come for sure, as we see the showers continuing in and around the bay area this morning. it's light, quarter inch to less than that for most locations today. this is not going to be a gulley washer, by any stretch. just light shower activity, even at the beach should be drying out through the day. we're not going to clear, but we'll see breaks in the cloud cover, only to thicken up again into tomorrow, as we've got another wave of moisture headed our way. we'll take a closer look at that for you, coming up in the complete forecast in just a few minutes. >> very unfortunate timing, jim. >> you think so? >> well, new year's day, then christmas day last week. >> it's all good stuff. >> okay. we'll take it. >> we got 100% some of normal. >> i like your attitude. top of the news this morning, a fire early this morning forced people to evacuate an apartment building in san francisco. flames could be seen on the roof at the building at the corner of montgomery and pacific in the financial

district. thick smoke poured out of the windows. one man was lying on the sidewalk while getting help from firefighters and paramedics. the fire was reported at about 1:30 this morning. to get to it, some firefighters climbed up the outside of an adjacent building. the cause has not been determined. people gathered throughout the bay area last night and into this morning to welcome the new year. >> happy new year! [ cheers & applause ] >> young and old rung in the new year along san francisco's waterfront. thousands of people packed the embarcadero for the annual fireworks display. it was a wet and cold night, but that did not stop people from celebrating in the streets at the stroke of midnight. no reports of any major problems. as the new year begins today, riding cal train becomes a little more expensive. a 25-cent per zone hike kicks in today. for example, a one-way ticket from san francisco to downtown

san jose is now $8.50, 75 cents higher than just yesterday. also this year, cal train plans to add three baby bullet express trains to its weekend service on a trial basis. and something else a little more expensive starting today, traffic tickets in california. the state is now adding a $4 surcharge to every traffic ticket. the revenue, an estimated $34 million a year, will help pay for emergency air transport services. the program had been facing a financial crisis because of a shortfall in medical funding. the new year brings in a new state law that aims to crack down on truancy. if kids don't show up for class, their parents may end up behind bars. >> reporter: kids and their parents are sliding into the new year at the hiller aviation museum in san carlo, a year that introduces a new state law on truancy, penalizing parents of kindergarten through eighth grade students who miss more than 10% of the school year

without a valid excuse. many parents we talked to say they didn't know they could be fined $2000 and spend up to a year in jail if their kids' attendance doesn't improve. some say the law's too strict, like this mother of kindergartner zoey. >> i know i want -- my daughter to spend time with people at school, but it's a step that feels too heavy- handed toment i can't really explain why. >> reporter: students are considered habitual truants if they miss three or more school days a year. penalties were pushed for students who missed more days. reducing truancy and dropout rates bring down crime. ward carson, father of a preschooler believes the new law will enforce the value offed wages. >> we missed three days in four years. i consider that to be

significant enough. i think missing, what did you say, 10% in one year? i think it's beyond the vail of accept tibility. >> reporter: some parents say the law doesn't take in the need of special education or family time. this mother kept her son out for a week for a hawaiian vacation. >> if we're given a homework packet to make sure children are keeping up with their school work. >> reporter: whatever the grade from these parents, the truancy measure becomes law january 1. in san carlo, sharon chen, cbs 5. and another new law, even though voters rejected proposition 19 in november, marijuana laws are getting a bit more lax in the new year. starting today, people caught with less than an ounce of pot won't be arrested. instead, they will get a ticket with a $100 fine. the law reduces the penalty from a misdemeanor to an infraction. the same level of punishment as a speeding ticket. >> this is the first time in 35

years that we've had a reduction in penalties for marijuana in california for anything other than medical. >> but the consequences are staying the same for people who smoke pot and drive. the court treats that like driving under the influence of alcohol. san jose is already looking into its first homicide of the year. the sjpd got a call just after 1:00 this morning to a 15-year- old boy who was shot and died at the scene. so far, police haven't said much about the suspects. this murder comes after a very low number of murders in 2010. san jose had only 20 homicides all of last year, a 26% drop from the previous year. also in san jose, a homeowner could potentially face charges for shooting a man he believes was trying to break into his home. the homeowner says he woke up early yesterday morning as the man was trying to break in through the back door of his house, which is on patio drive. he thought the intruder had a gun, so the homeowner fired his

own shotgun. >> he fired his firearm from inside the residence, outside to the individuals, fled out the front door because his residential land line was not working, neither was his cell phone. >> police say no gun was found on or near the 24-year-old man who was shot, but he did have a cell phone and may have been intoxicated. he underwent surgery and is expected to survive. the homeowner was questioned by police and released. it's now up to the santa clara county district attorney's office to decide whether he'll face any charges. the america's cup is coming to the bay area in 2013. the team headed by oracle ceo larry orson chose san francisco today over newport, rhode island. venues for the race will be built at several piers along our northern waterfront. ellison's group will invest up to $80 million for upgrades to the piers in x change for long- term development rights. the mayor's office projects the

race could inject $1.4 billion into the bay area economy. a powerful earthquake gave argentinian's a rude awakening this morning, a magnitude 7.0 earthquake hitting around 7:00 a.m. in the northern part of the country. not clear if there were any major injuries or damage. violent storms ripped through the midwest, killing at least six people. three people died when a tornado touched down in cincinnati, arkansas yesterday. dozens more were hurt. the twister reduced several homes to rubble, as you can see there. cincinnati, arkansas is a very small town, only has about 100 people. nearly everyone is affected by the storm. >> i was in shock. i couldn't believe it. this is my hometown. i grew up here. everything's gone. it's all gone. there's nothing left. it's really sad and devastating. >> two people were killed by another twister in missouri. the storm system is still

massive, stretched down into the gulf of mexico. of course i've been complaining a little bit about the holiday rain around here, but it's nothing like we've seen. we'll check in with jim for our weather forecast, i believe. >> we can do that. you've had enough, i gather? >> yeah, let's do it. >> okay. you know what, i think we're going to take a quick break, first. mega jackpot, even by mega million standards, but still belongs to no one. just ahead, the would-be winning numbers and how much the prize will grow for the next lottery drawing. ,,,,,,,,,,

mega million drawing. the jackpot reached $242 million, with no winner. the jackpot has gone without a winner for 15 consecutive drawings. since nobody won last night, it's going to get even higher. the estimated jackpot for the next drawing, which is this tuesday, $290 million. now, there would have been a winner last night if somebody had these numbers on the screen, 10-12-13-35-56 and the mega number of 9. chances of winning the jackpot, 1 in 175 million. mega millions is played in 41 states and the district of columbia. of course it's the first morning of 2011. many people stayed up very late to usher in the new year. manuel gallegos was in new york's times square, where cleanup crews have their work cut out for them. >> reporter: the party's over. workers wasted no time cleaning up, after new york's massive street gathering to ring in the

christmasy, don't you think? maybe not. had enough, all right. as we take a look around the bay, scattered showers this morning, pretty light, stuff. quarter of an inch, tapering on off to a tenth of an inch. even at the beach, a bit of rain out there this morning. and we will see that taper off to showers here this afternoon, with a brief pause before the next round of precipitation reds our way. here's a look at live high- definition picture right now. you see the brunt of the moisture this morning pushing off into the east bay and beyond, and as we zoom in on a little bit here, we'll see light returns showing up throughout the bay area. down to about 3000 feet in the local mountains. could be a dusting of snow there, but as mentioned, not much showing up in the way of any accumulation. any amounts will be very light, except, of course, up around keil. they will be 3 to 6 inches of snow through the weekend, to add to their already record

amounts. if you're already there, it's great news. if you're trying to get there, it's a bit problematic, as roads have been dicey through the holidays. let's take a look at the satellite picture right now, where we see this front coming ashore in the last 24 hours. well formed and impressive looking. however, it dissipated rapidly as it came ashore. here you see the leading edge pushing in and moving through the bay area. the center of circulation, still offshore. that's what will bring the next round of precipitation into the area for late tonight, into tomorrow morning. scattered morning showers here tapering off this afternoon, with more rain on the way. again, it will be the center of circulation, which is likely to continue to parallel the coastline, moving ashore and across southern california here by tomorrow night, into the beginning of the week. as we take a look at the radar expectations, you'll see a few monitor returns showing up in here, but primarily light showers expected. with the bulk of the moisture moving off to the south here through the day tomorrow. there you see crossing the south bay, a few moderate returns showing up, very

briefly as the bulk of the energy once again looks like it's headed to our south and/or going to remain in the offshore waters. temperatures went by too quick. mid-50s prevail for today, with a gradual warmup expected into next week. not quite so warm out across the highcountry of the tahoe basin, where they will hover around the freezing mark. scattered snow showers today and tomorrow. they, too, clear out come the beginning of the week. as you may have noticed, they did new snow surveys last week and in the highcountry of california, looking at 150% around the tahoe basin of normal for this time of year. up to 200% of normal snow pack in the southern mountains. so what was that, about a drop? maybe not this year, as we see we're doing pretty water wise throughout the state, as those levels are comparable to 1982 and '83 for this time of year, which was a very wet year across california. again, we do have a bit of a

of now. 2011 will mark the seventh year for cbs 5 profiling bay area jefferson award winners, as we look forward to a new year of inspiring stories. kate kelly gives us a look back at 2010's more creative local heroes. >> reporter: at first glance, you might find bill and dave's public service a bit make cab. but the twin brothers found a purpose for cars they could no longer use in their car business, by donating them. >> if you get a picture or a phone call saying they made it, that's, that feels good in itself. wow, that ambulance still had a lot of life left in it. the look on their face and the response when they are seeing these vehicles, it's amazing. they really appreciate it. >> reporter: veronica pope uses cars in an entirely different way to help young people already on the path to trouble.

know, that already struggles with many challenges in life. >> open your eyes so mom can see you! >> reporter: babies born with more than their fair of challenges are getting a good start in san jose. her access program provides food and gas vouchers, transportation, even overnight stays so parents can make the trip to see their infants in the neonatal intensive care unit. >> it feels really satisfying. i just never thought that there should be barriers to visiting your child and we've been able to remove a lot of those barriers. >> who's going to show you how to get to these rooms, though? >> reporter: even more barriers go down when juan carlos girths struggling students from around the bay area. >> those students who are at risk environment, at risk behavior, least likely to succeed, and let's work with them because there's a lot of

welcome back. on the first day of january, new year's eve turned out to be a dangerous night. three people died overnight due to drunk driving. here to talk about the problems, the california highway patrol. thanks for joining us this

morning, sergeant. a very busy night. did you expect that? >> well, you know, we expected it would be busy, but we're very disappointed with the numbers. there were 64 people arrested for dui and 4 fatal traffic collisions. so what that means is there's four families that are going to have to plan a funeral starting out this 2011. so we're really disappointed by that. how do those numbers compare to past years? >> well, over the years, they kind of fluctuate. this one, i would say, is about the average, but what we can't seem to understand is why do people choose to do it when reaching up to new year's, we let people know, hey, we'll be out there, increasing staffing levels, looking for people driving under the influence. yet people still do it anyway. so we still have till sunday at midnight, so we're telling people, please, plan ahead and think before you drink. we're looking at check points going on, check points in several bay area cities. guess they didn't seem to stop enough, but obviously stopped a lot of people from getting on

the roadways. >> it did prevent some people, but we want people to remember that if you are stopped and you're under the influence of alcohol and drugs, there is no verbal warning. you are going to go to jail. and that is really no way you want to spend your new year's. you should be spending it with friends and family, not in jail or regretting the fact that you possibly killed someone else. you still have one more day left. think ahead. spend the night at a friend's house or take a cab. there's so many other options rather than drinking and driving. when you mix the two, there's a possibility you could end up killing yourself or killing someone else. these four accidents just happened overnight and you might not have all the details, but do we know the people killed, were they the people driving drunk or innocent people driving on the roadway? >> a combination of both. you know, four different crashes, four different locations, but there's one thing that all four crashes have in common, which they were all preventible. so the reason why those crashes occurred is because someone wasn't being responsible behind

the wheel. and so that's really what it comes down to. so we want people to really get into the mindset that every single motorist, you make a difference out there on the road. so if you're courteous, obey the vehicle road, everyone can reach their destination safely and we don't have to have families planning funerals. i spoke with you yesterday about hoping the maximum enforcement would keep people from driving drunk. obviously that's not been the case. i guess what is that like for you guys, after you are pounding it into people's heads days before the holiday period, don't drink and drive. >> there's no frustration on our part. it's our job. it's what people expect from us to keep the roadways safe, but we're going to let people know that we're not letting down. like i mentioned before, if you're stopped and you're under the influence, you're going to go to jail. there's so many different other things you can do, especially when a first time dui is going to cost you approximately $10,000, with fees and fines,

and i'm pretty sure there's some nice limo companies or cabs or nice hotel rooms that don't cost that much for one night. that's definitely a better option instead of taking a ride with me or one of my coworkers. absolutely. sergeant, thanks so much for joining us this morning. we hope we don't have to meet under such circumstances again. meantime, more rain is about to come down in the bay area, jim bernard. >> it's coming down now, started about midnight. and of course this adds to the problems out on the highways and byways. slick roadways out there. rainfall amounts pretty light. we are looking at snow in the local mountains. officially snow levels running about 3000. however, i suspect we're expecting up accumulation lower than that, down around 2000, 2500 feet. as you see here on the live high-definition doppler picture, snowfall showing up in the north bay here, north of vacaville, where we're continuing to see very light

and mild. the bulk of the moisture is pushing off to the east, headed for the highcountry sierra, i- 80 and i 50 are experiencing snow problems. not unusual, given the pattern we've been under the last month or so. chains are required if you're headed over to the highcountry. for the rest of the bay area, lightly scattered hit or miss showers winding down through the afternoon. however, there is another wave on tap here for the wee hours of the morning tonight, into tomorrow, which looks pretty juicy at this point. let's take a look at it on satellite right now, where you see the center of circulation, which is this area right here still lurking in the offshore waters and we'll see it pass through the region tomorrow. leading edge last night, light rain showers beginning midnight, dissipating rapidly. as it came ashore, here's the remnants of it right now, packing the coldest air as it crosses the region, which could spark a few thunderstorms out there as well. scattered morning showers today giving way to a break this

afternoon. we'll hang on to the clouds, but the rain should taper off. however, there is more on the way into tomorrow and it will look a lot like today's moisture did, probably quarter to half of an inch of rain across the area, with the radar expectations showing for the most part light returns across the bay area, a few moderate cells popping up here and there. again, that would be the isolated thunderstorm development due to the cold, unstable air out there. but the bulk of it seems to be going by to our south. i expect that low pressure system to parallel the coast. as we head south, temperatures in the upper 50s today along the bay, with near freezing levels up in the tahoe area, so you can imagine what that does to the roadways out there. it could stay frozen into the beginning of the week. we're looking at a break our way by midweek, as our weekend showers taper off. that will dry out on monday and stay that way through most of the week, as temperatures rebound a bit. nothing dramatic. not a big warmup. we'll be back near seasonal norms after a chilly couple of

weeks, arriving just in time for the christmas holidays. again, this is our third wave of subtropical moisture crossing the west coast. it will work its way across the country once again. i'm sure we'll be talking about severe weather out in the midsection of the nation and possible snow for the eastern seaboard by this time next week. >> okay. so if somebody's in the sierra right now, when do you think they should come back? when's a good plan? >> spring! warriors won 96-95, winning four of their last five. local college basketball, san jose state lost to utah state, 80-71. st. mary's beat hartford. college football, notre dame defeated miami of florida in the sun bowl, 33-17. in the meineke bowl, south florida beat clemson 31-26. florida state beat south carolina in the chick-fil-a bowl 26-17. and central florida won the liberty bowl, beating georgia 10-6. in today's sports action, san jose sharks are at los angeles to face the kings at 6:00 tonight. the warriors visit lebron james and the miami heat at 4:30. there are also five college football bowl games this morning and this afternoon. in a few minutes, we'll have the story of hopes at the rose bowl, five decades ago. it's the anniversary today. it is a mega jackpot even by mega million standards, but

well, no winner for last night's mega millions drawing. ticket sales for the multistate lottery game were brisk, with the jackpot reaching $242 million. it's gotten so high because the jackpot has gone without a winner for 15 consecutive drawings. since no one won, it's going to get even higher. the estimated jackpot for the next drawing, this tuesday, $290 million. it is the first morning of 2011, and a lot of folks stayed
