francisco. and 880 through oakland looks okay. there still may be some ongoing roadwork in the northbound lanes past high street. continuing southbound more roadwork through hayward should be wrapping up within the next hour. check of mass transit coming up. back to you guys. >> thank you. saggy pants, believe it or not, got a man tossed off an airplane at sfo and put in jail. >> anne makovec is in redwood city where the man is due in court this morning. anne, how did this happen? >> reporter: he was taken to jail being held on an $11,000 bail. now he is facing charges of trespassing, battery on a police officer and resisting arrest all because of saggy pants. his name is deshon mar man. he was in town to speak at the funeral of his friend high school football star david henderson shot last month. marman was at sfo when a flight

attendant asked him to pull up his pants to hide his underwear. he refused here's his mother. >> deshon refused to pull up his pants because he had his bags in his hand. and the lady asked him to pull up his pants and said, i will as soon as i get a free hand. i don't think that was soon enough for her. >> reporter: then the crew ordered everyone off the plane. police say when marman got off, he refused to be put in handcuffs. there was a scuffle and an officer twisted his knee. that's where those extra charges come in. deshon is on a full football scholarship to the university of new mexico so his mom is concerned that this whole ordeal could affect his scholarship and therefore his future. the next thing in the future though is a court hearing sometime today. we have heard it is scheduled for 1:00 this afternoon.

we'll be on it for you. grace and frank? >> it's a little early. i understand. it's 4:30. i'm right there with you. anne makovec in redwood city this morning, thank you. right now oakland police are looking for clues in a deadly shooting overnight. officers were called to the 600 block of el paseo drive near the san leandro border around 11:30. they found a man who was shot. he died at the scene. police are tight-lipped on details and no word on a suspect. in the mean timed, the search is on for the gunman who shot a man in san francisco just after 11:00 last night. a man in his mid-20s was shot several times in the stomach at third street and newkom avenue. police saw a white vehicle leaving the area. tomorrow the family of michelle le will launch a three- day search operation to find

the missing nursing student. they will meet with police today to discuss possible search locations. le was last seen on may 27 at kaiser permanente in hayward. police are calling the case a homicide but they have yet to find a body. the man suspected of raping an oakland woman and was videotapes on her cell phone has been caught. oakland police found 47-year- old dion mcdaniel hiding in a doghouse tuesday near that same apartment where the woman was allegedly assaulted last week. officials said mcdaniel had been on the run since tv stations started airing the video. police describe him as a career criminal and a parole violator. a union city man facing child endangerment charges as his 5-year-old son is hospital ease upped with a head injury. the incident happened monday on monterey drive. police say [ indiscernible ] told them he threw a metal object during an argument. it accidentally struck his son.

malik was arrested yesterday. the "oakland tribune" says the boy is in critical condition. monthly meetings on controlling gang violence now have a more urgent tone in san jose. the mayor's gang prevention task force had its latest gathering at city hall last night. the city's murder rate is up sharply from last year and more than 100 police officers are about to be laid off to reduce the budget deficit. about half of the city's 27 homicides this year have been linked to gang activity. >> we could be pushing up to 13, 14, gang-related homicides when last year we finished with 6 for the whole year. >> last year san jose had just 20 homicides, one of the lowest per capita murder rates among major u.s. cities. the city is now on pace to hit 59 this year. that's slightly higher than san francisco's. many who spoke last night are concerned that the lack of officers will just encourage even more gang crime. there is a new state budget deal on the way to the

governor's desk. >> they were faced with no pay if they didn't do it. they passed the budget on time for the first time since 1986. the senate and the assembly approved bills to cut into the remaining $9.6 billion deficit in the state and didn't need any republican support, either. they include raising local sales taxes by a quarter of a percent, hiking car registration fees by $12 and cutting $3 billion from schools. now, part of the budget online shoppers can expect to pay a little bit more. a sales tax on internet purchases passed the legislature yesterday. the online tax would generate an estimated $200 million a year for the cash-strapped state. but some say the backlash could outweigh the benefits. amazon has already cut ties with thousands of advertising affiliates in some states that have passed similar online sales tax laws. >> amazon isn't going to pull out of california. what they might do is say,

it's been a long road but this morning, arizona congresswoman gabrielle giffords is waking up at home with her astronaut husband. doctors released her from rehab yesterday. it has been five months since she was shot in the head in an assassination attempt. even though the congresswoman still struggles to speak and walk, doctors say going home is a key milestone. >> the congresswoman is elated. this is a major step in her recovery and she is feeling very good about it needless to say. >> at home, giffords will receiver round the clock care. she will spend six hours in outpatient therapy every day going over speech, physical and occupational therapy. she has until may of next year to decide whether she will run again for election. 4:45 now. it is the end of the rough road for muni's embattled leader. chief nate forbes will step down at the end of the month as the agency is in the middle of a labor dispute in addition to

they say they eat the fish they are trying to catch. so those fishermen want permission to kill sea lions in the waters of the columbia river, below bonneville dam. a house subcommittee is working on ways to make it easier to kill those sea lions. "."i think that's a shame, i know the salmon are very important as well, and are this last few seasons, so, somewhere we got to find a compromise, and i don't know if that s it."" the government is capturing some of the sea lions that are eating salmon on the columbia river.. they're moved if possible, but many of them are killed. there's nothing like human breast milk to provide nutrients and fight disease. but now scientists in china and south america are producing milk
