trail. what police are sa a second shooting in less than a week at a popular east bay trail. what police are saying about the latest attack. a classroom goes up in flames. in daly city. a look at the damage and cleanup this morning. good morning to you. it is monday, july 11. i'm grace lee. frank is lucky. he has the day off. >> the next two weeks off. a lot of sleeping in for him. >> i'm elizabeth wenger. time is 4:30. let's start with a quick look at traffic and weather. >> hi. >> good morning, guys. >> it is early today. >> very wet out to the coastline. drizzle toward the beaches. a sign it will be cooler around the bay area. temperatures well below the average. headed outside today, only a high of 61 with. some partly cloudy skies. in san francisco.

73, some sunshine in san jose. and 76 in concord. it is going to get even cooler and we will talk about that in a bit but first a check on traffic. >> careful with the -- drizzle. metering lights are off. we have a high wind advisory as you cross the span. two hands on the steering wheel. more on the road work. coming up. back to you. >> and 4:31. another attack on a popular trail in the east bay. now this happened overnight, on the deanda trial in pittsburgh by harbor street and atlantic avenue. still no word on the condition of the victim who was shot there. it happened near the location where a man was fatally shot last wednesday night. there has been a number of attacks on or near the trial in recent months. police are still looking for suspects. and a fire broke out overnight at a daly city elementary school. the fire department was called to skyline elementary around 10:30 last night. there is significant damage

inside a portable building. it looks like the fire may have started outside just behind the portable. the fire crews have now cleared that location. we will have a live report coming up at 50bg 5:00 a.m. police say an argument over a drug deal killed three men in richmond. it happened at triangle court. a city run housing project. investigators are still trying to put together the sequence of events but two people are questioned. a 6-year-old nephew of one of victims way playing in another room at the time. he was unhurt and has moved out of the apartment with his mother. oakland investigators are looking into a shooting that left one person wounded. officers found the victim saturday evening. when they were called to a location on seminary avenue. it is not far from mills college. the victim's injuries are not considering life-threatening. today, or tomorrow, divers are expected to join the search for search northern california men missing since their chartered fishing boat sank off the coast of mexico.

and air and sea searches covered thousands square miles in the last week but still no sign of the men. the families still believe they could be alive. and linda yee says the coast guard agrees. >> the u.s. coast guard rescue teams searched another 990 square miles of the sea of cortez for the missing fishermen. they're still no sign of them. the coast guard says it is possible they are still alive. even after seven days. >> the coast guard and the mexican navy are pursuing this case, as a rescue mission effort. we're still hopeful to fine these seven missing fishermen. >> 27 passengers were tossed into the sea after a freak thunderstorm capsized the their charter fishing boat. 19 made it to land after swimming for hours. >> i was in the water for 16 hours. >> many survivors clung to ice chests as they tried to reach land miles away. >> i saw the waves.

i estimate that i was alone in the water for between nine and 10 hours. >> the coast guard has searched a total of 4600 square miles of ocean and land. it is possible survivors could drift for miles. rescue teams believe some could be on a remote island. >> many of these islands are uninhabited. they are basically giant rocks in the middle of the ocean. >> a u.s. navy dive team is brought in from hawaii. it is reported divers could search for the sunken boat to see if the bodies of the missing men are inside. mexican investigators found the body in about 223 feet of water. linda ye, cbs 5. it is back to the negotiating table today. for president obama and eight congressional leaders. they're trying to hammer out an agreement to cut the federal deficit and raise the debt limit before the time runs out. but joel brown reports,

compromise between democrats and republicans is not coming easy. >> reporter: president obama plans to sit down with congressional leadersed to and every day until a debt deal gets done. the sides met in a rare sunday night session but reportedly made very little progress if any. the prá president wants lawmakers to accept a $4 trillion deficit reduction plan. but republicans rejecting all tax hikes associated with it. instead, pushing for smaller $2 trillion measures. >> a big package will require big tax increases in the middle of an economic situation that is extraordinarily difficult. with 9.2% unemployment. we think it is a terrible idea. it is a job killer. >> reporter: even some democrats are raising concerns about the president's plan, especially cuts to medicare and other social services. >> he said we're not going to end the medicare guarantee. >> reporter: president obama scheduled a news conference for this morning. before he meets with lawmakers. he is expected to stress that a deal must be reached within the next week and a half. for the u.s. to avoid its first-ever default.

>> the president made it clear he is going to do some very difficult political things for him, for his party but the republicans will have to do some things, too. >> if a deal to raise the debt debt -- ceiling by august 2, the treasury department says the government will run out of money to pay its bim. the new head of the international monetary fund warns the impact could be felt worldwide. >> interest hikes. stock markets taking a huge hit. and real nasty consequences. >> reporter: as negotiations drag on, credit agencies are threatening to downgrade america's perfect credit rating. joel brown, cbs news, washington. the president will hold a news conference this morning. you can see it live here, on cbs 5. at 8:00. 4:36 now. if you're outside this morning, you will see a little bit of a drain -- well, not drain. lawrence, this is our way of saying drizzle. >> that's right. >> whatever you want to call it. >> indeed this morning. what a difference. last week, we were talking about

the 90s and hot 100s and now we have a trough along the coastline and guess what? low clouds and fog. extending onshore. heavy drizzle showing up toward the coastline today. watch out for that. that will make roadways very slick out there. temperature of 51 degrees in pacifica. 59 in san jose. 55 and clouds even in livermore. sot onshore push continues to keep the temperatures way down. plan on 50s and 60s as you approach the coastline. i think the warmest spots of the bay area only in the 70s this afternoon. you will find lots of sunshine as you head inland. still the temperatures are staying well below the average for this time of the year. checking out the numbers, we take things down through thursday it looks like. that's when we bottom out with the temperatures. drizzle will be common. out toward the coastline over the next few day, and then maybe we begin to warm things up slightly as we head to the next weekend. let's get a traffic check. >> we start off with a wind advisory for the bay bridge. a look at the upper deck. use caution, two hands on the steering wheel.

accident-free right now. metering lights are off. an easy ride off the carquinez bridge headed to the maze. an easy 18 minutes to make that route. there elsewhere, the golden gate bridge, looks a little hazy. foggy in that area. light out of marin county. it looks good approaching the toll plaza on the golden gate bridge. 8 minutes. and we are dealing with road work. not a lot. a couple of spots out there this morning. north 80 is one of them. the 92 jackson off-ramp is shut down at least until 5:30. use an alternate in the meantime. the green on the freeway shows it is not showing anybody major delays in that area. that's a look at traffic. back to you. after 168 years, the news of the world is saying goodbye. the tabloid published its last edition yesterday. this comes in the midst of allegations the paper hacks phones and paid police for stories. editors acknowledge the scandal and apologized by saying, quite simply, we've lost our way. owner rupert murdoch is facing criticism for the scandal and

his bid to buy british sky broadcasting. the skwaeubg -- the quake that hit japan 7.3 earthquake prompted a brief tsunami warning for the japan coast. for an area that is still recovering from a killer wave four months ago. residents from coastal areas were warned to evacuate for two hours after the quake. there were no immediate reports of damage. time now is 4:39. more people are cutting back. some of them, penny pinching strategies. it is the law. few obey. it the crackdown that is coming to keep police and road crews safe. the 110-ton package on the way from china today. ,,,,,,,,

police say 30- year-old mark lugo of new jersey removed the pencil drawing from a local gallery last tuesday. he was arrested the following day... allegedly with the drawing still in his possession. transit passengers can expect some changes starting today, in silicon valley. the quarterly service changes are part of the v- t-a's plan to keep improving on-time the quarterly service changes are part of the plan to keep improving ontime performance and to make connections more efficient. on the light rail system, there are scheduled changes on the green line between the mountainview and winchester stations. there are also schedule adjustments on the commuter express trains and some bus lines. another step toward completion of the new bay bridge. the chinese company manufacturing the steel girders and towers says it is putting the final touches on its part of the work. california outsource production to the company to save $400 million. the construction must meet stringent specifications so that the bridge is usable even after

an earthquake. the new eastern span opens in 2013. so they are predicting a-c-arm getten in los angeles. not a movie. when a 10-mile stretch of the 405 freeway will be closed for 53 hours, part of a lane widening project. but city leaders are warning of horrible gridlock. it gets worse than usual. the 405 carries half a million drivers, even on saturdays and sundays and they're now recommending that people just get out of town. forget it. don't even try. >> or don't head to town. >> they're warning people in the bay area, don't head down to l.a. it is a mess. traffic reporters will be going nuts down there. >> the 405, ugh. 4:43. joe montana gives his approval to building the 49ers a new stadium. >> i think he certainly should have first shot. he has done a lot for the community. >> why some city leaders in santa clara are saying not so

fast. and the dogs may finally have their day. the push in santa cruz to let pooches return to downtown. and if you're traveling around, we have low clouds and fog and drizzle this morning. 64 degrees expected with a high at sfo. we are expecting clouds and each the possibility of some thunderstorms if you're making your way into the chicago area. still going to be steamy hot. about 90 degrees. continues on, making your way to the eastern seaboard, in toward new york, we're expecting lots of sunshine, by the afternoon and that is going to crank up the temperatures. 90s for highs there. of course we will have the local forecast coming up next. ,,,,,,,,,,,,

welcome back. 4:46 now. this is a law that few know about and even fewer are following. >> yes, starting today, the state highway patrol will step up enforcement of the move-over law. it requires drivers to slow down and move out of the lane adjacent to caltrans or emergency workers. ads will be running on tv and on highway digital billboards.

the campaign follows the death of three caltrans workers in less than two months. violators can face fines, topping $200. drivers not getting as much of a break at the gas pumps anymonger. after months of steady declines. we knew it was coming. the prices inched up to $3.87 in san francisco. in oakland, the average price is now $3.77. and in san jose, it is averaging $3.78. and analysts say the price may reach $4 a gallon in the next few weeks. four times, super bowl champ joe montana is hoping to score bill in santa clara. tomorrow, he is going to be lobbying the city council to build an entertainment complex in front of the proposed 49ers stadium. now, the city usually requests outside proposals before making a decision. but montana is expected to ask officials to only negotiate with him. and some are not so thrilled about the suggestion.

>> just because he is a great football player and a great 49ers player, that is doesn't mean he has the pod up. >> i'm sure he is a fine businessman. but but this is free market, right? >> the city manager has recommended that the council deny montana's request. and allow others to bid on the land. construction will not start on the new 49ers stadium though until 2015. dining al fresco is about to make a come back in berkeley. the city is expected to relax rules tomorrow that will allow restaurants to add seating on sidewalks. a permit could cost as little as $350. and be issued in just weeks. san francisco recently streamlined its permitting process for outdoor dining at restaurants, and in virtually any unused public space. dogs can soon make a legal come back in the city of santa cruz. >> tomorrow the city council will consider a plan to reverse the 35-year ban on dogs in the

downtown area. the ban was approved back in 1976. in response to complaints of aggressive be a animals and the little piles that they leave behind. some merchants say the law should be reversed so dog owners can once again feel welcome downtown. >> my dogs are not welcome. i'm tending not to go. we take them to restaurants, to church, everywhere. >> i know some people who don't come down here simply because of it. but then again, i know some people who come down here and walk their dogs anyway. >> dog poop stinks. dogs bark and snarl at people. it is not peace and love. >> and it will be a three-month trial period. dogs would have to wear collars showing they're vaccinated and licensed and would have to be kept on leashes. plastic bags and polystyrene food containers are on the agenda this evening at san carlos city hall. the city council will hold a study session on whether to ban them. several local cities have

already jumped on the bandwagon forbidding businesses from giving customers those types of bags and containers. opponents say those materials are bad for the environment. all right, folks. big changes in the weather over the next couple of days. numbers cooling down outside. we're looking at low clouds and drizzle stretching onshore right now. heavy drizzle to the coastline making the roadway slick. and partly cloudy in some of the valleys, and stronger onshore push. high pressure is gotten out of the way now. and we're watching the temperatures running cooler than the average for this time of the year. and 70s on the high end by the afternoon and breezy and cool inside the bay with temperatures mainly in the 60s. and out toward the coastline, as an 60s. drizzle, breezy, cool and it is going to be very wet over the next few days out toward the water's edge as we see a saronger onshore push. a trough of low pressure that is hanging along the coastline. that will ramp up the low clouds and fog, and produce some of the drizzle out there. so the high pressure is giving way, and you've got the trough that is going to camp out for the better part of this week. and temperatures running well below the average through at

least thursday and friday and maybe some warming toward next weekend. a high of 70 degrees today in mountain view and sunshine there. and 68 in fremont. and 50s with fog out to the immediate coast. and about 78 and sunny in morgan hill. and the east bay numbers up in the 70s. many spots, well inland and 60s inside the bay and as you look toward the north bay. cool out toward the beaches with highs in the mid-50s. 60s and a few 70s. in some of the interior valleys. looking out over the next few days, we are back to that cool weather again. it looks like it is going to stick around. probably going to bottom out as we head to wednesday, thursday, when we see a whole lot of clouds around the bay area. then it looks like toward the weekend, the high pressure tries to sneak back in here, ever so gently. maybe some 80s return to the bay area. all right. that's a look at weather. let's check out the traffic. >> thank you very much, lawrence. let's head to the south bay for a live look at 101 in san jose. our photograph ser standing by. nice conditions so far for the monday morning commute. everything is cruising along

through there. the rest of the south bay, checking in problem-free. a look at continues near 880 and 237. everything moving along nicely here as well. in fact the travel times throughout the south bay are off to a very good start. northbound guadalupe parkway, 87. a few minutes, with an easy drive, 280. and 101, 280 to 237, 11 minutes. and 280 itself from 101/680 interchange. an easy 11-minute drive. let's jump to the east bay. reports of some police activity at macarthur boulevard. it is shut down between patterson and 39th avenue. they're hoping to have this reopened at least by 5:30. right now, do avoid that intersection if you can. again this is macarthur between paterson and 39th. jumping over to the bay bridge. right now at the metering lights, everything is off. everything is pretty clear, as you approach the toll plaza. once you get across the span, we have a high wind advisory in effect, so use caution. two hands on the steering wheel. traffic is very light into san francisco.

no delays to report right now out of san francisco headed into oakland. live look at the golden gate bridge. not too bad. things are actually pretty nice out of marin county. so far, so good, headed south 101 an easy 8-minute ride. from 37 to 580. past the toll plaza. and traffic is clear for san francisco. and live look at the san mateo bridge where conditions are moving pretty well. a 13 to 14-minute ride and 880 and 101. and now we still have some road work to contend with. north 880 at 92. the connector road is completely shut down at least until 5:30. a half hour more. use an alternate in the meantime. traffic looking pretty nice through that area. your mass transit, no problems to report. bart, ace, muni, cal train, checking in problem-free. when you hop in your car, check in with our radio partners. that's a look at traffic. problem-free. that's how we like it. 4:53. more reason to keep your children away from secondhand smoke. there is a report which shows children exposed to secondhand

smoke are 50% more likely to develop disorders like adhd or learning disabilities. and another new study reaffirms kids are more likely to become smokers if they are around people who light up. pregnant women who experience anxiety or depression could be putting their children at greater risk for asthma. and a new report found about 70% of mothers who said that they had high levels of anxiety or depression during their pregnancy also reported that their children were wheezing before the age of 5. and experts say that the findings support the theory that children are highly susceptible during that pre-natal period. consumers are re-evaluating their daily purchases and finding ways to cut back. more than one in five has given up the morning habit of buying a cup of coffee. that's according to new reports from harrison. and almost twice as many have stopped buying bottled water. instead just refilling a bottle with tap water am and the
