i'm on my way in. highs around the mid-50s to lower 60s. tonight is expected to be cloudy with more fog and drizzle. sunday expected to be cloudy with fog and drizzle in the morning. we will look at the full forecast. 7-days coming up in the next few minutes. first, stopping our news this morning, the military's policy of don't ask, don't tell for the gay service members will continue for now. a federal appeals court in san francisco issued the order last night the justice department says ending the policy now would end the process of rolling it back. but in the court ruling they said the government cannot penalize anyone under don't ask, don't tell. pose -- people opposed about gay lessons to social studies classes hopes to pup the issue to a vote. they want a referendum on the ballot. the group has to collect nearly

half a million signatures. the law signed by governor brown will allow the first state toe teach about gays and lesbians in public schools. someone shot and killed a man in hayward, and the search is on at west dennisson road and keller avenue at 50th. inside of the car, they found a man who had been shot. a man died at the scene. a bicyclist ran into a woman. police believe he didn't follow the rules of the road yesterday, but robert lyle shows us hours after the crash, several bikes went through the red light at the same intersection. >> reporter: you're taught to look both ways, stay in the crosswalk, and never cross on a red, but on the embarkdaro, our

cameras captured bicyclist after bikist abandoning the ruling out of the road by running the red light. >> i do see these guys running quick. >> reporter: the speed, and running the red, they intersect in one place, disaster. >> she is being treated with life-threatening injuries. >> reporter: san francisco police are refer together 67- year-old woman believed to be a tourist run down as she crossed during the night of the morning rush hour. >> it appears at this point the bicyclist ran through the red light. >> reporter: police are investigating how much speed the man generated before plowing into the woman. witnesses heard her scream and then watched her horrified as shy felt head-first to the asphalt do you see the bicyclists runs the light? >> reporter: sometimes they do. >> reporter: one cab driver admitted that they run the red light, but then seconds later a

cab driver almost hit our camera man clearly in sight. others admit to running the red but claim only when -- >> it's clear i'm not in danger, and i'm going to go. >> reporter: was this toddler potentially in danger as the cyclist zipped past him. we recorded bike after bike weaving in and out like an obstacle course even though it's illegal to ride on the san francisco sidewalks. we asked the police what gives? >> they have to follow the rules of the road. >> reporter: if the elderly come succumbs to her head injuries he will be treated -- >> as if he were driving a motor vehicle. >> reporter: mening it could be gross negligent manslaughter or vehicular manslaughter. police were nowhere to be found as cyclists ran the red during the evening commute. robert lyle, cbs 5.

>> the police say they don't track the locations so they don't know it's a dangerous crossing, but it looks to be one. more bay area headlines this morning. east bay area residents with a rude awakening this morning. a 3.3 earthquake. the epicenter was 2 miles from berkeley. several viewers called or e- mailed us to tell us about it thinking it was bigger. storms back in march caused widespread damage including these scenes, but fema rejected the request for nearly $45 million in aid. volunteer in the east bay will continue to search for any sign of michelle lei. the missing nursing student was last seen in hayward on may 27

may 27th. watch out for furious hairy potter fan -- harry potter fans at one no theater where the screen went to black. hundreds of people were watching the show last night, and at the beginning a plot twist that was not in the book, the movie went black, and dozens stormed out of the theater, missing the final minutes. workers had to call police when the fans turned rowdy in the lobby. the so-called carmegedan is happening right now. even celebrities are tweeting about the closure. candice gibson looks at all the hype. >> reporter: one of the busiest freeways in the nation is shut down for the weekend.

10-mile stretch of 405 is closed until the morning rush hour. >> the contractor will know flout the weekend where it is and where it needs to be to conclude the operations by monday morning. >> reporter: a $1 billion project to widen the busy sections of the 405 linking west los angeles to the san fernando valley. the bridge at the center of the construction will be partially brought down this weekend. there's a lot of hype around the weekend. the phrase was coined because of the threat of gridlock. more than a quarter million drivers who use the section of 405 will have to find an alternate route. >> depending on the outcome of the weekend, we can either say we survived the carmedegon or we survived the hype.

with fog and drizzle this a live look again around the bay area. we have to make it up above the clouds which are certainly all over the skies of the bay area this morning. it is going to be another cool morning. the bay area expected to be cloudy with fog and drizzle this morning. becoming partly cloudy, and the fog will take a really long time to burn off today. in fact, in some areas, it may not burn off at all. highs mid-50s to lower 60s, and tonight again cloudy, more fog, more drizzle. lows expected in the lower 50s. sunday, more of the same. cloudy weather, fog, and drizzle expected in the morning, and highs expected to be in the mid-50s to lower 60s. looking at the 7-day forecast there i mine obviously inland, warmer temperatures, and especially to midweek next

positive, we want them to get care. >> how long has this been going on? >> 25th anniversary. we have been dealing with hiv- aids for 30 years. it was 30 years a the -- years ago the first report from the cdc came out. there will be people tomorrow who have walked every single year a testament to their commitment of fighting the disease. >> certainly. >> a lot has changed when it comes to research, what are the big differences from now and 25 years ago? >> we are not in the crisis disease, but it's important to realize it's a disease and infection you don't want to get. we can prevent the transmission of hiv aids, and our goal is to radically reduce the number of new infections. those 2 a day we want to get it down to one a day or less by 2015. >> do you see there being a sense of -- as we do progress

and see more options for not necessarily a cure but ways to live your life, people are less scared about it? >> reporter: that's why this is so important, not only are we raising important funds, but we are raising awareness, especially with young people in san francisco, we have to reach the gay-bisexual maine men pop -- by sex -- bisexual men population to prevent the spread of aids. many big corporations in town will bring their employees and set up tents and serve breakfast. we have entertainment. what is really fund tomorrow, the "dancing with the stars" coming on. >> she's an icon. >> and then allen cumming and

penalize anyone under don't ask, don't tell. people appealing the legislation of putting gays in social study history is fighting the referendum that could be placed on the bill. it would be the first state to teach about the gays and lesbians in school. a man in hayward was shot and killed at west tennison road and police responded to shots of being fired at database station parking lot. inside of the car they found a man who had been shot, and he died at the scene. police say whoever shot him ran away and is still on the loose this morning. a woman is in the hospital after being hit by a bicyclist in san francisco with critical injuries. it was at on mission street

during the height of friday morning's rush hour. police are investigating how fast the cyclist was going before plowing into the woman. the woman who was hit is 67 years old, believed to be a tourist. >> she is currently being treated with life-threatening injuries, and it appears at this point that the bicyclist ran through the red light. >> witnesses say they heard the woman scream and then fall head first to the asphalt. police say if she does not survive, the cyclist could face charges of involuntary manslaughter or gross negligent manslaughter. nearly two dozen san jose firefighters are back on the job this weekend. yesterday the fire chief presented badges to 22 firefighters who were laid off last year. they say it is a relief to be back at work after a year off the job. >> i feel it's the greatest job in the world, and to have it taken away from me was really, really hard, and now that i have it back, everything is

good again. >> budget cuts of course forced san jose to lay off 49 firefighters last year. a $15 million fema grant helped the department pay for the rehires. saveway just lost a fight to sell cigarettes in san francisco. a federal judge dismissed the suit that argued grocery stores have a constitutional right to sell smokes. the city's ban on cigarette sale at drugstores originally excluded grocery stores that included pharmacies but now the law has been extended because it violated constitutional equal protection guarantees. the clock is ticking for congress. they have yet to reach an agreement to raise the debt ceiling. if they can't meet the deadline, it's the first time the lust default on the loans. we are expecting a new plan to

investors are pouring money into safe haven investments like precious medals. the government wants to know more about the fees that the airlines are proposing. new rules would require them to report the fees they charge passengers and also require them to give more useful stats about lost or danged luggage and mishandled wheelchairs so passengers can make better decisions about what airline to fly. last year airlines made $5.5 billion from baggage knees and -- baggage fees and fees passengers paid. the growing love of cheese burgers in asia is pushing cheese exports up. stipments to china have doubled, resulting in a 50% jump in wholesale cheddar cheese prices. you go to cbsmoneywatch.com for more. a rude awakening in the

east bay this morning. 3.3 magnitude earthquake hitting just before 4:00 a.m. its epicenter was 2 miles from berkeley. here we got several calls and e- mails to tell us about it. some of our viewers thought it was bigger than the 3.2, reporting it was shaking their light fixture and sloshing their pool water. traffic is a way of life every day on the los angeles freeways, but this weekend we have been warning about it, it could be the worst it has ever seen, but it's not as bad as some people feared. the so-called argue get -- carmageddon has shut down the 405 freeway. it will be shut down until monday morning's rush hour. the project has been hyped for quite some time. i'm sure you have heard the term carmageddon. the mayor is asking everyone down there to come together. >> we can either say we

survived carmageddon or we survived the carmageddon hype. >> they are widening the lanes on the stretch of highway to improve the flow of traffic. they are also demolishing the aging bridge during the closure. we saw reports from there this morning, things are running smoothly. a lot of people decided to abandon their vehicles and stay off the roadways. a lot of people taking advantage of cheap flight deals in the meantime, and yeah, not as bad as it could have been, so we will continue to monitor that throughout the weekend, and in the meantime, it's a foggy, drizzly morning in the bay area. taking a live look right now at the golden gate bridge. you can see some due droplets there on the live camera, because that is the picture that you are seeing repeat itself around the bay area, and in fact, it's foggy all the way down to san jose this morning. looking like it will take

this is pointed towards the east bay, and you can see we are above the clouds, one of the few places you are actually seeing sunshine this morning, and looking at highs in oakland, today, near 62 degrees, moving over to livermore high at 75. that will take until 11:00 in the morning where a lot of the patchy fog and clouds will burn off this morning. a live look at the golden gate bridge. you see it shrouded in fog there, over the water. the high in san francisco this morning is at 61 degrees, and it's going to be very cool. move together south bay. you can see the live look over san jose. the high there will be warmer, near 78 degrees, and we could see sunshine around noon, early afternoon hours, but then the fog will move back in. there's the 7-day forecast. it's looking like we will stay below normal until tuesday night or wednesday, and that's when we are going to see more summer-like temperatures. certainly get used to the fog

bay shelter from a neighbor and worked with the animal services to get them out of the home. oakland animal services who is a local partner of ourses and our executive directer took three of the bunnies home to give them a break from the really challenging conditions, and they are all really thriving and looking for new homes. >> we saw the pictures earlier, their legs were laid out. >> some of them may have develop mental conditions for being like that for a long period of time, but we are happy they are getting a second chance. >> will we see some of them? >> they will not be there, but a rescue group, save a bunny will be there along with 20 other groups. something for everyone. in addition to adoptable animals there will be education for people who have pets, my

cochipping onsight, and a lot of information for everybody. >> it's important to move the animals out as quickly as possible to make room for new. we saw the story of rabbits being mistreated in oakland, and there's stories like that all the time. the more you can move out of the shelter, the more you can make room for other guys in bad shape. >> reporter: there's more homeless animals than there are homes for them. we want to get them placed as quickly as we can. >> i want to talk more about the breed specific organizations that will be there tomorrow because a lot of people say i don't want to go to the shelter because i want specifically whatever type. if you want to adopt one, you to go to the breed specific rescues, and they work closely with you guys? >> absolutely. we will have pass tiffs, german sheppards -- mastiffs, german sheppards, and the specialized rescue groups as well. >> you can hear manny making

precept the orderly process of rolling it back. tomorrow she is walking out of jail. casey anthony filed an appeal for her misdemeanor conviction. she was acquitted last week of murdering her daughter, but she was found guilty on four counts of lying to police. thousands of people lacing up their walking shoes for one of the biggest aids fundraisers ever. the 25th annual aids walk in golden gate park will start at 10:30 tomorrow morning. time for a last look at weather. over the golden gate bridge, awfully cloudy, awfully foggy around much of the bay area this morning. it looks like it could be burning off noonish, and the temperatures below normal for the next few days, really, and we will not see a warmup until monday, maybe tuesday night, back to normal around wednesday. time for us to call it a morning. thank you for being here for the early weekend edition. we will be back tomorrow morning at 7:30 a.m. our next newscast coming up at
