and his thoughts on new taxes. the results still in limbo this morning. the razor-thin margin between some big races as a delay in counting could hold things up. good morning, it is thursday, the 4th of november. i'm sydnie kohara. >> i'm juliette goodrich. we have some breaking news in oakland. elizabeth wenger reports. >> chp confirms that three people died in this chase. it started on 580 and they ended up getting off the freeway. another passenger car was hit and now three people are dead. we are sending crews to the scene now. as far as road closures go, 106 is shut down between byron avenue and foothill boulevard. also a stretch of mcarthur boulevard is also closed between talbot and myers. again, it sounds like investigators are going to be out there for a while but right now all the activity is off of the freeway.

traffic is moving fine on 580 itself. we have another breaking situation in san jose. this is involving an overturned big rig. for a while they had shut down all southbound lanes of 101 right before the 880 interchange. traffic is getting by in the left-hand lane. delays not too bad. we have two incidents one in oakland, one in san jose. that's your traffic. here's tracy with your forecast. hey, thanks, elizabeth. well, we scored two beautiful days in a row. today more warm temperatures are expected. i have your seven-day forecast, we'll take a look at the cool temperatures and how much rainfall we are talking about in just a few moments. back to you. >> we'll keep you updated on those developing stories, as well. tracy, elizabeth, thanks very much. california's governor-elect plunges into work. today he heads back to the state capital.

anne makovec is in oakland at jerry brown's campaign headquarters. anne, good morning. >> reporter: good morning. yeah, he is going from this humble office back to the state capital. of course, he has been there as attorney general. but he has been doing a lot of work here in his oakland headquarters before getting the office that he just won earlier this week. and now he is headed to sacramento today to start talking with lawmakers on both sides of the aisle to figure out how to fix california's financial mess. yeah. that is a tall order for the 72- year-old, california's oldest governor. the state budget deficit is estimated at $12 billion. he calls it daunting. but he says we are going to pull out of this despite a classically polarized legislature. he is aware that californians are not interested in a tax hike. but he hasn't ruled it out. >> i don't want people to understand, i didn't create this mess. i haven't been there for 28 years. but i'm going to do everything

i can to make it better. >> reporter: a lot has changed since brown left office as the youngest governor in california in the early '80s. california has 13.5 million more people. and the budget has nearly quadrupled from around $23 billion to almost 83. obviously coming up with any solutions in sacramento is going to be a very long process that starts today. the other piece of good news is obviously, the bay area is going to be very well represented in sacramento this year from jerry brown and lieutenant governor-elect gavin newsom. >> anne, thank you very much. anne makovec in oakland this morning. well, it could be weeks before we know who the next state attorney general is. look how close the race is. democrat kamala harris, the district attorney in san francisco, leading republican steve cooley by a tenth of a percent, a margin of just 9,000 votes out of more than 7

million counted. cooley is the d.a. in los angeles county and he had the lead most of election night. time now 5:03. election day is over. several key races are still up in the air and tens of thousands of ballots in the bay area haven't been counted. mark sayre is in san jose to explain how it's affecting some close races. reporter: good morning. an estimated 153,000 uncounted ballots here in santa clara county alone. that's affecting several races including one race for the san jose city council. of course, the race everybody is watching, the 11th congressional district race where incumbent jerry mcnerney is just 121 votes ahead of his republican challenger david harmer. this congressional district spans four counties including santa clara, contra costa, alameda and san joaquin. but exactly how many uncounted ballots there are in each of those counties and what potential impact that could have on this race at this point remains a mystery. both candidate, though, say they are gearing up for a long

fight. >> when it's a close outcome like this the state mandates a certain what they call recanvassing. it's a lot like a recount. >> i think it's inevitable and i think the voters probably want that. everyone wants to be sure who won. >> reporter: here in santa clara county smudges on ballots are to blame for many of the uncounted ballots. optical scanners cannot read the smudged ballots, that were put there by the printer who printed the ballot so election workers are erasing those smudges, using old-fashioned erasers. of course that is impacting several races here in district 5 on the san jose city council. two candidates just 236 votes apart and listen to this, juliette. in the city of milpitas, there are two would-be city council members separated by just 13 votes. so what happens with those 150,000-plus uncounted ballots here could have an impact on a lot of local races.

>> absolutely. thank you, mark sayre. a local congressional race in question. jerry mcnerney leading republican challenger david harmer by just 121 votes. our time now is 5:06. san pablo police looking for the parents of a little boy left abandoned on a street. the boy is between 18 months and three years old. he was last seen with a woman in her 20s. police say she left the boy on the street and jumped into a taxi. the boy was left on valencia way in san pablo yesterday morning. he apparently doesn't speak clearly, but otherwise appears to be healthy. sentencing is scheduled tomorrow for the former bart police officer who killed a passenger. a jury convicted johannes mehserle of involuntary manslaughter for shooting oscar grant. prosecutors are asking for a prison sentence. the defense had requested probation. there is going to be a day of

hope event for grant this evening at the federal building in oakland. australia's qantas airlines has grounded all flights for its airbus a-380 jets after some scary moments midair. a flight had to make an emergency landing in singapore this morning. witnesses reported hearing a loud explosion and then seeing pieces of debris fall from the sky. qantas says one of its four engines cut out right after take-off. none of the 459 people on board was hurt. 5:07. let's get another check of traffic and weather. elizabeth, you told us about that developing story a couple of big problems out there. >> yeah. we have a problem in the east and south bays. we'll start with the high-speed chase. it is now over but it ended with three people confirmed dead according to chp. it was a high-speed chase started on the freeway on 580 then got off at the foothill macarthur boulevard off-ramp. the suspect went through an intersection and hit another

car. now three people are dead. no officers are hurt. but there are a number of road closures on city streets in oakland including some major roads. 106th at foothill shut down and mcarthur boulevard at talbot. investigators are going to be out there for a while. oakland police department is now handling the investigation. so expect those closures for at least another hour or so. all right. in the south bay we have an overturned big rig now. they issued a traffic alert. this is on southbound 101 right before the 880 interchange. the big rig is still in lanes completely overturned. for a while they had shut down all the southbound lanes. they were able to get one lane open. so you can squeeze by and so far we are not seeing any huge delays in the area. at least according to our traffic sensors. but they are going ahead and closing a ramp. the southbound 101 connector to northbound 880, they are shutting down that ramp here shortly. again, a traffic alert issued in san jose. that is your traffic. let's get an update on your forecast once again.

welcome home their world series champion giants. police say it was a very successful and festive events and the fans agreed. players and coaches cruised the parade route in cable cars waving to fans that stood 50 feet deep in some spots. then the players talked to the fans at a civic center rally. >> not a man of many words. i don't even know what to say right now. kind of having a mini heart attack. i'm not sure what it's from? maybe the electricity in the crowd, maybe the smell of prop 19, i'm not sure. good morning. we have two major problems to start off your morning commute. we'll start you off in the south bay where there is a traffic alert that was issued just after 5:00. southbound 101 on the approach to 880, there's a big rig that overturned. they just went ahead and shut down the connector ramp from southbound 101 to northbound

880. so they can upright that rig. if you are coming down southbound 101, they were able to get one lane open. three right lanes remain blocked. so expect it to be extra slow this morning. so far it's early and traffic is still light in the area. if that closure continues, you may want to consider 280 later on. there was a deadly police chase overnight. we continue to have crews following this breaking situation. it started on 580 and ended on city streets with three people confirmed dead. the crash ended on 106th and mcarthur. we have a number of street closures in the area including 106th blocked off at foothill and macarthur boulevard, a very popular stretch there, right around talbot. expect closures to continue on city streets for at least another hour. again, three people confirmed dead. the 580 freeway is fine as well as 880. both are unaffected. live look at 880 by the

necessary. and the former bart police officer who killed an unarmed passenger will be sentenced tomorrow. johannes mehserle was convicted of involuntary manslaughter in the shooting death of oscar grant. this evening, a day of hope event for grant is planned in oakland. time now 5:23. a berkeley hiker recently detained in iran is making a new plea. sarah shourd is asking country to release her fiance and friend. she says both deserve a compassionate release without trial. back in july of 2009, all three were detained near the iran- iraq border accused of illegally crossing into iran and spying. there is new hope this morning for an 80-year-old alameda woman robbed of her dog. police say two men snatched the woman's purse along with her 6- year-old yorkie. the dog does have a microchip implant. the police still need your help. they have released new information about the alleged

a deadly crash this morningn th good morning. it's thursday, november 4. i'm sydnie kohara. >> good morning. i'm juliette goodrich. >> we are going to go to some breaking news this morning. a deadly crash in the east bay. police are investigating what happened. the accident had been causing problems on the morning commute. elizabeth wenger reports. >> chp confirms three people died in this earlier police chase that started on 580. we are told it was not a high- speed chase. but it started on 580. they are following another car got off the freeway right there by the foothill macarthur boulevard off-ramp and it ended on city streets. it sounded like they went through an intersection, crashed through another vehicle and now three people are dead. there are a number of road closures right off of the freeway. 10 sixth avenue is completely shut down at macarthur boulevard. oakland police are handling the

investigation but it could be another hour before they are able to re-open those city streets. traffic isn't impacted. we have a crew heading to the scene. we have another breaking traffic story in the south bay. this is southbound 101 right there by the 880 interchange. we had an overturned big rig around 5:00. one lane was opened. but they are closing down this connector ramp from southbound 101 to northbound 880. that could cause big problems for the morning commute if the ramp closure continues. consider southbound 280 instead. two major situations one in the east bay one in the south bay. we'll continue to update you. back to you. >> thank you. also, we are following another developing story this morning. people living in a redwood city apartment complex have been forced out of their homes by a fire. first calls came in around 3 a.m. on the 2400 block of linden

street. the response went to three alarms. firefighters right now are mopping up and investigating the cause of the fire. at this point, there are no reports of any injuries. we'll stay on top of all of these breaking news stories this morning. it could be several days before there is a winner in the race for mayor of oakland. former state senate president pro tem don perata and city council member rebecca kwan are the top members so far. thousands of ballots need to be counted. then because no candidate earned a majority, the race will go to an instant runoff based on voters' alternate choices. san francisco representative nancy pelosi has only a couple of more months as speaker of the house. she won reelection but republicans will take control of the house in the new session. she is urging democrats and republicans to find common ground by supporting the middle class, creating jobs and moving

the nation forward. pelosi hasn't yet said what she wants to do next. she tells abc news the nation's high unemployment rate is the reason the democrats had so many house seats tuesday -- lost so many. and 5:35 now congressional republicans are pushing their new agenda following their gains on capitol hill. the american people want smaller government that spends less money. president obama says he looks forward to finding common ground with the gop but one of the top republican priorities is not on the table. >> the healthcare bill in my view is a metaphor for the government excess that we witnessed over the last two years. >> both democrats and republicans have certain beliefs and certain principles that each feels cannot be compromised. >> president obama plans to sit down with republican leaders in the next few weeks. 5:35. san pablo trying to figure out who abandoned a little boy on a

arrested last week for allegedly assaulting jerold lindner at a jesuit retirement center in los gatos. lynch say he and his brother were molested by lindner in 1975 during a church camping trip. lindner was never charged. the church paid a settlement. lynch will be arraigned next week. it is 5:37. high-speed rail projects in california could stall out when the new congress assembles in january. republicans stepping into leadership roles on the transportation committee have shown a preference for freeway toll lanes. the likely chair says he supports high-speed rail but only in the northeast where there is a higher population density. and the city of palo alto says there is no need for concern about the smell of gas in parts of their town. the city says it's the result of pg&e releasing gas while doing some maintenance. the aroma generated caused quite a few calls yesterday. pg&e expects to be doing more work around palo alto and mountain view area in about

a deadly crash this morning in the east bay. anne makovec is in oakland now where police are still investigating what happened at macarthur boulevard and 10 sixth avenue. good morning. >> good morning. this entire intersection behind me is blocked off as you can see. a fatal accident, two people have died. apparently this started on highway 580. ah ah car was seen speeding. it ended up at this intersection hitting another vehicle and both drivers died. i'm here with an officer to tell us what happened. >> it started at 2 a.m. where we attempted to make an enforcement stop on a vehicle for speeding. the vehicle then exited here at foothill macarthur off 580 and started around 150th. >> reporter: what kind of speed are we talking about? >> i'm not sure. probably in excess of the 65- mile-per-hour maximum speed limit is my guess.

vehicle came in here through the intersection then collided with the other vehicle and then both drivers unfortunately didn't make it. >> obviously it's going to be a lot involving this investigation. but also, the officers involved and should they have been following this driver? >> yes. they were trying to initiate an enforcement stop on the vehicle and the driver didn't want to stop. >> reporter: how fast do you think this driver was going on city streets? >> i don't know. it's still under investigation. we are still trying to get all of our statements from everybody in the witnesses and the everything. >> reporter: what is going on, the oakland pd is taking over because it occurred in the city? >> yes. the oakland police department is conducting the collision investigation because it is their city. so they are helping us out. >> thank you for that, officer with the chp. 106th and macarthur closed off for some time.

>> earlier we were reporting three people were killed. were these two single drivers one in each car no one else was in the car? >> yes. the report said at the beginning you end up with -- the erroneous people at the beginning, that's the wait it goes in these situations. so two people died in the single vehicles. 106 th avenue blocked off. this is close to the oakland zoo. it's just off the freeway. so you can see a lot of oakland police vehicles still out there. we don't know how long this closure is going to be in effect but it sounds like at least another hour or so once our morning commute really gets under way. so that's going to make a dent in the morning commute. san jose, southbound 101 right before the 880 interchange, a big rig overturned right now three right lanes are blocked

traffic getting by in the far left lane. we have not seen any major delays because of this. it is early in the morning commute. so southbound 101 traffic looks okay. but they are telling us they are going to close this ramp. some southbound 101 to northbound 880. right now it sounds like it's not closed yet but they are in the process of closing it so they can upright that big rig that's still blocking three right-hand lanes. in the meantime, 280 looks fine. we have a camera by the 880 interchange. showing you traffic out of downtown san jose where it is still exceptionally light this morning. so 101 and 280 both look okay as you head up along the peninsula. an accident at the bay bridge. there are conflicting reports whether it's the upper or lower deck. sounds like the upper deck westbound 80 on the incline section of the bridge blocking one lane. so unfortunately that means traffic is likely to back up at the toll plaza.

situation on city streets. 106th avenue still shut down at macarthur boulevard just west of 580. it's closer to an accident. they are still out there. oakland police department is out there investigating a crash involving a car fleeing from police hit another vehicle and now two people are confirmed dead. again 106th closed at macarthur boulevard and likely going to be closed for at least another hour. san jose, southbound 101 approaching 880, three right lanes remain closed due to an overturned big rig. it is still there in lanes on its side but as you can see from our sensors in the area, traffic is so light, they are getting by in the far left-hand lane without any huge delays. they have been closing more connector ramps in the area. the connector ramp from southbound 101 to northbound 880 closed. also the connector ramp from southbound 880 to southbound 101 has been shut down. all right. let's take a quick look at the bay bridge, where it is already stacking up on the incline. we have an accident now at the
