you're getting close, too, my friend. weatherwise, it looks great. we are going to see cooler weather today. fog and low clouds moved back onshore and even starting to make its way inside the bay. high 67. 73 oakland. only 88 degrees still warm in concord but a far cry from the triple digits we have seen over the past few days. things will continue to cool down. let's check traffic with elizabeth. >> let's go out to the nimitz. 880 through oakland looks okay past the coliseum. roadwork around oak street and we were getting word of an accident southbound 880 approaching embarcadero. looks like that might be in the clearing stages. we'll continue to keep you up to date throughout the show. in the meantime, back to you guys. >> all right. guys, thanks much. it's 4:31 now. right now a water main break has left behind a soggy mess in an east bay neighborhood. people are scrambling to save their stuff. they got the call around 3 a.m.

all the water bubbled up by the mount diablo boulevard and village centers and flowed down the streets. one man had just moved into the neighborhood and in fact, he still had moving boxes in his garage. >> put my shoes on and looked out the sliding glass door and the backyard was probably five inches deep of water. >> u time crews will have to dig -- utility crews will have to dig up the pipeline. we'll have a live report coming up. in an hour from now a sentencing hearing is set to begin for casey anthony the florida mother acquitted of murder in the death of her 2- year-old daughter. >> she was convicted of lying to investigators but as karen brown reports, anthony's time in jail may soon be over. reporter: casey anthony could walk away a free woman this morning. >> we, the jury, find the defendant not guilty. >> reporter: just two days after being acquitted in the murder of her daughter caylee, the 25-year-old will be sentenced on four misdemeanor

counts of lying to investigators. each charge carries the maximum sentence of one year in prison but since anthony has already spent nearly three years behind bars, she could be released for time served. >> justice for kaylie! >> reporter: because of the high-profile nature of the case, the court will take extra precautions to keep anthony safe upon her release. >> she is widely despised by most of america if you listen to commentary. >> reporter: but casey anthony's future outside of jail remains unclear. she will need to find a mace to live and get a -- mace to live and get a -- place to live and get a job. but some say she could get half million dollars or more. >> this story demonstrated its ability to capture national attention and she has a chance to bankroll herself for the rest of her life. >> reporter: but whether that life will include anthony's family remains to be seen. her father george became the defense team's main target during the trial and a lawyer for anthony's parents says they

have not spoken to their daughter since 2008. >> at some point i imagine there will be some sort of family meeting. >> reporter: that will be missing little caylee marie anthony. karen brown, cbs news, orlando, florida. a state assembly committee will take up a bill that will ban capital punishment here in the state. it's authored by lonnie hancock of oakland. she contends the death penalty doesn't deter crime and says it contributes to the state's financial problems. the state has had only 13 execution since the death penalty was reinstated 33 years ago. the coast guard is more aircraft to help search for the missing northern california fish american in mexico. coast guard c-130 crews scheduled to fly out of sacramento a half hour from now. the mexican navy is coordinating the search-and- rescue effort. it did ask for the coast guard to send this help.

the c-130 has searched hundreds of square miles over the last few days. the mexican navy helped rescue dozens of survivors after the fishing boat named erik a single off baja california sunday morning. some of the survivors are back home in the bay area. they helped pressure mexican official to extend the search effort beyond the normal 96 hours. >> i was in the water for 16 hours. and i was okay. so given that it's maybe the third day, you know, there is still some hope. >> my staff and i have contacted the mexican consulate, and today they assured me that they will do everything that they can to continue the search for survivors. >> seven fishermen are still missing in the sea of cortez this morning. one has been confirmed dead. a key firefighting tool may be grounded for good just in time for the fire season. you probably have seen those huge dc-10s on the news. cal fire cancelled it contract

with the nation's largest air tanker company to save money. the tankers cost taxpayers about $7 million a year to operate. >> in tough budget times we are making tough decisions. that's one of them. >> it's expensive but it's cost- effective and what is saved is, of course if you're talking lives, you can't put a price on it. >> the dc-10s will still be available for the fires but without a contract it could take a lot longer to get them up and in the air. part of a popular cycling and jogging trail is closed now after a man was shot in the head. the shooting happened on the de anza trail in pittsburg near harbor street and atlantic circle. police say someone came across the victim at about quarter to 9:00 last night and then ran to a nearby mcdonald's to get help. paramedics took the man to the hospital. he is still alive this morning but not doing well. the de anza trail part of the east bay regional park district

runs from concord through pittsburg and antioch and ends in oakley. there have been a number of violent incidents on that trail in the past couple of months. s.w.a.t. teams found the bodies of two men following a six-hour standoff in watsonville. officers say someone inside the house fired shots at police when they investigated a domestic disturbance report yesterday. officers fired back in self- defense. they don't believe they hit anybody inside. the shooting prompted crews to lock down the neighborhood and evacuate two nearby homes. deputies have not identified the men, but one woman outside the house says they are her brother and her father. a serial murder suspect who is acting as his own attorney is asking for some legal help now. 77-year-old joseph naso is due back in marin county court this morning. there is a hearing on his request to have a legal advisor paid for by the taxpayers. marin independent journal reports the judge says he is likely to allow the advisor but

not at the public's expense. the oakland police officers association will announce this afternoon the result of a vote on a new contract agreement. the deal would have officers make more concessions like contributing extra money to their pension funds. the city is counting on it to help reduce its budget deficit. this comes a day after police chief anthony batts reorganized the department. among the major changes, the department will consist of two regions now east and west instead of the current three. specialized units like motorcycle and bicycle squads will be eliminated with those officers now moving to regular patrol. 4:38 now. time to get another quick check atraffic and weather. lawrence, how's it looking? >> yeah, you know, we have some more fog around the bay area this morning, guys. it looks like it is going to be pushing further and further onshore in the coming days all along the california coastline. we see the low clouds and fog moving in now. some of that's made its way inside the bay. it will be slower to burn off today. temperatures running a little

cooler than yesterday still mild inland, 63 degrees in livermore, 61 in san jose and 64 degrees in san francisco. by the afternoon, temperatures still toasty, 91 in livermore, 88 degrees in concord. you will see plenty of 70s and 80s around the bay but at the coast, only into the 60s with that patchy fog. next few days, we are going to see more of the fog penetrate further and further onshore. that looks like it will help to cool us down into saturday and sunday. that cooling trend will likely continue right into monday, tuesday and wednesday of next week. maybe even some drizzle as we head toward the beginning of the next week, too. let's check traffic with elizabeth. >> frank is fanning himself. so obviously he's hot already. >> he's feeling the heat wave. hot flashes. let's go out towards westbound 24. approaching fish ranch road we have an accident on the shoulder before the caldecott tunnel. no slowing at this time of the morning. but again some activity there out of lanes. to the bay bridge toll plaza, no metering lights, no delay

heading into san francisco. if you are on the lower deck we have some roadwork again until about 6:00 this morning. so you will find various lanes blocked there. but again, all the approaches pretty much look good including down the eastshore freeway. 18 minutes from the carquinez bridge to the maze. and 880 through oakland still looks okay even though we do have this report of an accident on the on-ramp now southbound 880 approaching embarcadero. that is your traffic. back to you guys. >> it does get hot in here with this big heavy coat on. >> i'm freezing constantly. but that's just me. >> all right. we digress. 100 people are still without water now. it started with a water main break last night in an east bay area neighborhood. >> it is a real mess this morning. kristy seifkin is live in lafayette now with what crews are saying about getting the water back on. kristy, everyone is wondering when they will be able to take a shower. >> reporter: good question. certainly if you are heading to work this morning, not going to be able to take a shower at least for the time being. taking a look over my shoulder

you can see they still have a positive pressure flow but that doesn't mean there is any water coming to residents. i talked to east bay m.u.d. earlier. they have been here since midnight trying to find the break below ground. you can see these gentlemen have already started to dig a hole. they need to go four to five feet under to find the break. right now it's just a lot of water with some tree roots. they haven't yet found the break. they are thinking it should be about an hour before they find it but still much more time until they are able to make repairs. in the meantime, people are without water and overnight this water has been flowing down the street and up against people's houses. we are going to have some sound from someone who just moved into his home who had his garage flooded because of the break. next time when we see you. >> water is not your friend when it's in the wrong place. thank you, kristy seifkin in lafayette. 4:41. a picture is worth 1,000 words. and so is surveillance video. the new clue that could help catch a brazen picasso thief. >> and there was a shoe bomber,

skateboarder. authorities say a 17 year old was riding down a hill in capitola while m an elderly woman is dead after what appears to be a freak accident with a skateboarder? a 17-year-old was riding down a hill on a skateboard in capitola while marianne was walking across the street in a crosswalk. the skateboarder was going about 15 to 20 miles an hour when he spotted her. he hopped off his board to try to avoid her but it was too late. and he slammed into this woman. she was 83 years old. no charges have been filed. but the d.a. is investigating. the woman lived in capitola with her husband george. >> i don't know what to do, you

know? we were together so long that you just really lose track of everything. >> the woman died late tuesday night at valley medical center. the skateboarder wasn't hurt nor arrested. his parents were told and detectives are still looking into the matter. >> tough story. caltrain directors are expected to vote today on a new leaner budget plan. the original budget had to be trimmed because caltrain will get less money than expected from its three funding partners the vta, samtrans and the san francisco muni. and because of that, some projects will have to be postponed including improvements to train cars and stations. golden gate bridge commuters may need to swap out cash for fastrak now. today a bridge district committee will vote on a proposal to install all- electronic tolling on the bridge. other payment options include license plate invoices and having drivers pay at another

retail location. if the proposal passes the committee it moves forward to a vote tomorrow. the new system may be in by next year. police in san francisco releasing surveillance video that they think shows the art thief who swiped a picasso sketch in broad daylight this week. after walking out of the weinstein gallery near union square he walked past lefty o'doul's bar which has a security camera. there are hopes the video will generate tips that leads to the recovery of the $200,000 sketch. facebook taking a big step to live up to its name. >> they are. as expected, the world's largest social networking site launched a face-to-face video chat feature yesterday. it's powered by skype. facebook users can now chat with their friends and they can do it for free. the feature is intended to fend off competition from google which launched a similar service a little earlier this week. time now 4:46. hours until the final space

congressional leaders will try to sit down and find common ground on dealing with that federal deficit. republicans and democrats are starting to show some signs they are more willing to compromise on some issues including the debt limit. the house majority leader says he is open to closing tax loopholes. republicans have been rejecting anything vietnambling a tax increase. -- anything resembling a tax increase. the ninth u.s. circuit court of appeals in san francisco says the "don't ask, don't tell" policy has to end immediately. congress has already decided to appeal the policy but the pentagon had not yet done so. the justice department is now reviewing the new ruling. u.s. security experts say terrorists are considering new methods of blowing up planes including surgically hiding bombs inside of humans. the tsa says that no exact plot has been uncovered yet but there is evidence that

terrorists are discussing this possibility. plastic explosives very deep inside the body would be difficult for the current equipment to detect. >> there are numerous technical problems to try to make an effective explosive device operate inside a human body especially one that has to incubate for some time and then explode. certainly the body itself will act as a bit of a cushion to the effect of the explosive. >> a law enforcement source told cbs news al qaeda operatives in yemen recently expressed interest in recruiting a surgeon to implant explosives. stopping at nothing. >> guess so. rain and thunderstorms may stop the final space shuttle launch for nasa tomorrow. mission managers say the weather would have to get worse before they actual his call off the launch for atlantis. a bay area man is prepping for the shuttle's final trip. rex walheim will suit up for

the mission tomorrow morning. >> folks, are you headed outside this morning? we have a few clouds, patchy fog on the increase, a sign of that ridge of high pressure weakening somewhat. that means cooler air is on the way. still some mild temperatures inland, not as warm as yesterday 50s in the bay area. patchy, dense fog at the coast. this afternoon, it will be sunny still a little hot in spots but a little more comfortable. low 90s in the warmest spots around the bay area. inside the bay 60s and 70s. mostly sunny, breezy in the afternoon and at the coast 50s and 60s. monsoonal moisture working its way into the sierra nevada especially at the south part but for the most part the bay area, clouds scoot east of us. cooling around the bay area as high pressure moves out. this trough will drop in and that had bring with it more low clouds and fog further onshore as we head in toward the weekend. temperatures are not that bad. 84 degrees and sunny skies in san jose, much more comfortable

there. 81 in fremont. 81 palo alto. at the coastline, 58 degrees daly city, 60 pacifica with fog. temperatures in the east bay up into the 90s well inland. you're looking at 70s inside the bay. age probably about 68 degrees in richmond for today. some of that cool air shoots right in across through the golden gate. 70s and 80s in the north bay, 60s at the immediate coastline except 59 in bodega bay. next couple of days looks like temperatures fairly similar but as weather head in toward the weekend those numbers will continue to drop off and it won't end there as we'll see the cooling trend continuing well into next week. all right. it's time for traffic now with elizabeth. >> let's go out towards the golden gate bridge. outbound 101 traffic looks okay as you make your way towards marin. is there fog in that shot? >> there fog. i will verify the fog. >> okay. the meteorologist says there is fog. so yeah, kind of a foggy commute. another foggy commute for the

golden gate bridge. san mateo bridge looks okay. the san mateo bridge is a good spot. no issues there this morning. otherwise the bay bridge nice and quiet here, as well. looks pretty good all the way into san francisco. ongoing lower deck roadwork to watch out for. no delays. nimitz live traffic sensors picking up top speeds in hayward. northbound lanes 880 between oak and union ongoing roadwork. past the coliseum things look good. everything nice and quiet including towards oakland airport. you have an early-morning flight to catch, southbound 880 hooks great cruising past hegenberger. we'll continue to go south to the south bay. guadalupe parkway 101 nice and quiet in morgan hill. we have a camera showing 280 approaching the 880 interchange. it looks great right there. it usually does this time of

the morning. today is no exception. and mass transit is all time. bart, ace, muni metro and caltrain are all on schedule. remember kcbs, our radio partners, at 740-am and 106.9- fm. that's a wrap. back to you. >> thank you. climate change could have a chilling effect on california's vineyards. scientists at stanford are forecasting a 2% rise in temperature in napa and santa barbara counties in the next 30 years. and more very hot days. doesn't sound like much but it is. they say global warming could shrink some of california's vineyards by half. after an incredibly wet winter most people assume the worst is over when it comes to colds but summer colds can actually be worse. we have seen some of those around the newsroom here. doctors say cold and flu viruses that plague us in the winter can combine with other warm weather viruses in the summer and that combination can last longer and come back more

easily. often times, this is because our immune systems are already worn out. >> it really taxes the immune system more. they're more run down and i think that's what is making it last longer. >> doctors think strenuous summer activity after a winter layoff can also wear out our immune systems more quickly. increased air travel in the summer months with air- conditioning and recirculated air also increase chances of illness. >> summer colds are the worst! >> yeah. they're pretty severe. i have been able to successfully avoid the thing that's been going around the newsroom. >> just hang out with us a couple more days and we'll take care of that. from feeling blue to seeing red thousands of people packed the streets of spain today for the running of the bulls. >> i can never believe those people go out and do this. two people slightly injured and needed hospital treatment for cuts and bruises. the number of runser is down
