in a liferaft just past the cliff house restaurant. one of the men had to be taken to the hospital. they say that their boat capsized when a load of their gear shifted on the deck about 1:00 this morning. this morning, bart will continue negotiating settlements for people impacted by the shooting that killed oscar grant. robert lyles has details of yesterday's settlement with grant's mother. reporter: >> no amount of money can replace oscar. if i got a dollar or $100 million, it still wouldn't bring oscar back. >> reporter: wanda johnson says the 1.3 million settlement with bart today for the new year's day 2009 death of her son brings no closure and no sense of satisfaction. >> what would make me satisfied is that my son would be here. that's what would satisfy me. >> reporter: the settlement does bring to a close some of the bay area's darkest days, including violent protests in the street of downtown oakland and the murder trial of former bart cop johannes mehserle. a los angeles jury ultimately

convicted him of involuntary manslaughter. still, the 1.3 million paid to wanda johnson and an earlier payout of $1 $.5 million to oscar grant's 6-year-old daughter is not a legal admission of fault. >> you can say legally i admit it or not. but the payment of the substantial amount of money is acknowledgement that the officer's conduct itself was wrong, inappropriate, and against the law. >> we took responsibility right after the shooting for what happened. i mean, we -- before anybody was talking settlement and lawsuits. >> reporter: bart is also accepting responsibility for the five cops involved. each is being sued by brothers nigel and jackie bryson, michael greer, carlo reyes, oscar grant's father and one other including claims against johannes mehserle and his fired training officer anthony pirone. >> he should have been

prosecuted. we don't have control over that. >> that was robert lyles reporting. a fairfield business owner is dead after being attacked during a robbery. police say the man was able to call them after the robbery just before 8:00 last night on the 100 block of east travis boulevard. he said he was attacked by three men who stole several items from the store. the man later died at a nearby hospital. so far police aren't saying anything about the nature of the attack or the store where it happened. california is almost certain to have a budget plan in place when the new fiscal year begins this friday. last night state lawmakers approved the deal reached earlier in the week between governor jerry brown and his fellow democrats in the legislature. they say that the plan closes what is left of the state's deficit. that's about $9.6 billion. because the plan contains no tax increases, it only needed a simple majority to pass. but not a single republican voted for it. >> we have our staff going through the bills that have been released to us. we haven't received them all. so it's difficult to do

anything other than stand there and look meaningless and irrelevant. but that's the whole point of a majority vote budget. they don't need us and so they aren't consulting us. >> the plan contains more spending cuts and relies on greater-than-expected tax revenues. if the extra revenues don't pan out, there would be further cuts to education as well as to social services. governor brown is expected to approve this package as soon as today. now, in order to get a budget plan passed, the governor postponed his plan to let voters decide whether to extend some temporary tax increases. that means on friday, the state sales tax will go down from the current 8.25% to 7.25%. that can vary since a lot of cities and counties have additional sales taxes. still, someone buying a $20,000 car can save $200 in taxes by waiting just a couple of days. >> i think when it's going down it's going to have a positive impact but it will be short- lived. >> anytime taxes go down, i

think consumers are happy. if the consumers are happy, i think business owners are happy. >> the temporary tax hikes which expire on friday were approved by the state's lawmakers in 2009. some new information has an expert changing his mind about what caused last year' san bruno pipeline explosion. pg&e released some documents last week that show that the pipeline had operated under a wide range of pressures over several decades. a member of the investigation team says the pressure changes could have weakened the pipe. he earlier thought vibrations from a nearby sewer project probably caused that disaster. meanwhile, the "chronicle" reports that pg&e is cutting the maximum pressure on a peninsula pipeline. the line is just north of the one that exploded last summer. a video inspection showed what the utility calls minor dents and weld problems with that pipe. a move for the prime suspect in the bryan stow beating. giovanni ramirez is not at state prison near san diego. he is expected to spend 10

months there for a parole violation involving a handgun. ramirez has not been charged with the attack on stow. in the meantime, bryan stow's family does not believe that a dodgers fan videotaped arguing with stow is responsible for beating him into a coma. tmz released this video of the confrontation between the two men during that march 31 game. the woman who shot the video on her cell phone told stow's cousin that bryan was not instigating a fight. 4:37 now. a soldier from albany has been killed in afghanistan during his third deployment overseas. the pentagon confirms this morning specialist kevin hilaman died saturday after insurgents attacked his unit. during his career the 28-year- old received several medals including the bronze star and purple heart. he joined the army eight years ago. specialist hilaman was based in hawaii. taliban fighters are blamed for a deadly attack at an

afghanistan hotel. 11 afghan citizens confirmed dead and so are eight attackers. nato helicopters killed three of the gunmen on the roof of the hotel in kabul. afghan security forces rushed to end the standoff. the local police chief says the victims were all hotel employees and police officers. the attack happened as high level officials were gathering there for a meeting to discuss transferring the country's security to afghan forces. 4:38 now. a lot of people walking around said they were enjoying the rain and the cool weather yesterday. >> boy, i didn't see any of those people. [ laughter ] >> i was driving across -- >> well, one. >> that's a lot? >> at least you saw one, grace. somebody appreciated the weather out there. >> right now, we can see the center of that low is right over the forecast region although that moisture band is heading to the east. still the possibility of showers and thunderstorms for the inland area as that moisture wraps around and does build a lot of instability but for the most part we have cleared out so we are definitely feeling the cooler temperatures. it will warm up by the end.

hours for hazmat crews to clean up the crew. five acres of the surface was covered in the northwest area of the lake. the lake is about 140 acres. san jose police are investigating a rash of strong- armed robberies in the city in a 16-hour period ending yesterday morning. the locations are widespread, little saigon, valley fair, blossom valley and the north side. no one was seriously injured. there is mow indication of any connection between these crimes. >> from the information that we have right now, we can almost unequivocally say it's a coincidence. we don't believe they are related. >> in the valley fair case, a thug forcibly grabbed a bank deposit bag from two store employees. 4:43 now. one problem related to a construction project at stanford has apparently now been resolved.

a $5billion project to expand stanford medical was put on hold last week. that's because of its potential impact on the nearby daycare center for children of university staff and students. now the daily news reports that there is a plan to move the daycare to a site away from the construction zone. google diving into facebook's turf. i guess so. the site unveiled its new social network service yesterday. it's called google plus. they invited a few users to give it a test drive. it has the same features as facebook like sharing photos, videos and links but it's designed for smaller groups of friends. google plans to use the information to offer personalized search results. one of the first social networking sites may be sold today. a "wall street journal" blog says that the news corporation may sell its struggling myspace for $35 million. remember myspace? it marks a major loss for the company who bought the startup for $580 million in 2005.

for the second straight day in egypt. they're considered the most significant demonstrations since d protestors are clashing with security forces for the second day in egypt. they are considered the most significant demonstrations since the uprising which toppled president hosni mubarak earlier this year. police in riot gear have deployed around the interior ministry and using tear gas to keep protestors under control. some of the demonstrators have been responding with rocks as well as firebombs. and some more intense protests in europe where a crucial vote is set for today in financially troubled greece. we have live pictures. police are cracking down on protestors in athens. you can see large groups right there. today parliament will decide whether to adopt more austerity measures so the country can receive another bailout. the bill is aimed to prevent default. the incoming head of the international monetary fund

will have to deal with this european debt crisis when she takes over next week. french finance minister christine lagarde will be the first woman to head the imf. she will serving five terms. her predecessor dominique strauss-kahn resigned after being charged with sexual assault. the pope is going digital with his prayers. pope benedict xvi launched the vatican's new web portal. he tweeted, dear friends i just launched news.va. he just learned how to publish messages on the site. the injured to reach out to the faithful with modernday forms of communication like online videos. well, if you are heading out the door, conditions right now, we are still seeing some clouds, the center of the low right over us. we are looking at low 50s to high 50s. a cloudy start, some sprinkles. but overall we are definitely seeing an improvement in the weather.

this afternoon mid-50s to high 70s, sun and clouds for the inland areas. a 20% chance of showers and a very slight chance of thunderstorms. i did want to add that into the forecast because we do have that instability overhead. partly cloudy skies for the bay and sun and clouds, cool for the coast. some breezy conditions there. here's a look at what we have going on. there is the center of the low that's making its way towards the east. it will dry out, will pave the way for a warmer weekend. here's that high pressure system that will build nicely and that is what we can expect by the weekend so definitely a lovely holiday weekend on tap. santa rosa expected high 68. napa 69. vallejo 67. oakland 64. san francisco expected high 62 degrees. so we are still keeping conditions below average as far as those daily highs go. but that's because we do have the influence of that low pressure system overhead. as we take a look at our extended forecast, we can see that we do definitely have some wonderful news on the way. we have warming temperatures by thursday as that high pressure ridge starts to move over the

region. holds steady by friday, 90s in the forecast for friday, 90s all the way through tuesday. so we're definitely seeing warmer temperatures and clearer skies. that's your weather. here's elizabeth with traffic. >> thank you, erika. and let's go out live to san jose. here's live look near the alum rock exit. and our photographer edgar has been standing by so far this morning and he reports that traffic has been moving great. and you can see those headlights moving northbound towards santa clara, southbound traffic looks good, as well. and elsewhere we have cameras all over the bay area. here's another one near the dublin interchange. headlights moving westbound into pleasanton right there approaching the dublin interchange. so far pretty nice drive. in fact, let's go to our maps. the drive time across the stretch, 16 minutes now coming out of the altamont pass. take you out towards 680, and the dublin interchange, seeing a couple of slowing sensors out there making your way through livermore but overall, not too bad of a ride in those westbound lanes. elsewhere, antioch westbound
