spirit all over this town. >> jim cox is talking about his brother dave who was hit and killed last night as he wheeled himself in his wheel care along esmond avenue in richmond. >> dave is gone, it's all over with. >> there's flower memorial out there today. that's where we saw the witness. >> i saw his body on the ground with the wheelchair 30 feet away from his body. >> she didn't want to appear on camera but after the driver hit cox from behind he took off. >> then he tried to drive forward. the wheelchair was stuck in the bump. so he reversed the car and then turned. >> it could have been an accident but the fact that the person failed to stop after he hit the victim makes it a crime at this point. so it's a felony hit and run. >> cox died at the hospital at age 2, a life long richmond resident. >> being in a wheelchair, he was

still energetic. to me he really loved life. >> he spent his life in that chair. >> his nerves grew down his back and grew into a circle, they didn't go into his legs. >> jim cox lost his own leg a few years ago and since they lived in their childhood home together dave had been coaching him along. >> he had his flags on the wheelchair, he had all the criteria for running. it's just that -- just a crazy thing to happen. >> police are looking for the vehicle, an older model black lexus with tinted windows and a rear spoiler. it probably has front end damage from the crash. they're offering a $10,000 reward. >> i don't understand the guy driving off. well, a sunnyvale mother is jailed in the death of her infant son. police were called to an apartment on santa lissa avenue yesterday. the mother was found nearby

trying to jump from a 101 overpass. police say an autopsy will be needed to term how the baby boy died but there were no signs of trauma when they found him. neighbors say they heard nothing and there was no sign the mother was despondent. latissio laterno was looked at at the hospital before being transferred to jail. the da will determine what charges will be filed. he's a season ticket holder with prime seats to be seen and to see. now he's being told what not to wear. don is here with more on the t-shirt trouble. >> reporter: inside the shark tank it may look like freedom of expression but on television is looks like free advertising, at least it looks like that to the sharks management. they think the guy who has the season tickets behind the bench of the sharks is causing concern. sharks fans who watch their team on tv during the past three

seasons got plenty of glimpses of the pent and jeff stanley, his family and friends wear t-shirts promoting their bad boys bail bond company. >> it's about our company showing support for the sharks. our company is involved in over 200 charities and at each one of these events that we attend we show our community spirit by wearing our t-shirts. >> reporter: but as of this game, the free tv exposure for the t-shirts is to end. >> i received a letter from the counsel for the sharks, said if i tried to go in there with my t-shirts i will be rejected from the pavilion and have my tickets confiscated for the season. >> reporter: that's $20,000 of tickets. and for the past couple of seasons stanley has been paying $70,000 to put his bad boys bail ad banners on the penalty box. this year he cancelled the ads. >> this came three days after we informed them that we were no longer going to be sponsoring

the sharks for this season. >> reporter: but the sharks, in a statement handed out before the game, say the purpose of the policy is to protect the investment of its corporate partners. from an individual or business to buy tickets to get in and using the seats to market a product or business. stanley says it's a first amendment aimed at him because other people have their ads up. >> nike, google, adidas, if so. then you'll find out half the arena will not be full. they're keeping everybody out with a logo. >> reporter: the game starts at 7:30 but stanley says he's going in at 7:15. that is if he can get in because he's wearing that shirt. >> guess we'll have to see. thank you. well, tonight the list is out and hundreds of oakland families will not be happy. the district has identified five elementary schools it wants to close. the announcement came hours after the grand opening of oakland high school's

changes to leadership and training. want to avoid being towed in san fransisco? there may be an app for that. david shu wants to warn motorists before their vehicle is towed. the app idea goes before the board on tuesday. and a facebook post announcing a bake sale in the berkeley campus next week is causing quite a stir. a student republican club plans to price items based on the gender and ethnicity of the buyer. the group says it's to protest a bill that would let the lessees consider ethnicity in admissions. the school says it will send out a letter on the matter monday. the two cal graduates in prison in iran for more than two years are on their way home to the united states tonight. they spoke to the press before leaving the country of oman where they spent the last two days since being released by

happened this week in oakland. the exhibit called a child's view in gaza had to be moved outside the oakland's museum of art after the museum cancelled it. several jewish organizations protested saying the work of palestinian children is the work of hamas propaganda. the group sponsoring says it will be moved to another gallery. customers at netflix are not happy with a new service and pricing change. now a new nightmare for netflix, this was just announced. >> reporter: one company, one bill, one connection for everything you need in video entertainment. >> it's called the blockbuster movie pass and it gives access to 100,000 movie, television, and video titles, available by mail, in video, or streaming on line. >> reporter: it competes with

the likes of amazon, houlu. >> in this changing market environment. >> speaking of the competition, the timing of this announcement at a san fransisco press event arrives on the heels of more bad news for netflix. today, net nix was lost 1 million customers after a price like over the summer. a broken partnership with stars network and recent news of the split between their mail-in and streaming services. >> i think it's a bit of sarn dependity that that's going on at the time we're launching. >> no amount of planning can replace good old luck so we'll take luck, too. >> while this blockbuster movie pass will compete with netflix and others it that is drawbacks. >> if you already have that cable provider, like comcast or time warrener, you have to switch to get this and that might not work for everybody. >> reporter: for dish customers, access to the service starts october 1st.

satellite has fallen to earth. ay never know wh . that space junk from an old satellite has fallen to earth, but we may never know where it landed. amateur video in france and los angeles caught the defunct satellite burning up but where it came down this morning may never be morning. it likely fell into the pacific ocean off canada. . meteorologist jim bernard joining us now and fall has come in. and apparently it's going to head out pretty shortly. >> we had a brief indian summer last week with temperatures warming nicely here. we saw upper 90s and low 100s hast week. big cooldown this weekend as

we're down into the mid to upper 70s for the warmer locations with fog and hoe clouds moving in this evening, they'll be with us in the morning, mostly cloudy with a slight chance of showers across the bay area. the greatest chance for rain is across the north bay and there it looks to be rather light and slight chance of showers making it into the bay. probably be more clouds than rain but nonetheless the threat is there, at least for tomorrow. it will be gone by tomorrow afternoon. look for cooling today, mid to low 70s for the bay area for the warmer locations. mid to upper 70s for the south bay. continue on the cool side, come tomorrow, as we see again a fall-like pattern here. cooler weather with a chance of showers as the onshore breeze moves in across the bay tonight. some tropical moisture moving off to our south into the sierra may cause some thunderstorms, but for us it looks like just some light showers and no thunderstorm development

expected at this point. as we continue with the onshore flow tomorrow, keeping the clouds around which will gradually break up through the day. best chance of any rain in the morning. and as you move to the north, you'll see a better chance of measurable precipitation in that direction. as we look for mid to low 70s across the south bay tomorrow and in the mid to low 60s on the peninsula. even warmer locations, mid-70s for livermore and concord. cooling across the bay with clouds and precip up there. upper 60s to low 70s. seven-day forecast, keeps tomorrow cool and then in the beginning of the week we reverse that trend and begin to warm up as we see, once again, a return to more fall-like weather here through the week. it will cool again gradually through next weekend but back into the mid-90s by mid-week. lets's get the sports update with kim. will the giants be eliminated from the playoffs before they took the field

the field, maynard finds his brother allen. huge game, career high 197 yards for the game. maynard threw for 349 yards. but they wouldn't be able to finish the drive. mainored overthrows allen on four and goal. the huskies hang on for the 31-21 win. cal loses their first game of the season. clemsen beat florida. the math is simple for the giants playoff hopes. they need to win out and have the braves need to lose all five of their remaining games. atlanta is stumbling to the finish line. they're just 9-14 in september. wong picks up his first career hit and rbi. on the mound, wong gave up one
