some of the tinsel stars? captioning funded by cbs good morning. i'm chris wragge. >> i'm erica hill. snowy out there in new york city. >> a little bit of a rough commute this morning. a lot of people this morning are also focused on apple. steve jobs, the last time we saw him in public, that is some older video but there you see one of his most recent public appearances looking frail and he has had a number of health problems and announcing he is taking a leave of absence, a medical leave of absence, saying he hopes to be back soon. a lot of people are focused on that word, "hope." and what this could mean as he steps aside for the future of apple. >> tim cook, the coo has been in this spot a number of times in the past few years will take over on this interim basis.

>> we will take a closer look at that situation ahead this morning. congresswoman gabrielle giffords continues to amaze the experts as she continues to recover from the gunshot wound to her head. her doctors think she may be out of the hospital within days. ben tracy has the latest for us this morning from tucson. >> reporter: doctors here at the university medical center say congresswoman giffords' recovery is nothing short of miles an hour miraculous. >> less than ten days since a bullet tore through giffords brain but her husband says she is showing remarkable progress. she has smiled and given him a neck rub. >> best case scenario i think she could be in her rehab destination within a week. >> that rehabilitation wenon't

easy and could take months. giffords is off the ventilator breathing on her own and nurses have seen her moving her lips. >> i think she could make a functional recovery. that is to reiterate back into society and be an independent individual. we just have to wait and see. >> the parents of 9-year-old christine yeah green, the younger of the shooting victims, say her donated corneas helped save the eyesight of two other children. the accused gunman jared lauf n loughner is in custody in fee administration and spending 23 hours a day alone. >> this is a police station. this is where the whole shaboozy goes down. >> we now see how disturbed he is. >> i'm in a terrible place. >> reporter: but that hasn't answered why he shot 19 people and killed six. >> this is jared. >> those who knew him well say it's exactly what he wants. >> like to the tee.

even this right here. like he knew that his friends were going to come out and speak about him and people were going to try to understand him. >> it's almost like he wants people to just question that. >> reporter: as for congresswoman's congressional seat if you don't surcharge the duties of your office three consecutive months your seat can be considered vacant and election held to fill it. likely they say this will not apply in congresswoman's seat because it is a federal case. joining us is a doctor at the brain rehabilitation center in new jersey. ben made an interesting point at the end of the piece there if a office is vacant for three months they could hold a special election and hope in arizona that perhaps congresswoman giffords could be, they won't have to be concerned about that with her seat. three months is not very much time when it comes to recovery. >> three months would be challenging for her to make a

sufficient recovery to take office but as everyone has said it is a miraculous recovery. as soon as you see this recovery we are hearing about, certainly the better it is. >> beyond it being the more that you see early on, the better it is, does that give you any idea of a time line for recovery or even what may be recovered in terms of what was injured? >> it's really too early to say particularly because we don't have path the bullet took. so i'd hesitate to guess. but we have a basic understanding of the time line of how things will unfold. >> we have heard she actually -- you hate to use the word lucky, but somein some cases, she was lucky. >> you think that a gunshot is worse than, say, the action you get in a sports injury or a car accident or falling our head. but it turns out that it's just a very sgrdiscrete path the bul can take.

it hit one or two critical structures rather than shaking up the entire brain as it would in, say, a car accident. >> we've heard, too, she could be out and moved to a rehabilitation facility in a matter of days. what are the steps that need to help for us to see that and what happens when she gets to that rehab facility? >> you want to make sure they are stable. she has to have her feeding tube in place and make sure the brain swelling is not overwhelming and she doesn't have seizures and no infections and no blood clots. at that point, she goes to the rehab facility and starts therapy. the sooner, the better. >> when you see and hear about all of the signs that there have been in terms of this recovery, is it like anything you've ever seen before? because it does seem miraculous. >> for those on the outside it is and should be miraculous. we see this from time to time. it is on the higher end of expectations but not out of the realm of possibility. it tells me that maybe the bullet was more superficial and

that it just took a -- path. >> let's hope it continues along this miraculous path. this morning, sarah palin isn't backing down from controversial statements she made in the wake of the tucson shootings. meanwhile, the republican-led house of representatives gets back to work today promising to be more polite but no less aggressive in trying to push their agenda. nancy cordes is in washington this morning for us. good morning to you, nancy. >> good morning, chris. >> how are things going to be different on capital now with these debates that take place in the wake of the tragedy in tucson? >> i think you will see some changes, at least at first, chris. the rhetoric has already been a little softer and a little measured and a movement you heard to have republicans and democrats sit among each other at the president's state of the union address instead of having one party on the left and one party on the right. you even heard republicans

praising the president's speech in tucson saying he struck the note on both sides there. >> the first order of real business repealing health care. how tame a debate can people expect with two sides that are just so bitterly divided? >> this will be a test of their new resolve. almost no issue divides them like healer. the press releases are flying in advance of this debate. the democrats have launched new ads attacking republicans for trying to repeal the bill. so i expect this debate will be a heated one. it just might not be as venomous as it it would have been otherwise. >> talk about sarah palin a moment. she gave her first tv interview since the tucson shootings to fox news last night. what did she have to say? >> she accused the left and the news media to trying to destroy her message and trying to destroy her and said she was being accused of being an accessory of murder and defended her use of the cross-hairs and

her term of blood libel. let's listen to some of what she had to sachlt eye that came up right away oh, it must be a cause of this horrendous evil act of this shooter that perhaps he saw that map and that incited him towards violence which, of course, is ridiculous and, again, it's not an original use of an icon or a graphic. i will continue to speak out. they are not going to shut me up. they are not going to shut you up or rush or tea party patriots or those who, as i say, respectfully and -- >> we never said she was an accessory to murder. we simply said she was an accessory to incivility and politics. >> we will hear more about that all day today, i'm sure. nancy cordes, thank you very much. >> sure thing. it's interesting to see the

morning. they are angry because many of the new government includes many members of the old regime. one man set himself off on fire. a deadly suicide bombing in north central iraq this morning. a suicide bomber attacked a crowd outside a police station in tikrit. 45 people were killed and more than a hundred wounded. most of the victims were police recruits. this morning, flooding problems have spread to a community in southeastern australia. residents were forced to evacuate. the rain and flood crisis in australia has now killed at least 30 people. in brazil, amazing rescue a man buried in a mudslide. he was trapped under 13 feet of mud and rubble. take a look at this. rescuers had to dig him out for hours. they finally cheered when he was freed. he was lifted out. put on a stretcher and then t

taken to the hospital. he is expected to make a full recovery. last week's floods in brazil killed more than 660 people. heavy rain in the pacific northwest is bringing more weather problems there. oregon floods pushed across a road near mt. hood yesterday. rescue teams had to reach the people in up to 40 homes cut off. washington state rain and snow melt causing more flooding. our seattle station is in monroe, washington, this morning with the latest. jeff, good morning. >> reporter: good news to report, no rain after days of heavy rain and the rivers are starting to recede. days of heavy rain, though, pushed many of our local rivers above flood stage. in fact, some of our rivers reached 5 to 6 feet above flood stage. flooding farms and flooding homes and so forth. we have seen a lot of scenes of people wading through feet of water. sometimes taking their cars right through those big ponds of water across the roadway and getting stuck. we have had a handful of water

thanks so much. that is your latest weather. now over to erica. >> good morning. thanks. all eyes on apple this morning. steve jobs who has battled serious health issues for years says he is taking another medical leave. he survived cancer in 2005 and a liver transplant in 2009. this morning a number of investors are wondering not just his future but the future of apple. joining us is carmen. glad to have you back. when you see his most recent appent he is frail and e ma. everyone knows how delicate he looks. no surprise he needs to take time off for health reasons. >> not a surprise but what is in the surprise is an announcement. a short six sentence e-mail to st his staff announcing his leave. he said he doesn't know when he

is coming back. he used the word hope. >> a lot of focus on that. that begs the question for a lot of people who will take over because steve jobs and apple are so tight together. but no one can run a company forever. one would think that apple has been preparing for this for some time. >> he has been preparing. of course, he sent out his coo, the chief operating officer, tim cook, who is seen as his successor but concerns. even though the last leave of absence steve jobs took the stock of apple went up 65% in six months and that was under cook, right? but this time, they are wondering, listen. steve jobs runs the whole company. tim cook is the operations retail guy. what about the creative end? what about the innovation? that is what tim cook doesn't do. folks say it will take more than one person to run this company. >> if we look on the positive side, so much of this is steve jobs but there is an entire company, entire team and they innovate not just for apple but

push the industry. is there enough there to keep the momentum going without steve jobs? >> that is the question. down the pipeline the next couple of years things look good. we saw the huge deal with verizon with the new iphone. that is millions and millions of phones sold this year. ipad is coming out in the spring. new operating system for the mac coming out at the end of the year so a lot of things in the pipeline will keep them in the lead in terms of innovation. the blogs a fire what after two or three years, what then? are they going to be leaders or followers? >> that is likely what a lot of other tech companies are looking at now. this could be their opportunity. >> exactly. >> plenty of eyes on it. thanks. >> thank you. still head, hollywood buzzing orricky gervais' performance at the golden globes on sunday night. the big question -- did he go too far with his jokes? were they more like insults or are the celebrities thin-skinned. also ahead a quart of coffee it turns out may be just what you need in the morning.

it's 7:25. time for news headlines from cbs 5. i'm elizabeth wenger. just in from washington, the united states supreme court has rejected an appeal from opponents of same-sex marriage who want to overturn the district of columbia's gay marriage law. and here in the bay area, one person is in the hospital after a fire on the peninsula this morning. the fire forced five people out of an apartment on south grant street in san mateo about 2:00. investigators think a couch that was pushed against a heater caught fire. the oakland raiders will introduce their new head coach later today. hue jackson is getting the job. the team's scoring doubled after he was hired as defensive coordinator under tom cable. the raiders declined to renew cable's contract for next year. more than a dozen san francisco businesses face a forced move to make way for the

virn wa environment. so when it comes to crossing the line with these hollywood star, where do you draw the line, where is the line in your estimation? >> the line in my estimate nation is the comfort level of the stars. the whole reason is to bring together tv and film star which is no other awards show really does to that degree. as soon as reps like me start saying i'm not sure i feel comfortable putting my clients in that position, they're in a lot of trouble. and i've already talked to some people and heard a lot of inside information, a lot of reps called and complained. they just current happy. >> i want to show you a poll that we conducted where more than 60% of the people that were polled said he hit it out of the park. about 25% said a little bit too mean spirited. if you're philip berk of the hollywood foreign press association, would you invite him back considering all the controversy that's been stirred up? >> i think i would think long and hard about it, but philip berk has said, hey, we knew when we hired ricky you've got to

expect the unexpected. and i think that they're going to take the temperature and decide do they want to have an awards show that everybody will talk about and people are talking about it and the ratings were great. >> does hollywood need a little bit more of a sense of humor? >> hollywood has a great sense of humor. a lot of stars have already come out and said they thought the show was great p. al pacino, for one. christian bale, they thought he was hilarious. and most of america didn't hear all these jokes. they were too busy looking at all the celebrities and couples along angelina and brad. >> howard, let me ask you this. the hollywood foreign press, are they looking at all of this publicity both positive and negative and saying will will could really be good for the run-up to next year's show and does that factor into their decision making? do you think they just bring ricky back another year to see how things go and what could possibly happen next year? >> the hollywood foreign press

enlighten us on this story this morning. >> i get nervous before tests even today, and i know i'm going to have to take an esp test in a couple of minutes, so -- let's talk about esp. what exactly is it? >> it's really in most laymen of terms, it's that sixth sense. it's that hunch. it's that gut instukt that we have. it's extra sensory perception. we think of it as this very out there thing. the truth is it's that sense that you can predict something going to happen. we always kind of pull things from our past. this is the idea that our brain can pull things that are anticipated to happen or might happen soon. >> a lot of skeptics out there, as can you imagine, but what does this study say that dispels some of the skeptic that is are out there knees. >> the fact is darrell, who is a very well regarded psychologist and researcher found using 1,000 subjects and nine studies, so a pretty big number, that people do have the ability to predict. with a number that is really the same as what we did and to change our behaviors with aspirin and heart, you know, heart safety. he looked at all these people

doing different studies and found that some people do have this ability to predict what's coming up next before it happens. >> okay. there have been some controversies that a study like this doesn't belong in medical journals, but you seem to think the study is actually good enough that it is. >> he does demonstrate excellent scientific validity in his study. now, the reason i think there's a lot of skepticism is this is something that hasn't really been studied before. we've just kind of said it doesn't exist, and here's an opportunity for us to say maybe it does, and we have to take a leap of faith that his practices are actually valid and right. >> we're going to take a look at one of the experiments that was in this study and conduct. exactly what are we about to embark on here? >> it's going to be a little different than what he did because we can't do exactly what he did. there is a picture behind each of these curtans, and you are going to get to choose which one is going to show up randomly based on which drop? you're going to choose the one closest to you or closest to me? >> i will say closest to me. let's see. there you go. so you're batting 1,000 so far.

could be interpreted as esp during the course of the day? >> the things that make you go hmm. the things that make you saw, wow, that's really strange. i was about to open my friend, and there's an e-mail from my friend already, or i was thinking of some random song, and all of a sudden it comes up on my ipod. those are those things that we go that's just a weird coincidence, but maybe it's not. maybe there's something to it. >> are there personality traits that certain people have that would lend them to be a little bit more -- >> yes, he did find that people who were bigger risk takers tend to have an ability to have better precognition or esp than other people. is it that they are taking risks so they have to anticipate what might come next, who knows, but is more likely. >> do you think when all is said and done and they see that i have esp, that more people will now become believers? >> we are going to keep you as the benchmark, for sure, but i think there needs to be rep indication. we need to see how it can be done again and then we'll know for sure. >> you know what they say, two out of three ain't batted. >> exactly. >> thanks so much.

tips just in general. >> not to get taken again. >> so we have a couple questions that have come in and the first is -- michael is joining us via skype. good morning, michael. >> good morning. >> so what's your question for pete sner. >> i rented a hertz van from the airport and i used my capital one credit card to avoid the currency conversion surcharge. but when i returned the van, i noticed the hertz charged me a higher rate than capital one did. >> sounds like a bait and switch. >> capital one is one of those credit cards that does not charge the foreign conversion rate. the problem is the hertz dealership or the hertz location in ireland converted it anyway. and then charged his card that amount. so the thing is, even though it was not on the original reservation that he did, it was on the contract that he signed in ireland. so the key here is double check the contract before you sign it in that location.

>> so just clear that up one more time. so even though the credit card wouldn't charge him the conversion fee, the way that hertz did the transaction, they were making it a fee? >> they did. now, we contacted hertz and they gave him a full refund, but not because they had to, but because they fully disclosed it in the contract in ireland, but not when he made his rechb reservation. so check the reservation here and ask if they'll do the conversion there. >> so if i was overseas doing this and i was using that same credit card so i'd avoid the fee, i want to be charged in whatever the local currency is? >> without the conversion rate, correct. >> michael, i hope that helps. >> that did, thank you. >> up next a question from sarah who sent will thit this in via facebook. with all the fee, i get confused if child carrier, strollers, et cetera are still exempt from baggage fees to ship. does it count toward the number of allotted bags that you have?

>> here's some good news. we don't get a lot of it it these days in the airline business. strollers and the child seats attached on those stroller, the ones that can be removed, are still exempt. they will check help for you at the jetway or let you bring them on the plane if they will fit in the overhead compartments. so on u.s. domestic carriers, you're still exempt which is great. >> no extra charge. but as we were talking, international, you need to call first. >> every other carrier is another story. >> this next question, this comes to us from martha, and she sent this e-mail. shend she contracted with the vacation store to stay at a time share in florida last may. in august, the resort charged her card an additional $729.98 stating this they had never been

paid by the vacation store. she says she filed a complaint with the better business bureau, the florida division of consumer services. they were unable to obtain a response. so what happened here to martha? >> she paid the travel agency. they never paid the travel provider which is a time share in florida, so they charged her card again. it was a double dip. not the fault of the time share. we got a response. we called the owner of the vacation store who goes by two different names, by the way. and asked what was going on. he claimed he'd never heard of anything. and we said, no, we know we have a trail of those taeattempted. and he called the woman and said to her i'll give you a free vacation and a full refund as long as peter greenberg doesn't go on the air and report about it. well, guess what, we are reporting on it because you didn't do the right thing. we checked with the better business bureau. 37 separate complaints against will guy. so my advice to martha is small

kohara, with your c-b-s five headlines... oakland mayo she good morning. i'm sydnie kohara with your cbs 5 news headlines. oakland mayor jean quan says she was surprised when police chief anthony batts told her last week that he is in the running for the top cop job in san jose. according to quan, batts first interviewed for the job last october but didn't tell her he is a candidate until last friday. tonight, the walnut creek city council will hear proposals for new restrictions on alcohol at bars and restaurants. this comes after an uptick in rowdiness fueled by alcohol including several bar fights. one idea involves requiring some restaurants and bars to stop serving alcohol earlier in the evening. and doctors are speculating about why apple's ceo steve jobs is taking an indefinite medical leave. doctors not involved in his treatment say the two most likely reasons are a recurrence
