yup, it looks like still some 60s, partly cloudy skies into san francisco. 66 oakland. san jose 71. about 72 in concord. more on the forecast coming up. right now, let's check on traffic with elizabeth. >> thank you, lawrence. we're doing pretty good on the roads so far this morning. here's live look at the bay bridge toll plaza. ignore that drive time. it's actually only about 18 minutes right now -- our sensors must be updating. there is a little roadwork on the lower deck of the bridge heading towards the decline so watch out for that. but november delay on the nimitz. that's your traffic and weather. back to you. >> thank you. time now is 4:31. today we expect to learn the names of three people killed on the san jose state university campus. kiet do is in san jose with more on the case being investigated as a murder- suicide. kiet? >> reporter: good morning. we are just hours away now from the press conference where we could learn the names of the

victims and the gunman and the university has already hinted that at least one of them has ties to the school. sjsu said the tuesday night shooting was unprecedented with three dead. over the past 36 hours more details emerged about this murder-suicide. a man and woman were inside their car when they were shot dead on the fifth floor. the gunman fired from the outside of the car and paramedics took him to the hospital with what looked like a gunshot wound to the right side of his head. now, this shooting happened just at about 8:30 at night just before students got out of class. and many complained the schools took too long to let them know about the shooting. >> why do you have an emergency alert system if you're not going to alert us? or where we should be or where we should go? >> as soon as we knew there was no risk, we sent text messages. we notified people within 30

minutes to let people know they are safe. >> so that's why the school said they didn't send a test message out right away because they said there was no immediate threat thank you. san rafael police say it was gang activity that led a man to be stabbed to death, a 21-year- old from corte madera who collapsed in a yard south of downtown yesterday afternoon. police were in the area checking reports of young men running around with sticks and bats and of a white car chasing a red suv. that suv was eventually stopped. they are still looking for the white car. a campbell mother is in custody accused of felony child abuse involving the 3-year-old daughter. police say they found evidence of abuse yesterday while conducting a welfare check at jane marin's home on pollard road. a search began instantly for the mother and daughter, who

were found a short time later in south san jose. police are still searching for the mother's ex-boyfriend. investigators aren't releasing details of the alleged abuse. the 3-year-old was examined at a hospital and is now with child protective services. and there are new accusations against a top bay area cop charged with stealing and selling drugs. former cnet drug agent norman wielsch is now accused of operating a prostitution ring. cbs 5 has learned private investigator chris butler says he and wielsch ran a brothel in a pleasant hill office park. neighbors say they repeated calls to police about all the men visiting the space that's now vacant. >> they were scantily dressed provocatively dressed, you know, always totally, you know, made up. >> now, wielsch's lawyer denied

the prostitution allegations. butler and wielsch already face dozens of felony counts for stealing and selling drugs from cnet raids. neither has been charged in connection with the alleged prostitution. this morning, san francisco police are investigating another video that looks like officers abusing their authority. take a look. undercover officers are going after a by stander who sticks his head in a drug suspect's room while the officers were searching it. you can see they put him in a chokehold. meanwhile, the suspect says never gave permission for police to enter his room in the jefferson residential hotel. and that contradicts the police report. after the public defender's office released the video police announced an internal investigation. >> so the internal affairs division has begun an investigation and the chief instructed them to give this case the highest priority to determine if there is any merit or not to these allegations. >> also in the video, the

officers take a duffel bag from the man's room. that bag was never booked as evidence. the suspect says he never got the bag back, which contained an ipod, bottle of tequila and clothing. the officers are still on the job as police investigate. well, the giants fan who was beaten into a coma outside dodger stadium may be back in the bay area soon. 42-year-old bryan stow is expected to be moved to the uc- san francisco medical center next week. he has been in the southern california hospital since he was attacked march 31. the website following stow's progress says he is being given fewer antiseizure medications and has been moving more in the past couple of days. this morning, federal aid is on the way to neighborhoods devastated by floods in mississippi. president obama has signed a disaster declaration for 14 counties. around the state, people are

using boats to navigate flooded streets. high water from the mississippi river damaged hundreds of homes and businesses and the worst may be still to come. mississippi' governor has told people to get out now if they think their homes will flood. we'll have live report on this at 5:15. all right. in the meantime, let's get a quick check of traffic and weather. lawrence? >> you haven't been up here this early in a while , huh? >> this early. or this long. yes. >> brings back memories. >> oh, yeah. >> or otherwise. [ laughter ] a lot of clouds around the bay area but not as cloudy as yesterday, just partly cloudy skies. a sliding cold front into the state mixing out some of the low clouds. going to see a little more sunshine as we head in toward the afternoon. numbers outside right now, cool in sports, you're clear right now in santa rosa and they have watched that temperature drop to 43 degrees. you have some clouds though into oakland at 54 and cloudy skies into san francisco at 52 degrees. still, we are expecting a

little more sunshine today and how about these temperatures? warming up pretty nicely. lots of 70s showing up in many of the interior valleys even around the bay you may see some temperatures sneaking into the low 70s into fremont and into san jose, 50s and 60s with patchy fog at the coast. next couple of days will look good. but chance of rain developing by saturday night. better chance of rain for the entire bay area towards sunday and monday. let's check your opinion traffic with elizabeth. >> thank you. mostly we have overnight roadwork going on right now including the usual stretch through pittsburg. eastbound 4 they have one lane blocked off as you approach loveridge towards somersville road. should be wrapped up by about 5:30 or so this morning. again, not causing any delay, not seeing any slowdowns for your westbound highway 4 ride as well in the commute direction. dumbarton bridge more roadwork here, as well. again, going against the commute. eastbound 84 as you approach the high-rise, watch out for various lanes blocked until

about 5:30 or 6:00 this morning. in the meantime, you can see maybe that traffic is very light right now approaching the dumbarton bridge toll plaza. no problems. san mateo bridge top speeds. here's live look across the span. the right side of the screen, that's the commute direction. westbound 92 should be about a 13-minute drive right now between hayward and foster city and the peninsula. and for marin county commuters, so far they have not done the lane change on the golden gate bridge. and traffic is just one little lonely headlight there traveling across the span heading into san francisco. aw, yes, from juliette. back to you. >> thank you. 4:39. local transit agencies are often targets of criticism but a new study suggests silicon valley is the second best place in the nation for mass transit. the bookings institution ranked 100 metropolitan areas. the criteria include how many people live close to bus on train stops and the percentage

of transit passengers who cab get to work in less than 90 minutes. the san jose sunnyvale santa clara metro area ranked number 2 behind honolulu, hawaii. also ranking high, the san francisco, oakland, fremont area in san franciscoth. other california regions in the top 20, fresno, modesto and bakersfield. hundreds of bay area commuters are expected to leave their keys at home today for "bike to work" day. oakland organizers say at least 700 cyclists participated last year. volunteers will help with energizer stations this morning offering snacks and drinks to cyclists. in addition to oakland and san francisco, "bike to work" day events will be held in other counties from alameda to sonoma. all right. time now 4:40. waiting months to get your new driver's license, how the dmv is finally fixing its big backlog. that's coming up.

already to big oil. you're doing just fine on your own. and you don't need the taxpayer giving you an extra handout to help. >> reporter: fueled by high gas prices and a soaring deficit, members of the senate finance committee are expected this morning to grill top executives from chevron, develop, conocophillips, bp america and exxon exxonmobil. >> feels like we are getting gouged. >> i don't think they have done anything for us except taken our money. >> reporter: senate democrats have introduced a bill they say would lower the federal deficit by repealing $21 billion in tax breaks over 10 years. but republicans and even some democrats argue that's not the answer. they fear taxing the oil companies will only end up hurting consumers th most. >> higher gas prices, fewer

american jobs at the expense of american energy? that's their plan. no thank you. >> reporter: the oil industry is also expected to come out swinging against the proposalna . statement ahead of today's hearing, conoco's chief executive described the plan's tax reforms as unprecedented and un-american. tara mergener for cbs news, washington. time now 4:45. president obama says automatic spending cuts and tax increases will be key to any compromise plan for reducing the nation's deficit. he made his comments in a town hall type meeting with cbs news. the president says congress needs more incentive to negotiate. >> well, i think that what we're going to end up having to do probably is to set some targets and say, you know, those targets have to be hit. if not automatically, some cuts

and tax increases start taking place and that will give incentive for to us negotiate and figure something out. >> part of the president's plan calls for tax increases on the wealthiest americans. republicans say that would cause further harm to the economy. now, you are correct watch the town hall at 8:00 this morning right here on cbs 5. san jose-based cisco systems says it's preparing to cut thousands of jobs worldwide as part of a cost-cutting plan to get profits growing again. cisco's sales bounced back from the recession but started stalling again last year. the company's ceo announced yesterday he wants to cut annual expenses by $1 billion or roughly 6%. cisco is the world's largest maker of computer networking gear and the largest private employer in san jose. 4:46. it was a huge headache for the dmv and drivers. how it's finally fixing the delay with its new licenses.

commutation, has a constitutional duty under marcy's law to include the voices of victims. in this case, this clearly didn't happen. >> the lawsuit filed by the victim's family and the san diego district attorney seeks to reinstate the 16-year prison sentence. she oversaw the execution of four men but this morning, a former warden is fighting against the system she once led. she was warden at san quentin from 1999 to 2004. today the antideath penalty group death penalty focus will announce her as their executive director. she says that as a catholic she was never in favor of capital punishment but professionally she had a duty to carry it out. woodforde tells the "l.a. times" the death penalty serves no one and is an unnecessary financial burden to taxpayers. and a court hearing is planned today for a controversial memorial to

victims of the 1978 massacre in jonestown, guyana. 1900 members of the people's temple died at the direction of cult leader jim jones. he also died and the controversy is over the inclusion of his name on the memorial plaques at evergreen cemetery in oakland. some victims' relatives do not want jones' name included. >> ng a reporter in the middle of his a large earthquake knocking down a church in spain nearly crushing reporters in the middle of this live shot. he holds on to his mic and continues his report. the 5.3 magnitude quake destroyed several buildings and cars in the tourist town of lorca. the quake killed 10 people. all right, folks. if you are just getting up, got some partly cloudy skies around the bay area this morning. not as cloudy as yesterday.

we are not seeing drizzle at the coast but it looks like as we head through the day these temperatures will improve as we see more sunshine outside. we are going to see some 70s popping up in some spots inland. breezy inside the bay but not bad, 60s at the coast, mix of sun and clouds. you will continue to see a gentle breeze. this cold front falling apart here and that may be just enough to start mixing out parts of the north bay. clear in napa and santa rosa. off the coast this guy right here. eventually this is going to start to drop down off the coast and by this weekend, we could be talking about some rain. that's right, some rain returning to the bay area. let's talk temperatures as we will see a nice day in morgan hill, 74 there. 70 los gatos. 70 fremont. at the coast, we'll keep the temperatures cooler in the 50s and low 60s in the half moon

bay area. you will see a mix of sun and fog at the coast. inside the bay afternoon sea breeze kicks in at oakland. 64 in richmond. 70s in many spots well inland toward the afternoon. we'll squeeze in a little more sunshine today. and it's going to hold in the north bay, as well. lots of 70s in the valley so we're looking good there off toward the coastline winds kicking in and, of course, you're starting out with patchy fog this morning to keep temperatures down mainly in the 50s coastside. looking out over the next couple of days, i think these next two are looking good as we'll see a lot of sunshine, a mix of sun and clouds early on and then by the afternoon, you will see a lot of sunshine out there. as we head in toward the weekend, though, clouds roll in on saturday. by saturday night, there is a chance of rain developing. i think rain becoming more likely especially into sunday. could see some lingering showers and then it looks like another storm may move in next tuesday. that's a look at weather. elizabeth, how about that

traffic? >> thank you. let's go towards the benicia bridge. things look great across the benicia bridge. southbound 680 you're fine all the way towards martinez. you can see traffic moving fine across the span. we just learned that that roadwork on eastbound 4 through pittsburg is gone. picked up a little bit ahead of schedule, too. now, westbound and eastbound traffic looks great in and out of antioch. to the south bay, and we're seeing mostly top speeds. these are live traffic sensors. they are picking up great speeds coming up 101 from morgan hill, guadalupe parkway, delay-free. not much overnight roadwork in the south bay, either. so here's live look at the 280 traffic heading out of downtown san jose. a few headlights there approaching the 880 interchange but it's a quick trip even as you make your way towards cupertino. the east bay, all the approaches to the bay bridge so far look great. slight delays in maybe some of the far left cash lanes but overall not too bad. it's the lower deck where we have that roadwork. three left lanes blocked until 6:00 this morning. also we just learned that the first street and essex street on-ramps are both going to be

makes the new version of the licenses. one bay area lawmaker wants the contract with that company to be renegotiated to avoid problems in the future. sharing the same name as the founder of facebook could get you knocked right off the site. it happened to attorney mark zuckerberg. the company disabled his account saying it looked like a fake one. this is not the first time he had to prove his identity to the social media site. two years ago, he sent facebook his driver's license, passport, barnum, even his code to get into court. all to prove he was officially mark zuckerberg. >> how many friends did you have? >> i had about 350 and you know i had all my pictures on there, too. >> after a reporter called facebook about the situation the company said it was in the middle of reactivating his account and apologized for this mistake. one outrageous hat in the royal wedding could actually be
