california. so at 8:45 this morning, the first lady will be at a breakfast reception at the claremont hotel in berkeley. then she is going to head to san francisco for a luncheon. that one will be at the merchants exchanged building in the financial district. both of them are to raise money for president obama's re- election campaign. guests will pay $1,000 for general seating at the berkeley breakfast and then up to $25,000 to co-hose the event featuring from food from star chef alice waters. the san francisco luncheon, $2,500. some republican leaders are questioning whether taxpayer money is paying for mrs. obama's trip. we'll have a live report on the first lady's visit at 5 a.m. of the race for the gop presidential nomination off to a polite start. >> they are just getting started. the first major republican debate last night, thought to be a slugfest but as sharon chin shows us, that just wasn't the case. reporter: 7 republican

[ indiscernible ] filed the paperwork to -- michele bachmann filed her papers. minnesota congressman had been indicating a formal announcement would be later this month but she threw her hat in the ring last night. coming up on "the early show," bob schieffer will host a special town hall meeting on the economy and the republican leaders starting at 7:00 here on cbs 5. this morning, house democrats will meet behind closed doors and discuss the "sexting" scandal that involves congressman anthony weiner. he is resisting calls from his colleagues to quit. yesterday, president obama commented on the scandal. he said if were in the same situation, he would resign. democrats do have several options including passing a resolution urging weaner to quit or simply stripping him of committee assignments. in local politics it's do or die tonight at san jose for mayor chuck reed's controversial budget plan. the city council will vote on a proposal including deep cuts to

deal with a deficit estimated at $115 million. it calls for an across-the- board 10% cut to pay benefits for city employees. it would also lay off more than 100 police officers, reduce hours for libraries and community centers, and outsource several services including park maintenance and airport security starting in two weeks. elsewhere the police chief in san francisco plans to hold a community meeting to discuss a deadly officer-involved shooting. san francisco police shot joshua smith last week after officers said he tried to run them over with a car. now, josue smith was suspected of robbing two banks in southern california. the fbi called him the gen x bandit because the suspect was caught on surveillance video wearing plaid in both robberies. chief greg suhr will meet with the public at 6:00 this evening at the harvey milk art center to discuss. napa police are trying to

solve three brazen attacks by groups of young men, the worst last month near california boulevard and oak street. four to six suspects attacked a father of six as he was walking home. he is in a medically-induced coma after his head struck the ground when he was knocked down. >> he had a brain bleed and his brain was swelling and they didn't know what his outcome was going to be. today he is not able to remember his mom, who she is. and he is not able to remember our kids' names. >> two other victims are recovering after a similar attack. one 16-year-old was arrested for one of them. a santa clara man is behind bars this morning accused of murdering a woman whose body was found in a garbage bag in sunnyvale. 47-year-old feliciano va lenses yeah santiago was arrested on friday. police believe he killed 46- year-old maria esther orozco of san jose in a vacant home and

then dumped her body on a front lawn on ticonderoga drive. investigators are trying to find a motive for the killing. the federal judge in the fight over the legality of proposition 8 says he hopes to issue a ruling sometime today. backers of the ban on same-sex marriage want judge james wear to overturn another ruling by another judge that threw out prop 8. but yesterday the judge sounded skeptical that judge vaughn walker's relationship with another man was relevant. there was no indication that he planned to marry and had a stake in the outcome. >> we may need to bust out the shorts today. >> maybe i already have. i had them on yesterday. >> get them out there. >> thank you. we are going to see some nice weather, some of the warmest weather we have seen in sometime. we have a couple of patches of fog thick at the coast. watch out for that especially some dense fog there, even a little drizzle at the beaches. but that marine layer is compressed meaning it's going to break up in a hurry.

temperature now 59 degrees and clear in concord. 55 in livermore. 51 dense fog showing up in pacifica and some drizzle too. by the afternoon a whole lot of sunshine come our way. 81 in fremont. 84 degrees in san jose and sunny there. even 77 degrees in oakland. you get the idea some of the warmer temperatures we have seen in sometime. and it's going to continue. looks like into tomorrow a whole lot of sun coming our way maybe patchy fog overnight but otherwise offshore winds keeping us mostly clear. then as we head toward the latter part of the week temperatures begin to cool off as more of a sea breeze kicks in and the temperatures drop off toward the first part of the weekend. how about that, elizabeth. >> i like it. is that two 90s i see? >> back to back. >> awesome. love it. thank you. on the maps, mostly roadwork going on now across the bay area. if you are commuting down through marin county, southbound 101 sounds like

raises and potentially tougher disciplinary procedures. >> all we're saying is we want respect for the work that we do in the city and we want to basically be in a position to do our jobs without people looking over our shoulder treating us like children. >> there was talk that workers may strike over the contract. but there is no word what the next move may be. the agreement is expected to save more than $41 million in the next three years. and now this from muni. another operator caught breaking the rules. one of our viewers posted this clip of a driver smoking on an n-judah train. we contacted muni. the agency says it has a strict no smoking policy and will issue a reminder to drivers. muni says it will identify the operator and hold a personnel hearing before taking appropriate disciplinary action. 4:44. a 49er legend joe montana recovering after being hurt in a car accident over the weekend. not exactly clear what happened. his attorney would only say his

the bay area something we haven't been able to say in quite a while. mostly clear skies inland but patchy fog at the coast, even drizzle at the beaches early on. but by the afternoon, that is all gone and the sunshine is going to really crank things up today. 70s to 90s in the valleys, you get the ideas. 60s and 70s inside the bay even at the coast should become mostly sunny there and temperatures up well into the 60s in many spots. so high pressure takes hold. we have a weak offshore wind that's helped to bring you that ridge of high pressure and the offshore winds will clear out the skies for today and warm the temperatures up outside. so that strong ridge holding for today. looks like probably tomorrow, too. and then it will start to weaken somewhat and we'll begin to see more of an onshore push kicking in. so enjoy the temperatures today. about 84 degrees in san jose, getting hot in morgan hill, 90. 83 milpitas. at the coast should be a nice beach day if you want to head there this afternoon. 66 degrees in half moon bay

about 65 in pacifica and about 79 degrees in fremont. east bay the 90s inland this afternoon. 92 brentwood, 91 antioch, about 88 in livermore. 76 degrees alameda. north bay looking at lotta's fountain toward the afternoon, lots of 60s at the coastline. those offshore winds cranking the numbers up in santa rosa to 87 degrees. 90 in fairfield and 88 degrees in the napa valley. so you get the idea, some of the hottest temperatures we have seen will continue likely into tomorrow, maybe slight cooling at the coast. and then we get more of a sea breeze on thursday. that will help to drop those temperatures around the bay area through thursday and friday. toward the weekend, though, we could very well see the temperatures warming up. that's a look at weather. let's check of traffic with elizabeth. >> thank you, lawrence.

control, still encourage routine screenings for autism. and there apparently is no need to get rid of that family's pet when a baby arrives. a study in the journal of clinical and experimental allergy shows that infants who grow up with pets are 40 to 50% less likely to develop allergies to those animals. researchers say early exposure to pet bacteria and allergens may actually boost a child's immune system. >> and it's fun. >> i'm sure the dogs and cats are relieved. >> yeah. >> speak of cats, there is a bay area cat lover who is celebrating a really big win against the irs. >> jan takes care of more than 70 stray cats in her home in oakland. the neighbors must love that. the irs had rejected her tax return after she tried to deduct the cost of putting up the animals but she appealed that decision to a tax judge and she won her case. >> i argued that it was no different from a daycare center where you can deduct a portion of the house and a portion of
