>> el dorado district attorney showed this video inside garrido's van. she is seen getting little girls to perform gymnastic girls as she tried to tape them. nancy garrido admitted to taping young girls as many as 20 times. there is a hearing in the capital this morning aimed at keeping better control over parolees like phillip garrido. the prosecutor in the jaycee dugard case is one of the witnesses. elizabeth wenger is in the newsroom with the da's criticism that let garrido roam free. >> reporter: good morning. the d.a. no surprise said there is plenty of blame to go around. as you mentioned, that is why today the district attorney victims rights groups will be testifying at a hearing at the state capital to talk about possible legislative solutions to prevent cases like this from ever happening again. yesterday, the man responsible for phillip garrido's 431-year

prison sentence said the system failed. the d.a. released 162 pages of blistering documents many of them once confidential. now, in those reports, new information shows the situation was worse than previously known. it shows more than a dozen time over four years garrido submitted urine samples that had been watered down even faking his drug tests with mountain dew. even when did he test positive for drugs, no action was taken. >> we have tried to strike a balance of saying this is so bad that the behavior, the failings of the parole system, the failures of the criminal justice system, is so bad, we need to release enough information so the public is able to grasp and understand the magnitude of it. >> reporter: those documents show when garrido was released to california, the state failed even the minimum level of probation supervision. in fact, in the first year of

probation, no agent visited his antioch home for almost a full year. the bottom line, the d.a. says it's too easy for dangerous felons like garrido to win release. right now, inmates are not released based on the crime that sent them to prison but on how successful they are at completing therapy behind bars. so all of this will be discussed later today at that public meeting at the state capital to again identify possible legislative solutions so hopefully this can't happen again. back to you. >> thank you, elizabeth wenger. 16-year-old boy allegedly kidnapped during an armed robbery at an antioch barbershop is arrested after he admitted he wasn't abducted. hassan ford was safe about midnight monday night but a neighbor saw him shortly after the supposed kidnapping. he confessed he was an accomplice and police arrested the suspected suspect eric walker. a strange scene in egypt as

a trial began for the country's ousted president. hosni mubarak appeared in a cairo courtroom laid out on a hospital bed inside a cage of mesh and iron bars. doctors say mubarak is suffering from heart problems. he is charged with corruption and ordering the killing of protestors during the uprising that forced him out of others earlier this year -- office earlier this year. there are nine co-defendants in this case including his two opposite is. activists in syria say there are new explosions today in a city. phone lines in the city are not working and they appear to be cut. it is estimated more than 100 people opposed to president assad have been killed since sunday. that uprising is in its fifth month. the battle over the debt ceiling is over for now after president obama signed a plan that no one seems to like. but as jay dow reports, the economic fallout continues as stock markets around the world

continue to drop. reporter: president obama may have signed the debt kneel law but that's not bringing much re-- deal into law but that's not bringing much relief to global markets over fierce there could be a u.s. recession. european stocks took a hit. on wall street things don't look much better. all three major indices dropped more than 2% tuesday following news that consumers cut their spending in june. the dow jones was down nearly 266 points below the 1,000 mark. >> what you're seeing in the market is some of the frustration with the deal as it was passed versus what we -- what we expected or thought we even needed. >> reporter: there is some good news. so far, the u.s. is hanging on to its triple-a credit rating but financial agencies say there could still be a downgrade in the next year or so if america does not deal with its debt problems. president obama insists the new law is only the first step in

getting the nation's ballooning deficit under control. he is calling for tax increases on the wealthiest americans when lawmakers take up the issue again in the fall. >> since you can't close the deficit with just spending cuts, we'll need a balanced approach. >> reporter: a bipartisan committee of 12 lawmakers will have until thanksgiving to come up with another round of budget cuts. congress will make any changes and vote on the plan by christmas but republicans insist tax hikes will not be part of that deal. jay dow, cbs news, washington. a homeless man is in custody this morning after climbing over the white house fence. secret service agents who guard the complex around the clock quickly caught the man yesterday evening. a cnn news crew shows the agents leading the 48-year-old crudup away. he is facing charges of unlawful entry and violating an order to stay away from the white house. the president was in the white

house at the time. protestors plan to bring petitions to the san francisco airport today demanding an apology from u.s. airways over that so-called saggy pants ordeal this summer. it was back in unthat the airline asked university of new mexico football player dashon marman to pull up his trousers leading to a conflict. marman was arrested on several counts including battery of a police officer. all the counts were dropped later. protestors claim to have 40,000 signatures. they are accusing the airline of racial profiling. and a former supermarket worker who says he was unjustly fired plans to begin a three- day hunger strike today. the man will stage his protest outside the headquarters of the place, workers to form a -- rather encouraging workers to form a labor union. that's why he says he was terminated. and marquez worked for the latino grocery chain at its

gilroy market. he claims he was terminated for trying to form a union. mi pueblo laid off workers at 19 stores because of slow sales. on this wednesday hoping it's going to warm up. i think it might be the warmest day of the week. lawrence, is this true? >> well, not exactly. >> not exactly? [ laughter ] >> well, it will be nice. >> i'm going to the giants game. >> bundle up for that. hopefully it will be a better game for the giants better than the last couple anyway. we are starting with low clouds and fog and that's going to break up around the bay area and move toward the coastline and then we'll see plenty of sunshine and nice temperatures. numbers right now 59 in livermore, 58 in san jose, and 56 degrees in san francisco. by the afternoon, how about this? 80s in many spots inland, near 90 in the warmest spots. plenty of 70s inside the bay. high of 77 degrees in san jose.

out at the coastline 64 degrees partly cloudy into pacifica. next couple of days we are going to see a cooldown in the works. temperatures going to drop on thursday and friday, probably going to see a lot of drizzle especially at the coast and just inside the bay as we head in toward thursday and friday and the first part of the weekend. temperatures warming up after that. >> let's head to the freeways right now. we have an accident southbound 880 right at industrial parkway. it is an injury accident. a vehicle flew off the side of the roadway. no main lines. road are affected all activity on the side. but there are injuries. they have fire crews and chp on the scene. heads up passing the area. the rest of 880 problem-free. live look at conditions northbound as you head into the maze. southbound again not too bad. the only trouble spot is that accident near industrial parkway. 101 southbound we are still dealing with roadwork between 37 and atherton. looks like we are seeing slight slower speeds as you work your

they just recently moved in. a car was also destroyed there. and a hero wales come this morning for a 9-year-old boy. isheen singh is being honored for helping save a toddler from drowning. on monday the 9-year-old boy pulled a 3-year-old girl from the bottom of an apartment complex pool in west san jose. the girl's grandfather was also rescued. this morning, san jose's police chief is going to give the boy a special award for his heroism. another hero, too. a san francisco cabbie will be honored at city hall for helping police catch a mugging suspect all caught on camera. the attack was recorded on a dashcam from the taxi. the man runs up behind the woman. she is on the cell phone. he will snatch the cell phone and then take off. that's when officers say the cab driver quickly stepped in. the cab driver saw this happen, pulls forward, offers his assistance to the victim, having her get in the cab and he handed her his cell phone so she can call police and he began to follow the suspect.

oakley has started to send o d-u-i bills ranging from 380 to 790 dollar it is payback time for some drunk drivers in the east bay. oakly is sending out dui bills ranging from $380 to $790. under the city's new ordinance those arrested for dui could be billed for the cost of breath, urine blood tests, drug screenings and even the officer's time. critics accuse the city of using dui arrests as a cash cow. >> seems like the drunk drivers

are an easy target for generating revenue. there isn't another type of crime around that generates the kind of money. >> oakley officials say 76% of the city's dui arrests involve people who are not from their city and they say it's only fair for people to pay up. 4:49 now. there is a new look on one of the sidewalks on the golden gate bridge. the goal is to keep bicyclists and the pedestrians from running into one another. there is now one lane marked for bikes and one for the walkers on the sidewalk on the east side of the bridge to prevent collision while there is a closed bike lane for retrofitting. bart directors are close to choosing a new general manager. grace crunican is the choice. she was second in charge during the clinton years and most recently director of transportation up in seattle. final confirmation could be as

soon as next week. >> we have patchy fog at the coast and the valleys as well so starting out cloudy early on but by the afternoon plenty of sunshine coming our way. going to heat things up possibly to the low 90s well inland though as you will see mostly sunny skies. inside the bay 60s and 70s. at the coastline, mainly into the 50s and 60s. trough deepening a bit more so tomorrow. so caller temperatures are on the way. enjoy the sunshine outside today as it looks like temperatures are going to start to drop off. expecting a high of 102 degrees getting hot in fresno today, 95 in yosemite. 81 gorgeous in lake tahoe, all those thunderstorms now have moved east so it should be sunny and bright up there and 66 degrees, mostly sunny in the afternoon into the monterey bay. how about 77 in san jose today and sunny? 87 morgan hill.

75 redwood city. east bay temperatures up into the 80s. some low 90s in the far reaches places like brentwood closer to antioch at 88 degrees in pittsburg. north bay mostly sunny skies, high as 75 in san rafael, 81 in santa rosa and 61 degrees in bodega bay. next couple of days, we are going to watch those temperatures dropping off on thursday and friday. a lot of low clouds and fog even some drizzle at the coastline. probably more drizzle at least into the first part of the weekend. and then it looks like things begin to dry out a bit as high pressure begins to build in. temperatures warm up towards saturday and sunday, possibly 90s majoring a return as we head to monday and tuesday. and just for you, grace, yup, we have the official giants forecast today! planning on about 69 degrees should be sunny and bright. if you do get lucky enough to head to the game, looks like a great game and boy, they are going to need all the fans they can get. of course, the giants have dropped a couple of a row at home and they are all tied up

in the national league west. let's check traffic now with gianna. >> thank you, lawrence. let's over to a live look at conditions right now through san jose. 101 near alum rock not bad. we are off to a good start throughout the south bay. jumping over to our maps, travel times right now. northbound guadalupe parkway looks like traffic still light in the green north 101, 280, 680 to 238 no delays along 280 as you head into downtown san jose. elsewhere, san mateo bridge not too bad along 92. once you hit 880 that earlier southbound accident near industrial is cleared -- or it was over to the right shoulder but cleared off the freeway so not too bad along 880. north of there northbound as you work your way towards east 980 that connector is shut down for roadwork and will be closed for another 10 minutes. not too many delays in the area. live look at the bay bridge, so far, so good, clear across the upper deck into san francisco. no delays along the lower deck. but we have some road construction as you work your

way onto the skyway towards the lower deck into oakland. so just a heads up there. various lanes blocked that in effect at least until 6:00 today. elsewhere as you work your way along the freeways, san mateo bridge again not too bad only 14 minutes between 880 and 101. once you hit the peninsula, traffic cruising along both directions northbound clear all the way towards sfo. golden gate bridge also problem- free, not a lot of cars taking the bridge now, all looking good into san francisco. 13 minutes though south 101 from 37 to 580. that's due to ongoing construction near atherton so just a heads up through there. remember kcbs, our radio partners, at 740-am and 106.9- fm. that's a look at traffic. back to you. >> thank you. 4573 now. the government is looking for the source of a salmonella outbreak that's believed to be linked to ground turkey. at least one person in sacramento county died after eating the meat. 76 people in 26 states got sick after eating tainted food.
