[ laughter ] >> think positive it's going to stay looking good. thank you, elizabeth. topping our news, nursing student michelle le was the victim of a homicide. >> that's the conclusion of the hayward police department now. the le family plans to make statement today about the new developments from the police. she hasn't been seen since may 27 when she left class at kaiser hospital in hayward during a break. her car had been in the kaiser parking garage although it was later found parked on a nearby street. >> the investigation is telling us that the person who did this intended to do this to

michelle. we have confirmed that michelle's car was in fact parked in that garage and we do believe that's where a -- some sort of confrontation took place. >> and that's where the homicide took place. >> yes. >> police say video from surveillance from the garage and cell phone records from her phone led them to believe there was a confrontation. investigators returned to the home of a former friend of le's. neighbors said the friend told him she had a falling out with michelle. >> because michelle had an affair with her ex and -- and that was a cause of grief for her. she didn't say grief but that's what i interpret. >> he also said the woman told him she didn't have anything to do with michelle le's disappearance. other people who live in the area say the police left with a few bags of items from her apartment. we'll have a live report on this story coming up at 5:00. her infant son was shot and

killed and this morning, a grieving bay area mother pleads with parents to be involved with their children. yvonne garcia lopez and her husband were wounded when someone opened fire on the family in their car in east palo alto sunday morning. their 3-month-old son was killed. >> i tried to protect them as soon as i heard the gunfire. i protected the 4-year-old with my body and i tried -- i thought that i had protected my baby in the car seat. but one of the bullets went into his head. >> a 17-year-old is under arrest now. police are searching for more suspects. they think the shooting was in retaliation for a gang beating the suspect suffered last week and that this was just a case of mistaken identity. the mother whose baby was killed wants parents to pay attention to their children so they don't get in with the wrong crowd. tonight tributes to honor the memory of two san francisco firefighters who died battling

a house fire last week. anser hussein is at at&t park where the mayor will make one of those tributes. >> reporter: good morning. san francisco fire department doesn't know the cause of the fire last thursday that killed two san francisco firefighters. but the city isn't wasting time in honoring two of its heroes. tonight mayor ed lee will throw out the first pitch in their honor. lieutenant vincent perez and firefighter tony valerio both died fighting a house fire last thursday. the two veteran firefighters were first on the scene last week of the diamond heights house fire. reports indicate that the two were caught in what's called a flashover. that's when everything in a room ignites all at once causing a huge surge in heat and flames. the two were taken to sf general hospital. perez died on thursday. vincent passed away saturday. less than a week later, company 26 [ signal breakup ] a

gathering spot for those who want to pay respects. they have gotten cards from hundreds of firefighters around the country. coit tower will be lit up in red tonight in honor of the two firefighters. the game starts at 7:15. mayor lee will throw the first pitch at 7:05. >> thank you, anser hussein, in san francisco. attorneys for the man suspected of beating bryan stow says there is video proving their client is innocent. lawyers for giovanni ramirez filed a motion yesterday to get surveillance video from a hollywood motel. they say it shows ramirez checking into the comfort inn the day after the attack at dodger stadium in march and he had hair at the time. witnesses to the attack say the suspect had shaved heads. ramirez remains in jail on a parole violation but has not been charged with the beating. police in pittsburg asking for the public's help after a series of violent attacks on a

popular walking and jogging trail. the latest incident on de anza trail happened friday. a good samaritan was attacked as he tried to help a woman being harassed. police say that that woman was held against her will by three men at about 10:45 in the evening. that was after the trail's curfew of 10:00. someone tried to help the woman and the suspects told him to go away. then they grabbed and kicked him and stand him twice with a pocketknife. and just last month a 19-year- old man was shot. now some residents are weary of using that trail at any hour. >> i wouldn't recommend anybody walk on it. >> it's like so long and there's no houses to where you can run to if somebody does attack you. >> police say they are trying to step up patrols and they are asking anyone with information about the recent attacks to come forward. pg&e is doing more pressure testing on gas lines today. today's tests will be in south san francisco. the testing is being done in an

effort to prevent another pipeline explosion like the one that killed eight people in san bruno last september. 4:37 now. let's check traffic and weather. lawrence is everyone's best friend this week because he is delivering. >> yes. we are bringing the sunshine back today. that is right, frank. we're finally going to catch a break from all the stormy weather. that area of low pressure finally kicking to the east and moving out. now, there's still some clouds outside but they're low clouds, typical for this time of year. temperatures right now under mostly cloudy skies running generally into the 50s outside. kind of a mild start to the day but i think you are going to love the finish as we are going to see a whole lot of sunshine outside and look at these temperatures. 72 livermore. 73 santa rosa. 60s and 70s inside the bay, cooler at the coast with low clouds and fog of temperatures

rising over the next few days. a weak ridge of high pressure bringing mostly sunny skies peaking on thursday and friday. but staying dry all the way through the weekend. how about that? >> i'm very excited. thank you, lawrence. westbound 92 approaching clawiter road waiting for tow crews to get out there. the main lines of the freeway, activity on the shoulder. westbound towards the san mateo bridge, there is a live look. those taillights are moving westbound toward foster city and the peninsula. about a 13-minute drive right now if you are coming out of hayward. so that incident there at clawiter shouldn't slow you down too much. roadwork, the nimitz 880 through oakland, northbound past high street you will find various lanes blocked until about 5:00 this morning. again, no major delay but watch out for the construction worker out there. and same thing on the dumbarton

bridge. eastbound 84 approaching the high-rise various lanes blocked there until around 6-ish. typically they pick that roadwork up a little bit ahead of schedule. and the bay bridge light heading into san francisco. that's your traffic and weather. back to you guys. >> thank you. there will not be a state ethics investigation involving a former governor schwarzenegger's affair with that housekeeper. the state fair political practices commission turned down a request from l.a. democrats for a probe. the fppc says the democrats did not provide enough information to warrant a probe into whether the former governor violated rules about campaign finances. this morning a new york congressman says he will fully cooperate now with a house ethics investigation. >> anthony weiner came clean yesterday tearfully admitting that he did in fact send lewd photos on twitter. >> last friday night i tweeted a photograph of myself that i intended to send as a direct message as part of a joke to a

woman in seattle. once i realized i had posted to twitter, i panicked, took it down and said that i had been hacked. i then continued with that story to stick to that story which was a hugely regrettable mistake. this woman was unwittingly dragged into this. >> the congressman also said that he has exchanged sexually explicit pictures with women over the internet for the last three years! he says he has never met any women or had -- or had physical relationships with them. he won't resign or split up with his wife. >> incredible. you tell the kids now with "sexting" and texting -- once it's out there it's throughout. >> and such a public figure and then lying to his wife and constituents, his staff. now coming clean... >> and to just do it in the first place.

councilman. today the voters in hercules will decide whether to recall the mayor and a city councilman. the allegations against the elected officials include financial mismanagement and sweetheart deals and jobs for friends and relatives. one of the challengers is gerard boulanger. now he was on the hot seat for pumping up his resume'. >> my mistake is i translate both my education and my political skills in france into the system here. >> boulanger claims to have served on both the city council

and planning commission in his original hometown in france. he also said he has master's degrees in engineering and best administration but none of those claims are true. it is 4:45 now. the fate of a massive redevelopment plan on treasure island is now in the hands of the board of supervisors. the board will consider an appeal by opponents of a plan that would add 8,000 homes for the former naval base. it also adds 420,000 square feet of retail space t comes with a $1.5 billion price tag. environmental groups are worried about the impact on the bay bridge traffic. another step towards building a new stadium for the 49ers in santa clara. a committee will update the city council on efforts to work out financing. the status report is expected to provide the clearest picture yet of where the money will come from. officials have been working on the funding since voters approved a ballot measure just a year ago. apple has unveiled its new music software but it is steve

jobs' health that has the attention of investors this morning. jobs temporarily emerged from medical leave yesterday to promote the new service called icloud at an developers conference in san francisco. icloud stores your music, documents and photos on the company's servers. jobs looked particularly thin and frail and as soon as he took the stage, apple stock started to drop. it closed down 1.5%. nintendo about to unveil a new gaming console. >> the next system will be shown off at the e3 this week in l.a. nintendo hasn't yet announced a name or described its features but it will be a successor to the very popular wii game console. industry experts say it's certain to support high definition gaming, something the wie lacks. sony unveiled its next generation portable gaming divide called the playstation vida. it allows gamers to be

from 22 helicopters. the fire has sent smoke and haze across five states all the way to iowa. a much smaller fire in california's gold country now 75% contained. this fire near lake isabella in kern county charred hundreds of acres burning through heavy grass and timber on steep terrain. 300 firefighters are working on it. all evacuations have been lifted and the cause of the fire is still under investigation. well, bay area fishermen say they have never seen anything like it. >> you love this story, don't you? >> yes. >> she is a fisher woman. do you like sturgeon? the population booming in san pablo bay. it's attracting fishermen from all over the bay area and they have some fish stories to tell, too. >> all of a sudden bam, my line hit again. i was trying to let go the fish that just pulled in the boat and had another one on already. turned out to be a 62"-er behind a 42"-er i just caught

up. >> not everyone agrees why there are so many out there. some say it's bad weather and something good that came from all the june rain. >> out the door, we have mostly cloudy skies today and well, we don't have to worry about the rain. that's the good news. these are typical low clouds and fog outside. that is going to break up in the afternoon in many spots. more sunshine on the way, warmer temperatures, highs in the mid-70s warmest spots inland, 60s and 70s inside the bay. at the coast couple of clouds to keep you cool there. but if you are stepping outside right now a lot of clouds across the entire bay area and we are keeping the temperatures fairly mild right now mainly into the 50s. if you do plan on traveling around the state you will find 70s, almost 80 in the sacramento valley. watch out in the high country still a chance of lightning storms in the afternoons, late in the day. still it looks like finally going to get things right as

the storm system is winding down. no real strong ridge of high pressure just yet. we have this area of low pressure that's driving down the coastline today. that may spark some thunderstorms in the sierra nevada but all in all looks like more sunshine coming our way and high pressure will be building in over the next few days and as it does we are going to warm those temperatures up. today not a bad start. 69 degrees in sunnyvale. looking good further inland today. 74 brentwood, 71 walnut creek, 60s inside the bay. north bay 60s and 70s. napa valley 72. 73 in santa rosa, 70 degrees in san anselmo. next few days, high pressure building into the bay area. those temperatures moving well into the 70s many spots inland on thursday and friday, cooling down into the weekend but elizabeth, you got to love this. we have sunshine and dry conditions right on in through

sunday and monday. >> that 76 went up to 77 inland. all right. thank you, lawrence. i'm paying attention. back out to hayward, westbound 92 approaching clawiter road waiting for tow crews to clear an accident, road off the embankment. activity on the shoulder. main lines of westbound 92 look okay. towards the san mateo bridge one more live look, 13 minutes out of hayward towards foster city and the peninsula. the nimitz again there is still a little bit of ongoing roadwork on northbound 880 past high street. this is a live look near the coliseum. all of our sensors across that stretch from hayward towards downtown oakland are giving us top speeds. silicon valley commuters ride on westbound 237 light. typically around 7:00 we start to see delays towards san jose
