>> good morning. navy blue, the u.s. nav investigates raunchy videos shown to thousands aboard a carrier. the captain who made those videos could lose his job. back to work as the president and members of congress return to washington republicans vow the take on mr. obama. with everything from health care to government spending at stake. but the president's not backing down. we're live on capitol hill for the big showdown. >> and lindsay's release. the actress could leave rehab today. her next step. her father michael lohan joins us in a live interview about his daughter's plans and their relationship. early this monday morning, january 3, 2011.

a lot to get to in that respect. and a lot happening. >> let's begin with a scandal engulfing the navy. the raunchy videos under investigation produced several years ago and broadcast to the crew while deployed in the wars in iraq and afghanistan. bob is in washington with the latest for us. good morning. >> reporter: good morning, chris. this is not the first incident involving sexually explicit behavior in the u.s. military. the videos you mention were put together by the officer now the commander of the uss enterprise. >> there is a really good chance you'll be offended. >> his words may prove to be the understatement of the new year. >> as usual the admiral and the captain have no idea about the contents of the video. >> the videos have gone public but were recorded in 2006 and 2007 while the carrier was overseas supporting missions in iraq and afghanistan.

they are filled with anti-gay slurs. >> let's get to my favorite topic. >> and simulated sex acts including masturbation. >> we've got different chicks in the shower in a clip previously too sensitive to show. >> honors the star of the videos and the number two officer at the time. ids the of the crew were concealed by the newspaper that released the videos. >> over the years i have several complaints about inappropriate material during these videos. >> they were broadcast to all 6,000 men and women aboard the he wants price. honors appears in some clip as three people at once. he says he is trying to entertain the crew. >> enjoy the movie and the videos. >> while light hearted videos are common on ships, navy officials say these cross the line. in a statement the navy said the videos created onboard the "uss enterprise" in 2006-2007 are

clearly inappropriate. those in command are charged to lead by example and are held accountable for setting the proper tone and upholding the standards of honor, courage and commitment that we expect sailors to exemplify. >> i guess we won't show this. >> in may honors was named commander. the ship is scheduled to depart again in weeks. still in question whether the ship's top officer will be aboard. the newspaper that broke the story the virginian pilot reports that crew members complained about the video when they were first broadcast. those who voiced complaints claim they were brushed off at the time. >> bob, given what we know now and seen what do you think's going to happen? >> it's a question. there is a navy investigation. clearly this is a problem for the military and embarrassment of public relations problem. but the investigation will look at more than captain honors. obviously it looks at who knew what when meaning some of the senior officers knew about the videos could be in hot water.

publicly the navy is not saying anything for the record. >> thank you. here is erica. >> turning attention to politics. it is a new year and a new era in washington. republicans taking control of the house for the first time in five years. nancy has more this morning on the looming battle between the gop and president obama which promises to be a heated one, nancy. >> reporter: erica, good morning. the president is enjoying his final full day of his hawaiian vacation knowing that when he comes back to washington he'll be returning to a very different city. when republicans take control of the house this week they'll have the largest majority in 70 years. on sunday they made it clear they will try to use their 49-vote advantage to wipe out key democratic legislation from 2010. including the president's signature achievement, health care reform. >> we'll look at these individual pieces to see if we can't have the thing crumble. >> the republicans now have the

power to launch investigations into the white house, the chairman of the oversight committee will hold hearings on everything from wikileaks to federal spending. >> time and again what we've seen with the obama administration they played fast and loose with the walking around money congress gave them. >> both parties say debt reduction is top. one of the first tests will come this spring when congress must vote to raise the nation's debt ceiling which stands at 1 powu1 trillion. the white house warned a no vote could be disastrous. >> the impact on the economy would be catastrophic. that would abworse financial economic crisis than anything we saw in 2008. >> 37 new house members consider themselves part of the tea party and they'll be looking to make their mark in ways that make both parties a little

>> as we know and nancy pointed out the number one issue for republicans as they move into power is health care reform. ideally getting rid of it. what is the likeliho llihood of happening? >> the likelihood is that it's not going to happen. it's not going to be repealed even if house republicans can pass a repeal the senate would have to bring it up. they are controlled by democrats. that's not going to happen. if it did happen, then the president would probably veto it and both houses would have to override that and the votes aren't there for that. >> there are certain provisions that have actually gone over well with a fair number of americans like keeping your adult children on insurance and of course those lifetime coverage limits. >> and new things that people like are kmuming on line with the new year. middle income seniors will see get some relief in prescription drug prices. but there are other parts that people don't like and those are tied to the economy.

onerous paperwork process that small business has to go through and that's something republicans are targeting. the key is link anything they do to the economy, that is still the central issue. and republicans have to focus on health care and say this is how this hurts the economy and that's why we're trying to get rid of it. >> republicans have promised to keep focus on spending. there is a challenge coming up in the new year because of course in february there's going to be congress is going to have to pass a resolution basically to keep the government running. that could mean raising the debt ceiling. how are they going to make that work for them in terms of what they promised and what may have to be done? >> austan goolsbee said it would be cat astrophic. as they battle over spending reduction to raise that limit what republicans will try and do is say to the tea party backers we had to raise the debt limit,

but we got spending reductions as part of the deal to do so. and they'll have to hope the reductions will be good enough for the tea party supporters. >> when it comes to the tea party supporters a lot are watching this. some things that the tea partiers may want to do could make both parties uncomfortable. how is this going to play out between the republicans and tea partiers? >> in the moment of excitement when republicans won in november a lot of tea party activists said republicans are on probation, no time for celebration. immediately they are on the hook. and the thing that tea party backers will be looking at is spending. will the reductions be real. they are angry already that the gop and agreements with the president in the lame duck session of the last congress just spent a bunch of money and didn't behave in the way those tea party backers would like them to have behaved. so the question for republican leaders will be to be able to say look, we're doing what you sent us here to do but we only control one of the two houses we

concern is more rain, the fear elsewhere in california is cold and snow. this is not california weather to make any one jealous. bly freezing temperatures caught people by surprise, it's normally 65 degrees. >> did not expect the snow. >> it was hurricane force wind gusts combined with slick roads and mountain passes that forced the patrol to close california's major north-south interstate and the cold temperatures turned fatal for an 81-year-old woman and her 63-year-old daughter who died of carbon monoxide poisoning 56 using the oven for heat. >> it was good to everybody. >> near las vegas four adults and two children had to be rescued after getting stuck in mud. they were treated for hypothrmia. it certainly has been a winter to remember. more than ten inches of rain fell last month in los angeles. the wettest december since 1889. in sacramento levee secured

rivers are at flood levels. farm fields are saturated. mudslides cost damage in san bernardino county. the fear is the latest storms could trigger more. in the meantime, thin-blooded californians are just trying to stay warm. >> layers, lots of clothes. >> unlike the other storm systems we've seen in the past two weeks this one's moving pretty quickly, expected to be out of the area by the end of the day today. we expect drier conditions for the rest of the week. and hoping to see some california sunshine. ben tracy, cbs news. >> scientists will announce plans for a blood test for cancer today. the test could potentially be able to spot a single cancer cell among a billion healthy ones. reso muchers at massachusetts general hospital join johnson and johnson and say it might transform care for many type of cancers. >> in ohio, family and friends

this morning remember a deputy killed during a new year's day shooting. in that shooting a second deputy was wounded and the suspect was killed. cynthia bowers has more. >> reporter: when officers arrived to check reports of shots fired this camp ground turned into a killing ground. >> 69 is down. i've got a silver trailer with a male and a shot gun in it. and i've got man down in front of that trailer. >> the downed officer in the distress call is deputy hopper. she was ambushed without warning. >> 69's been shot. i cannot check her. >> reporter: even as officers tried to rescue the dying deputy, negotiators tried to talk the suspect into surrendering. an appeal met with a hail of gun fire erupting into a fire fight.

>> they came in swarms. the guys putting on flak jackets. the next thing i hear a shot. the trailer is coming apart. glass flying, metal flying. it was scary. >> reporter: the officer in this photo was wounded in the heated exchange. he is listed in fair condition. the gunman identified by police as michael fairmon, a resident, was killed. hopper, a 40-year-old mother of two was an 11-year veteran of the clark county sheriff's department. >> as we speak she is being returned to clark county. she's being escorted by lieutenant wit and lieutenant lucas and she'll be coming in a coffin draped by a flag. it's a loss for this community. >> reporter: a loss that leaves questions, not so much what happened but why. cynthia bowers, cbs news,

chicago. >> in central arkansas, a bizarre bird mystery about 2,000 dead red-winged black birds fell from the sky friday. workers in hazmat suits collected the remains. they speculate that fireworks caused them to die from stress. they said it may have been hit by hail or lightning. >> 15 minutes past the hour. we turn to marysol castro. >> it's great to be here. great too finally say good morning to you.

the good news is she lived to tell about it. >> why she jumped in 33-degree water. >> we had an argument. i told her to jump in the lake. she took it a step further. >> first, it is a new year for lindsay lohan and hopefully a promising one. the troubled actress could be released from rehab today. correspondent priya david clemens have a look at where things stand for the young star. >> reporter: on new year's day, lindsay lohan's twitter account crackled back into exist en. she tweeted, today's the first day of the rest of my life. the future depends on what we do in the present. gandhi, one step at a time. encouraging words but gandhi likely never had a year on lohan's 2010. jailed twice. went to rehab twice and last month an employee at the betty ford clinic accused her of assault, a charge later

recanted. so is the tumult over? lohan's expected to complete the 90-day treatment this week. addiction specialist says that lohan's most difficult work is ahead of her. >> you either change your behavior and your life style or you're going to end up institutionalized, crazy or dead. >> reporter: samuels anies lohan should lay low for a while. over the weekend, new photos emerged, pictures taken in august about which the starlet reportedly quipped, these are for my comeback and then there's this. a new website. lindsay lohan.com which promises to be coming soon. another indication the troubled actress wants to resurrect her career. if that's possible. >> she's going to have to kind of prove that she is reliable. she can't just ride on the coat tails of what she did when she was a teenager. >> reporter: can she deliver?

that remains to be seen and if we believe the tweet, the future is now. priya david-clemens, cbs news. >> joining us from los angeles, lindsay lohan's father michael. michael, good morning to you once again. >> good morning. happy new year. >> happy new year. you visited with lindsay yesterday. give us a quick update. how is she doing right now? >> she is doing unbelievably. e's turned this whole situation around to use this to her advantage and to she has taken the right steps and put the right people back in her life that she had at the best part of her life to really use it as a springboard. >> can i ask you, was that the key? bringing people that were in her life when she was healthy and she was this up and coming star? >> well, you tell me. i mean, when you have the wrong people in your life, it seemed -- she did and didn't seem to work. it makes sense to bring the same team at the beginning it would have a profound affect in her life. there are new additions, lou

taylor and others that are good, new additions helping her out a lot but there's one imperative, key element that's missing. i'll say this now. i don't want to be held responsible in the future. if dina and i can't get on the same page and resolve the differences she believes that we have, it's going to be a neverending battle for lindsay. she needs that stability in her family. all my kids need it. >> can i ask why that is still so difficult when it's really comes down to the best interest of your daughter to have you all on the same page? >> it's a good question, chris. i'm asking this for a long time and saying it publicly. it's -- i don't know what the issue is. i mean, i'm asking dina right now, begging her to put our differences aside, to let our children have a good shot at the future and lindsay have the, you know, close that gap in her life that she was stuffing the wrong things in. i mean, she needs her mom and dad on the same page. they don't need to be involved in the differences.

no children do when parents are separated or divorced. it creates a gap they fill with the wrong things. >> michael, when will she be released from betty ford? >> you know, the question of the hour. it's going to be soon. i'm not going to say it's today but it's a very controlled move. she needs all the right elements in place when she gets out and waiting for that to happen and she's being very patient about it. i'm so proud of where she is now and i don't want that to falter. she's really come full turn. >> let me ask you this. what do you feel is more important? getting lindsay back to work or removing her from a situation and an environment where she really got herself in trouble? >> i agree with you and what you're saying. she needs to remove herself and listen to the people that truly care about her that are on her team. she has legging line. she has a beautiful handbag line she just came out with.

wall street actually had good news in 2010. great year. the dow ended 11% higher. in fact prks it rose more than 5% in december alone. what, though, about the overall health of the economy, especially when it comes to the housing and job markets? for those answers, correspondent rebecca jarvis joins us with the outlook for 2011. happy new year. >> to you, too, erica. >> stocks back to the 2008 pre-crash levels which was a great indicator for people. really strong, holiday retail sales. >> uh-huh. >> but now what? >> now what is the question and people are optimistic. momentum tends to beget

momentum. stocks moved higher. the unemployment rate is stuck at 9.8% but many are saying they think that jobs are going to be coming back. the big sticking point is companies. do companies hire or do they continue to cut costs as they did in 2010? cutting costs was a way that companies were able to make good numbers and wall street happy. >> if unemployment is going to stay, there are some companies that will be hiring so what industries can we look to and what sectors are hiring? >> temporary servicing companies. companies that hire temporary workers have been very strong in 2010 and many think they'll continue to be strong in 2011 and health care. this is a field people think, well, i don't necessarily know science. the reality about health care is they're hiring throughout so people who do paperwork in health care, assistance, those types of jobs out there right now. >> bookkeeping skills are essential and becoming more so. >> exactly. >> definitely a lot of opportunities. when it comes to the new year,

in this morning's "healthwatch" we are doing everything question to help you stay flu-free this year. federal officials say there are widespread reports of a flu outbreak in at least five states. nationwide, the number of visits to the hospital has gone up for flu-related illnesses. medical correspondent dr. jennifer ashton, though, is here with advice how to stay healthy. a few weeks ago we talk about, oh, you haven't seen that many case of flu yet, but it is coming. lo and behold, the good doctor was right. >> exactly. the cdc is reporting across country higher than normal flu-like activity in every state, and in five states, confirmed influenza. in georgia, alabama, mississippi, virginia and new york. so for those people, they're really suffering. >> i see definitely a rise, just with my own friends and family in the week leading up to christmas. my husband got hit way bad case of it. >> people need to understand, erica, this is not just a bad

cold. this is potentially life threatening sending over 200,000 people a year to the hospital. >> how do you know it's not just a bad cold and it is the flu? >> symptoms can be difficult to distinguish between common cold, but basically can includes fever, although you don't have to have feever to have influenza. upper respiratory symptoms. sore throat, runny nose, cough. diffuse body aches, your body feels like it's been hit by a truck and headache. those constellation of symptoms highly suspicious of the flu. kmulry you can go to your doctor and be tested for it. >> they can test you for the flu, which i've been told is sort of actually -- my husband's doctor said i can give you the test, but it's not always accurate. sometimes it's better to just start you on the medication. is that the best treatment. >> if you catch the symptoms with the first 24, 48 hours and you have a high suspicion you have the flu or confirmed with a nasal swab, yes, anti-viral medication can be helpful. otherwise it really has to run

will i do with my time? where do i go next? or exhausted or insomnia. you're fatigued. really mimic depression and usually shorter term. >> we put so much build-up into the holidays, so much run-up to christmas and new year's and when it's gone, you can see how people do kind of first monday after the holidays and a letdown. >> it is. >> i was joking around about it a second ago. the difference of kids and adults. >> there are some. we think kids don't experience that letdown. why wouldn't they? they haven't been in school. their responsibilities have been minimal. getting play with the new stuff and see family maybe they don't see a lot and want to work on getting the kids back into the routine as best as possible and anticipate stubbornness going back to school just like we might feel going back to work. >> that used to kill me. >> sunday night blues is real. >> so let's talk about what we

can do and adults and children both can do. >> there's important things to do. think about what you can do to eat right, to feel right. you want to look at your diet. we have overindulged in every day. too many sweets. so start with replenishing the water supply, start with thinking about eating more whole grains which are going to keep the energy levels up. even nuts. magnesium shown to keep the energy level at a certain level and we want that up. nonsalted nutds are good, lean meats, salmon. things to keep the omega-3s up with the fish and the lean meets with the energy level at an even balance. fruits and vegetables, too. >> diet is so important for your life. >> right. >> talk about the weather, too. >> weather. >> plays a significant role, especially when you have to go back to the dark, gloomy days. >> exactly. we might not have noticed that they happened because we're so wrapped up in the holiday things. you want to get outside. get sun. even if it's a cloudy day, get outside. we have the fabulous sun lamp here. ten minutes a day. i know.
