good evening, i'm ann notarangelo. so the new year brings some new laws including one federal law that was inspired by legislation right here in the bay area. don knapp is in south san francisco where fast food restaurants not just here but nationwide have to add a new feature to their menus. don, eating more or less. >> reporter: i don't know. by now we know that fast foods can be high in calories but we eat it anyway. so the question is would it make a difference if we went into this mcdonald's here and saw a sign on the wall that said that double cheese burger packing 1350-calories. will we still eat it? well, this year we are about to find out. when this family orders chicken they will know what it costs both in dollars and in calories. up on the wall is the calorie count menu board required by the new health care reform law and effective on this 1st day of 2011. >> i think it is pretty good. i think everybody should know what they are eating and what

they are consuming. because health is important. >> reporter: but tony mitchell says he will still eat what he likes and won't be counting calories. >> seems like the calories don't matter. still a lot of fast foods. calories don't matter. >> calories don't matter, don't count? > >> reporter: not to me. that's okay with the pioneer in the county law. >> i think this gives the public a fabulous opportunity to really know what they are eating, understand what is in it and make their own decisions. we are not going to make it for them. that's not what this is all about. >> reporter: the supervisor was behind santa clara county's menu board law four years ago. it became state law. and is now part of the federal health care reform law. at this san math county mcdonald's there is a menu board inside but none visible in the drive-threw lane. it may lead to a delay in implementing the new law. the orange county register,

differences in federal and state law create expensive problems and confusing issues that restaurants have to spend money designing and implementing the menu boards. it may not be in effect for sixth months. this woman says it does help. >> makes us a little more conscious as to what i'm actually buying and eating. >> reporter: there is some hope aamong health food advocates knowing the calorie count may lead to competition between fast food restaurants. we may get healthier food out of this. >> all right. don knapp, thank you very much. even the vote, rejected proposition 19 marijuana laws are getting lighter in california. people will now get a ticket with a $100 fine. it is reduced to an infraction.

same level of punishment of a traffic ticket. but the consequences are saying the same for people who smoke pot and drive. the courts treat that like driving under the influence of alcohol. it is a familiar story in oakland. a teenager killed. two other teens wounded in a shooting just after midnight. it is oakland's first homicide of the new year. despite that, we are told homocides in oakland have dropped for the fourth year in a row. >> many shots we heard. many shots. >> reporter: remnants of crime scene tape still sits on high street in east oakland, the scene of the city's first murder of the year a few minutes after midnight. >> very bad. very bad. >> reporter: but believe it or not, this story contains good news about crime in oakland. it is down 14% according to police. last year saw 90 homicides

after 102 in 2009. >> i think that's great news. >> reporter: but it depends on who you ask. >> 90 murders last year. >> oh, my god. >> reporter: one murder is obviously too many but for a city that was just named the city's fifth most dangerous in the nation, a reduction is a plus. >> i'm not sure what that is attributable to. we have got less police out there. how did that happen. >> reporter: he is right. the city laid off 80 police officers in 2010 couple that with retirement and the force is down more than 100 officers. >> a lot of people are raising the consciousness about the violence and i think that is probably responsible for the impact of that. >> reporter: while oakland has seen this drop in homicides there is still a serious battle against other violent crimes like armed robberies and burglaries. >> pretty scary to go out at night. >> maybe it is more break ins because people need money and they need ready cash and less homicides because maybe it doesn't get them that much. >> reporter: but at the start of the new year the people of oakland still have hope. >> we have to be street smart

and take care of ourselves and hopefully get the police back that we lost. >> better people, better thinking. >> reporter: in oakland, cbs5. san jose is also looking into its first homicide of the new year. the call came in at 1:00 a.m. a 15-year-old boy was shot and died at the scene police say. police haven't said much about the suspects. san jose had 20 homicides in all of last year. 26% drop from the previous year. a rough start to the new year for dozens of people in san francisco. 45 people are out of their homes tonight after fire tears through an apartment building. this was at the corner of montgomery and pacific streets in the financial district. flames on the roof, thick smoke pouring out of windows. some of the people who escaped were injure. the fire started about 1:30 a.m. and to get to it some firefighters had to climb up

the outside of an adjacent building. the new year brings about a number of changes including a new law that aims to protect the health of your children. the vaccine required for all middle and high school students. 4 pounds, 5-ounces. we will introduce you to the first bay area baby born in 2011. high, i'm meteorologist lawrence karnow in the cbs5weather center. 2011 starting like it ended in 2010. how much more can we expect in the rain department? we will talk about more on that coming up. ,,,,,,,,,,,,,,

cough. a new state law now requires all middle and high school students be vaccinated against whooping cough. most are given a vaccine before they start school between the ages of 4 and 6 but immuneity begins to wain after 10 years. health officials say older students will need to show proof of booster shots before starting school next year. more than 7800 cases of whooping cough were reported in california last year including 10 deaths. it is a girl.

the first bay area baby to be born in the new year delivered in berkeley. she was born at 12: 12:07:00 a.m. she was born a few weeks early but is in good health. the mother said she was surprised her little girl was the first to be born in 2011. >> i didn't believe it. i was like she can't be the first baby. there has to be a whole bunch of other babies born. but no, she was the first one. >> the baby's mom said she chose her name because it means help from god. haiti means female battle warrior. so no winner for last year's mega million drawing. ticket sales were brisk bringing the jackpot to $242 million. the jackpot has now gone 15 consecutive drawings without a winner. and since nobody won it, it is going to get even higher. the estimated jackpot for the

next drawing this tuesday. $290 million. so even though no one picked all the numbers for the big jackpot two people in california picked five numbers without the mega number and they win $579,000. 28 people picked four numbers with a mega number for $11,000. so check your tickets. here are the numbers. 10, 12, 13, 35, 56, and the mega number is 9. lawrence is up next with a cold and wet forecast. and a statement of arts and ecolgy. how a new idea can help protect the health of people around walls. ♪ i may be mud, but i have standards. mops? please.

fast-food restaurants... the city of fremont is joining a county-wide effort to ban plastic grocery bags. ite fears of a law after banning some containers the city of fremont is banning plastic grocery bags now. despite fears of a lawsuit from the plastic bag industry, the fremont city council has shown unanimous support for a law banning the bags in 2012. that's after the county completes an environmental study on the issue. environmentalists are pushing to outlaw plastic bags and clog land fills, rivers and teams. an architect is bringing life to some buildings in san francisco literally. vertical gardens can make even the most urban areas green. >> one of the coolest things at the san francisco academy arts and science building is its roof.

it is alive. designer of that living architecture is taking the roof vertical creating outdoor living walls. >> but that vertical surface is just an astonishing resource. so this is a way in which we can plant vegetation. we can shelter storm water. we can create a statement of art and ecology. >> reporter: also helping insulate the buildings and soften the city noise. living walls are already seen around the world from paris to canada. even thailand. now a san francisco neighborhood wants his help bringing their walls to life. >> our goal is that for the next seven years each year we will have a living wall in a different location in our district. >> reporter: you can see why this south market district wants more greenery. besides a few trees it is mostly steel and cold concrete but it could look lush and full of vegetation that looks and

smells good. >> we know that it affects human well being which can equate to productivity, a loss of absenteeism when people are surrounded by plants and vegetation they feel good. >> reporter: there is one challenge to this beauty. the cost. around $50,000 per wall. >> well, we raised the funds. we raised 90% of the funds. and that comes from the community benefit district. that also comes from our community and our neighbors. >> people will look at this internationally as an icon. a place where vertical vegetation is not -- it is not just a statement but it is a way in which we express our love of nature. >> reporter: the neighborhood's fist living wall is planned to be completed by summer of 2011 and will look something like this. in san francisco cbs5. no matter which way your garden is growing you done need to water it right now, do you? >> no, everything should be looking real good.

a lot of the water levels running 130, 140% normal. and more to come. of course, lots of snow in the sierra nevada. snow showing up in parts of the north bay. out there right now yes, indeed we have a couple of showers continuing. high-def doppler is picking up on some of the moisture right now mostly concentrated in parts of the north bay. let's get you in for a closer look and see how things are working out. some cells sliding on through. just east now of santa rosa we are seeing some moderate amounts of rainfall and kind of catching a break in towards san rafael. a lot more moisture off the coastline and looks like things will be picking up throughout the evening hours. rainfall in this area and snow being reported in some of the higher peaks. things staying unsettled and wet at least for another day. this area of low pressure sliding right down along the coastline and that will crank up the moisture. temperatures chilly though. 39 degrees if you can believe

that right now in fairfield. 41 in concord. 50 degrees in san jose. looks like showers continuing into the central valley for tomorrow. possibility of isolated thunderstorms in monterey bay. high country. want to sneak up there? winter weather advisory. pretty good snowfall. even lake level may see almost a foot of snow at lake level through now and tomorrow morning. so expect that if you're traveling in that direction, bring those chains with you up there. monday looks like a chance of a few more snow flurries then it will start to dry out. should be some great skiing as we head towards the middle of this next week. area of low pressure really diving down the coastline. a low that will continue to slide on by and skirts along the coastline and you'll see some of the moisture lifted right up into bay area. we will keep the showers going overnight tonight and looks like for tomorrow even the possibility of an isolated thunderstorm as that system slides on by. yes, taking the clock forward to 7:00 p.m. tonight. showers showing up around the bay area. heaviest amounts coming looks like as we head into the early parts of the morning hours tomorrow. and even the possibility of

some isolated thunderstorms rumbling on through. and tomorrow, more of that on the way on and off throughout the day seeing those scattered showers. so if you have any plans prepare it will likely be on the wet side. and those temperatures to go along with that will be chilly. highs running only in the 40s in most spots and 50s inside the bay but you've got those cold numbers outside and got the showers. it will feel pretty chilly around the bay area. looks like we start to dry things out heading in toward monday. partly cloudy skies. maybe return of some of that patchy tule fog. high pressure building in it looks like things will start to dry out middle of the week and stay dry right towards next weekend. that's a look at weather. here is gary with sports. >> lawrence, thank you. is jim harbaugh headed to the 49ers. joe paterno playing in a bowl game. how he did and a whole lot more coming up in sports. ,,,,,,,,,,,,,,,,,,

state in the gator bowl. perfect pass by owens. leading 14-10 after the first quarter. looking good for michigan but then all bulldogs. on 4th and 10. hit michael carr for the third touchdown pass of the game. mississippi state scored 42 unanswered points and blew the doors off michigan. 52-14 to win the gator bowl. wolverines worst bowl loss in school history. pretty sure this guy will not be wearing the spartans head gear back on the flight to east lansing. alabama scoring a touchdown on their first four possessions. mark inngram with. winning the capitol one bowl. big 10 went 0-5 today and really struggled against the sec losing all three match ups by an average of 30 points. the three schools forcing eight turnovers. mike hayward was fired
