluskey and welch are considered armed and dangerous. >> reporter: the couple that referred to themselves as bonnie and clyde had been on the run ever since with their last sighting would weeks ago in northern montana and over 700 leads coming in from all over the country, authorities feared the worst. >> trail had gone absolutely cold. >> reporter: this morning exactly three weeks after the initial escape the two are behind bars. both mccluskey and welch are suspects in those murders in new mexico. they have not yet been indicted in those crimes. that process could take a while along with the extra dix. for the time being they will remain here in the apache county jail. their freedom no longer their own. their movements once again closely watched by prison guards. erica? >> patrick reynolds in st. john's arizona. we are joined along with the apache county sheriff. good to have you with us this morning.

sergeant, do you have any idea from what i understand, they are familiar with the areas, folks knew that perhaps they could be in campgrounds. any idea how long they had been at this location? >> at this time we haven't determined yet how long they were actually in our area. we are still, obviously, investigating their appearance here. >> your offices, teams, reacted quickly. they run the license plate and comes up in new mexico where the body of the elderly couple were apparently from santa rosa found burned. how quickly did it take from running that plate to knowing you had your man? and woman? >> we received initial notify indication about 4:30 and approximately 7:10 we had them in custody when we made the official identification. >> everything happened quickly. we heard from pat, there were firearms at the campsite. was there -- was there ever a

point when your officers when your team there, were concerned for their own safety for their lives? >> when our team went in mr. mccluskey attempted to turn and run. he was knocked to the ground immediately and taken into custody. welch was attempting to draw handgun on the officers. she ultimately followed their instruction and placed the weapon on the hood of the car where she was taken to the ground. >> sheriff, will was, as i understand it, a third party who was with this couple. what do we know about that person? >> well innocent bystander camping next to the couple that was there at the campsite. he was detained briefly and released. >> so it doesn't seem he may have helped them in any way? >> not at this time no. >> sergeant when they were taken into custody, is there anything they said can you share

with us? were they upset? what was their demeanor? >> their demeanor was pretty much one of almost resignation, i would say. mccluskey did -- when he was questioned as to who he was, did make a spontaneous statement to the effect of you know who i am. i'm the one you have been looking for. >> sergeant richard guinn and joseph dedman, thank you. a look at the road ahead in afghanistan where u.s. forces are building up just as the combat mission in iraq is coming to an end. at least 18 u.s. troops have died in afghanistan this month, including one who died yesterday in an explosion. "cbs evening news" anchor katie couric is report thing week from afghanistan where she sat down with u.s. commander general david petraeus. katie is with us now from kabul this morning. katie, good morning. >> reporter: good morning to you. nearly the full complement of 100,000 troops here in

afghanistan along with 40,000 coalition troops the top u.s. commander here general david petraeus, who, of course led the american effort in iraq is hoping to convince an increasingly skeptical american public that progress is in fact, being made. while he acknowledges that public support has declined and is eroding for this war, americans are very frustrated he also warns about what would happen if a military vacuum were created here. >> if the coalition forces went away precipitously which i think is very, very likely, given our interests here and given the determination of all involved here to help afghanistan achieve our common objectives but obviously there are different forces here that would be unleashed. those forces would collide, there could be -- certainly regional involvement and so forth. not a particularly pretty picture, i don't think. >> reporter: general petraeus and i talked a lot about

something that may be -- to the american people. and that is the fact that most experts are saying an ultimate solution to the war will undoubtedly involve negotiating with the taliban along with al qaeda, enemy troops that u.s. troops have been trying to crush. now, many are worried that this will really have a chilling effect on the strides women and girls have made here in afghanistan since the invasion and the fall of the taliban. i asked general petraeus about that. hillary clinton recently said any deal with the taliban that traded peace for women is a red line. will women's rights be gambled away to get the taliban? >> given what you just quoted obviously that's not the case. again, she has been very clear about that. the united states has been very clear. the afghan government has been very clear. >> reporter: tonight we will have more on the prospect of

negotiating with the taliban, what that would entail with general petraeus as well as more on the plight of girls and women here and their fears about the future. harry? >> katie, during the evening news last might we saw you go in with general pet russ to coast an eastern part of afghanistan. what was that like? >> harry, it was our c.e. eastern region of afghanistan, a particularly difficult hotspot for u.s. and coalition forces. that's because of the treacherous terrain and it is -- its unpredictable weather and proximity to the pakistan border. that's where the headquarters of a terrorist network is and pakistan has tried to rein them in. they con to cross the border and plant ieds and train local fighters and travel south for even bigger battles.

it is a very tough area. general petraeus and commanders say they are making progress there. it was an interesting to see i firsthand. >> katie stay safe. we will look forward to your reports tonight on the "cbs evening news." afghanistan, the road ahead on "the evening news" here tonight on cbs. this morning government health officials say salmonella outbreak is likely to keep growing. a single company, wright county egg in iowa recalled 380 million eggs that have been linked to salmonella cases in four states. minnesota, colorado california and now alaska. investigations are also going on in 12 other states. we want to get the latest information for you now about the egg recall. dr. jennifer ashton is here with us this morning. that sounds like a huge number of eggs. how many people are going to be affected by this? >> let's put night context knew mayorcally. when you talk about salmonella cases in this country, every year, there are 40,000 cases

recorded each year. there are estimated to be well over 1 million cases of salmonella every year that just go underdiagnosed and undiagnosed and unreported. really we have to put this into context here. again, to break down the information again, this recall deals with eggs that came out of wright county farms in iowa. 380 million eggs recalled. about 2,000 cases diagnosed to late. again, it is important to remember about 700 of those may be the baseline existing cases of salomon allege we see. they have added two plant numbers in the recall. the numbers are up there. it is plant numbers 1026 1413 1946 1720 1942. you can see those right at the end of an egg carton. this is not a carton recalled but started in the letter "p" and you see a four digit number. >> that's rye underneath where the date you would find on your carton.

we how do you reduce your risk? >> again and again, every year we see salmonella. the first thing when you are talking about eggs is you want to really avoid consuming raw or undercooked eggs. that's key. don't let food cooked with eggs sit out more than two hours. always wash your hands. if in doubt, throw it out. that's the -- if you don't know where your carton came from -- >> get rid of it. jen, thanks. between want to get you a closer look at the headlines on this friday morning. jeff glor is at the news desk. >> good morning to you. there is breaking news this morning about the middle east peace talks broken off nearly two years ago. cbs news chief white house correspondent chip reid is traveling with president obama this morning in martha's vineyard. chip, good morning. >> reporter: good morning, jeff. there reports this morning that the obama administration has convinced israel and palestinians to return to the bargaining table for direct negotiations. according to "the new york times," secretary of state hillary rodham clinton will announce later today that the

talks will begin early next month in washington. israeli prime minister benjamin netanyahu and mackabbas. president president is expected to attend the talks. >> chip reid in martha's vineyard. the lawyer for roger clemens says his client is looking forward to his day in court. charged with lying to congress in thursday. in 2008 the former pitcher and seven-time cy young award winner testified he never used steroids and human growth hormone and his lawyer was repeating that yesterday. >> roger did not use steroids, he didn't use hgh and didn't lie to congress about. >> it clemens faces charges of obstruction of congress and making false statements and perjury. he faces up to 30 years in prison if convicted. american airlines may be hit with a record fine for faulty maintenance. today's "wall street journal" says the proposed $25 million

fine is the largest faa penalty ever against the u.s. airline. it is for improper electrical wiring around landing gear that could have led to fires and fuel tank explosions. american airlines was forced to ground 300 planes in april of 2008 while their problem was fixed. a security scare kept an american airlines flight on the ground in san francisco yesterday. the new york-bound jet was moved to an isolated area on the tarmac after a telephone hijacking threat. two passengers were taken away in handcuffs but later released. the fbi and tsa decided the threat was not credible. in texas, the police chase turned into a runway incursion. look at this. suspected carjacker crashed through a locked gate at the airport in dallas. started driving towards the runway there. flights had to be halted while the chase went on. a patrol car eventually, as you can see, eventually slammed into him. the suspect got out and was captured. he may be linked to a string of crimes. he has been arrested now.

investigators say th good morning. it's 7:25. in the headlines sheriff's investigators say the death of a man on a saratoga concert stage was suicide. it happened last night at mountain winery during a show by the folk rock duo the swell season. witness say the man was way up on a light fixture and jumped on the stage. he landed right next to the front man, the band's front man, glen hansard, who was not hurt. a drug task force has shut down a major operation in gilroy. agents seized more than $100 million worth of drugs from a home there. they found 300 pounds of metal bat, 88 pounds of cocaine and

$35,000 in cash. three men were arrested. most state offices will be closed today, the first furlough friday since july 1. state lawmakers still haven't reached a budget agreement. traffic and weather right after this.

seeing some delays northbound 101 from 280 at least to 13th street. you can see northbound guadalupe parkway also on the break just as you connect to 101. live look at your drive along 280. so far, so good. pretty friday light through there although no delays through downtown san jose. live look right now at the bay bridge toll plaza, backed up at least to the parking lot overcrossing for some cars in the cash lanes. metering lights are on so expect some slight delays through there. here's tracy with traffic. >> let's look at the forecast today. currently, cloudy skies looking out toward the bay bridge, we do have some delays on arrivals at sfo because of the low clouds there. you can see why there. can barely see all the bay bridge. our seven-day forecast, we will illustrate highlight what will be going on later on today with your high temperatures. mid-80s inland, mid-60s around the bay and the lower 60s for the coast. it is cooling down today. those cooler temperatures will round out the weekend. they will begin to warm up, though, just in time for the beginning of next week.

expire or don't go used. $88 billion a year business in the united states give yards. >> maze. >> we are going to explain new rules that give you more time to use them and also cut down on hidden fees that you often have to pay. >> i like this new rule. as we heard yesterday, the park worker that let 12-year-old teagan fall 100 feet to the ground, was an accident. we are getting reaction from her father and a check on her condition in just a moment. cbs news correspondent ben tracy joins us with the latest in this case. good morning. good morning. doctors plan to update teagan's condition later today. after falling ten stories and slamming into the ground she wound up with a fractured spine and pelvis, swelling on her brain, and lacerations to her spleen. the case against the man responsible could still be hard to prove. it has been more than two weeks and teagan has yet to talk. in a wisconsin hospital room

doctors say she could be paralyzed. all she wanted was a rush from the terminal velocity freefall ride at a small amuse many park. but this man, charles carnell, made what his attorney is now calling a terrible mistake. carnell admits he quote, blanked out and removed the harness before the safety nets were in place to catch her. she plunged 100 feet and fell flat on her back on the pavement below. with carnell's lawyers said prosecutors have a tough case to make. >> they have to show not that he had one of those moments where he said oh my god, what did i do you about rather i don't give darn what happens next. there is a big difference there. >> reporter: carnell is charged with first-degree reckless yuri and face 25s years in prison. prosecutors need to show he had utter disregard for human life. >> usually that's something like

taking a loaded gun and waving it around and firing it into the air. that's a very high standard legally. >> reporter: carnell's lawyer says his client is a dedicated worker who simply had a bad day. >> it is awful. it's terrible. we don't believe it is criminal. >> reporter: in addition to the investigation into what carnell did, authorities are also looking into the suspicious activity involving several other extreme employees at the park. in this report obtained by cbs news, they observed workers at the closed crime scene repairing the the ride around 2:00 a.m. two weeks after the accident. erica? >> ben, thanks. joining us now exclusively from madison, wisconsin is teagan's father. good to have you with us. how is teagan doing? >> teagan is critical but stable. making progress every day. every day is a new day. >> she is able to communicate a

little bit by blinking is that correct? >> that's correct. yes is one blink. >> there will be an update on her condition. you have been her side since it happened. you are from florida. have you gone home at all or have you just stayed right there? >> no. we have been here in madison the whole time. >> mr. grossman you just heard a little bit from the attorney who was with us yesterday. you have heard the explanation from his client as to what happened. and how do you respond to that? >> well first of all, in terms of the civil case, the negligence is absolutely clear. with respect to what his attorney said yesterday, that he -- blanked at the time of this incident when did he blank? what does that term mean? he had to remove the safety harness from teagan and unfasten it. then he had to put it down and

move over and release her. these are conscious acts. you hardly are blanking during that period of time. you are doing something. you are doing something affirmative. what he did, in my opinion, does show an utter disregard for human life. especially when you add to the fact that he has admitted he never looked down to see p the nets were in place. how can that be thought of as anything other than an utter disregard for her life? >> you sent a letter. in this letter i'm quoting. you said in all capital letters it is vitally important, terminal velocity not be altered, repaired modified or changed to any degree whatsoever until have you had a chance to examine it. ben mentioned in his report cbs news obtained the report, there had been work going on the ride. do you have any further information whats was happening at that point and why they were working on the ride at 2:00 in morning? >> well the police report itself says that the manager admitted that the arms that were

used to elevate this machine were hopelessly rusted. that they hadn't been repaired in over eight years. maintained. and then we have -- on absolute authority that they also put a red cape marking how high the platform should have been lifted, that would have engaged the nets. simple safety mat their could have been done by the manufacturer, by the ride operator, and at any time prior to this incident. >> for anybody operating the ride, it is visual. do you believe any of that work done at that point was as a result of

we have a followup now on the murder of the university of virginia student yeardley love. newly released documents show she had a fight with the murder suspect just days before she was found dead. cbs news correspondent rick johnson. >> reporter: court documents reveal yeardley love and former boyfriend and fellow lacrosse player jordan huguely had verbal and physical fights leading up to may 3rd. that's when love was found murdered in her apartment. police have fragments of an e-mail they believe love september to huguely relating to a fight between the two.

the e-mail fragments were extracted from love's laptop which was recovered from a trash bin where huguely told police he had dumped it. the affidavit also says one love's sorority sisters told police she saw a fight in which love hit huguely with her first in huguely's apartment. huguely told police that he kicked in love's bedroom door and shook her and her head hit the wall several times. he's being health without bond and his lawyer maintains that the death was accidental. huguely's trial is set to begin october 7th. >> we will be sure to be watching that. up next, give cards. you still have to use them or lose them. but not quite as fast. >> good news for procrastinators like me. we will tell you how the new rules will help protect and you the amount on the car. in this morning's "moneywatch," good news for gift card users. new federal rules go into effect on sunday protecting consumers from hidden fees on gift cards and regulating their expiration dates. cbs news business and economics correspondent rebecca jarvis is here with more. especially during the holiday time as we do these segments about gift cards, we would talk about, well all these caveats and do it by this and can't do it by that, and make sure you do that. there has been a lot of confusion about gift cards. >> there's been a lot of confusion. it shows you in the numbers. $88 billion in gift cards were sold last year but $5 billion of those went unused. that's because either fees ate away at them or people lost the cards or people thought they were expired and now these new rules will protect consumers from that problem. >> that's why retailers love them so much because people don't cash them in. >> exactly.ey they love them. people, you know -- it gives you

flexibility as a shopper to go out and just tell people i'm -- >> and get what you want. >> right. >> what are the new rules about? >> one of the big components is the expiration date. now you have five years before the money on these gift cards expires. >> wow. >> the important thing to know is that the card itself may expire but the money on the card doesn't expire for at least five years. >> that's a big deal. >> if you try to use the card and it doesn't work, call up the retailer and tell them i need a new card. on top of that no more inactivity fees until you reach 12 months of inactivity. it used to be maybe an inactivity fee could eat away at the value. now they can't do it for at least 12 months. and only one fee per month. it doesn't set a limitation on what that fee per month can be on the card. as a kurm you want to check that out with the retailer. >> as a consumer and financial expert, i'd think the big headline on that has to be the expiration, five years. >> it's a lot longer. in the past it might are been a year, might have been less than that. now it's got to be five.

most california state offices will stay closed today. this irst "furlough friday" it's 7:55. time for news headlines from cbs 5. i'm julie watts. most california state offices will stay closed today. this is the first furlough friday since the state supreme court ruled the governor does have the right to require the unpaid days off for 156,000 state workers. the fiscal year began 51 days ago. still no budget in sight. a crackdown on drunk and drugged drivers begins in the bay area and across the country today. the special enforcement effort will run through labor day. similar operation in previous years have cut down with drunken driving deaths and injuries in the final weeks of summer. 2500 citations were

this morning. >> first jeff glor at the news desk. good morning, jeff. >> good morning, harry, erica. good morning everyone. we begin with the capture of the couple that call themselves a modern day bonnie and clyde. they were finally tracked down last night. it happened at a carp ground in eastern arizona after sheriff's deputies and u.s. marshals identified a stolen car by its license plates. mccluskey and welch had been on the run for three weeks since she allegedly helped him and two others broke out of prison. a short time ago i asked a member of the team how the fugitives reacted. >> they were surprised. mccluskey was pretty much speechless. i think it's important. obviously we confirmed the fact at the time of the arrest welch had a gun in the small of her upper back. she reached for the gun. the apache county sheriff's officer subdued her and she was

taken to custody without incident. >> mccluskey and welch are suspects in several crimes including the apparent murder of a couple whose burned bodies were found on a remote ranch in new mexico. federal health officials warning a salmonella outbreak from contaminated eggs is likely to grow. nearly 2,000 cases reported from may to july. that is nearly triple the usual number. more expected when more reports from july come in. the 380 million recalled eggs come in cartons stamped on the end with the letter p and numbers 1720 1942 1026 1413 or 1946 followed by a number from 136 to 229. scientists say a huge plume of oil is still lurking under water in the gulf. government officials say most of the oil spilled in gone but researchers say there is a plume that is 22 miles long and more than a mile wide.

it is 8:55. good morning, everyone. i'm julie watts with your cbs 5 headlines. most california state offices will stay closed today. furlough fridays are back for more than 150,000 state workers. the state supreme court ruled this week that the governor has the right to impose those days off without pay because the state budget is overdue. a drug task force has shut down a major operation in gilroy. agents seized more than $100 million worth of drugs yesterday from a home there. they found 300 pounds of meth, 88 pounds of cocaine and $35,000 in cash. three men were arrested. 2500 citations were written in the bay area in this month's crackdown on people talking or
