7:01 am
this thursday morning, june smashing windows and "early" this thursday morning, june 16th, 2011. captioning funded by cbs good morning. welcome to "the early show." it is 7:00 a.m. on the -- excuse me. just a few moments ago, we learned that congressman anthony weiner plans to resign from congress. nancy cordes is in washington with the latest for us this morning. good morning. >> reporter: good morning, chris. our new york city city cbs affiliate has confirmed that congressman weiner will announce his resignation as a press conference in the new york city area thorkt. a short time ago, we got a sense that something might be changing in this story because at his offices on capitol hill, a staffer walked out of the door, locked it and walked away with a box. that was a big change. because in the past couple of
7:02 am
weeks, even when he hasn't been there, even when he has been on this leave of absence he has been tag the taken two weeks the office was operational. the place was up and running. now the door is locked and everyone is gone which may be a sign he is, indeed, intending to leave office in week three of this scandal. >> one thing we did know during the course of the scandal he said before making a decision, anthony weiner said he wanted to talk to his wife what was overseas with secretary of state clinton before making a decision. do we think this weighed into the decision here? >> reporter: i'm sure it did. she returned yesterday morning landing at andrews air force base and then to their home in washington, d.c. we don't know whether she took a flight to join him at this undisclosed treatment facility. or whether they talked by phone. she said the pressure became intense this week with democratic leaders calling for him to resign and the president saying he should resign and the

new photos and texts coming out leading democratic leaders to say it was just too much for him to be able to continue to do his job effectively and then just, yesterday, another bombshell. a former porn star coming out to say that he had tried to engage her in sexual conversations. >> i did not sex anthony weiner. i did not send photos to him or receive any from him. >> reporter: the former adult film actress who now works as a stripper, says weiner contacted her online after she praised him on her blog. in about 100 messages back and forth, the two mostly discussed politics but, from time to time, she said, the congressman tried to get personal. >> any time that he would take our communications in a sexual direction, i did not reciproc e reciprocate. >> reporter: her lawyer, gloria allred, read some of the suggestive e-mails alive. >> all right. our package and i aren't going to beg. you aren't giving my package due credit.
7:04 am
i have wardrobe demands, too. i need to highlight my package. >> reporter: lee attracted attention after the scandal broke because she was one of only about 200 people the new york congressman followed on twitter. she turned to him for advice. >> he asked me to lie about our communication. i put out a three sentence communication he told me to say. >> reporter: lee says she has a different view of the politician she once ghir admired. >> i think he said resign because he lied to the press for more than a week. >> this is all a hoax. >> it might have turned into the truth but he kept lying. >> reporter: she said she would cooperate are an ethics investigation. >> now she needs to return to work and resume her career as a feature dancer, which is how she was supporting herself before she became entangled in this twitter sex scandal. >> reporter: ginger lee says she didn't sell her story like several other women because she
7:05 am
didn't want to be the one to throw someone who she used to admire under the bus. >> nancy, to repeat for the folks at home we can confirm that congressman weiner will announce his resignation at a press conference in the new york city area later on today. what can we expect to be next for the congressman after what has been a very embarrassing few weeks here? >> reporter: gosh, a great question, chris, because for a lot of politicians in this type of position, we have seen in the past, they have sort of gone underground and stayed away from public life, but congressman weiner has always been someone who had very high ambitions. he wanted to be the mayor of new york. he was very public about that. and many of his constituents still support him. a majority of constituents in recent polls said he should stay in office, so it's possible that he might leave public life for a while and then try to re-enter it. we just don't know. i think we will learn more about what his next moves will be at that press conference this afternoon. >> i think when the scandal first broke a lot of people sat back and said it won't get much worse than this but we have seen
7:06 am
it unfold it has gotten worse with every development that has surfaced. do we think there is potentially more damaging material out that may surface in the next few days? >> it's always possible. he always said he oncommunicate with six women in this fashion and i think we have heard roughly from that number. if that number escalated that would be a new development. >> nancy cordes in washington for us on this breaking story, thank you. another real and present danger. a shadowy group of hackers is claiming responsibility for taking down the cia's main website. the same group that broke into the u.s. senate's group over the weekend. cbs news national correspondent david martin is at the pentagon this morning. what happened here, david? >> reporter: well, last night, for a couple of hours, people couldn't get on the cia website and that was as a result of what is called a denial of service attack by claimed -- by a group called lull security which specializes in these attacks.
7:07 am
and what happens is that the attack generates so many bogus requests for information, that legitimate users cannot get on the site to use it. this morning, the cia says the, quote/unquote, technical issues are now resolved and that website, cia.gov is back up and running. >> no real sensitive information was acquired by these hackers? >> this was a website anyone can go on to do anything from, read the cia director's latest speech to look for a job at the cia. there was even a section for kids. no classified information. you didn't need a password to get on. i'm sure a colossal headache for the administrators of the site but no damage to classified information here. this was a prank but i am quite certain the cia is not laughing. >> cbs' david martin at the pentagon for us, thank you very much, david. america is now involved in

wars on three different fronts. iraq, afghanistan, and libya. and it is the third one that is really causing a lot of issues right now in washington. congress claims the president has overstepped his bounds and is abusing the war powers act. the white house argues otherwise. cbs news senior white house correspondent bill plante has the latest now for us. bill, good morning. >> reporter: good morning to you, air consierica. the question is whether the president has the authority to continue operations in libya without the consent of the congress. the white house has now answered in a report which says that president obama is acting in both the spirit and the letter of the law. the law at issue is the vietnam era war powers resolution. passed over president nixon's veto that says a president must get congressional approval to deploy the military in battle for more than a total of 90 days. >> the idea of the war powers act, when it was passed was, to
7:09 am
limit the ability of the president to continue u.s. involvement in a conflict. if you're in it, you're in it. if you're out of it, you're out of it and we're still in it. >> reporter: the report released by the white house believe current military operations in libya do not require because u.s. forces are playing a constrained and supporting role in a multinational coalition, unquote. it also says that the u.s. forces are not involved in sustained fighting and there are no u.s. troops on the ground. lawmakers demanded to know the cost of the u.s. mission in libya. the white house says it was almost $716 million through june 3rd and is likely to rise to $1.1 billion by september 30th, which is currently the end date for the nato coalition. in answer to another question from congress, the report says the operation in libya has had no significant impact on u.s. efforts in iraq and afghanistan. and driving the white house position home, spokesman jay
7:10 am
carney says congress should continue supporting the libyan mission. >> now is not the time to send mixed messages as we haved success we have had in that mission. >> reporter: house speaker john boehner's office called the report creative but says it raises a number of significant issues which must be further explored and, at the same time, the number of members of the house of both parties filed suit against the president to end the war. >> bill plante at the white house this morning, thanks. five months ago, arizona congresswoman gabrielle giffords was clinging with a gunshot wound to the head. today she is out of the hospital. don teague with this story. >> reporter: this happened rather quickly and quietly. gabrielle giffords is out of the hospital staying at her husband mark kelly's home here in houston but her recovery does still have a long way to go. it was just four days ago that
7:11 am
the world caught its first glimpse of gabrielle giffords face since that awful january day when six people were killed and giffords lay gravely wounded, and now word she is leaving the hospital. >> the congresswoman is elated. this is a major step in her recovery and she is feeling very good about it, needless to say. >> reporter: as tucson continues to more than the victims giffords's remarkable recovery is an inspiration for people like susan heilman who brought christina taylor-green to see her congresswoman. both were shot and christina shot. now she sees hope. >> if anybody is going to do well is gabby. look at that snil. she will be back. i have confidence. >> reporter: confidence is something those around giffords have expressed repeatedly even back in january as she lay unable to speak and barely able to communicate. touching her husband astronaut mark kelly's hands. >> she will be walking and talking and, in two months
7:12 am
you'll see her walking through the front door of this building. >> reporter: it's been much longer than two months. five months have now passed and even though giffords attended the recent shuttle launch "endeavour" commanded by her husband she continues to struggle to speak according to our colleagues and friends but progress is still progress and with this latest news. >> it is going to be a significant boost to her abilities and her morale to be able to go home every day. >> reporter: giffords will have 24-hour medical care at home, but doctors say physically, she is doing very well. chris? >> don, now she is actually headed home to mark's home there in houston, does that change anything for her from a medical standpoint. >> reporter: yes and no. it does change the fact she will be undergoing intensive physical therapy with the same medical team she has had. she will now get to experience the joys of houston traffic every day and the other little
7:13 am
bits of normal life which is very positive for her, despite what you might think about traffic, getting out of a hospital and back into a home environment is very important. the question doctors have now is how well all of this helps her brain function which is what we are continuing to work on at this point. >> don teague in houston for us, thank you very much. not only is traffic an issue, humidity is also a problem. >> you never thought you would look forward to traffic and humidity quite so much as gabby giffords is. jeff glor is at our news desk with more headlines. good morning. al qaeda announced this morning that osama bin laden's long time number two is now in charge. in a video eulogy for bin laden last week, ayman al zawahiri warned america is faces a worldwide muslim rebellion. he worked with bin laden for years. it believes he is living along

cbs news has confirmed that disgraced congressman anthony weiner will resign today. welcome back to "the early show." >> not entirely shocking but the story of the morning. latest from washington. nancy cordes is covering the breaking story and in our washington bureau this morning. so, nancy, give us the latest at this hour. do we know when this official resignation will happen? >> reporter: right now, we are hearing 2:00 eastern time in brooklyn, new york. we don't know whether his wife huma will be at his side when he announces his resignation. we are told he called democratic leader nancy pelosi and steve israel last night to inform them
7:31 am
that he did, indeed, intend to step down and, of course, the two of them, in particular, had been putting a lot of pressure on him over the past week, telling him he should step down and making that public and then indicating they might consider stripping him of his committee assignments if he didn't go ahead and resign. >> we did now know he is going to resign. you mentioned his wife huma may or may not be at his side when it happens later today. he had said he he was waiting for her to get home before he made a decision. clearly, they had some discussion. >> reporter: i imagine they did. we are told she arrived early yesterday morning in washington, d.c. and don't know whether she has traveled to be with him or not. one would assume they were probably having some preliminary conversations while she was abroad with the secretary of state. but i think that the wheels were probably already in motion before she got back. once the president himself weighed in and said that anthony weiner should resign, i think he had very few avenues left.
7:32 am
>> this has been qoing on quite some time. he said his twitter site was hacked june 8th and the calls had already started for his resignation. what happens now? what happens to his seat? and is there even any talk of his future at this point? >> reporter: there is likely to be a special election. unfortunately, they have a lot of experience with this in new york recently. two other members in congress in the past 18 months have had to step down. under somewhat similar circumstances. you had congressman chris lee who bared his craigslist. special elections were held and those seats have been filled and most likely happen here. as for congressman weiner's future, he is quite ambition. he may be hoping, overtime, the scandal will fade away and he can re-entry public life. >> when all of this started, there were calls for an ethics investigation.
7:33 am
given the fact he is now resigning, is that officially off the table? >> reporter: typically, that is what happens. it doesn't have to happen that way but, usually, members of congress do not like to investigate colleagues who have gone ahead and stepped down. they don't like to waste their time that way. so, most likely, if he does leave office, that investigation will just be tabled. >> nancy cordes in washington this morning, thanks. >> sure thing. jeff glor is at the news desk with another look at the headlines. >> good thursday morning to you. al qaeda announced new leader this morning. he is ayman al zawahiri,
