good evening, i'm juliette goodrich. ann notarangelo is off tonight. topping our news, a deadly crash shocked and stunned a san jose neighborhood, after a cash slammed into a building, where nursing home patients gathered for activities. one person is dead. six others injured. it happened just minutes, or just before 10:00 this morning at the amberwood gardens home on peterson avenue in san jose and anne makovec is has -- has more on the tragedy. >> on a quiet morning at amber woods nursing home, no one could have seen this coming. >> here comes a car. >> reporter: a 90-year-old woman trying to park in the space dries through a wall of windows and a beam, straight through the dining room where more than a dozen dementia patients were preparing to exercise. >> that noise, the noise, they

can't get past the noise. >> reporter: the car pushed several whole chairs landing against this wall, knocking out a metal door. and the wheels still spinning, melting tiles on the floor. >> she was still on the gas until somebody came into the car and actually, you know, pulled her out and shut the car off. >> reporter: the driver was okay but six residents and one staffer were taken away by ambulance. >> i'm shaken by the core. >> reporter: kim is a care giver for a 100-year-old woman who she came to take for a walk. >> i saw her sock and her shoe laying there full of blood and i kept asking everybody, where is suzanne? where is suzanne? i see her sock and her shoe, where is suzanne? >> reporter: she was at the hospital, her wheelchair demolished. >> i kine of feel bad because i feel like if i had been here at 9:30, you know, i would have taken her out of there. >> reporter: the families of those that are left are worried, too. >> he is just shocked. he is in shock. big time shock. i don't know what to do to get him out of here. >> eric chin was the therapist

in the room when it happened. >> sorry, like for the families, for the person who did it, and for everybody who kind of is affected, i'm sorry that it happened and there is no way anybody can really control something like this. >> the maintenance staff here expects to have this room fixed and everything back to normal by tuesday. in san jose, anne makovec, cbs 5. new information tonight on that deadly collision between a truck and an amtrak train that killed five people. the california zephyr was heading from chicago to emeryville. the truck slammed into it in a nevada desert near love lock about 70 miles east of reno. nevada highway patrol officials say he tried to brake before slamming into the train, there were tire marks at the crossing, the truck and the train burst into flames, the truck driver and one person aboard the train are confirmed dead. the highway patrol says five to six people died, and 20 others

why injured. >> it is like a bomb exploded over the war zone. it is crazy. bloody people everywhere. not good. i was just sitting there, riding the train, looking out the window and next thing i know, get hit by something. a big ball of fire comes in, jump out the window. >> you jumped out the window? >> yes, we were on fire. >> the search for victims is going slowly because the burned out train cars are unstable and too dangerous to enter. >> a very visible symbol of this weekend's gay pride celebration is on display tonight in san francisco's twin peaks. this morning about 100 volunteers installed a huge pink triangle to honor gay victims of the holocaust. organizers say it serves as a reminder of discrimination against gays and other minorities around the world. >> those who stand up and fight for their rights get their rights and that's what the pink triangle is. we're trying to remind people of where we started and where we've come to today. >> the pink triangle is almost

200 feet across, and one acre in size. it can be seen from about 20 miles away. hundreds of thousands of partying people in the streets of san francisco right now. for pride weekend, and this year, there is much to celebrate. don knapp is at the civic center where the party is just about breaking up. hi, don. >> reporter: hi there. it is breaking up, and of course these parties are never just a party. they always have underlying social issues. this year, no exception, especially when it comes to marriage equality, getting a big boost from the big apple. the pride party at the civic center was in full swing despite a hangover debt from last year and lingering security concerns after last year's shooting at the castro street party left a 19-year-old man dead. but last year was better says dominique james of sunnyvale. >> it was actually fun. >> what do you think is

happening? why is last year better? >> because last year is hotter. >> and this year security guards are clamping down on alcohol at the street party. it is not allowed. and they use metal detecting wands to check for weapons. the committee says there is enough financial support to pay off groups who claim they were shortchanged last year and many say it has enabled them to significantly reduce a $225,000 debt to $75,000. officially this year's theme is in pride we trust. but there is another idea that is caught on. new york state sudden success with efforts to allow same-sex marriage is encouraging californians lgbt community. >> the victory in new york is a perfect beginning to pride weekend. kicking off pride celebrations with full marriage equality in the empire state. it really was a dream come true. and it really inspires us in california to get back the marriage equality that we had here in 2008. >> california's law is headed for the u.s. supreme court.

>> it is a step by step process. and so the new york victory is hugely positive i think for the battle. and the more states that we have with full marriage equality, by the time the case reaches the high court, if it does, i think the more comfortable the court may be, with ruling in favor of the plaintiff. >> molly mckay who has been the pride weekend face of same-sex marriage for years is here again despite facing a divorce in her own same-sex marriage. >> marriage equality is a basic fundamental civil right. and unfortunately, i'm learning how important those rights are, as we go through a very painful divorce. and yet that is what equality is about. the great wonderful things that come with marriage and the hard things that come with it as well, that we're ready to assume those legal obligations, responsibilities, and what happens in life just like everybody else. >> reporter: molly mckay soldiering on, and the next big event tonight, the dike march as they call it, and starts at delores park and goes to the castro. >> don knapp, thank you.

also on this pride weekend, the passage of a bill legalizing same-sex marriage by the new york legislature could have an impact nationwide. last night's victory made new york the sixth and largest state to allow the union, and activists hope to convince politicians across the country that mainstream americans support same-sex marriage. >> we are really, really happy about new york. and hope to achieve that here in california. so there are still consequences, and there's still, you know, further steps to take, but certainly, this is significant. >> action by congress or the supreme court will probably be necessary, if same-sex marriage is to be recognized nationally. gang-related incidents, they're on the rise in america's safest big cities. why some say they are skeptical about the heavy duty outside help san jose is getting to fight crime. also, what santa clara county plans to do to help keep unwanted electronics from

been a surge of gang killings. kiet do tell san jose is turning to the feds for help in stopping what has been a surge of gang killings. kit dough tells us not just any feds. homeland security agents. >> reporter: starting next week, two federal agents will be working with san jose police to help bust gang members. they are paid for, and will report to immigrations and customs enforcement. now, this has some people in the community nervous, but the chief insists this is not a witch hunt for illegal immigrants. >> if you're a law abiding citizen, we're not interested in your status, and however, if you're causing grief in your community and our community and you're a gang member, we will use whatever resource we have to bring to you justice. >> gang murders are up but the city is laying off 100 officers next week. sjpj says they need the help.

groups are skeptical. >> there is a system in place to catch the bad guys. i think we need to be clear with what the collaboration means for the community. >> in the gang investigations unit, this will be the agent's new home. they will re-evaluate the partnership in six months. in san jose, kit doe, cbs 5. santa clara county wants to keep toxic waste away from children in other counties. and countries. supervisors passed a bill to stop items is such as computers from going to poor countries overseas. where they can be broken down chiefly by child workers. that can expose them to lead, mercury and other toxic materials. the ordinance goes into effect next year. 600 celebrity items up for auction. what belonged to michael jackson that is going up for sale? and the other celebrities who are unloading some of their wares. and temperatures are cooling down just a bit, some showers possibly on the way. i've got your forecast so stay

conference in london where he announced the "this is it" tour. among other items are things from the beatle, janice joplin, fleetwood mack and the grateful dead. a typy pooch from petaluma has been crowned the world's ugliest dog. meet yoda. the mutt weighs about 1.8 pounds. she won the annual contest at the sonoma/marin fair last night. the trophy is about 15 times her size. yoda also won $1,000. yoda got the money? who got the money? she was in the field 14 years ago and the people who found her thought she was a rat. no way. this is the first year that the fair allowed dog fans to vote via text messages. i covered this story years ago. this is a huge contest in sonoma every year. >> i'm glad they got good weather for that. >> there you go. they did. and you could just text message

which one. yoda. >> beauty is in the eye of the beholder. i thought he was kinds of cute. >> getting $1,000. >> i hope he spends it well. >> dog food. >> good weth -- weather so far. >> what we do have is temperatures steadily on the decline and some moisture at the upper levels of the atmosphere. we can see bay bridge right from the shot here. and we're seeing a lot of clouds starting to make their way in, especially some low level clouds, indicative of the air parcels definitely hanging on to some moisture and that's what we see when we get those clouds. here is a look at the high pressure ridge, that is helping steady over the region but starting to break down a bit. and starting to flatten out and starting to see this instability and these clouds work their way in and we can expect that here by tomorrow. and then increasing chances of precipitation, in the meantime. for today, let's enjoy the rest of today. we have temperatures ranging from the low 50s to the low 80s and sunny and breezy conditions inland. and temperatures really nice, low 60s to 80s and bay areas, low 50s to mid-40s or mid-60s,

the effect of that. here is a look at the extended forecast. temperatures steadily decline through tuesday. we will see the increasing instability in the atmosphere. increasing chances of showers and we may see the showers here by tuesday night. and into wednesday. and hanging through wednesday. and then by thursday, it is going to clear on out. the atmosphere will dry out nicely and then we will see an increase in the temperatures as the high pressure ridge starts to hold steady over the region, 90s by friday. kent, how is sports looking? >> serena williams, comeback at wimbledon, continues. and runs were once again hard to come by at at&t park. just the way the giants like it. sports is next. ,,,,,,,,,,,,,,,,,,

that's certainly the case with there is an old saying in baseball. that you can never have enough pitching. and that's certainly the case with the giants. they placed jonathan sanchez on the disabled list with bicep tendinitis and activated barry zito who will start tuesday in chicago. matt kaine gave up two straight singles to start the game. but thanks to back-to-back strike-outs, he got out of a jam. big daddy cain would go on to pitch seven shutout innings. justin masterson got into a jam of his own in the second but blew the fastball past miguel tejada and painted the outside corner to freeze matt cain and strand the runners at second and third. scoreless in the 7th.

the indance reliever gets called for a balk. miguel tejada scores the game's first run. 8th inning. second and third. one out for cleveland. adam everett tries to score on the ground but pab lore sandoval throws him out. javier lopez leaves the bases loaded. they beat the indians 1-0 and have one four straight. . yellow jerseys on the road. taking on cole hamels and the phillies. scott sizemore shoots a single through the right side. cocoa scores to give the a's the lead and trevor kayhill made it hold up. the curve ball, holds jimmy rollins. six strike-outs for kayhill with 7 and 2/3 and picks up the eighth win of the season. the a's beat the phillies 4-1. marty fish is the only american left on the men's side at wimbledon but fortunately on the women's side both williams sisters survived the first week at the all england club. conditioning won't be a factor for serena as long as she's got the big serve working.

and she smashes one of her ten aces right past maria kirilenko. and when a return was saved, she wasn't in a position to do much with it. serena wins in straight sets to advance to the fourth round where she takes on ninth seeded mar i don't know bartoli. and djokovic did not handle losing a set very well and he got a new racket and regrouped to win in four sets. nadal and federer and djokovich advance to the fourth round. third round of the lpga championship. sang has a one stroke lead and ends up five after shooting a 67. the 22-year-old is seeking her fourth major title, paula creamer is tied for 5th but eight strokes behind sang. mls, and galaxy here, the l.a. goalie gets a red card. which of course is an automatic ejection. and they replaced him with the

forward mike mcgee and played the rest of the match, one man down, but the quake couldn't take advantage, despite outshooting l.a. 26-8. and they have to settle for a scoreless tie against the first place galaxy. >> tony stewart is currently 11th in the spring cup standings and hasn't won a race this season but the former bad boy of nascar remains one of racing's biggest stars. >> i don't know what is going on. there i would like to take that finger and jam it up his rear end, i tell you that. >> with tony stewart, you know where you stand. you can call him arrogant but make sure you put winner in the same sentence. >> does this affect your chances of winning the 500? >> i don't know, rocket scientist, i'm sitting here with a backup car. what do you think? >> the bad boy of nascar, is probably a good thing for marketing and your career and can you get that far off the beaten path or do you have to be careful? >> i think we over the last three years kind of shed that role and i think there are some drivers in the series that picked it up. you realize there are a lot more
