>> won't be long. now if we can only get the weather right. we had a lot of rain around the bay area, reports of tornadoes in the central valley. things calming down today. almost 70 toward concord today. but the holiday weekend is coming up. will we see rain? we'll talk about that coming up. first elizabeth has traffic. things are light heading into the city. we have better news this morning if you ride the alameda harbor bay ferry. service has been cancelled for the past few days but it sounds like they are set to resume this morning at 6:30 out of alameda. >> thank you, elizabeth. police station in san jose investigating their 20th homicide of the year this

morning. >> they are. the latest happened just before 11 p.m. at checkers. kiet do joins us from the east side. >> reporter: live in east san jose close to the crime scene. it's a very active crime scene still going on that happened just a couple of hours ago. those are crime scene text standing next to a white colored volkswagen. in fact, you can see some of the evidence markers that are still on the ground. they were combing through the grass for clues, also. when officers arrived at 11:00 they found a man laying in the street. he died at the hospital at 11:24. that is pretty much it. that's all we know. we hope to get an update from an lieutenant out here. the street will be closed for a

couple of hours. this is the 20th homicide for the year. san jose had 20 homicides in all of 2010. so here we are now with 7 months left to go and looks to be a deadly year for san jose so far. so we'll be out here on the scene for a couple of hours. they hope to have the streets open probably before sunrise but looks like they are still trying to figure out what happened. >> thank you. the lapd says it is satisfied with the results of a police line-up featuring the prime suspect in the bryan stow beating. police wouldn't give any other details. now that giovanni ramirez has been put in a line-up, we are showing you his mugshot for the first time and you can see how it compares to the sketch witnesses gave police after the beating. there are some similarities. ramirez denies any involvement though saying wasn't even at the game because he was babysitting his 10-year-old daughter at the time. his lawyer visited him in jail yesterday and explained why he

believes his client is innocent. a lot of it is the way he asks. he is in tears. he is willing to take a police polygraph. i have never had anyone say that before in the 40 years i have been practicing criminal defense. >> tmz showed these pictures of family members at the game. their claim is that since ramirez isn't in any of the pictures wasn't there. the lapd says they are pleased with the case and expect criminal charges to be filed shortly. bail has been raised to $5 million for the woman accused of kidnapping her granddaughter in contra costa county. 4-month-old ramy gallego back with her parents in knightsen. 58-year-old erica gallego from southern california is accused of taking the baby over the weekend. police say she threw a fake baby shower and wanted to pass off the child as her own. a vallejo man is in custody suspected of severely injuring

his girlfriend's baby. joseph alan wilson arrested yesterday in minnesota. he will soon be extradited to solano county. that one month old baby boy brought to children's hospital oakland friday. the infant is in critical condition with brain trauma, bleeding and broken ribs. a high school senior from oakland is dead, the victim of a shootout three weeks before his graduation. this all happened just before 2:30 yesterday afternoon on ritchie street near bancroft avenue. witnesses told police that two teenagers were shooting at each other. vivian franklin, jr., was riding his bicycle when he was struck. investigators still trying to clarify if the victim was targeted or just caught in the crossfire. police are asking witnesses to come forward. >> it's not the oakland police department that solves crimes. it's the community with information that solves crimes. >> no suspects so far. franklin was a student at leadership prep high school. 4:35. your electric bill no surprise could be going up soon

if you're a pg&e customer. today the california public utilities commission is scheduled to vote on a proposed rate hike. the utility wants to charge all residential electrical customers a flat fee of at least $2.40 a month. it also wants to raise rates for customers who use the least amount of electricity and lower rates for the big users. more than 60 lawsuits against pg&e will be the focus today of a pretrial discussion in san mateo county. the suits stem from last year's deadly explosion involving a pg&e gas pipeline in san bruno. it killed eight people, destroyed 38 homes. today's conference is expected to include coordination of future trial dates and requests for documents, as well. well, tornadoes continue to ravage the midwest. >> but it is a rare twister in northern california that's got people talking this morning. take a look. >> right there. you go it. we got a funnel! >> that is a funnel cloud

turning into a tornado in butte county north of sacramento. it is just one of three tornadoes reported in northern california yesterday afternoon. they were part of an unusual late season cold front. they all hit in pasture land so there was no significant damage. there is a chance of more severe weather today, though, from a storm system that slammed several states this week. we have new video now of the deadly tornado that hit chickasha oklahoma. at least 13 people were killed in three states tuesday. more tornadoes yesterday causing minor injuries in missouri and indiana. the search for survivors continues this morning in joplin, missouri. and remember that truck driver whose rig was blown apart by the tornado in oklahoma? he is now talking about his ordeal. yes, he lived. we showed you the video. he pulled off to the side of the road when he saw the twister coming and he used his cell phone to record the tornado that was bearing down on his rig and then it hit. >> i felt the driver's side of

the truck come up off the ground. closed my eyes, put my arms over my face and bounced around in the cab a little bit. not real sure if i blacked out. i know that i was laying on the ground and picked myself up and looked over and the truck was on its wheels. >> that driver escaped with only minor injuries. >> you saw him in the sling here. i guess he only had a broken arm which is remarkable when you see the truck. >> we saw it blow apart. >> crumple. >> weather-wise i think we're look good today. i had a lit chat with lawrence. >> yeah, he said, it better not rain today! [ laughter ] >> a zonal flow things moving from west to east right across the pacific. we'll see some clouds moving across our skies but looks like we should stay dry at least for today. by tomorrow another chance of rain returns to the forecast. temperatures outside partly cloudy skies, 40s and 50s at this hour. i think as we head toward the afternoon we'll see a little more sunshine today and

comfortable numbers in toward the afternoon. still cool in spots. and running a little below normal. 68 degrees in livermore, 67 in fremont and about 69 degrees in napa. at the coast still breezy and 59 degrees in pacifica. next couple of days, yup, there's more clouds on the way for tomorrow, a slight chance of showers mainly north of the golden gate bridge. as we get to the weekend, the unofficial beginning to summer, well, it's not going to be real hot. but right now, looks like it's going to stay dry while saturday, sunday and probably into monday maybe some showers return like elizabeth wants the middle of next week. closure until 5:30 this morning. they may have one lane re- opened. we were seeing some slowing on our sensors in those eastbound lanes. they have now disappeared and turned to green. westbound traffic has been getting by fine from antioch towards concord. more roadwork near the 880/92 interchange should be wrapping up here shortly by about 5:00 this morning. and for right now crossing the san mateo bridge, here's live look at conditions across the span. looks good this morning heading towards foster city and the peninsula. that's a check of traffic. back to you guys. >> thank you. 4:40. a "get out of jail free" card for hundreds of inmates. the glitch that put dangerous criminals back on the street. plus, a bay area man takes judgment day to the extreme. how he risked his life because of the rapture. these people i think can make it no matter what they do. >> who needs a degree? why some silicon valley students are getting paid to drop out of college. after we make a dingy floor look brand new, it's not uncommon for the term "hero" to be bandied about.

all right. we should see a little more sunshine around the bay area today. 50s and 60s into palo alto and berkeley. could be a little more rain in the forecast. we'll talk about that coming up. it is 4:43. the death of a man is being blamed at least indirectly on the prediction of the rapture. the "contra costa times" quotes an investigator who says the judgment day procrastinatormation made a florida man believe that god would help him swim across the 80-acre reservoir in contra loma regional park near antioch. that 25-year-old man couldn't swim. but went into the water anyway telling his family that he believed god was going to come save him. he died on friday 20 minutes after the first of the world ending series of earthquakes was supposed to have started. the state of california has released hundreds of violent criminals from prison by mistake without any mandated supervision. state inspector-general blames

it on a computer error. a seven month investigation found a faulty computer program wrongly assessed the potential that inmates will commit more crimes if they were released. >> it's a get out of jail free without parole supervision card. >> parole agents in the state of california are prohibited from tracking these parolees. >> the corrections department got the computer system after convincing lawmakers it could assets inmates better than human beings could. but it has an error rate of over 23%. some of those released have already gone on to commit new violent crimes and the state says there is no way the felons can be put back behind bars. the bart board is expected to decide today whether to buy stun guns for every officer on its police force. that was one of the recommendations from an outside consultant following the oscar grant shooting death in 2009 by an officer who said he thought he was reaching for his taser, not his gun. price tag would be $140 now for

130 new tasers, holsters and extended warranties. so how much is a college degree worth these days? >> one silicon valley tycoon is paying students to drop out. 24 teenagers will be paid $100,000, not to go to college for two years. instead, they will use that time to work on their entrepreneurial ideas. the paypal cofounder launched the program. he says college can sometimes get if the way of creativity. one of the winners is from palo alto. >> the intent of the fellowship is not to pay kids to drop out and pursue their ideas. these people i think can make it no matter what they do, like, they're that good so i think it's a great idea to produce like really good opportunities for the future. >> award winners are working on projects ranging from biotech to economics. >> sounds more like a sabbatical. >> these 20 kids get two years and the fact is they will probably get into any college after two years if their idea

morning. looks like the weiss there, carla bruni, the wife of french president nicolas sarkozy. looks like the wives there. the president will have one on one meetings with leaders of france, japan and russia. one issue involving russia is the u.s. plans for a missile defense system based in europe. it is 4:49 now. the criminal case against the man accused of shooting congresswoman gabrielle giffords and killing six others is now on hold. a judge ruled that loughner is not mentally fit to stand trial for the january shooting. experts concluded that he suffers from schizophrenia. before the ruling, federal marshals dragged loughner from the courtroom screaming. he will remain in custody until september. and another hearing will decide whether his condition has improved over the next three months. elizabeth smart got her first chance to address the man who held her captive and raped her for months when she was 14. it took smart about 30 seconds to speak her peace to brian

david mitchell, who closed his eyes and sang hymns as she spoke. yesterday, he received two life sentences without parole. smart told him he took away nine months of her life that can never be returned, that never affect her again and that she will have a good life despite what he did. >> i told brian david mitchell today in court that whether he received his just sentence here on earth or after this earth life that one day he will have to be responsible for his actions. >> smart is now 23 recently returned from a mormon mission to france. she says she plans to finish college and is considering a career in law. the walt disney company has withdrawn its application to trademark the name seal team 6. that's the same name. elite navy team that killed osama bin laden. okay. seal team 6, disney, not sure if that goes together t had applied for the trademark rights two days after the

military raid in pakistan. the company pulled the plug on its application after the navy moved to protect naming rights. all right, folks. just getting up today? we have some better weather for you. if you like sunshine you will see more of that still some partly cloudy skies to begin the day, temperatures in the 40s and 50s out the door. this afternoon more sunshine and mild temperatures in most spots. inland cool inside the bay and at the coast. breezy toward the beaches. temperatures expected to be in the 50s, upper 60s in some of the warmest spots. so things beginning to settle down now as we have more of a zonal flow. that cold front has moved by. a lot of clouds sweeping into the northern parts of the california state today but we'll see clouds making their way across our skies too. but it should stay dry for the most part. cool to mild around the bay area and breeze especially at the coast. friday yup we are going to get clipped by this next system. but most of that energy stays north of the golden gate bridge. so a chance of showers to our north. more clouds for the rest of us.

temperatures, 69 degrees today, a lot of sunshine toward morgan hill. 67 milpitas. 50s at the coast and breezy in the afternoon. east bay sunshine and a couple of clouds. about 69 in antioch and brentwood, 68 degrees in livermore. and about 65 degrees in oakland. our friends in the north bay a little cool at the coast. temperatures there mainly into the 50s. inland more sunshine and some warmer weather. 60s in those spots, almost 70 in the napa valley. clouds roll in and a chance we could see some showers mainly to the north on friday, but the weekend, the unofficial beginning to the summer season, looks like cooler than normal. but right now, elizabeth, it looks like at least it is going to stay dry. >> well, that's great. we like it when it's dry. thank you, lawrence. so do our photographers who have to stand out in the rain sometimes when it's all messy outside for a morning commute including edgar, who is showing us a live traffic shot right now. he is loving the dry weather and he is standing by 101 near

the mckee accident. hid lights moving northbound and everything looks great in the south bay. no major issues. thank you for that live traffic shot near the mckee exit. to our maps we have much better news. alameda harbor bay ferry riders, they are expected to resume service at 6:30 this morning coming out of alameda. so it has been cancelled for the last few days, winds caused some damage to the docks but again normal regular schedule supposed to be starting this morning. bart systemwide on time as well as ace train number one. mostly just roadwork going on right now including on the dumbarton bridge. eastbound 84 as you approach the high-rise various lanes blocked until about 6:00 this morning. this is ongoing roadwork on the dumbarton bridge. it really hasn't seen any big delays because of it. you can see here is a live look at the bay bridge toll plaza. we also have some roadwork across the span here on the lower deck as you head towards treasure island. watch out for that. various lanes blocked until 6 a.m. golden gate bridge more roadwork. you can see a little slowing
