elizabeth with traffic. >> thank you. let's go to pleasanton. we have a camera showing you westbound 580. all those headlights towards 680. 15 minutes out of the altamont pass heading here. more traffic in a bit including your roadwork hot spots in just a couple of minutes. back to you guys. >> thank you. thanks very much. it's 4:31 now. new developments in the case of that missing nursing student michelle le. there is a report that le's cell phone was used after she disappeared in hayward last month. >> but le's family is disputing those claims. kgtv in san diego says le's phone was used to make a phone in reno and another to a woman somewhere in arizona. le's brother confirms a woman did contact him about the reported call. >> i did get a phone call from her and told the police. >> it is not known if the woman who reported the phone call actually new le. san diego report says hayward

police went to arizona to talk with the woman but hayward police haven't confirmed that. le's family plans another search for the missing woman this weekend. today marks the last day for dozens of laid-off city workers in san jose. they include about 70 police officers who will be out of work and a few dozen others who are retiring or transferring to other departments all part of a budget plan approved by mayor reed and the city council to reduce the city's $115 million budget deficit. in all, 264 city workers are losing their jobs. the oakland city council is still struggling to come up with a budget plan just hours before the new fiscal year begins tomorrow. council will meet in special session tomorrow afternoon following a four-hour hearing tuesday. then, councilmembers discussed proposals but couldn't settle on a budget. they are trying to close a $58 million budget deficit. an internet giant says it won't go along with part of

california's new budget plan. late last night, amazon said it will not charge california customers sales tax which is a requirement by the new state budget. as kiet do reports, that's not the only way the company is flexing its muscle. reporter: for mindy roberts one of the leading mommy bloggers, the bombshell email from amazon came today. >> confused. >> reporter: mindy is for now a so-called amazon affiliate based on scotts valley. buy products through her site, amazon ships them to her and she gets the sale. >> we are dumping you. somebody wants you to conform to some new rule. we like you, we don't want to dump you so we have to. sorry. >> reporter: for amazon based in seattle, eliminating the nexus of california affiliates is part of a strategy they have done in other states that also have online taxes. by getting rid of affiliates, there is no physical presence

and therefore, no need to collect sales tax. however, assembly member nancy skinner one of the authors of the new online tax law issued a statement saying, severing affiliate ties won't change the fact that under our efairness law they will still need to collect sales taxes. we hope that amazon and overstock rethink these bullying tactics. >> it's a staring competition with amazon. amazon won blink. >> reporter: says the law backfires if the businesses will leave california. >> if they can shift across the border to nevada and do this, they probably will. >> reporter: as for mindy, she feels caught in the middle. >> this hurts though. this feels personal. this feels like aren't there bigger fish to go after? was this low enough hanging fruit? it's going to hurt a lot of little people. >> reporter: kiet do, cbs 5. >> we received an email last night from an amazon executive who says, this legislation is

counterproductive and will not cause our retail business to collect sales tax for the state. survivors of the san bruno pipeline explosion are upset that safe and sane fireworks are still legal in their city. san bruno is one of a dozen bay area cities that allows the sale and use of these fireworks. a lot of charities and sports programs depend on that money raised from fireworks sales. last september, that blast killed eight people and destroyed dozens of homes. and now residents in the neighborhood are wary of anything that may spark a fire. >> i'm hoping that people will respect the situation and not come to our neighborhood and even though those people that live here, i hope that they will not set off fireworks legal or illegal. >> so city leaders have promised neighbors that there will be extra fire and police patrols over the holiday weekend in order to reduce the fire danger. crews have cut down overgrown grass and weeds where homes once stood. 4:35 now. those yellow stickers that let hybrids use carpool lanes in

california are about to become obsolete. today is the final day for 85,000 hybrid drivers to get a free pass in the fast lane. they have had that right for six years to reward drivers. all-electric cal and compressed natural gas vehicles will get to use their stickers until 2014. getting around the bay area is more expensive starting tomorrow. bridge tolls for big rigs and cars towing trailers go up. also increasing tomorrow, fares and parking fees for caltrain. fares for golden gate transit buses and ferries as well and fares on san francisco's muni system are going up. so get ready to pay the piper. >> that's right. we only had one day of rain. but i noticed yesterday, so many people out and about enjoying the sun. >> i bet you got a little more today we still had a little bit of clouds situation going on. it's supposed to be gorgeous. >> it's going to be absolutely beautiful and going to get a lot warmer. in the meantime, we can see that we have a marine layer working its way over the forecast region.

we just have some cold air that's saturated and due to the high pressure system, it's actually keeping this marine layer a lot thinner so it will mix out and evaporate early this morning after the sun rises at 5:50 a.m. our current temperature is mild. we have santa rosa at 53 along with fremont and livermore. pacifica 52. things will warm up nicely. we'll see fairfield at 83, livermore at 80, pacifica 62, san francisco's expected high 68 degrees with clear sky conditions. here's a good look at your extended forecast. 90s in the forecast by tomorrow. triple digits for the weekend by monday into tuesday. we may see an increase in cloud coverage due to tropical storm arlene that's on its way a little further to the north and it's not going to affect us too much but we are getting a seasonal reversal of some patterns there. so in the meantime, get out there and enjoy the rest of your workweek. here's elizabeth with traffic. >> thank you. just weird to see a 100-degree

on the seven-day. haven't seen that in a long time. outside pretty good towards the bay bridge toll plaza. no metering lights. there is some roadwork on the lower deck, so watch out for that. various lanes blocked there until 6:00. live traffic sensors usually pick up good speeds around this time of the morning. 59, 66, closer towards the macarthur maze. i also threw up an as symbol. as play florida again at 12:35 so may find some extra traffic this afternoon. for right now, it's easier to see these headlights at this time of the morning, so southbound 880 looks okay toward hayward. if you are crossing the san mateo bridge/hayward bridge, all your bridges pretty much look good. this one is no exception. the right side of the screen is westbound 92. right now a 13-minute drive so pretty much a good speed. top speeds there all the way across the span. eastbound 92 looks great, as well. there is roadwork on the

dumbarton bridge. westbound and eastbound highway 84 as you approach the high- rise. silicon valley commuters, we have a camera near the 880/237 interchange. you can see some headlights coming around the bend. everything is moving fine right now all the way towards san jose. and the golden gate bridge, i threw up this camera because right before air time before 4:30 we had an accident southbound 101 right before the toll plaza. they have cleared it already. now you can see traffic is moving fine all the way into the city. northbound traffic looks good, as well. that is your traffic and weather. back to you. >> thank you. president obama is issuing a blunt challenge to republican lawmakers. he told reporters yesterday that any deficit reduction plan must eliminate selected tax breaks for oil companies and the wealthiest americans. he also blasted lawmakers for planning to skip town without reaching a deal. meanwhile, republicans are criticizing the democrats' plan to raise the country's borrowing limit. >> we know that if we increase

some drivers to steal to fill their tanks. "claycord dot com" repor victims in high gas prices may be forcing some drivers to steal to fill their tanks. a company reports hearing from eight gas theft victims in concord most in residential neighborhoods. thieves are also draining tanks in livermore where three cars were hit while parked on the

street. >> the car was parked here and like i say, both cars, their gas tank compartments, face the neighbors so the neighborhood, you think? you know, it's pretty bold. >> a gas station owner in concord has surveillance video of two people stealing gas from his tanks. company fleets and motorhomes are also being hit. thieves have swiped more than 2,000 pounds of copper wiring from a future home of facebook. construction crews in menlo park say the thefts occurred over a three-day period earlier this month. police have no suspects. the estimated cost of the copper stolen, $8,500. maximum fee that banks can charge merchants for debit card transactions will soon be cut in half. it's dropping from $44 to 21 cents. the federal reserve board wanted to cap it at 12 cents. what does it mean? lower fees will allow companies

daughter. the big question is whether 25- year-old suspect casey anthony will take the stand. she is accused of suffocating caylee anthony three years ago. her lawyers claim the child accidentally drowned in her grandparents' swimming pool. and the british are coming! today prince william and his new bride kate arrive in canada to start their north american tour. after landing the duke and duchess of cambridge will head to the national war memorial to lay a wreath on the tomb of the unknown soldier. the newlyweds will also make stops in six other canadian cities including montreal and calgary. in ottawa, the security detail is doing a practice run of the royal motorcade. the duke and duchess will visit the city tomorrow on canada day. tens of thousands are expected to try and catch a glimpse of royalty. >> because we all love 'em. we all love 'em. we think they're great. they're down to earth. they're just special. >> following their canadian tour, the couple will head to santa barbara, where prince

highway 4 mostly green meaning speeds over 40 miles per hour. really from antioch all the way into concord as you make your way towards 242. once again, there is a lunchtime as game taking on florida at the coliseum. past the coliseum everything is great. headlights are moving southbound, a quick trip towards 238. in fact, we'll give you some drive times for the east bay. you can see mostly top speeds this morning up and down the eastshore freeway. westbound 80 in the commute direction no delays. no delay coming out of the altamont pass, 16-minute drive in westbound 580 from the altamont pass to the dublin interchange. and again the nimitz 880 through oakland, no delays north- and southbound, 15 minutes there. mass transit forgot to make the map but everything is on time for bart, ace, muni metro and caltrain. if anything changes, remember kcbs, our radio partners, at 740-am and 106.9-fm. that's your traffic and your weather. back to you. >> we believe you even without

[ laughter ] i don't. >> kidding! you know that guilt-free diet soda may be actually adding on the points believe it or not. researchers at the diabetes conference reported volunteers who drank 2 or more diet sodas a day gained weight over the course of 10 years. their bellies grew 70% more than than those who didn't drink diet soda. weight gain could lead to cardiovascular disease and diabetes. and if you are trying to diet it's not all about portion size. a new study suggests the reason for weight gain may be more that we're eating too many snacks. a nutrition professor says food advertisements are the reason we snack throughout the day even when we're not even hungry. it suggests eating just three meals a day and snacking on fruits and vegetables is the way to go.
